THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2007/NĐ-CP dated July 18, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Forest Protection Department and the Director of the Cadre and Civil Servant Affairs Department

DECISION:

Article 1. Forest rangers at the commune level are civil servants under the establishment of the District Forest Protection Office, Specialized Forest Protection Office, Protective Forest Protection Office (hereinafter referred to collectively as the District Forest Protection Office) assigned to work in communes, wards, towns with forests (hereinafter referred to collectively as the Commune-level Forest Ranger) and are subject to management and direction by the Head of the District Forest Protection Office.

Article 2. Responsibilities of the Commune-level Forest Ranger

1. Advise the Chairman of the People's Committee of communes, wards, and towns with forests (hereinafter referred to collectively as the People's Committee at the commune level) on performing state management functions over forests and forestry land, including:

a) Developing plans for managing, protecting, and developing forests; guiding inspections after the plan has been approved;

b) Proposing zoning for shifting cultivation areas and inspecting implementation; guiding the process of allocating forests;

c) Establishing community forest protection teams and fire prevention and firefighting teams;

d) Mobilizing civilian defense forces and other resources and means for fire prevention and firefighting, preventing illegal deforestation and logging, and controlling forest pests;

đ) Handling administrative violations in the management and protection of forests and forestry products according to the law;

e) Confirming the origin of forestry products according to the law;

2. Perform the following professional tasks:

a) Reporting and proposing to the Head of the District Forest Protection Office about forest management, protection, development, fire prevention, and firefighting activities in the area;

b) Detecting cases of illegal deforestation, logging, transportation, and trading of forestry products and wildlife, promptly reporting to the Head of the District Forest Protection Office and the Chairman of the People's Committee at the commune level to prevent and handle them promptly;

c) Statistics and inventory of forests and forestry land in the assigned area;

d) Inspecting activities related to forest management, protection, development, and forestry product management in accordance with the law;

đ) Guiding and supervising forest owners in protecting and developing forests, breeding and planting wild animals and plants;

e) Promoting and mobilizing the public to comply with laws on forest protection and development;

f) Handling administrative violations within their authority.

3. Participate in other forestry activities when assigned by the Head of the District Forest Protection Office and the Chairman of the People's Committee at the commune level:

a) Guiding and promoting village communities to establish and implement regulations for forest protection and development;

b) Activities related to forest development and promotion of forestry;

c) Other activities in the forestry sector.

Article 3. Responsibilities and management and directive powers over the activities of the Commune-level Forest Ranger

1. The Chairman of the People's Committee at the commune level.

a) Directing and supervising the activities of the Commune-level Forest Ranger as stipulated in this Decision;

b) Directing coordination between the Commune-level Forest Ranger and the police station, civilian defense forces, and other organizations and individuals relevant to forest protection, development, and forestry product management in the area;

c) Organizing and creating conditions for the Commune-level Forest Ranger to perform tasks as stipulated in this Decision;

d) Allocating workspace and living quarters and resolving expenses for the activities of the Commune-level Forest Ranger for tasks assigned by the People's Committee at the commune level.

2. The Head of the District Forest Protection Office.

a) Managing all activities of the Commune-level Forest Ranger as stipulated in this Decision comprehensively;

b) Resolving salary, allowances, and operational funding for the Commune-level Forest Ranger according to the law.

Article 4. This Decision takes effect 15 days from the date of publication in the Official Gazette, replacing Decision No. 105/2000/QĐ-BNN-KL dated October 17, 2000 of the Minister of Agriculture and Rural Development on the duties of forest rangers responsible for the area.

Article 5: The Director of the Ministry's Office, the Director of the Cadre and Civil Servant Affairs Department, the Director of the Forest Protection Department, relevant units under the Ministry, Directors of Departments of Agriculture and Rural Development, Chiefs of Forest Protection Sub-departments of provinces and centrally-administered cities are responsible for implementing this Decision./.
