JOINT CIRCULAR
Guidelines for implementing the appointment and salary classification into positions within the National Reserve sector as stipulated in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs December 19, 2005of the Minister of Home Affairs
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, and armed forces personnel;
Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state agencies;
Pursuant to Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding the implementation of salary reclassification for cadres, civil servants, and public officials when changing jobs and cases of transfer from the armed forces, telegraph services, and state-owned enterprises to work in state agencies and state-run organizations;
Pursuant to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for positions within the National Reserve sector;
The Ministry of Finance and the Ministry of Home Affairs jointly issue guidelines for implementing the appointment and salary classification into positions within the National Reserve sector as stipulated in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs as follows:
1. Scope of application:Cadres and civil servants currently holding positions within the National Reserve sector who have changes in their job titles and professional standards according to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for positions within the National Reserve sector.
2. Principles for transferring from old positions to new positions
a/ The transfer of positions must be based on the job requirements and needs of cadres and civil servants.
b/ Cadres and civil servants must meet the conditions and professional standards of positions as stipulated in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for positions within the National Reserve sector.
c/ Successfully completing assigned tasks, being properly placed in specialized positions consistent with their educational background, and not being under disciplinary action.
d/ When transferring positions from old to new positions according to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for positions within the National Reserve sector, it shall not involve combining the transfer of civil servant categories from Category B and C to Category A or from Category C to Category B.
3. Method of transferring positions from old to new positions
a/ For the position of Intermediate Preservation Technician, code 19.222
Cadres and civil servants currently holding the position of Quality Control and Preservation Technician (code 19.183) will be transferred to the position of Intermediate Preservation Technician - code 19.222 as stipulated in Section II of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards and qualifications for positions within the National Reserve sector.
b/ For the position of Preservation Storekeeper, code 19.223
Cadres and civil servants currently working in storage, receipt, and preservation at national reserve warehouses who hold the position of Group 1 Preservation Storekeeper (code 19.184) or Group 2 Preservation Storekeeper (code 19.185), if they meet the conditions and standards as stipulated in Section III of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards and qualifications for positions within the National Reserve sector, will be transferred to the position of Preservation Storekeeper - code 19.223.
c/ For the position of Warehouse Security Officer, code 19.224
Cadres and civil servants currently working in security for national reserve warehouses who previously held the position of Patrol Guard (code 19.186) will be transferred to the position of Warehouse Security Officer - code 19.224 as stipulated in Section IV of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards and qualifications for positions within the National Reserve sector.
4. Principles for transferring salaries: The transfer of salaries for cadres and civil servants within the National Reserve sector when moving from old positions to new positions shall be implemented according to Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding the reclassification of salaries for cadres, civil servants, and public officials when changing jobs and cases of transfer from the armed forces, telegraph services, and state-owned enterprises to work in state agencies and state-run organizations.
1. This Circular takes effect from May 15, 2013.
This circular takes effect fifteen days after its publication in the Official Gazette.
Any difficulties encountered during implementation should be reported to the National Reserve Administration for study and resolution.
