AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE LAW ON ELECTIONS OF NATIONAL ASSEMBLY DELEGATES AND PEOPLE'S COUNCIL DELEGATES
ELECTIONS OF NATIONAL ASSEMBLY DELEGATES AND PEOPLE'S COUNCIL DELEGATES
Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;
The National Assembly promulgates this Law amending and supplementing certain articles of the Law on Elections of National Assembly Delegates and People's Council Delegates No. 85/2015/QH13.
Article 1. Amendments and supplements to certain articles of the Law on Elections of National Assembly Delegates and People's Council Delegates
1. Amend and supplement Clause 6 of Article 4 as follows:
"6. The election committee at the provincial or municipal level organizes elections for National Assembly delegates at the local level; the election committee at the provincial or municipal level, the election committee at the commune or ward level, and the special administrative region organize elections for provincial-level People's Council delegates and corresponding communal-level People's Council delegates; the election boards and polling stations implement the work of electing National Assembly delegates and People's Council delegates at all levels in accordance with the provisions of this Law."
2. Amend and supplement Clause 3 and Clause 4 of Article 8 as follows:
"3. The number of women proposed as candidates for National Assembly delegates shall be forecasted by the Standing Committee of the National Assembly based on the proposal of the Central Steering Committee of the Vietnam Women's Union, ensuring that at least thirty-five percent of the total number of people on the official list of candidates for National Assembly delegates are women.
4. The forecast of the structure, composition, and allocation of the number of people proposed as candidates for National Assembly delegates by the Standing Committee of the National Assembly shall be sent to the National Election Council, the Permanent Standing Committee of the Vietnam Fatherland Front Central Committee, the election committee at the provincial or municipal level, and the Permanent Standing Committee of the Vietnam Fatherland Front Provincial Committee."
3. Amend and supplement Article 9 as follows:
"Article 9. Forecasting the structure, composition, and allocation of the number of people proposed as candidates for People's Council delegates
Based on the number of People's Council delegates to be elected in each administrative unit as prescribed by the Law on the Organization of Local State Administration, after reaching consensus with the Permanent Standing Committee of the Vietnam Fatherland Front and the People's Committee at the same level, not later than 105 days before the election day:
1. The Standing Committee of the People's Council at the provincial or municipal level (hereinafter referred to as the provincial level) forecasts the structure, composition, and allocation of the number of people from political organizations, political-social organizations, social organizations, military units, state agencies at their own level and subordinate administrative units, public institutions, and economic organizations within their territory proposed as candidates for provincial-level People's Council delegates, ensuring that at least thirty-five percent of the total number of people on the official list of candidates for People's Council delegates are women; the number of candidates who are ethnic minorities is determined appropriately according to the characteristics, ethnic structure, and specific circumstances of each locality;
2. The Standing Committee of the People's Council at the commune or ward level (hereinafter referred to as the communal level) forecasts the structure, composition, and allocation of the number of people from political organizations, political-social organizations, social organizations, military units, state agencies at their own level and villages, hamlets, villages, villages, villages, villages, villages, villages, villages, public institutions, and economic organizations within their territory proposed as candidates for communal-level People's Council delegates, ensuring that at least thirty-five percent of the total number of people on the official list of candidates for People's Council delegates are women; the number of candidates who are ethnic minorities is determined appropriately according to the characteristics, ethnic structure, and specific circumstances of each locality;
3. The forecast of the structure, composition, and allocation of the number of people proposed as candidates for People's Council delegates by the Standing Committee of the People's Council at each level shall be sent to the National Election Council, the Standing Committee of the People's Council at the provincial level, the Permanent Standing Committee of the Vietnam Fatherland Front, and the election committee at the same level."
4. Amend and supplement Clause 2 and Clause 3 of Article 10 as follows:
"2. Provinces and municipalities are divided into constituencies for electing National Assembly delegates.
The number of constituencies, the list of constituencies, and the number of National Assembly delegates to be elected in each constituency are calculated based on population, determined by the National Election Council upon the proposal of the election committee at the provincial or municipal level, and announced not later than 80 days before the election day.
3. Provinces and municipalities are divided into constituencies for electing provincial-level People's Council delegates. Communes, wards, and special administrative regions are divided into constituencies for electing communal-level People's Council delegates.
The number of constituencies for electing provincial-level and communal-level People's Council delegates, the list of constituencies, and the number of delegates to be elected in each constituency are determined by the election committee at the relevant level upon the proposal of the People's Committee at the same level, and announced not later than 80 days before the election day."
