Circular No. 86/2025/TT-BCA on measures to implement health insurance for police workers, employees, students, and dependents of officers, soldiers, and police workers serving and working in the People's Public Security Force

CIRCULAR

Regulations on implementing health insurance for police workers,

employees, students,trainees,officers,

workers currently working or studying in the People's Public Security Force

On the basis of Law Bhealth insurance Law No. 25/2008/QH12 amended and supplemented by Law No. 46/2014/QH13 and Law No. 51/2024/QH15 (hereinafter referred to as the Health Insurance Law);

Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security amended and supplemented by Decree No. 11/2025/NĐ-CP dated July 1, 2025 of the Government;

Pursuant to Decree No. 188/2025/NĐ-CP dated July 1, 2025 of the Government detailing and guiding the implementation of certain provisions of the Health Insurance Law (hereinafter referred to as Decree No. 188/2025/NĐ-CP);

At the proposal of the Director of the Cadre and Civil Servant Management Department;

The Minister of Public Security issues this Circular stipulating measures for implementing health insurance for police workers, employees, students, trainees, and relatives of officers, soldiers, and police workers currently working or studying in the People's Public Security Force,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates measures for implementing health insurance for police workers, employees, students, trainees, and relatives of officers, non-commissioned officers, soldiers, and trainees receiving living expenses who are Vietnamese citizens, and police workers currently working or studying in the People's Public Security Force, including: contribution levels, responsibility for contributions, methods of contribution to health insurance; declaration, establishment of lists for health insurance cards, and responsibilities of related organizations and individuals.

Article 2. Applicability

1. Persons participating in health insurance under this Circular include:

a) Police workers;

b) Employees working under indefinite-term labor contracts; definite-term labor contracts lasting at least one month; citizens in temporary recruitment periods before being officially recruited into the People's Public Security Force (collectively referred to as employees);

c) Relatives of officers, non-commissioned officers in business affairs and technical non-commissioned officers currently working in the People's Public Security Force; relatives of non-commissioned officers and conscript soldiers serving with fixed terms in the People's Public Security Force; relatives of trainees receiving living expenses who are Vietnamese citizens studying at schools within and outside the People's Public Security Force (collectively referred to as relatives of officers and soldiers) and relatives of police workers specified in point a of this Clause but not falling under the categories of persons participating in health insurance stipulated in points a, b, c, d, đ, e, g, and h of Clause 1, Clause 2, and Clause 3 of Article 12 of the Health Insurance Law, including: father, mother of the individual; father, mother of spouse; foster parent of the individual or spouse recognized by law; spouse; children aged over six but under eighteen years old; children aged eighteen or older still continuing general education; children of spouse aged over six but under eighteen years old or over eighteen years old still continuing general education and living together with officers and soldiers;

d) Students studying at the Cultural School of the People's Public Security Force (including foreign students);

đ) Civilian students and trainees studying at public security schools (excluding those specified in point d of this Clause).

2. Units under the Ministry of Public Security, provincial and municipal public security organs, enterprises, public institutions, and schools within the People's Public Security Force (collectively referred to as public security units and localities). Officers, non-commissioned officers in business affairs and technical non-commissioned officers currently working in the People's Public Security Force; non-commissioned officers and conscript soldiers serving with fixed terms in the People's Public Security Force; trainees receiving living expenses who are Vietnamese citizens studying at schools within and outside the People's Public Security Force (collectively referred to as officers and soldiers). Social insurance agencies; other organizations and individuals related to the implementation of health insurance for the subjects specified in Clause 1 of this Article.

Chapter II

SPECIFIC PROVISIONS

Article 3. Contribution Levels and Responsibility for Health Insurance Contributions

The monthly health insurance contribution level is determined as a percentage of the salary used as the basis for mandatory social insurance contributions under the Social Insurance Law (hereinafter referred to as monthly salary) or the reference level prescribed by the Health Insurance Law, specifically:

1. For the subjects specified in points a and b, Clause 1, Article 2 of this Circular shall be implemented as follows:

a) At 4.5% of the monthly salary, where the local police unit contributes 3%, and the employee contributes 1.5%.

In the case of employees receiving state budget salaries, the health insurance contribution amount that falls under the responsibility of the local police unit (the employer) shall be guaranteed by the state budget.

