Pursuant to Decree No. 102/SL dated May 20, 1957 on the right to establish associations;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government stipulating the organization, operation, and management of associations;
Considering the proposal of the Chairman of the Vietnam Dance Artists Association and the Director of the Department of Non-Governmental Organizations,
DECISION:
Article 1. Approves the Charter (amended) of the Vietnam Dance Artists Association which was adopted at the Fourth National Congress of the Vietnam Dance Artists Association on July 3, 2005.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.
Article 3. The Chairman of the Vietnam Dance Artists Association and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision./.

CHARTER (AMENDED) OF THE VIETNAM DANCE ARTISTS ASSOCIATION

PART I
NAME, PURPOSE, SCOPE OF ACTIVITY AND ORGANIZATIONAL PRINCIPLES OF THE ASSOCIATION
AND PRINCIPLES OF ORGANIZATION AND OPERATION OF ASSOCIATIONS
Article 1. Name
1. The official name of the Association is: Vietnam Dance Artists Association.
2. The name in English: THE VIETNAM DANCE ARTIST ASSOCIATION.
Article 2. Aims and Objectives
1. The Vietnam Dance Artists Association is a political, social, and professional organization of professional dance artists with solid professional qualifications who voluntarily participate in the activities of the Association.
2. The Vietnam Dance Artists Association operates under the leadership of the Communist Party of Vietnam following the Party's cultural and artistic policies and is subject to state management. The Association organizes and operates according to its Charter and the laws of the Socialist Republic of Vietnam.
3. The Vietnam Dance Artists Association organizes, unites, and encourages those engaged in dance work to create works of art based on the spirit of promoting national dance traditions and absorbing the finest elements of world art in order to produce many talents, works, and pieces of high value in thought and art. It strives to build a progressive and distinctively national Vietnamese dance art, contributing to the cause of building and defending the socialist fatherland.
4. The Vietnam Dance Artists Association protects the legitimate rights and interests of members in politics, society, and professional activities as stipulated by law.
Article 3. Scope of Activities
The Vietnam Dance Artists Association operates throughout the country and has relations with organizations in other countries and regions for the exchange of dance art according to the provisions of the law.
Article 4. Principles of Organization and Operation of the Association
The Vietnam Dance Artists Association organizes and operates on the principles of voluntariness, democracy, majority decision-making, collective leadership, individual responsibility, and the promotion of the active and creative role of members based on the Charter of the Association.
Article 5. Relations
1. The Vietnam Dance Artists Association (hereinafter referred to as the Association) is a member of the Federation of Literature and Art Associations of Vietnam.
2. The Association has relations regarding professional activities with central specialized literature and art associations and local literature and art associations.
3. The Association maintains friendly relations and exchanges and cooperates in dance art with artistic organizations and progressive artists worldwide on the principle of mutual benefit according to Vietnamese law and international practice.
Article 6. Headquarters and Legal Status of the Association
1. The Association has legal status, seals (wet seal, raised seal, miniature wet seal), and a separate bank account as prescribed by law.
2. The headquarters of the Association is located in Hanoi, the capital city.
Chapter II
TASKS AND RIGHTS OF THE ASSOCIATION
Article 7. Tasks of the Association
1. Organizing dance art activities to provide conditions for members to create works that promote the development of all aspects of Vietnamese dance art;
2. Propagating and implementing the Party's cultural and artistic policies and state laws among members and within the Association;
3. Enhancing the ideological and professional competence of members, promoting theoretical criticism, and combating erroneous and reactionary artistic views and trends;
4. Participating in the evaluation and advisory services on dance art for agencies and organizations that request such services;
5. Organizing and participating in seminars and research on topics related to dance art;
6. Cooperating with state agencies and mass organizations to improve the aesthetic appreciation of the public, especially among young people, and to enhance the quality and promote mass dance art activities;
7. Proposing and recommending policies and regulations to the Party and State concerning those engaged in dance art work;
8. Expanding friendly cooperation with dance art organizations and progressive dancers worldwide in accordance with the Party and State's foreign policy;
9. Providing services in accordance with its profession as prescribed by law;
10. Developing membership nationwide.
Article 8. Rights of the Association
1. Establishing subordinate agencies and units and local and grassroots branches in accordance with the law;
2. Organizing domestic dance art activities and cooperating with foreign entities as prescribed by law;
3. Managing subordinate agencies, branches, and members nationwide in accordance with the Association's Charter;
4. Awarding commendations and disciplinary actions against subordinate agencies, branches, and members;
5. Deciding on the financial affairs and assets of the Association.
6. Receiving financial support from the state and economic and social organizations both domestically and internationally.
