Regarding the establishment of certain organizations at local levels

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Law on the Organization of People's Councils and People's Committees (amended) dated June 21, 1994;

Pursuant to Decree No. 73/CP, November 1, 1995, on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 74/CP, November 1, 1995, on the functions, tasks, powers, and organizational structure of the Ministry of Industry; Decree No. 75/CP, November 1, 1995, on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

At the proposal of the Minister, Head of the Civil Service Committee under the Government, and the opinions of the Ministers: Planning and Investment, Industry, Agriculture and Rural Development;

DECIDES;

Article 1. - Establish and dissolve certain Departments under the People's Committees of provinces and centrally governed cities as follows:

1. Establish the Department of Agriculture and Rural Development based on the merger and reorganization of existing state management organizations related to agriculture, forestry, and water resources to assist the People's Committees of provinces and centrally governed cities in managing state affairs concerning agriculture, forestry, water resources, and rural development.

2. Establish the Department of Planning and Investment based on the merger and reorganization of the Planning Committee and the organization responsible for investment cooperation work in provinces and centrally governed cities.

3. Dissolve the Electricity Department in provinces and centrally governed cities, transferring the state management function regarding electricity to the Department of Industry, while the production and business operations of electricity belong to Vietnam Electricity Corporation.

Article 2. - Establish certain offices under the People's Committees of districts and equivalent county-level units as follows:

1. Establish the Agricultural and Rural Development Office in districts based on the merger and reorganization of existing state management organizations related to agriculture, forestry, and water resources.

2. Establish the Planning and Investment Office in districts and counties based on the merger and reorganization of existing organizations related to planning and investment.

Article 3. - The Minister, Head of the Civil Service Committee under the Government shall coordinate with the Ministers: Planning and Investment, Industry, Agriculture and Rural Development to provide specific guidance on issuing decisions to establish these organizations and define their functions, tasks, powers, organizational structures, and staffing.

Article 4. - This Decision takes effect from the date of issuance. All previous regulations, including those issued by local People's Committees, that conflict with this Decision are hereby abolished.

Article 5. - Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decision./.