In the case of employees not receiving state budget salaries, the health insurance contribution amount that falls under the responsibility of the local police unit shall be recorded as part of the business expenses of enterprises and public service units according to the provisions of the law.

b) If an employee has one or more indefinite-term labor contracts or labor contracts with a term of at least one month, the monthly salary for health insurance contributions shall be based on the labor contract used as the basis for participating in mandatory social insurance.

c) During the period when the subjects specified in points a and b, Clause 1, Article 2 of this Circular are on leave due to illness caused by diseases requiring long-term treatment or are on sick leave for at least 14 working days in a month, or are on maternity leave for at least 14 working days in a month according to the laws on social insurance, the monthly health insurance contribution rate is 4.5% of the reference level. The local police unit is responsible for compiling a list of individuals participating in health insurance as stipulated herein and sending it to the health insurance agency issuing the health insurance card for registration and settlement with the Vietnam Social Security.

d) During the period of temporary detention, arrest, suspension from work, or suspension from office without disciplinary action, health insurance contributions shall be made according to the provisions of point g, Clause 1, Article 6 of Decree No. 188/2025/NĐ-CP.

2. The monthly health insurance contribution level for the subjects specified in point c, Clause 1, Article 2 of this Circular is 4.5% of the reference level. The state budget guarantees health insurance contributions for the dependents of officers and soldiers and the dependents of police workers receiving state budget salaries; the funding for health insurance contributions for the dependents of police workers not receiving state budget salaries is covered by the local police unit and recorded as part of the business expenses of enterprises and public service units according to the provisions of the law.

3. The monthly health insurance contribution level for the subjects specified in point d, Clause 1, Article 2 of this Circular is 4.5% of the reference level, which is covered by the local police unit from the following sources:

a) For students with Laotian or Cambodian citizenship, using training funds as prescribed in Article 4 of Circular No. 75/2023/TT-BTC dated December 28, 2023, issued by the Minister of Finance, guiding the management of training funds for Laotian and Cambodian students (under agreements) studying in Vietnam using Vietnam Government aid funds.

b) For Vietnamese students, the state budget shall guarantee the funding.

4. The monthly health insurance contribution level for the subjects specified in point đ, Clause 1, Article 2 of this Circular is 4.5% of the reference level, where the state budget supports at least 50% of the health insurance contribution, and the remaining portion is self-funded by the individual. When the state adjusts the health insurance contribution level or the reference level, the health insurance participant and the state budget will not have to make additional payments or be refunded the difference due to adjustments in the health insurance contribution level or the reference level for the remaining time during which the participant has already paid health insurance contributions.

Article 4. Methods of Paying Health Insurance Contributions

1. Monthly, at the same time as salary payments, the Public Security unit or locality shall deduct and pay health insurance contributions for the subjects specified in points a, b, and the relatives of police workers specified in point c, Clause 1, Article 2 of this Circular to the social insurance agency issuing the health insurance card, with the latest payment date being the last day of the month for that month's contribution.

2. Within the first 15 days of each quarter, the Public Security unit or locality shall transfer the health insurance contribution funds for the subjects specified in points c and d, Clause 1, Article 2 of this Circular (excluding the relatives of police workers) to the social insurance agency issuing the health insurance card. By December 31 at the latest, the transfer of the year's health insurance contribution funds must be completed.

3. Annually, semi-annually, or quarterly, the Public Security unit or locality shall collect the health insurance contributions due from the subjects specified in point đ, Clause 1, Article 2 of this Circular and submit them to the social insurance agency issuing the health insurance card.

4. Specific Cases

a) When officers, soldiers, and police workers are transferred to work in another region, attend centralized training at People's Public Security Schools, graduate and return to their original units, or withdraw from school and return to their previous units, the transferring unit is responsible for paying health insurance contributions for the officers', soldiers', and police workers' relatives until the end of the month they are transferred, while simultaneously notifying the receiving unit to prepare a list requesting issuance of health insurance cards for the relatives starting from the following month.

b) When officers, soldiers, and police workers cease service in the Public Security Forces or pass away, the Public Security unit or locality shall continue to pay health insurance contributions for the officers', soldiers', and police workers' relatives until the end of the month they cease service or pass away; simultaneously, a list will be prepared and sent to the social insurance agency issuing the health insurance card to reduce the health insurance card from the following month of cessation of service or passing away.

c) For students in grade 1 and grade 12 who are relatives of officers, soldiers, and police workers; civilian system students in their first and final years of study, health insurance contributions shall be made according to the provisions of Clause 7 and Clause 8, Article 13 of Decree No. 188/2025/NĐ-CP.