5. Amend and supplement some clauses of Article 11 as follows:
a) Amend and supplement Clause 2 as follows:
"2. Each polling station has from three hundred to four thousand voters. In mountainous areas, islands, and places where residents are not concentrated, even if there are fewer than three hundred voters, a polling station may still be established.";
b) Amend and supplement Clause 4 as follows:
"4. The determination of polling stations is decided by the People's Committee at the commune level and reported to the People's Committee at the provincial level. If necessary, the People's Committee at the provincial level may adjust the determination of polling stations. The determination of polling stations must be completed before the establishment of the polling station board."
6. Amend and supplement Article 21 and Article 22 as follows:
"Article 21. Election organizations at local levels
1. Provincial election committees, district election committees, special economic zone election committees (hereinafter collectively referred to as the election committee).
2. National Assembly election boards, provincial People's Council election boards, district People's Council election boards (hereinafter collectively referred to as the election boards).
3. Voting teams.
Article 22. Establishment, structure, and composition of the election committee
1. At least 105 days before the election date, the provincial People's Committee, after reaching consensus with the Standing Committee of the Provincial People's Council and the Standing Committee of the Provincial Vietnam Fatherland Front Committee, decides to establish the provincial election committee (hereinafter referred to as the provincial election committee) to carry out the work of electing National Assembly deputies and organizing the election of provincial People's Council deputies in the province.
The provincial election committee consists of twenty-three to thirty-seven members including the Chairperson, Vice-Chairpersons, Secretary, and members representing the National Assembly delegation, the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the same level, and some relevant agencies and organizations.
The list of the provincial election committee must be sent to the National Election Council, the Standing Committee of the National Assembly, the Government, and the Standing Committee of the Central Vietnam Fatherland Front Committee.
2. At least 105 days before the election date, the district People's Committee, after reaching consensus with the Standing Committee of the District People's Council and the Standing Committee of the District Vietnam Fatherland Front Committee, decides to establish the district election committee (hereinafter referred to as the district election committee) to organize the election of district People's Council deputies.
The district election committee consists of nine to seventeen members. Members of the district election committee include the Chairperson, Vice-Chairpersons, Secretary, and members representing the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the district level, and some relevant agencies and organizations.
The list of the district election committee must be sent to the provincial election committee, the Standing Committee of the People's Council, the People's Committee, and the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level.
7. Amend and supplement Article 24 as follows:
"Article 24. Election Boards
1. At least 70 days before the election date, the provincial People's Committee, after reaching consensus with the Standing Committee of the Provincial People's Council and the Standing Committee of the Provincial Vietnam Fatherland Front Committee, decides to establish an election board for each constituency electing National Assembly deputies consisting of nine to seventeen members including the Chairman, Deputy Chairmen, Secretary, and members representing the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the same level, and some relevant agencies and organizations.
2. At least 70 days before the election date, the provincial and district People's Committees, after reaching consensus with the Standing Committee of the People's Council and the Standing Committee of the Vietnam Fatherland Front Committee at the same level, decide to establish an election board for each constituency electing People's Council deputies at their respective levels consisting of representatives from state agencies, political organizations, political-social organizations, social organizations. The composition of the district-level People's Council election board includes additional representatives from local voters.
The election board for the provincial People's Council consists of eleven to fifteen members. The election board for the district People's Council consists of nine to fifteen members. The election board includes the Chairman, Deputy Chairmen, Secretary, and members.
3. The election board has the following tasks and powers:
a) Inspect and urge the implementation of election laws by voting teams within the constituency;
b) Inspect and urge the establishment and posting of voter lists and the posting of candidate lists by voting teams within the constituency;
c) Direct, inspect, and urge the arrangement of polling rooms and voting activities in those rooms;
d) Receive and distribute election materials and ballots to voting teams at least 13 days before the election date;
đ) Receive, compile, and inspect the voting result reports from voting teams; prepare a report confirming the election results in the constituency;
e) Resolve complaints and denunciations regarding the conduct of voting teams' election work and complaints and denunciations about elections transferred by voting teams; receive and transfer complaints and denunciations about National Assembly deputy candidates to the provincial election committee; receive and transfer complaints and denunciations about People's Council deputy candidates to the corresponding election committee;
g) Report on the organization and conduct of the election according to the guidance and requirements of the National Election Council or according to the requirements of the same-level election committee;
h) Transfer election files and documents for National Assembly deputies to the provincial election committee; transfer election files and documents for People's Council deputies to the same-level election committee;
i) Organize the implementation of additional and repeat elections (if necessary).
