AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 170/2021/TT-BQP DATED DECEMBER 23, 2021 ISSUED BY THE MINISTER OF NATIONAL DEFENSE ON TRAINING, TESTING, AND ISSUING MILITARY DRIVER LICENSES; PROVIDING LEGAL KNOWLEDGE ON ROAD TRAFFIC FOR OPERATORS OF SPECIALIZED MOTORCYCLES IN THE MINISTRY OF NATIONAL DEFENSE
Pursuant to the proposal of the Director of the General Department of Technology;
The Minister of National Defense issues this Circular amending and supplementing certain articles of Circular No. 170/2021/TT-BQP dated December 23, 2021 issued by the Minister of National Defense on training, testing, and issuing military driver licenses; providing legal knowledge on road traffic for operators of specialized motorcycles in the Ministry of National Defense.
Article 1. Amending and supplementing certain articles of Circular No. 170/2021/TT-BQP dated December 23, 2021 issued by the Minister of National Defense on training, testing, and issuing military driver licenses; providing legal knowledge on road traffic for operators of specialized motorcycles in the Ministry of National Defense
1. Amending and supplementing Clause 5 of Article 44 as follows:
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to the Law on Vocational Education dated November 27, 2014;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;
"5. The application for exchanging a military driver license for a civilian driver license shall be carried out in accordance with the regulations of the Ministry of Transport."
2. Amending and supplementing Article 46 as follows:
"Article 46. Revocation of Military Driver License
1. The vehicle unit under the Ministry of National Defense has the authority to propose the revocation of a military driver license when discovering fraudulent acts or false documents to obtain, exchange, or reissue a military driver license.
2. The vehicle unit under the Ministry of National Defense sends a letter along with the military driver license proposing its revocation to the Vehicle Bureau/General Department of Technology.
3. Within seven working days from the date of receipt of the revocation request letter, the Vehicle Bureau/General Department of Technology examines and decides to revoke the military driver license according to the regulations."
3. Amending and supplementing Article 53 as follows:
Article 53. Revocation of Certificate
1. The vehicle unit under the Ministry of National Defense has the authority to propose the revocation of the certificate for providing legal knowledge on road traffic for operators of specialized motorcycles in the Ministry of National Defense when discovering fraudulent acts or false documents to obtain, exchange, or reissue the certificate.
2. The vehicle unit under the Ministry of National Defense sends a letter along with the certificate for providing legal knowledge on road traffic for operators of specialized motorcycles in the Ministry of National Defense proposing its revocation to the Vehicle Bureau/General Department of Technology.
3. Within seven working days from the date of receipt of the revocation request letter, the Vehicle Bureau/General Department of Technology examines and decides to revoke the certificate for providing legal knowledge on road traffic for operators of specialized motorcycles in the Ministry of National Defense according to the regulations."
"4. Amending and supplementing Clause 1 of Article 55 as follows:
"1. Annually, coordinate with the General Staff Department to compile the demand and propose the allocation of training quotas for military drivers. Based on the unit's proposal, consider sending additional training beyond the allocated quota to promptly meet the requirements of the mission."
2. The vehicle-motor unit under the Ministry of National Defense, which serves as the main unit, shall send a letter along with the Certificate of Traffic Law Knowledge for Military Special-Purpose Motor Vehicle Drivers to the Motor Vehicle Department/General Technical Department requesting the recovery of such certificates.
3. Within seven working days from the date of receipt of the request letter, the Motor Vehicle Department/General Technical Department shall examine and decide on the recovery of the Certificate of Traffic Law Knowledge for Military Special-Purpose Motor Vehicle Drivers according to regulations.
4. Amend Clause 1 of Article 55 as follows:
"1. Annually, coordinate with the General Staff Department's Personnel Directorate to compile the training driver requirements and propose the allocation of training quotas. Based on the unit's proposal, consider sending additional training outside the allocated quota to promptly meet the mission requirements."
Article 2. Supplementing, replacing, and abolishing certain provisions of Circular No. 170/2021/TT-BQP dated December 23, 2021, issued by the Minister of National Defense, regarding military driving license training, examination, issuance; and traffic law knowledge training for personnel operating specialized motorcycles within the Ministry of National Defense.
1. Replace the phrase "revoking the right to use" with the word "recovery" before the phrase "military driving license" in Article 1, Clause 1 of Article 2, the name of Chapter III, and the name of Section II of Chapter III.
2. Replace the phrase "training vehicle" with the word "training" in the title, Clause 1, Point b of Clause 1, and Point b of Clause 2 of Article 15.
3. Replace the phrase "Place of registration of permanent residence" with the phrase "Place of habitual residence" in Forms No. 01, 02, 03, 04, 07, 08, 10, 11, and 12 of the Appendix.
4. Abolish Article 4.
5. Abolish Point d of Clause 2 of Article 9.
Article 3. Implementation Provisions
1. This Circular takes effect from January 4, 2024.
2. The Chief of General Staff, Director of the General Department of Technical Services, Director of the Motor Transport Bureau, Heads of relevant agencies, units, organizations, and individuals shall be responsible for implementing this Circular./.
