DECREE

Regulations on the welfare and policies for families and relatives of non-commissioned officers and soldiers serving on a fixed term in the People's Public Security Forces

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Public Security Law dated November 29, 2005;

Pursuant to the Education Law dated June 14, 2005;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government issues this Decree stipulating the welfare and policies for families and relatives of non-commissioned officers and soldiers serving on a fixed term in the People's Public Security Forces,

Article 1. Scope of Application

This Decree stipulates the welfare and policies for emergency hardship allowances and exemption from school fees for families and relatives of non-commissioned officers and soldiers serving on a fixed term in the People's Public Security Forces (hereinafter referred to as non-commissioned officers and soldiers).

Article 2. Applicability

1. Relatives of non-commissioned officers and soldiers include: father, mother; father-in-law, mother-in-law or father, mother of spouse; legal guardian; spouse; biological child, legally adopted child of non-commissioned officers and soldiers.

2. Family of non-commissioned officers and soldiers (is the place where non-commissioned officers and soldiers usually reside before serving with a fixed term in the People's Public Security Force).

Article 3. Welfare for families and relatives of non-commissioned officers and soldiers

1. Families and relatives of non-commissioned officers and soldiers shall be entitled to emergency hardship allowances in the following cases:

a) In case the family of non-commissioned officers and soldiers encounters accidents, fires, natural disasters leading to house collapse, house drift, house fire or relocation, they will be granted a one-time allowance of 2,000,000 VND per person.

b) Father, mother; father-in-law, mother-in-law or father, mother of spouse; legal guardian; spouse; biological child, legally adopted child of non-commissioned officers and soldiers who suffer from illness for one month or more, or hospitalization for seven days or more will be granted a one-time allowance of 500,000 VND per person.

The emergency hardship allowance provisions set forth in Points a and b of this Clause shall be implemented not more than twice a year for each individual.

c) Father, mother; father-in-law, mother-in-law or father, mother of spouse; legal guardian; spouse; biological child, legally adopted child of non-commissioned officers and soldiers who pass away or go missing will be granted a one-time allowance of 1,000,000 VND per person.

2. Biological children, legally adopted children of non-commissioned officers and soldiers shall be exempted from school fees when studying at public and private educational institutions according to current laws on fee exemptions and reductions.

Article 4. Implementation funds

The funding for implementing the welfare and policies stipulated in this Decree shall be guaranteed annually from the state budget in accordance with the State Budget Law.

Article 5. Effective Date

1. This Decree takes effect from September 14, 2013.

The Decree No. 54/2008/NĐ-CP dated April 24, 2008 of the Government stipulating the welfare and policies for relatives of non-commissioned officers and soldiers serving on a fixed term in the People's Public Security Forces is hereby repealed.

Article 6. Responsibility for Implementation

1. The Minister of Public Security shall take the lead and coordinate with the Ministry of Finance and relevant agencies to guide the implementation of this Decree; prepare budgets and implement emergency hardship allowances for families and relatives of non-commissioned officers and soldiers as stipulated in this Decree.

2. The Ministry of Finance shall be responsible for coordinating with the Ministry of Public Security in the preparation and execution of state budget estimates in accordance with the State Budget Law to ensure the implementation of the welfare and policies stipulated in this Decree.

3. The Chairperson of the People's Committee of provinces and centrally-administered cities shall be responsible for directing and organizing the implementation of the school fee exemption policy stipulated in this Decree for the children of non-commissioned officers and soldiers residing within their jurisdiction.

4. The ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial people's committees under the central government shall be responsible for implementing this Decree./.