Chapter III
MEMBERS
Article 9. Conditions for becoming a member
1. Being a Vietnamese citizen engaged professionally in the fields of dance art: creation, theoretical research, teaching, performance, and voluntary mass movement work, who submits an application to join the Association and complies with the Charter of the Association.
2. Loyalty to the political-cultural-artistic line of the Communist Party of Vietnam.
3. Meeting professional standards:
a) Engaging in professional dance activities for five years or more.
b) Having outstanding achievements in the fields of dance art activities:
- For creators, must have several works with good content and artistic quality that have been performed by artistic units.
- For theoretical researchers, must have several scientific studies that contribute to the field of dance.
- For trainers, must have experience and good teaching results.
- For performers, must have solid professional skills and creative performance.
- For those working in the field of folk art, must have high effectiveness in training, directing, and staging.
Article 10. Members
1. Regular members are Vietnamese citizens meeting all the criteria as stipulated in Article 9.
2. Honorary members are individuals not directly engaged in dance art activities but have made special contributions to the development of dance art and the activities of the Association.
3. Supporting members: shall be specified by the Executive Board.
Article 11. Obligations of members
1. Strictly complying with state laws, protecting the reputation of the Association;
2. Continuously improving political and professional qualifications; actively participating in artistic activities and organizational building activities of the Association, contributing to the development of advanced and distinctive national dance art;
3. Adhering to the Charter and resolutions of the Association, fulfilling all tasks assigned by the Association or Branch, uniting and supporting each other for mutual progress;
4. Through their artistic activities, contributing to the popularization and enhancement of aesthetic appreciation of dance art among the masses;
5. Paying membership fees according to the membership regulations.
Article 12. Rights of members
1. Receiving a Membership Card of the Vietnam Dance Artists Association;
2. Having the right to nominate and be nominated for leadership positions within the Association, discussing and participating in the Association's policies and directions of activities;
3. Being provided conditions by the Association to improve professional knowledge and skills, having the Association protect their political and professional rights, author rights, and works based on the authorization from members to the Association;
4. Enjoying rewards according to the regulations of the Party, State, and the Association;
5. Having the right to resign from the Association.
Article 13. Procedures for joining the Association
1. Individuals meeting the conditions and standards set out in Article 9 wishing to join the Association must voluntarily submit an application and prepare a dossier according to the model prescribed by the Association's Executive Board.
2. The Executive Board is the authority responsible for examining and deciding on new memberships. The admission of new members must be agreed upon by more than half of the Executive Board members. The Association organizes two examinations for new members annually during regular meetings of the Executive Board.
3. The President of the Association signs the decision on admission. The membership period of members is calculated from the date of the decision.
Article 14. Procedures for leaving the Association
1. Members wishing to leave the Association must voluntarily submit a resignation letter to the Executive Board.
2. Members violating the law and sentenced to non-custodial reform or higher will be expelled from the Association.
3. Members violating the Charter of the Association, breaking the law and damaging the Association's reputation (but not reaching the level of punishment as stated in Item 2 - Article 14 above), failing to participate in Association activities and not paying membership fees for two consecutive years or more will not enjoy member benefits.
4. Cases of expulsion, removal, and resignation are decided by the Executive Board. Expelled members must return their Membership Cards.
Chapter IV
ORGANIZATION OF THE ASSOCIATION
Article 15. Organization of the Association
The structure of the Vietnam Dance Artists Association includes:
1. Central Leadership Bodies of the Association:
- Executive Board.
- Standing Committee.
- Inspection Board.
- Art Council.
- Central Office of the Association.
2. Subordinate Units of the Association:
- Southern Regional Representative Office.
- Specialized Journal.
- Branches.
In necessary cases, the Association may establish subordinate bodies according to legal provisions.
Article 16. National Congress
1. The National Congress is the highest authority of the Vietnam Dance Artists Association.
2. The National Congress consists of two levels: Basic Congress and National Delegates Congress.
3. The term of the National Congress is five years. In exceptional circumstances, the Congress can be held earlier or later, but not more than one year beyond the term and must be announced to all members.
An extraordinary Congress can only be convened when over 50% of the members or over two-thirds of the Executive Board members agree, or upon request by the competent state management agency.
