Guidelines for implementing the appointment and salary grading into the ranks of civil servants in the National Reserve sector as stipulated in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, and armed forces personnel;
Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state agencies;
Pursuant to Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding the implementation of salary grading changes for cadres, civil servants, and public officials when changing jobs and cases where they are transferred from the armed forces, cryptologic services, and state-owned enterprises to work in state agencies and state-run organizations;
Pursuant to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector;
Jointly issued by the Ministry of Finance and the Ministry of Home Affairs, these guidelines provide guidance on implementing the appointment and salary grading into the ranks of civil servants in the National Reserve sector as stipulated in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs as follows:
I. OBJECTS AND SCOPE OF APPLICATION:
Civil servants currently holding ranks within the National Reserve sector that have changed in job titles and professional standards according to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector.
II. ON THE PRINCIPLES FOR TRANSITION FROM OLD RANKS TO NEW RANKS a/ The transition between ranks must be based on the position and work requirements of the civil servant.
b/ Civil servants who meet the conditions and professional standards of the ranks of civil servants as prescribed in Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector.
c/ Successfully completing assigned tasks, being properly placed in specialized positions consistent with their educational training, the unit having the new rank position, and not being under disciplinary action at the time.
d/ When transitioning from old ranks to new ranks according to Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector, it shall not involve combining the transfer of civil servant types from type B or C to type A or from type C to type B.
III. METHODS FOR TRANSITIONING FROM OLD RANKS TO NEW RANKS
a/ For the rank of Intermediate Preservation Technician, code 19.222
Civil servants currently holding the rank of Quality Control and Preservation Technician (code 19.183) may be transferred to the rank of Intermediate Preservation Technician - code 19.222 as stipulated in Section II of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector.
b/ For the rank of Preservation Storekeeper, code 19.223
Civil servants currently working in storekeeping, delivery, and preservation at national reserve warehouses who hold the rank of Group 1 Preservation Storekeeper (code 19.184) or Group 2 Preservation Storekeeper (code 19.185), if they meet the conditions and standards set out in Section III of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector, may be transferred to the rank of Preservation Storekeeper - code 19.223.
c/ For the rank of Warehouse Security Officer, code 19.224
Civil servants working in security for national reserve warehouses who previously held the rank of Patrol Guard (code 19.186) may be transferred to the rank of Warehouse Security Officer - code 19.224 as stipulated in Section IV of Decision No. 136/2005/QĐ-BNV dated December 19, 2005 of the Minister of Home Affairs on issuing the professional standards for the ranks of civil servants in the National Reserve sector.
IV. PRINCIPLES FOR SALARY GRADING TRANSITION:
The transition of salary grading for civil servants in the National Reserve sector transitioning from old ranks to new ranks shall be implemented in accordance with Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding the salary grading changes for cadres, civil servants, and public officials when changing jobs and cases where they are transferred from the armed forces, cryptologic services, and state-owned enterprises to work in state agencies and state-run organizations.
V. EFFECTIVE DATE OF IMPLEMENTATIONThis circular shall take effect fifteen days after its publication in the Official Gazette.
During the implementation process, any issues encountered should be reported to the National Reserve Administration for feedback to the Ministry of Finance and the Ministry of Home Affairs for study and resolution./.
