PRIME MINISTER

   Considering the proposal of the Minister of Finance, the Minister of Education and Training, the Minister of Labor, Invalids and Social Affairs, the Minister of Health, the Minister of Culture, Sports and Tourism, the Minister of Natural Resources and Environment,

  Pursuant to Decree No. 33/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Office;

  Considering the proposal of the Minister and Head of the Government Office.

DECISION:

Article 1. Position and Functions

1. The Government Electronic Information Portal is an integrated information portal and electronic newspaper, multimedia communication agency of the Government on the Internet, under the direct and comprehensive management of the Government Office by the Minister and Head of the Government Office (hereinafter referred to as the Minister and Head).

2. The Government Electronic Information Portal has the function of organizing, managing, and publishing official information of the Government on the Internet; serving as the connection point for the Government's administrative electronic information network on the Internet with Ministries, ministerial-level agencies, agencies under the Government, People's Councils, People's Committees of provinces and centrally governed cities (hereinafter referred to as Ministries, sectors, localities), and related organizations and agencies; integrating online government public services information.

The Government Electronic Information Portal has the international trading name in English: Vietnam Government Web Portal (abbreviated as VGP).

3. The Government Electronic Information Portal is a public service unit, having legal personality, its own seal, and an account at the State Treasury; operating funds are guaranteed by the state budget; it organizes and operates according to the model of press, information, and communication agencies; it is subject to state management in information and communication by the Ministry of Information and Communications in accordance with the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

3. To coordinate professionally with ministries, sectors, localities, and related agencies to connect and synchronize databases (excluding classified information) to the Government's Electronic Data Center; standardize software for national information resource utilization; collect, receive, integrate, and update all types of information (excluding classified information) in a timely manner; ensure compatibility and smoothness in information sharing and exchange processes in line with administrative reform programs to meet the requirements of government leadership and management,

1. To take the lead and coordinate with relevant units and Ministries, sectors to submit to the Minister and Head for approval within his/her authority or to the Prime Minister for approval the strategic plans, programs, and other important projects of the Government Electronic Information Portal; to coordinate with relevant agencies to implement after receiving approval from the competent authority.

2. To coordinate professionally and technically with Ministries, sectors, localities, and related agencies to connect and synchronize databases (excluding those within the scope of state secrets) updated on the Government Electronic Information Portal; standardize software used to exploit national information resources in connecting web pages or electronic information portals into a unified electronic information network on the Internet; to exploit, receive, integrate, and update all types of information (excluding state secrets) in a timely manner; ensure compatibility and smoothness in the process of sharing and exchanging information, in line with the government's administrative reform program, the Prime Minister's directives, and the roadmap for building an e-Government.

3. To take the lead and coordinate with Ministries, sectors, localities, and related agencies to integrate online government public services information.

4. To coordinate with units under the Government Office to fully exploit and receive all types of information; to process and update such information (excluding those within the scope of state secrets) in a timely manner to perform assigned functions, tasks, and powers in accordance with the law.

5. To organize and implement exchanges, meetings, online dialogues, and other forms of communication using information technology between the Government, the Prime Minister, Ministries, sectors, localities, and related agencies and the people.

6. To receive complaints, denunciations, reflections, and suggestions from organizations and individuals sent via the Internet to the Government and the Government Office; to transfer them to competent authorities and request resolution and response in accordance with the law.

7. To design, structure the technology, engineering, and aesthetics of the Government Electronic Information Portal and the capacity of the data resource library on the Government Electronic Information Portal; to develop diverse content, forms of operation, and multimedia applications and products to enhance the ability to disseminate and promote the Party's guidelines and policies, state laws, economic and social conditions, domestic and international news; to effectively serve the Government's and Prime Minister's guidance and management work.

8. To coordinate professionally and technically with web pages or electronic information portals of Ministries, sectors, localities, and related agencies.

9. To coordinate with related units to upload the Electronic Gazette of the Socialist Republic of Vietnam to the Government Electronic Information Portal.

10. To manage the Government Data Center on the Internet and technical infrastructure, specialized equipment.

11. To manage and implement investment and construction projects assigned in accordance with the law; to participate in consulting, designing, and reviewing proposals and projects related to the specialized field within the system of electronic web pages or electronic information portals of Ministries, sectors, localities, and related agencies when requested; to participate in reviewing the professional and technical aspects of other important projects assigned by the Minister and Head.

12. To organize training in professional and technical areas related to the activities of the Government Electronic Information Portal in accordance with the law.

13. To research and apply scientific and technological advancements to improve the efficiency of the Government Electronic Information Portal.

14. To implement international cooperation in the fields of activity of the Government Electronic Information Portal in accordance with the law.

15. To take the lead and coordinate with units under the Government Office and related agencies to ensure confidentiality, network security, and internal security.

16. To carry out value-added services in accordance with the law and the guidance of the Ministry of Finance to use existing facilities efficiently and reinvest, ensuring that it does not affect assigned political tasks.

17. To manage organizational structures and staffing; to implement salary systems and incentive policies, rewards, and disciplinary measures for officials, civil servants, employees, and collaborators in accordance with the law.

18. Management and use of assigned assets; allocated funds and other financial sources in accordance with the provisions of the law.

19. Perform other tasks and authorities delegated by the Prime Minister, the Minister, and the Chairman.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

1. The Government Electronic Portal shall have an Editor-in-Chief and not more than three Deputy Editors-in-Chief.

The Editor-in-Chief of the Government Electronic Portal (hereinafter referred to as the Editor-in-Chief) shall be appointed, relieved, or dismissed by the Minister and the Chairman; shall be responsible to the Minister and the Chairman and to the law for all activities of the Government Electronic Portal.

The Deputy Editors-in-Chief shall be appointed, relieved, or dismissed in accordance with the law by the Minister and the Chairman; shall be responsible to the Minister and the Chairman and to the Editor-in-Chief for the areas of work assigned to them.

2. Structure

a) Secretariat - Consolidation Department;

b) Professional - Specialized Department;

c) Technical - Technology Department;

d) Planning - Finance Department;

e) International Cooperation Department;

e) Office;

g) Research and Development Center.

3. Domestic resident offices in Ho Chi Minh City, Da Nang City, and Can Tho City.

4. Overseas resident offices shall be decided by the Minister and the Chairman after receiving approval.

5. Depending on the development requirements of the Government Electronic Portal, the Minister and the Chairman shall submit proposals.

6. The Minister and the Chairman shall appoint, relieve, or dismiss the heads and deputy heads of units specified in Clauses 2, 3, and 4 of this Article.

7. The Editor-in-Chief shall specify the functions, tasks, and authorities of units under the Government Electronic Portal. When necessary, the Editor-in-Chief shall submit to the Minister and the Chairman for the establishment of certain departments within the units specified in Clauses 2, 3, and 4 of this Article.

8. The staffing of officials and civil servants of the Government Electronic Portal shall be decided by the Minister and the Chairman in accordance with the provisions of the law.

Article 4. Effective date

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette; it replaces Decision No. 229/2003/QĐ-TTg dated November 7, 2003, of the Prime Minister regarding the establishment of the Government's electronic information website in Vietnam; Decision No. 250/2005/QĐ-TTg dated October 10, 2005, of the Prime Minister regarding the organization and operation of the Government's electronic information website in Vietnam.

2. Abolish previous provisions that are contrary to this Decision.

Article 5. Responsibilities for Implementation

Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Councils, Chairmen of Provincial People's Committees directly under the Central Government, the Editor-in-Chief of the Government Electronic Portal, and related agencies and organizations shall be responsible for implementing this Decision./.
