DECISION
Regarding the regulation on the level of collection and management, use of fees for the use of
Bai Long Vỹ Port and Anchorage Area, Haiphong City
THE MINISTER OF FINANCE
In order to create a favorable environment for the issuance and trading of securities, ensuring that the securities market operates in an organized, safe, and effective manner, the Ministry of Finance guides the amendment and supplementation of Circular No. 110/2002/TT-BTC dated December 12, 2002 guiding the collection, payment, management, and use of fees and charges in the banking, securities, and insurance sectors (hereinafter referred to as Circular No. 110/2002/TT-BTC) as follows:
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to the proposal of the People's Committee of Haiphong City (in Circular No. 3897/CV-UB dated August 21, 2002 and Circular No. 2888/CV-UB dated June 28, 2004) and the proposal of the Director of the Tax Policy Department,
DECISION:
Article 1. This Decision promulgates the schedule of fees for the use of Bai Long Vỹ Port and Anchorage Area, Haiphong City.
The subjects subject to the fee levels prescribed in this Decision are fishing vessels and seafood purchasing vessels, transportation means for seafood products, goods derived from seafood, and goods serving the catching, purchasing, and preservation of seafood through Bai Long Vỹ Port and Anchorage Area.
Article 2. The Bai Long Vỹ Port and Anchorage Area Management Board, authorized by competent state agencies to organize the management of activities at Bai Long Vỹ Port and Anchorage Area, shall be responsible for collecting fees for the use of Bai Long Vỹ Port and Anchorage Area (hereinafter referred to as the fee collection unit) according to the fee levels stipulated in this Decision.
For cargo and passenger transport vessels docking at the port, the Bai Long Vỹ Port and Anchorage Area Management Board may collect fees for the use of bridges, wharfs, and mooring buoys within the port area, with the collection level following current laws and regulations regarding maritime fees and charges.
Article 3. The revenue from the fees for the use of Bai Long Vỹ Port and Anchorage Area stipulated in this Decision is a government budget revenue item, to be managed and utilized as follows:
1. The fee collection unit for Bai Long Vỹ Port and Anchorage Area may retain 90% of the collected fees to cover expenses related to the collection process as specified in point 4-b, section C, part III of Circular No. 63/2002/TT-BTC dated July 24, 2002 issued by the Ministry of Finance guiding the implementation of laws and regulations on fees and charges.
2. The fee collection unit for Bai Long Vỹ Port and Anchorage Area is responsible for declaring, paying, and settling 10% of the collected fees into the government budget according to the current government budget classification and the provisions of Circular No. 63/2002/TT-BTC dated July 24, 2002 issued by the Ministry of Finance.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Other issues related to the collection, payment, management, and utilization of fees not covered in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 issued by the Ministry of Finance guiding the implementation of laws and regulations on fees and charges.
Article 5. Organizations and individuals subject to the obligation to pay fees, units assigned the task of organizing the collection of fees for the use of Bai Long Vỹ Port and Anchorage Area, and relevant agencies are responsible for implementing this Decision.