8. Amend and supplement Clause 1 of Article 25 as follows:
"1. At least 43 days before the election date, the district People's Committee, after reaching consensus with the Standing Committee of the District People's Council and the Standing Committee of the District Vietnam Fatherland Front Committee, decides to establish a voting team in each polling area to carry out the work of electing National Assembly deputies and deputies of all levels of People's Councils. The voting team consists of eleven to twenty-one members including the Team Leader, Secretary, and members representing state agencies, political organizations, political-social organizations, social organizations, and local voter representatives.
Military units identified as separate polling areas shall establish a voting team consisting of five to nine members including the Team Leader, Secretary, and members representing the unit command and military personnel of that military unit.
In the case where a people's armed unit and a locality share the same polling area, the People's Committee at the commune level shall decide to establish an election team consisting of eleven to twenty-one members, including a Team Leader, a Secretary, and other members who are representatives from state agencies, political organizations, socio-political organizations, social organizations, local voters, commanding officers of the armed unit, and military personnel of the people's armed unit, after reaching consensus with the Standing Body of the People's Council, the Standing Board of the Vietnam Fatherland Front Committee at the same level, and the commanding officer of the armed unit.
9. Amend and supplement Clause 1 of Article 31 as follows:
"1. The list of voters shall be established by the People's Committee at the commune level for each polling area."
10. Amend and supplement Clause 3 and add Clause 4 following Clause 3 of Article 36 as follows:
"3. A citizen may submit candidacy application forms for election as a member of the People's Council at a maximum of two levels within the same term; if submitting a candidacy application form for election as a member of the National Assembly, they can only submit a candidacy application form for election as a member of the People's Council at one level.
4. After the deadline for submitting candidacy application forms for election as a member of the National Assembly or a member of the Provincial People's Council has passed, if a person who has submitted a candidacy application form transfers their work from one administrative unit to another, the transfer of the candidacy application form shall be carried out according to the guidelines of the National Election Council."
11. Amend and supplement Clause 2 of Article 41 as follows:
"2. At state agencies, the leadership of the agency proposes candidates for election as members of the National Assembly, organizes meetings of electors where the candidate works to solicit opinions. Based on the opinions of the meeting of electors, the leadership of the agency organizes a meeting comprising leaders of the agency, representatives of subordinate units' leaders to discuss and propose candidates for election as members of the National Assembly;"
12. Amend and supplement Clause 2 of Article 42 as follows:
"2. The leadership of public service units, economic organizations coordinates with the trade union committee of the organization, unit (if any); the leadership of state agencies proposes candidates for election as members of the National Assembly from their own agencies, organizations, units, and solicits opinions of elector meetings where the candidates work. Based on the opinions of the elector meetings, the leadership of the agencies, organizations, units organizes meetings comprising leaders of the agencies, organizations, units, representatives of the trade union committee (if any), and representatives of leaders of subordinate units to discuss and propose candidates for election as members of the National Assembly;"
13. Amend and supplement Clause 1 and Clause 2 of Article 45 as follows:
"1. The elector meeting at the commune, ward, special zone level, held in the village, residential group where the candidate for election as a member of the National Assembly resides regularly, shall be convened and chaired by the Standing Board of the Vietnam Fatherland Front Committee at the commune level in coordination with the People's Committee at the same level.
The candidate for election as a member of the National Assembly and representatives of the agencies, organizations, units that have proposed candidates shall be invited to attend this meeting.
2. The elector meeting at state agencies, political organizations, socio-political organizations, social organizations shall be convened and chaired by the leadership of the agencies, organizations; the elector meeting at public service units, economic organizations shall be convened and chaired by the head of the organization, unit in coordination with the trade union committee of the organization, unit (if any); the elector meeting at people's armed units shall be a military meeting convened and chaired by the leadership and command of the unit.
The candidate for election as a member of the National Assembly shall be invited to attend this meeting."
14. Amend and supplement some clauses of Article 50 as follows:
a) Amend and supplement Clause 2 as follows:
"2. The first round of consultation meeting at the provincial level shall agree on the structure, composition, and number of persons to be proposed as candidates for election as members of the People's Council from political organizations, socio-political organizations, social organizations, people's armed units, state agencies at the same level, and public service units, economic organizations, lower-level administrative units within the territory."
b) Amend and supplement Clause 4 as follows:
"4. The minutes of the consultation meeting must clearly record the participants, the number of attendees, the proceedings, and the results of the meeting.
The minutes of the consultation meeting at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and the Standing Body of the People's Council, the Election Committee at the same level.
