Pursuant to Decision No. 77/2003/QĐ-CP dated July 1, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Considering the proposal of the Director of the Price Management Department and the Head of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1.
The accompanying regulations on training and professional development in the specialized field of appraisal are hereby adopted.
Article 2.
This Decision shall take effect fifteen days from the date of publication in the Official Gazette, replacing Decision No. 2722/2004/QĐ-BTC dated August 24, 2004 of the Minister of Finance regarding the approval of the program and content for professional development in the specialized field of appraisal.
Article 3.
The Director of the Price Management Department, the Head of the Cadre and Civil Servant Affairs Department, the Director of the Ministry of Finance’s Office, the Heads of relevant units, and the Heads of units permitted to organize training and professional development in the specialized field of appraisal are responsible for implementing this Decision./.

TRAINING AND PROFESSIONAL DEVELOPMENT IN THE SPECIALIZED FIELD OF APPRAISAL

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These regulations stipulate the content and curriculum of training and professional development; management and organization of training and professional development; examination and issuance of certificates for training and professional development; instructors and trainees participating in training and professional development in the specialized field of appraisal.
Article 2. Applicability
This Regulation applies to:
1. Units authorized to organize training and professional development courses in the specialized field of appraisal.
2. Organizations and individuals requiring training and professional development in the specialized field of appraisal.
Article 3. Purpose of Training and Professional Development
1. Updating and systematizing basic and advanced knowledge on price management, appraisal, valuation, and related laws to enhance the appraisal capabilities of price appraisers working in enterprises; at the same time, increasing the understanding of appraisal knowledge for those with such needs.
2. Standardizing professional and vocational qualifications for those engaged in appraisal work.
Article 4. Principles of Training and Professional Development
1. Adhering strictly to the curriculum, content, and duration of training and professional development in the specialized field of appraisal as prescribed in these regulations.
2. The curriculum, content, and duration of training and professional development in the specialized field of appraisal must be appropriate for the participants according to the provisions of these regulations.
3. The quality of training and professional development in the specialized field of appraisal must continuously improve to meet the requirements of the participants and the appraisal activities of appraisal enterprises.
Chapter II
CONTENT AND CURRICULUM FOR TRAINING AND PROFESSIONAL DEVELOPMENT
Article 5. Content and Curriculum for Training and Professional Development
1. The content and curriculum for training and professional development include specialized subjects:
1.1 Laws applicable to valuation and appraisal activities;
1.2 Principles of market price formation;
1.3 Fundamental principles of appraisal;
1.4 Real estate appraisal;
1.5 Machinery and equipment appraisal;
1.6 Enterprise value appraisal;
1.7 Application of information technology in appraisal activities.
2. The Ministry of Finance (Price Management Department) shall manage the content, curriculum, and teaching materials for training and professional development in the specialized field of appraisal throughout the country.
3. The specific content and duration of each subject are detailed in Appendix No. 01 attached to these regulations.
Chapter III
MANAGEMENT AND ORGANIZATION OF TRAINING AND PROFESSIONAL DEVELOPMENT
Article 6. Form, time of organizing training courses and professional development
The organization of training courses and professional development in specialized appraisal business can be conducted in a continuous period or divided into multiple periods for one training course or professional development session, but the maximum duration of a training course or professional development session shall not exceed three months and must ensure sufficient teaching and learning time and content according to the program as prescribed by this Regulation.
Article 7. Units permitted to organize training courses and professional development
1. The following units are permitted to organize training and professional development in specialized appraisal business:
1.1. Academies, Universities, Colleges, Economic Institutes with specialized training programs in appraisal business that have been authorized by competent authorities in accordance with the law; the Financial Cadre Training School under the Ministry of Finance;
1.2. Vietnam Appraisal Association;
2. Ministries, agencies at the level of ministries, government agencies, Provincial Departments of Finance, centrally governed cities, appraisal enterprises, and other enterprises may cooperate with the units specified in Clause 1 of this Article to organize specialized appraisal business training and professional development courses for cadres and staff within their respective ministries, sectors, localities, and units, with the units specified in Clause 1 of this Article taking the lead in organizing such courses.