Article 5. Health Insurance Cards

1. The health insurance cards for the subjects specified in Clause 1, Article 2 of this Circular shall be issued electronically by the social insurance agency where the Public Security unit or locality is stationed. If the insured person requests, the social insurance agency may issue a paper health insurance card.

2. Information on the health insurance card and the validity period of the health insurance card shall be implemented according to the provisions of Article 16 of the Health Insurance Law, Article 10, and Clause 9, Article 13 of Decree No. 118/2025/NĐ-CP.

Article 6. Declaration and Preparation of Lists for Requesting Health Insurance Cards

1. Principles for Determining Insured Subjects

Each individual can only participate in health insurance under one subject category at the same time. In cases where an individual belongs to multiple different categories of insured subjects, the participation in health insurance shall be determined according to the provisions of Clause 5, Article 13 of the Health Insurance Law.

2. Determination of the Person Declaring Health Insurance Cards for Relatives of Officers, Soldiers, and Police Workers

a) In cases where an individual is simultaneously a relative of an officer or soldier of the Public Security Forces and a relative of a military personnel, a civil servant, a police worker, a worker, or a defense employee, they can only declare under one subject category in the following order: relative of an officer or soldier of the Public Security Forces or a military personnel or a civil servant; relative of a police worker or a worker or a defense employee, prioritizing declaration under the state budget category before employer contributions.

b) In cases where multiple officers, soldiers, military personnel, civil servants, police workers, workers, or defense employees have common relatives participating in health insurance, only one person can declare for the relatives in the following order: officer or soldier of the Public Security Forces or military personnel or civil servant; police worker or worker or defense employee, prioritizing declaration under the state budget category before employer contributions.

3. Within thirty days from the date of occurrence of the insured subject, the Public Security unit or locality must complete the guidance on declaration and preparation of lists for submission to the social insurance agency to issue health insurance cards according to the procedures stipulated in Clause 2, Article 11 of Decree No. 188/2025/NĐ-CP, specifically as follows:

a) The application form for joining and adjusting health insurance information shall be filled out according to Model Number 02 promulgated together with Decree No. 188/2025/NĐ-CP.

Subjects specified in points a, b, đ, Clause 1, Article 2 of this Circular shall fill out the information on the application form and submit it to the direct management unit; subjects specified in point c, Clause 1, Article 2 of this Circular shall have officers, soldiers, or police workers as representatives filling out the information on the application form and submitting it to the direct management unit; subjects specified in point d, Clause 1, Article 2 of this Circular shall have the direct management unit fill out the information. In cases where there is a basis for changing benefit information, the declarant must provide copies of relevant documents to accompany the application form.

b) The direct management unit is responsible for verifying the accuracy and legality of the information on the application form for joining and adjusting health insurance information and sending it to the organizational cadre agency of the Public Security unit or locality.

c) After receiving the application form for joining and adjusting health insurance information transferred by the direct management unit, the organizational cadre agency of the Public Security unit or locality is responsible for preparing the List of Insured Subjects (Model Number 03 promulgated together with Decree No. 188/2025/NĐ-CP), which will be signed by the head of the Public Security unit or locality and submitted to the social insurance agency where the unit is stationed to issue health insurance cards according to regulations.

4. When the health insurance card expires, individuals or their representatives do not need to resubmit the Health Insurance Enrollment Form except in cases where there is a request to change information on the health insurance card; the directly managing agency is responsible for reviewing and compiling a list to send to the personnel organization agency of the local police unit for submission to the head of the local police unit to sign and forward to the social insurance agency where the unit is stationed to extend the health insurance card according to regulations.

Article 7. Reissuing paper health insurance cards and adjusting health insurance card information

When it is necessary to reissue a paper health insurance card or adjust health insurance card information, the subjects specified in Clause 1 of Article 2 of this Circular may choose one of the following two forms:

1. Directly requesting the social insurance agency that issued the health insurance card:

Individuals or their representatives fill out the required contents on the Health Insurance Enrollment and Information Adjustment Form attached with the paper health insurance card (in case of a request to reissue the health insurance card), copies of documents serving as the basis for adjustment (in case of a request to adjust health insurance card information) and submit them directly at the one-stop service counter of the social insurance agency assigned to receive such applications, or through the National Public Service Portal, or via the application of the social insurance agency, or send them through public postal services to the social insurance agency assigned to receive such applications.