The minutes of the consultation meeting at the commune level shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the provincial level, and the Standing Body of the People's Council, the Election Committee at the same level."
15. Amend and supplement Clause 2 of Article 52 as follows:
"2. The leadership of public service units, economic organizations coordinates with the trade union committee of the organization, unit (if any); the leadership of state agencies proposes candidates for election as members of the People's Council from their own agencies, organizations, units, and solicits opinions of elector meetings where the candidates work. Based on the opinions of the elector meetings, the leadership of the agencies, organizations, units organizes a meeting comprising leaders of the agencies, organizations, units, representatives of the trade union committee (if any), and representatives of leaders of subordinate units to discuss and propose candidates for election as members of the People's Council;"
16. Amend and supplement some clauses of Article 53 as follows:
a) Amend and supplement Clause 1 as follows:
"1. The second round of consultation meeting at each level shall be organized by the Standing Board of the Vietnam Fatherland Front Committee at the same level not later than forty days before the election day. The composition of the second round of consultation meeting shall comply with the provisions of Clause 1 of Article 50 of this Law."
b) Amend and supplement Clause 3 as follows:
"3. The minutes of the consultation meeting must clearly record the participants, the number of attendees, the proceedings, and the results of the meeting."
The minutes of the consultation meeting at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and the Standing Body of the People's Council, the Election Committee at the same level.
The minutes of the consultation meeting at the commune level shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the provincial level, and the Standing Body of the People's Council, the Election Committee at the same level."
17. Amend and supplement Clause 1 and Clause 2 of Article 54 as follows:
"1. The elector meeting at the commune, ward, special zone level, held in the village, residential group, shall be convened and chaired by the Standing Board of the Vietnam Fatherland Front Committee in coordination with the People's Committee at the same level.
2. The voters' meeting at state agencies, political organizations, socio-political organizations, social organizations shall be convened and chaired by the head of the agency or organization; the voters' meeting at economic organizations, public service units shall be organized and convened by the head of the organization or unit in coordination with the trade union executive board (if any); the voters' meeting at people's armed forces units shall be a military personnel meeting convened and chaired by the leadership and command of the unit.
18. Amend and supplement some clauses of Article 56 as follows:
a) Amend and supplement Clause 1 as follows:
"1. The third round of the consensus conference at each level shall be organized by the Standing Committee of the Vietnam Fatherland Front Committee at the same level, not later than 23 days before the election day. The composition of the third round of the consensus conference shall be carried out according to the provisions of Clause 1 of Article 50 of this Law."
b) Amend and supplement Clause 3 as follows:
"3. The minutes of the third round of the consensus conference must clearly record the composition, number of participants, proceedings, and results of the conference. The minutes of the consensus conference at the provincial level shall be immediately sent to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and the Standing Body of the People's Councils and the Election Committees at the same level.
The minutes of the consultation meeting at the commune level shall be immediately sent to the Standing Body of the People's Council, the People's Committee, the Vietnam Fatherland Front Committee at the provincial level, and the Standing Body of the People's Council, the Election Committee at the same level."
19. Amend and supplement Clause 1 and Clause 2 of Article 58 as follows:
"1. Not later than 21 days before the election day, the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level must send the minutes of the third round of the consensus conference and the list of candidates who meet the eligibility criteria for People's Council deputies to the National Election Council, the Standing Committee of the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and the Standing Body of the People's Councils and the Election Committees at the same level; the Standing Committee of the Vietnam Fatherland Front Committee at the commune level must send the minutes of the third round of the consensus conference and the list of candidates who meet the eligibility criteria for People's Council deputies to the Standing Body of the People's Councils, the People's Committee, the Vietnam Fatherland Front Committee at the provincial level, and the Standing Body of the People's Councils and the Election Committees at the same level.
2. Not later than 17 days before the election day, the Election Committee must establish and publish the official list of candidates for People's Council deputies according to each electoral district. The establishment of the official list of candidates for People's Council deputies shall be carried out according to the provisions of Clause 5 of Article 57 of this Law."
20. Amend and supplement Article 66 as follows:
"Article 66. Voters' Meeting
1. The Standing Committee of the Vietnam Fatherland Front Committee at the provincial level shall take the lead in coordinating with the People's Committee at the electoral district to organize the voters' meeting for those running for National Assembly deputies and provincial People's Council deputies. The attendees of the voters' meeting include representatives from agencies, organizations, units, and voters in the locality.