3. Rights and responsibilities of units permitted to organize training courses and professional development in specialized appraisal business:
3.1. Rights:
a) Admit students in accordance with the target groups stipulated in Article 14 of this Regulation.
b) Issue and grant the Appraisal Business Specialized Training and Professional Development Certificate in the format prescribed in Appendix No. 05 attached to this Regulation.
c) Be permitted to collect tuition fees from participants in training and professional development courses. The level of tuition fee collection is decided by the head of the unit organizing the training and professional development course based on ensuring reasonable compensation for the costs of the training and professional development course and compliance with the State's regulations on education tuition fees. The collection, management, and utilization of revenue from tuition fees must comply strictly with current laws.
3.2. Responsibilities:
a) Register with the Ministry of Finance (Price Management Department) regarding the training and professional development in specialized appraisal business (Registration documents include: Photocopy of the Training Permit issued by the competent authority in accordance with the law; Application for registration of specialized appraisal business training and professional development).
b) Report to the Ministry of Finance (Price Management Department) on the content of the training and professional development program; lecturers participating in the specialized appraisal business training and professional development course.
c) Ensure appropriate facilities and lecturers commensurate with the scale of the specialized appraisal business training and professional development course.
d) Strictly implement the provisions of this Regulation.
đ) Submit reports on the results of organizing specialized appraisal business training and professional development courses to the Ministry of Finance (Price Management Department) and retain all relevant files and documents related to the organization of training and professional development courses at the unit for a minimum of five years.
e) Shall not issue specialized appraisal business training and professional development certificates to individuals who are not listed in the attendance roster, or those who participated in the training but did not meet the criteria stipulated in Article 9 of this Regulation.
g) Organizations and individuals engaging in fraudulent activities or violations of the training and professional development regulations set forth in this Regulation will be subject to disciplinary actions ranging from warnings to removal from the list of permitted training and professional development institutions, and may also face legal proceedings in accordance with current laws on education and training or criminal liability as prescribed by law, depending on the nature and severity of the violation.
Article 8. Procedures for organizing training and enhancement courses
Units permitted to organize training and enhancement courses in specialized appraisal valuation business as stipulated in Clause 1 of Article 7 of this Regulation shall be responsible for submitting to the Ministry of Finance (Price Management Department) relevant files and documents related to the organization of such training and enhancement courses for monitoring and management before opening the courses.
The files and documents include:
- Decision to open the training and enhancement course;
- List of the Steering Committee for the training and enhancement course;
- List of trainees participating in the training and enhancement course (Annex No. 02);
- List of lecturers (Annex No. 3);
- Content, program, and schedule of the training and enhancement course.
Notably, the list of trainees participating in the training and enhancement course may be submitted later, with the latest submission deadline being the end of the first week of the course.
Chapter IV
EXAMINATION AND ISSUANCE OF TRAINING AND ENHANCEMENT CERTIFICATES
Article 9. Examination and Assessment of Training Results
1. At the end of each subject in the training and enhancement course program, the unit organizing the course must conduct an examination. The examination will be conducted in a written form with a minimum duration of 120 minutes per subject (For the Applied Information Technology topic in appraisal activities, the minimum duration is 60 minutes). Examination scores are graded on a scale of 10 points. A passing score for the examination is a minimum of 5 points. for use in the appraisal valuation review activitiesThe examination test score is graded on a scale of ten points. To pass the examination test, a minimum score of five points is required.
2. Trainees participating in the training and enhancement course must ensure attendance of at least 90% of the class time for each subject to be eligible to take the examination for that subject.
Trainees meeting the eligibility criteria for the examination must participate in the examination according to the regulations of the training and enhancement course. If, due to special reasons, they cannot participate in the examination for a subject in the course they attend, they must submit a request letter to the unit organizing the course accompanied by confirmation from the head of the agency or unit sending them to study and take the examination together with the subsequent course examination period.
3. Upon completion of the training and enhancement course, the unit organizing the course bases its assessment of the trainees' learning outcomes on three categories:
- Average: The average score of all examination papers is from 5 to less than 7 points (No examination paper score is below 5 points);
- Good: The average score of all examination papers is from 7 to less than 8 points (No examination paper score is below 7 points);
- Excellent: All examination paper scores are 8 points or higher (No examination paper score is below 8 points).