4. Main contents of the National Delegates Congress:
- Discussing and approving the report on the term's summary and the direction of activities for the new term;
- Discussing and amending the Charter (if necessary);
- Finalizing financial accounts of the previous term;
- Electing the Central Executive Board of the Association;
- Building and approving the Congress Resolution.
Article 17. Procedures for electing and removing representatives at the National Delegates Congress
1. Official delegates attending the National Delegates Congress are:
- Members elected by the Basic Congress as delegates. (Each member can only participate in the election of delegates at one Basic Congress).
- Members serving as Executive Board and Inspection Board members are automatic delegates.
- Members designated by the Executive Board to attend (but not exceeding 5% of the number of delegates elected through voting).
2. The number of delegates attending the National Delegates Congress is calculated based on the proportion of members from Basic Congresses. Localities without enough members to form a Branch will be decided by the Executive Board to convene.
3. In case of missing official delegates, the Congress Organizing Committee will summon corresponding substitute delegates to replace them and become official delegates (in the order of the substitute delegate list of the electoral unit).
4. Official delegates violating the representative standards will be proposed by the Qualification Review Board and voted on by the National Delegates Congress, with more than 50% of delegates agreeing to remove their representative status.
5. Official delegates have the right to speak, nominate, propose, and vote at the National Delegates Congress.
Article 18. Executive Board
1. The Executive Board is the highest leading body of the Association between two Congresses.
2. The Executive Board is directly elected at the National Congress of Delegates. The number of Executive Board members is decided by the Congress.
3. The Executive Board elects the President, Vice Presidents, Standing Committee members, Inspection Board and its Chairperson, Art Council and its Chairperson by secret ballot.
4. The Executive Board leads the implementation of Congress resolutions, formulates policies, plans, and measures for Association activities, prepares financial budgets and final accounts, admits new members, rewards and disciplines within the Association... The Executive Board meeting convenes every six months.
5. The Executive Board decides to relieve an Executive Board member of their duties when such a member submits a resignation letter, or upon the proposal of the Association President and must be agreed by more than half of the Executive Board members through a secret ballot.
6. In necessary cases, the Executive Board has the right to elect additional Executive Board members to replace those who are absent from the Executive Board.
7. The procedure for the first session of the Executive Board: The person elected to the Executive Board with the highest number of votes convenes the Executive Board members to elect the President. Subsequently, the President conducts the Executive Board meeting to elect other positions of the Association.
Article 19. Standing Committee
1. The Standing Committee is the management body of the Association between two meetings of the Executive Board. The Standing Committee consists of the President, Vice Presidents, and some Standing Committee members. The number of Standing Committee members is determined by the Executive Board but must be less than half the number of the Executive Board.
2. The Standing Committee carries out all Association work according to the resolutions of the Executive Board, appoints and relieves administrative and specialized agencies under the Association.
3. The election and relief of Standing Committee members must be agreed by more than half of the Executive Board members.
4. The Standing Committee meets regularly every three months; in urgent cases, convened by the Association President.
Article 20. President.
1. The President is the head of the Association's agency, the Association's legal representative; the Association President is responsible for managing the Association's activities.
2. The President is elected among the Executive Board members by the Executive Board.
3. The President proposes lists of Vice Presidents and Standing Committee members for the Executive Board to elect.
4. The President proposes lists of the Inspection Board and Art Council for the Executive Board to elect.
Executive Board members have the right to nominate candidates for the above positions.
5. When there is a vacancy for the President or the President needs to be relieved, the Executive Board elects a new President from the Executive Board members by secret ballot and must be agreed by more than half of the Executive Board members.
6. The election results are announced to all members.
Article 21. Vice President
1. The Vice President assists the President in specific tasks and is responsible to the President for decisions made within the scope assigned.
2. The permanent Vice President acts on behalf of the President to handle matters when the President is absent and must report back to the President afterwards.
Article 22. Inspection Board
1. The Inspection Board is responsible for inspecting and supervising the implementation of resolutions and regulations of the Association; Proposes measures to resolve complaints and reports of violations by members and Association staff for the Executive Board to consider and resolve. In special cases, the Inspection Board may recommend the Executive Board to request intervention from legal authorities and state management bodies.
2. The number of Inspection Board members is decided by the Executive Board; the Chairperson of the Inspection Board must be an Executive Board member.