2. Through the local police unit:

Individuals or police officers, soldiers, or workers representing family members fill out the required contents on the Health Insurance Enrollment and Information Adjustment Form attached with the paper health insurance card (in case of a request to reissue the health insurance card), copies of documents serving as the basis for adjustment (in case of a request to adjust health insurance card information) and submit them to the directly managing unit for forwarding to the personnel organization agency of the local police unit.

The personnel organization agency of the local police unit compiles a list to request reissuance or adjustment of health insurance card information, which is then submitted to the head of the local police unit for approval and signature before sending it to the social insurance agency that issued the card to implement the reissuance or adjustment according to regulations.

Chapter III

IMPLEMENTATION

Article 8. Responsibilities for Implementation

1. Responsibilities of the Personnel Department

a) To take the lead and coordinate with relevant agencies to study, advise, guide the organization and implementation of health insurance, and promptly address any issues arising during the implementation of health insurance for the subjects specified in Clause 1 of Article 2 of this Circular;

b) To coordinate with the Planning and Finance Department to check and guide the budgeting and settlement of funds provided by the state budget for health insurance for the subjects specified in Clause 1 of Article 2 of this Circular, ensuring timely and full funding; to direct financial agencies of local police units to prepare budgets, collect, pay, and settle financial accounts for health insurance in accordance with regulations; and to inspect compliance with financial regulations related to health insurance within the People's Public Security Forces.

2. Responsibilities of the Planning and Finance Department

a) To prepare budgets and ensure timely and full funding from the state budget for health insurance for the subjects specified in Clause 1 of Article 2 of this Circular; to direct financial agencies of local police units to prepare budgets, collect, pay, and settle financial accounts for health insurance in accordance with regulations; and to inspect compliance with financial regulations related to health insurance within the People's Public Security Forces;

b) To settle the budget for health insurance contributions for the portion funded by the state budget for the subjects specified in Clause 1 of Article 2 of this Circular with the Ministry of Finance in accordance with the State Budget Law, the Health Insurance Law, and other guiding documents.

3. Responsibilities of Local Police Units

a) By December each year, to settle the budget for health insurance contributions for the subjects specified in Clause 1 of Article 2 of this Circular for the year; and simultaneously report the results of implementing health insurance to the Personnel Department and the Planning and Finance Department;

b) By June each year, to prepare the budget for the state budget contribution for health insurance for the next year for the subjects specified in Clause 1 of Article 2 of this Circular (along with the budget for social insurance and health insurance income and expenditure) for the following year, and report to the Planning and Finance Department and the Personnel Department;

c) To compile a list and notify the social insurance agency issuing the health insurance card to reduce the budget for health insurance contributions when the subject no longer participates in health insurance under the category specified in Clause 1 of Article 2 of this Circular or takes leave with benefits as stipulated in Point c, Clause 1 of Article 3 of this Circular;

d) Based on actual circumstances, local police units may delegate subordinate units to compile lists to request the social insurance agency to issue, extend, replace, or reissue health insurance cards for the subjects specified in Clause 1 of Article 2 of this Circular.

4. Responsibilities of health insurance participants specified in Clause 1 of Article 2 of this Circular and police officers, soldiers, and police workers:

a) To fully comply with regulations on applying for, reissuing, and replacing health insurance cards and be responsible for the contents declared;

b) To use and guide family members to use the health insurance card in accordance with the law;

c) To install the national identity application to receive electronic health insurance cards and use them for medical examination and treatment under health insurance using the citizen identification card or electronic identity account.

Article 9. Effectiveness and Application Provisions

1. This Circular shall take effect from October 13, 2025, and replace Circular No. 57/2019/TT-BCA dated November 11, 2019, issued by the Minister of Public Security guiding the implementation of health insurance for workers, students, and cadres, soldiers, and public security workers' dependents serving in the People's Public Security Force.

2. When the referenced documents in this Circular are replaced or amended, the content shall be implemented according to the new document.

3. The measures for organizing the implementation of health insurance for dependents of cadres and soldiers performing special tasks shall be decided by the Minister of Public Security based on the proposal of the Director of the Cadre Organization Department.

Article 10. Responsibility for Implementation

1. Heads of units under the Ministry, Directors of Provincial and Municipal Public Security Departments, heads of enterprises, public service organizations, and schools within the People's Public Security Force shall be responsible for disseminating, implementing, and organizing the execution of this Circular.

2. The Director of the Cadre Organization Department shall be responsible for guiding and inspecting the implementation of this Circular.

During the implementation of this Circular, if difficulties or obstacles arise, local public security units shall report to the Ministry of Public Security (through the Cadre Organization Department) for timely guidance./.
