On the training and improvement of state officials and civil servants

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Implementing the conclusions of the Government at the session on August 27, 1996, approving the project on training and improving state officials and civil servants;

To strengthen management, improve the quality and effectiveness of the current training and improvement of state officials and civil servants;

At the proposal of the Minister, Head of the Government Organization and Cadre Department;

DECISION:

Article 1. The objectives and subjects of the training and improvement of state officials and civil servants in the current phase are:

1. Equipping basic knowledge and skills, supplementing specialized knowledge and management skills to build a cadre of state officials and civil servants who are proficient in their fields, loyal to the socialist regime, dedicated to their duties; having the necessary qualifications to manage effectively, meeting the requirements for the reform and enhancement of the efficiency of the state apparatus; implementing the program for the initial reform of the state administrative system.

2. Training and improving state officials and civil servants according to the standards of each rank of civil servant and managerial position established by the State to basically overcome existing deficiencies and shortages in performing duties, ensuring job requirements, and providing a continuous supply of human resources for state agencies, including civil service examinations, pre-service training, training and improvement before appointment, and examinations for promotion to higher ranks.

3. Annually, starting from 1997, ministries, sectors, and localities must ensure that at least 20% of state administrative civil servants and grassroots-level cadres in communes and wards receive training and improvement in administrative management and state governance knowledge relevant to their tasks and responsibilities.

4. The subjects of training and improvement are the cadre of state officials and civil servants, with priority given to key groups of state administrative civil servants and grassroots-level cadres in communes and wards.

Article 2. The main contents of the training and improvement of state officials and civil servants are:

1. Training and improvement in political theory, updating the Party's and State's policies and guidelines to continuously build a cadre of state officials and civil servants with firm political positions, correct political attitudes, and good ideological qualities.

2. Training and improvement in administrative management knowledge to build a strong cadre, enhancing the adaptability of state officials and civil servants to new task requirements.

3. Training and improvement in state management knowledge in a market economy under socialism to equip them with basic knowledge and skills about the market economy and the role of the State in the new mechanism.

4. Training and improvement in specialized knowledge and vocational skills to build a cadre of experts capable of formulating, implementing, and organizing the execution of policies and managing state programs and projects effectively, meeting development goals.

5. Training and improvement in foreign languages for state officials and civil servants to enhance their ability to conduct transactions and study foreign materials in their fields.

6. Providing basic knowledge about information technology and using IT tools to gradually modernize and enhance the capacity of the state administrative system.

7. For grassroots-level cadres in communes and wards, the main contents of training and improvement are: Training and improvement in political theory, updating the Party's and State's policies and guidelines; basic knowledge about laws and administrative tools.

Article 3. International cooperation in the training and improvement of state officials and civil servants, especially sending state officials and civil servants abroad for study, must be carried out according to the State's regulations, ensuring practical content and selecting candidates for study within the planning and training and improvement plans of ministries, sectors, and localities.

Article 4. Assign the following agencies the responsibility for managing and implementing the training and improvement of state officials and civil servants:

1. The Ho Chi Minh National Political Academy is responsible for guiding the content of the curriculum, textbooks, teaching methods, and training lecturers in political theory subjects for training and improvement institutions of ministries, sectors, and localities; directly training and improving political theory for mid-to-senior level state officials.

2. The National Administration Academy is responsible for guiding the content of the curriculum, textbooks, teaching methods, and training lecturers in administrative management subjects for training and improvement institutions of ministries, sectors, and localities; directly training and improving administrative management knowledge for civil servants at the specialist level and above.

3. The Ministry of Education and Training is responsible for guiding the content of the curriculum and teaching methods for training and improving cultural, language, and information technology knowledge for central and local training institutions; coordinating with the Ministry of Planning and Investment to guide the content of the curriculum, textbooks, and teaching methods for training and improving economic management knowledge for training and improvement institutions of ministries, sectors, and localities to train and improve state officials and civil servants in economic management and business.

4. The Ministry of Finance shall be responsible for:

Establish financial regulations, standards, and expenditure quotas for the training and improvement of state officials and civil servants.

- Take the lead and coordinate with the Ministry of Planning and Investment, based on the training and improvement tasks for state officials and civil servants and the annual budget balance, report to the Government and submit to the National Assembly the budget estimate for the training and improvement of state officials and civil servants.

- Allocate the annual budget for the training and improvement of state officials and civil servants.

5. The Government Organization and Cadre Department is the focal point for state management of the training and improvement of state officials and civil servants, responsible for:

- Compiling the planning and training and improvement plans (domestic and international) of ministries, sectors, and localities and developing the planning and training and improvement plan for state officials and civil servants to be submitted to the Government for approval.

- Allocate training and capacity building quotas for state officials annually to ministries, sectors, and localities.

- Develop policies and guidelines for organizing activities, and serve as the coordinating body for managing the training and capacity building work for ministries, sectors, localities, and the system of training and capacity building institutions for state officials.

- Together with the Ministry of Finance and the Ministry of Planning and Investment, establish standards, quotas, and annual and long-term state budget plans dedicated to the cause of training and capacity building for state officials.

- Establish a State Civil Service Training and Capacity Building Bureau under the Government Organizational and Cadre Affairs Board to implement management and oversight tasks in this field.

Article 5. Immediate measures to implement the training and capacity building work for state officials:

1. Ministries, sectors, and localities develop long-term planning and annual plans to be submitted to the Government Organizational and Cadre Affairs Board for consolidation, development of a general plan, and allocation of training and capacity building quotas closely aligned with requirements and capabilities.

2. The Government Organizational and Cadre Affairs Board, in collaboration with ministries, sectors, and localities, conduct surveys to grasp the current level and training needs of state officials as a basis for developing training and capacity building plans for state officials from now until the year 2000.

3. Ministries, sectors, and localities proactively strengthen material foundations, improve organizational structures, and enhance operations of training and capacity building institutions to meet the growing demand for training and capacity building for state officials.

a) Provincial Political Schools under the People's Committees of provinces and centrally-administered cities are public service units equivalent to departments and sectors at the provincial level, tasked with training and capacity building for state officials and grassroots-level administrative cadres in their respective regions.

b) Central-level training institutions under ministries and sectors are public service units subordinate to their respective supervising ministries and sectors, requiring reorganization in structure and position to suit specific functions and tasks. Consider establishing new schools or centers for training and capacity building for state officials for certain ministries and sectors currently lacking such institutions.

4. Strengthen and develop the National Administration Academy in terms of infrastructure, faculty size, and capability; invest in curriculum and textbook development; enhance international relations to effectively carry out training and capacity building for state officials.

5. Standardize curriculum content; complete and standardize basic textbooks; unify training procedures, regulations on class formation, and specific responsibilities among training and capacity building institutions for state officials.

6. Improve the teaching staff for training and capacity building institutions. Reassess the quantity and quality of the teaching staff, organize domestic training courses and send teachers abroad for further education to enhance their professional expertise. Develop necessary standards, policies, and benefits for teachers and part-time teachers.

7. Expand and manage international cooperation in training and capacity building for state officials.

Article 6. Ministers, heads of ministerial-level agencies, and chairpersons of provincial and centrally-administered city people's committees must directly oversee and implement the training and capacity building work for state officials, considering it a key task for their respective ministries, sectors, and localities.

Article 7. This Decision takes effect from the date of signature.

Article 8. The Minister of the Government Organizational and Cadre Affairs Board shall lead coordination with the Minister of Planning and Investment, the Minister of Education and Training, and the Minister of Finance to guide ministries, sectors, and localities in implementing this Decision.