3. The addition or relief of Inspection Board members is proposed by the Executive Board or the Inspection Board and must be agreed by more than half of the Executive Board members through a secret ballot.
4. The term of the Inspection Board follows that of the Executive Board. The Inspection Board meets regularly every six months, in urgent cases convened by the Chairperson.
Article 23. Art Council
1. The Art Council comprises artists with outstanding expertise in areas of creation, research, teaching, and performance, familiar with nationwide dance activities and directions, impartial, enthusiastic, and responsible for Association work.
2. The number of Art Council members is determined by the Executive Board; the Chairperson of the Art Council must be a member of the Executive Board; the Deputy Chairperson of the Art Council is elected by the Art Council and approved by the President.
3. The Art Council advises the Association leadership on major issues related to professional work.
4. The relief or addition of Art Council members is proposed by the Executive Board or the Art Council and must be agreed by more than half of the Executive Board members.
5. In necessary cases, the Standing Committee may organize advisory boards in specialized fields to assist the Art Council.
Article 24. Branch Associations
1. Branch Associations are the grassroots organizations of the Vietnam Dance Artists Association and are also collective members of local literary and artistic associations.
2. Branch Associations are led and managed by local party committees and governments; coordinate activities according to the general plan of the local literary and artistic association and the specialized plan of the Vietnam Dance Artists Association.
3. Localities, regions, and units with five members or more can establish Branch Associations. The establishment of Branch Associations is decided by the Executive Board of the Vietnam Dance Artists Association based on the agreement of the local literary and artistic association and the approval of the local party committee and government.
4. The Branch Association Executive Board is elected by the Branch Association Congress by secret ballot; the Branch Association Chairperson and Vice Chairperson are directly elected and recognized by the President of the Vietnam Dance Artists Association. In cases of relieving or replacing Branch Association staff, it must be proposed by the majority of members.
5. The operational rules of Branch Associations are stipulated by the Executive Board.
Chapter V
ASSETS AND FINANCES OF THE ASSOCIATION
Article 25. Financial sources of the Association
- Membership fees contributed by members.
- State budget allocation and support.
- Sponsorship from individuals and organizations both domestically and internationally.
- Revenue-generating activities of Association organizations and agencies.
Article 26. Management and use of Association assets and finances
1. The Association manages assets and finances in accordance with the provisions of the law.
2. Assets and finances of the Association shall be assigned to subordinate agencies of the Association for management and use for purposes specified in the functions of the units. The heads of the units shall be responsible to the Executive Board for the management and use of assets and finances of their units and shall regularly report to the Executive Board.
3. The transfer of assets and finances of subordinate agencies of the Association shall be decided by the Executive Board.
4. Assets and finances of the Association shall be used for activities according to the general plan of the Association decided by the Executive Board and must be publicly announced on a regular annual basis.
5. The Association shall be dissolved in the following cases: the Association dissolves itself or is ordered to dissolve by a competent state agency. The settlement of assets and finances of the Association upon dissolution shall be carried out in accordance with the provisions of the law.
Chapter VI
REWARDS AND DISCIPLINE
Article 27. Awards
1. Members and organizations, agencies subordinate to the Association that have achievements in the activities of the Association shall be directly rewarded by the Association: awarding certificates of merit, awarding the Commemorative Medal "For the Cause of Vietnamese Dance Art" and processing procedures to request the State, relevant sectors, and levels to consider granting national awards, honorary titles of the State, and other forms of reward.
2. Individuals who are not members but have made significant contributions and provided positive support for the development of Vietnamese dance art shall be considered for the Commemorative Medal "For the Cause of Vietnamese Dance Art" by the Association.
Article 28. Disciplinary Measures
1. Members who violate the law and the Charter of the Association shall be subject to the following disciplinary measures: reprimand, warning, removal of name, expulsion from the Association.
2. The implementation of disciplinary measures shall be proposed by the Inspection Board and decided by the Executive Board.
Chapter VII
IMPLEMENTING PROVISIONS
Article 29. Supplementary and Amending Procedures for the Charter
Only the National Congress of the Vietnam Association of Dance Artists has the right to supplement and amend the Charter of the Association.
Article 30. Effectiveness
This Charter consists of 7 chapters and 30 articles which were adopted on July 1, 2005 at the Fourth National Congress of the Vietnam Association of Dance Artists.
2. This Charter shall take effect pursuant to the approval decision of the Ministry of Home Affairs.
