Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Considering the proposal of the Minister of Labor, Invalids and Social Affairs.
DECISION:
Article 1. Position and Functions
1. The Vocational Training General Department is an organization under the Ministry of Labor, Invalids and Social Affairs, performing the function of advising the Minister of Labor, Invalids and Social Affairs on state management of vocational training, including areas such as objectives, programs, contents, plans, quality of vocational training, occupational skills, teacher standards, vocational training management staff, examination regulations, enrollment, system of certificates and diplomas, list of occupations for training, material infrastructure and equipment for vocational training; organizing the implementation of state management tasks in the field of vocational training as prescribed by law.
2. The Vocational Training General Department has legal personality, bears the seal with the National Emblem, is a budgetary unit at level II, and has its own account at the State Treasury.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Vocational Training General Department performs specific tasks and powers as follows:
1. Submit to the Minister of Labor, Invalids and Social Affairs for submission to the Government and the Prime Minister for consideration and decision:
a) Draft laws, ordinances; draft resolutions of the National Assembly and the Standing Committee of the National Assembly; draft resolutions, decrees of the Government on vocational training;
b) Strategies, planning, long-term, five-year, annual plans on vocational training; national target programs, projects, and proposals for developing vocational training; draft decisions and directives of the Prime Minister on vocational training.
2. Submit to the Minister of Labor, Invalids and Social Affairs for approval and decision:
a) Draft decisions, directives, circulars on vocational training;
b) Regulations on standards, technical norms, economic-technical quotas; planning networks, professional procedures, and business practices within the field of vocational training.
3. Assist the Minister of Labor, Invalids and Social Affairs in directing, guiding, supervising, evaluating, and being responsible for organizing the implementation of regulatory documents, policies, strategies, planning, national target programs, and proposals and projects on vocational training after approval.
4. Issue according to its authority professional guidance documents on vocational training, individual documents, and internal regulatory documents as prescribed by law.
5. On vocational training:
a) Manage the list of training occupations;
b) Take the lead in organizing the construction and review of the framework program for higher vocational college and intermediate vocational levels for each occupation;
c) Guide and inspect vocational training institutions in the development, issuance, and implementation of training programs and textbooks; the application of foreign vocational training programs; registration of vocational training activities; implementation of vocational training enrollment, examinations, graduation certification, and issuance of vocational certificates and diplomas. Inspect Vietnamese vocational training institutions in issuing foreign vocational certificates and diplomas; joint training and linked training programs of vocational training institutions;
d) Implement registration of high college-level vocational training activities.
6. On teachers and vocational training management staff:
a) Guide and inspect the development and implementation of training and upgrading programs for teachers and vocational training management staff; the implementation of policies and systems for teachers and vocational training management staff; the implementation of professional standards for vocational teachers; standards for heads of vocational training institutions; regulations on the evaluation of vocational public servants; provisions on the content and form of recruitment of vocational public servants; teaching contests for vocational teachers at all levels;
b) Manage professional upgrading work for teachers and vocational training management staff.
c) Direct the organization of vocational public servant grade promotion exams;
d) Direct and organize the implementation of awarding honors to vocational teachers and management staff according to the law;
đ) Organize the implementation of national vocational teacher teaching contests.
7. On student and trainee affairs in vocational training:
a) Guide and inspect the implementation of student and trainee management regulations; crime prevention and social evil eradication work, and the creation of a healthy educational environment in vocational training institutions; political thought education, moral education, lifestyle education, cultural and aesthetic education for students and trainees; physical education and health care work in vocational training institutions; cultural, artistic, sports movements among students and trainees; the implementation of scholarship policies from the state budget and other policies for vocational learners;
b) Inspect the implementation of regulations on tuition fees and other charges for students and trainees.
8. On material infrastructure and equipment for vocational training:
a) Develop standards for vocational college schools, vocational secondary schools, vocational training centers, and vocational training equipment standards for each occupation.
b) Guide and inspect the implementation of standards for material infrastructure and equipment for vocational training institutions as prescribed; organize vocational training equipment competitions at various levels;
c) Guide the management and use of vocational training facilities and equipment;
d) Organize the implementation of national vocational training equipment making contests.