4. Upon completion of the training and enhancement course, the unit organizing the course issues a Decision recognizing the learning outcomes of the trainees who participated in the course, simultaneously sending the Decision along with the list of qualified trainees according to the model specified in Annex No. 04 attached to this Regulation to the Ministry of Finance (Price Management Department).
Article 10. Training and Enhancement Certificate in Specialized Appraisal Valuation Business
1. The head of the unit specified in Clause 1 of Article 7 of this Regulation issues a "Training and Enhancement Certificate in Specialized Appraisal Valuation Business" to trainees achieving satisfactory results classified as Average, Good, or Excellent based on the criteria set out in Clause 3 of Article 9 of this Regulation.
Such certificates are recognized for trainees who have completed the specialized appraisal valuation business training and enhancement course.ứissued to trainees who have completed the specialized vocational training course in appraisal valuation.
2. The Training and Enhancement Certificate in Specialized Appraisal Valuation Business can be used to register for the examination to obtain an appraisal valuation license. Eligibility criteria for the examination to obtain an appraisal valuation license are separately defined.
Chapter V
LECTURERS AND STUDENTS
Article 11. Instructor Standards
Instructors participating in teaching must meet the following conditions and standards:
1. Hold a bachelor's degree or higher.
2. Possess pedagogical qualifications, high professional expertise, and extensive experience in teaching.
3. Have worked for at least five years in research or teaching in the field of valuation, pricing, finance, accounting, economic law at academies, universities, colleges, institutes, or in practical state management work related to appropriate specialized subjects as stipulated in this Regulation.
Article 12. Duties of Instructors
1. Fulfill teaching tasks according to the prescribed training and vocational upgrading program for valuation specialization as set forth in this Regulation and agreed upon with the training institution.
2. Adhere fully to the teaching process, including preparing teaching materials, lesson plans, exercises, discussion questions, and organizing evaluations of student performance.
Article 13. Benefits of Instructors
1. Receive remuneration for teaching as agreed between the training institution and the instructor.
2. Oaccounting vouchers that have been erased, altered are invalid for payment and journal entries. When making a mistake on a pre-printed voucher, it must be invalidated right to request training and vocational upgrading institutions to provide necessary materials related to the teaching content.
Article 14. Student Standards
1. Have a clear record; no criminal record; not currently under disciplinary action or criminal investigation;
2. Hold a bachelor's degree or higher (domestic or foreign) in fields such as Pricing, Valuation, Accounting, Auditing, Finance-Banking, Economics, Economic-Engineering, Business Administration, Economic Law.
Article 15. Duties and Benefits of Students
1. Duties:
Students participating in the vocational training and upgrading program for valuation specialization have the duty to:
a) Fully comply with the internal regulations and study rules established by the training and upgrading organization.
b) Comply with the provisions of Clause 2, Article 9 of this Regulation.
c) Pay all required fees for attending the training and upgrading course as stipulated.
2. Rights:
Students participating in the vocational training and upgrading program for valuation specialization are entitled to:
a) Acquire comprehensive basic knowledge about the vocational specialization of valuation according to the training and upgrading program for valuation specialization prescribed by the Ministry of Finance.
b) Request training and upgrading institutions to provide necessary materials related to the learning content.
c) Receive a certificate of training and upgrading in the vocational specialization of valuation as provided for in Clause 1, Article 10 of this Regulation.
d) Use the certificate of training and upgrading in the vocational specialization of valuation as provided for in Clause 2, Article 10 of this Regulation.
Chapter VI
IMPLEMENTATION
Article 16. Implementation Organization
The Minister of Finance authorizes the Director of the Price Management Department:
1. Regularly inspect and supervise training and upgrading institutions authorized to organize courses on vocational specialization of valuation to ensure compliance with this Regulation.
2. Organize the receipt, processing, and management of training and upgrading program files from authorized training and upgrading institutions sent to the Ministry of Finance. Timely issue written opinions requesting these institutions to strictly adhere to this Regulation.
3. Take the lead and coordinate with the Cadre and Civil Servant Organization Department and relevant units to manage and regularly inspect the implementation of this Regulation.
