Amending and supplementing certain Articles of the Law on the Organization of the National Assembly
Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 as amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the Tenth Session of the Tenth National Assembly.
This Law amends and supplements certain Articles of the Law on the Organization of the National Assembly which was adopted by the National Assembly of the Socialist Republic of Vietnam on December 25, 2001.
Article 1. Amending and supplementing certain Articles of the Law on the Organization of the National Assembly:
1. Article 22 shall be amended and supplemented as follows:
"Article 22
The National Assembly establishes the National Ethnic Council and the following Committees:
1. Committee for Legal Affairs;
2. Committee for Judicial Affairs;
3. Economic Committee;
4. Committee for Finance and Budget;
5. Committee for National Defense and Security;
6. Committee for Culture, Education, Youth, Children and Adolescents;
7. Committee for Social Issues;
8. Committee for Science, Technology and Environment;
9. Foreign Relations Committee."
2. Article 27 shall be amended and supplemented as follows:
"Article 27
The Committee for Legal Affairs has the following tasks and powers:
1. Reviewing the draft program of the Government on the development of laws and ordinances, proposals from other agencies, organizations, and National Assembly deputies regarding the development of laws and ordinances, and recommendations from National Assembly deputies regarding laws and ordinances;
2. Reviewing draft laws and ordinances concerning civil and administrative matters, organization of state apparatus, except for the organization of judicial agencies; reviewing other drafts assigned by the National Assembly and the Standing Committee of the National Assembly;
3. Ensuring the constitutionality, legality, and consistency of the legal system for draft laws and ordinances before they are submitted to the National Assembly and the Standing Committee of the National Assembly for approval;
4. Taking the lead in reviewing proposals for establishing, abolishing ministries, and agencies at the ministerial level; establishing new, merging, dividing, adjusting provincial boundaries; establishing or dissolving special administrative-economic zones; reports of the Government on handling complaints and petitions of citizens;
5. Supervising the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly concerning civil and administrative matters, organization of state apparatus, except for the organization of judicial agencies; supervising the activities of the Government, ministries, and agencies at the ministerial level within the Committee's jurisdiction;
6. Supervising normative legal documents of the Government, Prime Minister, Ministers, Heads of agencies at the ministerial level, joint normative legal documents between central state agencies with authority or between state agencies and central bodies of political-social organizations within the Committee's jurisdiction;
7. Proposing necessary measures to improve the state apparatus and legal system.”
3. Supplementing Article 27a after Article 27 as follows:
"Article 27a
The Committee for Judicial Affairs has the following tasks and powers:
1. Reviewing draft laws and ordinances concerning criminal, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, organization of judicial agencies, and other drafts assigned by the National Assembly and the Standing Committee of the National Assembly;
2. Reviewing reports of the Government on prevention and suppression of law violations and crimes, work reports of the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy; taking the lead in reviewing reports of the Government on anti-corruption efforts;
3. Supervising the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly concerning criminal, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, organization of judicial agencies; supervising the activities of the Government, the Supreme People's Court, the Supreme People's Procuracy in investigation, prosecution, trial, enforcement of judgments, and judicial assistance;
4. Supervising normative legal documents of the Government, Prime Minister, Ministers, Heads of agencies at the ministerial level, the Supreme People's Court, the Supreme People's Procuracy, joint normative legal documents between central state agencies with authority or between state agencies and central bodies of political-social organizations within the Committee's jurisdiction;
5. Supervising the detection and handling of corruption;
6. Proposing issues related to the organization and operation of relevant agencies and issues concerning criminal, criminal procedure, civil procedure, administrative procedure, enforcement of judgments, judicial assistance, organization of judicial agencies.”
4. Article 28 shall be amended and supplemented as follows:
"Article 28
The Economic Committee has the following tasks and powers:
1. Reviewing draft laws and ordinances in the field of economic management, monetary policy, banking, business operations, and other drafts assigned by the National Assembly and the Standing Committee of the National Assembly;
2. Taking the lead in reviewing national programs, projects, plans for socio-economic development; reports of the Government on the implementation of socio-economic development tasks and plans;
3. Supervising the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the field of economic management, monetary policy, banking, business operations; leading supervision of the activities of the Government, ministries, and agencies at the ministerial level in implementing national programs, projects, plans for socio-economic development and implementing economic, monetary, and banking policies;
4. Supervising normative legal documents of the Government, Prime Minister, Ministers, Heads of agencies at the ministerial level, joint normative legal documents between central state agencies with authority or between state agencies and central bodies of political-social organizations within the Committee's jurisdiction;
5. Proposing issues related to the organization and operation of relevant agencies and issues concerning economic management, monetary policy, banking, business operations.”
5. Add Article 28a after Article 28 as follows:
"Article 28a
The Committee for Finance and Budget has the following tasks and powers:
1. Reviewing draft laws and ordinances in the field of finance and budget, and other drafts assigned by the National Assembly and the Standing Committee of the National Assembly;
2. Taking the lead in reviewing the state budget estimate, central budget allocation plan, and final settlement of the state budget;
3. Supervising the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the field of finance and budget; supervising the activities of the Government, ministries, and agencies at the ministerial level in implementing the state budget estimate and implementing financial and budgetary policies;
4. Supervising normative legal documents of the Government, The Prime Minister, Ministers, Heads of equivalent ministries, joint regulatory documents between central state agencies with authority or between state agencies with authority and central bodies of political-social organizations under the domain of the Commission responsible;
5. Propose issues related to the organization and activities of relevant agencies and financial matters;
6. Article 34 is amended and supplemented as follows:
Article 34
The National Assembly's Council and Committees within their respective duties and powers shall have the following responsibilities:
1. Participate with the Economic Committee in reviewing national programs, projects, plans for socio-economic development; reports from the Government on the implementation of socio-economic development tasks and plans;
2. Participate with the Finance and Budget Committee in reviewing the state budget estimates, central budget allocation schemes, and final settlement of the state budget;
3. Participate with the Legal Affairs Committee in reviewing proposals for establishing, abolishing ministries and equivalent ministries; establishing new, merging, dividing, adjusting provincial and centrally-administered city boundaries; establishing or dissolving special administrative-economic units; reports from the Government on citizens' complaints and denunciations resolution work;
4. Participate with the Justice Committee in reviewing reports from the Government on anti-corruption work;
5. Supervise the implementation of the state budget, anti-corruption prevention work within the domain of the National Assembly's Council and the responsible Committee.
This Law takes effect from July 1, 2007.
This Law was passed by the National Assembly of the Socialist Republic of Vietnam, the eleventh session, the eleventh meeting on April 2, 2007.