9. On vocational training quality assessment:
a) Manage and organize the implementation of vocational training quality assessment;
b) Guide and inspect the assurance of vocational training quality and self-assessment of vocational training quality;
c) Recognize, issue, and revoke certificates of meeting vocational training quality assessment standards;
d) Publicly announce lists of vocational training institutions and training programs that have been quality assessed;
đ) Organize training and upgrading for quality assessment staff and quality management staff of vocational training institutions; issue and revoke quality assessment staff identification cards.
10. On occupational skills:
a) Manage the system of occupational skill standards;
b) Guide and inspect the development and issuance of national occupational skill standards for each occupation; the organization and implementation of occupational skill assessments for workers; skill competitions at various levels;
c) Guide the use of national occupational skill standards and the application of regional and international occupational skill standards in Vietnam;
d) Organize training and upgrading for assessors and issue and revoke national occupational skill assessor certificates;
đ) Organize national skill competitions; participate in regional and international skill competitions.
11. Guide and inspect the establishment, merger, division, separation, and dissolution of vocational training institutions; organize the implementation of college-level vocational school establishment reviews; approve private college-level vocational school charters.
12. Assist the Minister of Labor, Invalids and Social Affairs in guiding and inspecting the activities of associations and non-governmental organizations in the vocational training sector as prescribed by law.
13. Promote, disseminate, and educate laws within the scope of state management over vocational training.
14. Organize the implementation of statistical work, information, and the establishment of databases on vocational training.
15. Direct and organize the implementation of research, dissemination, and application of science and technology in the vocational training sector.
16. Guide and inspect the organization and operation of vocational training activities of vocational training institutions with foreign investment in Vietnam; the implementation of joint ventures and cooperation between Vietnamese vocational training institutions and foreign vocational training institutions.
17. Implement international cooperation in the vocational training sector according to the provisions of law and the delegation of authority by the Minister of Labor, Invalids and Social Affairs.
18. Manage organizational structure, staffing, implement salary systems and incentive policies, appointment, dismissal, retirement, resignation, commendation, disciplinary action, professional training, and development for cadres, civil servants, and public officials under the management of the General Department of Vocational Training in accordance with the provisions of law and the delegation of management by the Minister of Labor, Invalids and Social Affairs.
19. Manage and organize the implementation of investment projects in the vocational training sector according to the delegation of authority by the Minister of Labor, Invalids and Social Affairs.
20. Fulfill the role of the main investor for affiliated units in the field of material and equipment investment for vocational training.
21. Implement administrative reform in the vocational training sector according to the administrative reform plan of the Ministry of Labor, Invalids and Social Affairs.
22. Inspect, audit, resolve complaints and grievances, and handle violations in the vocational training sector according to their authority.
23. Manage finance, assets assigned, and implement the budget allocated according to the provisions of law.
24. Perform other tasks assigned by the Minister of Labor, Invalids and Social Affairs.
Article 3. Organizational Structure
1. The Vocational Training Department.
2. The Teachers and Vocational Training Management Staff Department.
3. The Student and Trainee Affairs Department.
4. The Material and Equipment for Vocational Training Department.
5. The Vocational Training Quality Assurance Department.
6. The Vocational Skills Department;
7. The Policy and Legal Affairs Department.
8. Department of Organization and Cadre Management.
9. The Planning and Finance Department.
10. Inspectorate.
11. Office.
12. The Scientific Research Institute for Vocational Training.
The Office, the Vocational Training Quality Assurance Department, and the Skills Department shall be organized into divisions.
Organizations from Clause 1 to Clause 11 of this Article assist the Director-General in performing state management functions as stipulated in Clause 12 of this Article, which are state-owned non-business units directly under the General Department of Vocational Training.
The Director-General of the General Department of Vocational Training shall prescribe the functions, tasks, powers, and organizational structure of the organizations and units under the General Department of Vocational Training.
Article 4. Leadership of the Vocational Training Administration
1. The Vocational Training Administration has a Director and no more than three Deputy Directors.
2. The Director-General and Deputy Director-Generals are appointed, relieved of duty, transferred, or reassigned by the Minister of Labor, Invalids and Social Affairs in accordance with the provisions of law.
3. The Director-General of the General Department of Vocational Training is responsible to the Minister of Labor, Invalids and Social Affairs and to the law for all activities of the General Department of Vocational Training. Deputy Director-Generals of the General Department of Vocational Training are responsible to the Director-General of the General Department of Vocational Training and to the law for the areas of work they are assigned to manage.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect fifteen days after its publication in the Official Gazette.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and the Director-General of the General Department of Vocational Training are responsible for implementing this Decision./.