The Standing Committee of the Vietnam Fatherland Front Committee at the commune level shall coordinate with the People's Committee at the same level in the electoral district to organize the voters' meeting for those running for People's Council deputies at their own level. The attendees of the voters' meeting include representatives from agencies, organizations, units, and voters in the locality.
The voters' meeting may be held in person or, based on actual conditions, through online means or a combination of in-person and online methods. Online voter meetings or those combining in-person and online methods can only be conducted when technical, cybersecurity, and network security conditions are ensured.
The People's Committee where the voters' meeting is held shall be responsible for announcing the form, content, time, location of the meeting, and the online access point to ensure that voters can participate fully.
2. The program of the voters' meeting includes the following contents:
a) Statement of reasons;
b) A representative from the Standing Committee of the Vietnam Fatherland Front Committee organizing the voters' meeting shall chair the meeting, introduce and read the brief biography of the candidate;
c) Each candidate shall report to the voters about their program if elected as a National Assembly deputy or People's Council deputy;
d) Voters shall express their opinions and aspirations towards the candidates. Candidates and voters shall engage in democratic, frank, and open discussions on issues of mutual concern;
đ) The chairperson of the meeting shall make concluding remarks.
3. After the voters' meeting, the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level shall prepare a report on the organization of the voters' meeting for candidates running for National Assembly deputies and provincial People's Council deputies, and the voters' opinions on each candidate for National Assembly deputy, and send it to the National Election Council and the Standing Committee of the Central Committee of the Vietnam Fatherland Front. The Standing Committee of the Vietnam Fatherland Front Committee at the commune level shall prepare a report on the organization of the voters' meeting for candidates running for People's Council deputies at their own level, and send it to the Election Committee at the same level and the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level.
21. Amend and supplement Clause 3 of Article 85 as follows:
"3. The minutes of the election summary for People's Council deputies shall be prepared in six copies, signed by the Chairman and Vice Chairmen of the Election Committee. The minutes of the election summary for People's Council deputies at the commune level shall be sent to the People's Council, People's Committee, and Vietnam Fatherland Front Committee at the same level and the provincial level. The minutes of the election summary for People's Council deputies at the provincial level shall be sent to the People's Council, People's Committee, Vietnam Fatherland Front Committee at the same level, the Standing Committee of the National Assembly, the Government, and the Central Committee of the Vietnam Fatherland Front."
22. Supplement Clause 3 after Clause 2 of Article 98 as follows:
"3. During the implementation of the election work, if there are any difficulties arising, the National Election Council shall proactively adjust the timeline to suit the actual progress of the steps and guide the election-responsible organizations to comply with the regulations."
23. Replace certain phrases in articles, clauses, and points as follows:
a) Replace the term "town" with "special zone" in Clause 5 of Article 37;
b) Replace the phrase "district level" with "commune level" in Clause 1 of Article 39;
c) Replace the phrase "25 days" with "17 days" in Point g of Clause 1, Point h of Clause 2 of Article 23, and Clause 4 of Article 57;
d) Replace the phrase "70 days" with "42 days" in Clause 1 of Article 35;
d) Replace the phrase "65 days" with the phrase "40 days" in Clause 1, Article 43 and Clause 1, Article 44;
e) Replace the phrase "40 days" with the phrase "35 days" in Clause 4, Article 46 and Clause 4, Article 55;
g) Replace the phrase "55 days" with the phrase "38 days" in Article 47;
h) Replace the phrase "35 days" with the phrase "23 days" in Clause 1, Article 48 and Clause 1, Article 49;
i) Replace the phrase "30 days" with the phrase "21 days" in Clause 1 and Clause 2, Article 57;
k) Replace the phrase "20 days" with the phrase "16 days" in Clause 7, Article 57 and Article 59;
l) Replace the phrase "15 days" with the phrase "07 days" in Clause 3, Article 79; Clause 4, Article 80; and Clause 2, Article 81;
m) Replace the phrase "20 days" with the phrase "10 days" in Clause 1, Article 86;
n) Replace the phrase "05 days" with the phrase "03 days" in Clause 1, Article 87;
o) Replace the phrases "30 days" and "20 days" with the phrase "07 days" in Clause 2, Article 87.
24. Delete certain phrases from the following articles, clauses, and points:
a) Delete the phrase "Election Committee at the district level," in Clause 4, Article 61;
b) Delete the phrase ", at the provincial level" in Clause 3, Clause 4, Article 29; Clause 3, Clause 4, Article 30; Clause 1, Article 51; Clause 3, Article 62; delete the phrase "at the provincial level," in Clause 3, Article 89;
