DECREE

REGULATING THE MANAGEMENT OF EDUCATIONAL AND TRAINING DATA

BASED ON Law on Organization of the Government No. 63/2025/QH15;

BASED ON Law on Data No. 60/2024/QH15;

BASED ON Law on Electronic Transactions No. 20/2023/QH15;

BASED ON Law on Protection of Personal Data No. 91/2025/QH15;

BASED ON Law on Education No. 43/2019/QH14, Decree Amending and Supplementing Certain Provisions of the Law on Education No. 123/2025/QH15;

In accordance with the proposal of the Minister of Education and Training;

The Government promulgates this Decree to regulate the management of educational and training data.

CHAPTER I GENERAL PROVISIONS

Article 1. Scope of Application

1. This Decree regulates the management of educational and training data, including:

a) Digital data used in the field of education and training management; National database on education and training;

b) The construction, development, processing, connection, sharing, governance, protection, exploitation, and use of educational and training data and the national database on education and training;

c) The responsibilities of relevant agencies, organizations, and individuals in managing and using educational and training data.

2. This Decree does not apply to educational and training data related to state secrets.

Article 2. Applicability

1. Vietnamese agencies, organizations, and individuals.

2. Foreign agencies, organizations, and individuals directly participating or engaged in activities related to educational and training data of Vietnam.

Article 3. Interpretation of Terms

In this Decree, the following terms are understood as follows:

1. Educational and training data refers to digital data reflecting information on the field of education and training in accordance with the provisions of the Law on Education and other relevant specialized laws.

2. National database on education and training is a national common database containing basic, core educational and training data collected, standardized, stored, and managed uniformly throughout the country.

3. Specialized database on education and training is an organized collection of data collected, standardized, stored, managed, and exploited within the scope of management in the field of education and training.

4. Lifelong learning record data refers to data recording the entire process of learning of learners in the national education system, created according to the open format standard specified by the Ministry of Education and Training, having value for use as a substitute or equivalent to paper documents issued to learners.

5. Digital educational materials are documents and means serving teaching and research created, stored, and used in digital form.

6. Open educational resources are digital materials provided free of charge and allowing users to freely access, use, modify, and share under the conditions of use published.

7. Educational and training open data refers to data used in the national education system that is publicly announced by the competent authority of the database for agencies, organizations, and individuals to freely access, use, reuse, and share under the conditions of use published.

8. Digital education platform is a technological system serving the development of national education, designed to support educational, training, and learning management activities through a digital environment, using the Internet and digital tools.

9. National digital education platform is a collection of information systems, digital education platforms implemented and operated seamlessly from central to local levels to meet the requirements of promoting digital transformation, effective education management, improving teaching and learning quality, ensuring transparency and fairness in accessing education.

Article 4. General Principles on Management and Utilization of Data

1. Educational and training data are used to serve the development of education, management of the national education system, simplification of administrative procedures, construction of a digital government, development of the digital economy, and digital society.

2. The construction, development, processing, connection, sharing, governance, protection, exploitation, and utilization of educational and training data, as well as the National Database on Education and Training, shall comply with the provisions of this Decree and laws concerning data, information technology, electronic transactions, cybersecurity, access to information, personal data protection; regulations on management, connection, and sharing of digital data by state agencies; and laws concerning the establishment, updating, maintenance, exploitation, and utilization of the national database.

3. The collection and processing of personal data related to students, teachers, and educational administrators by managing authorities and educational institutions shall be carried out within the scope of functions and duties assigned in accordance with legal provisions. Other organizations and individuals when exploiting or utilizing educational and training data must ensure the rights of the data subject as stipulated in the Personal Data Protection Law.

Chapter II EDUCATIONAL AND TRAINING DATA

Article 5. Scope of Educational and Training Data

1. Organizational data of the national education system.

2. Data on early childhood education activities.

3. Data on general education activities.

4. Data on continuing education activities.

5. Data on vocational education activities.

6. Data on higher education training activities.

7. Data on national defense and security education activities.

8. Data on specialized educational activities for ethnic minority people, persons with disabilities.

9. Data on literacy education and teaching of the language of ethnic minorities.

10. Data to ensure quality and quality assessment in education, including data on employment status of graduates after graduation.

11. Infrastructure and educational facilities data.

12. Teacher and educational administrator data.

13. Student data, including lifelong learning records within the national education system.

14. Data on development of instructional materials and educational resources.

15. Data on scientific and technological activities in education and training.

16. Data on international cooperation activities in education and training.

17. Financial data in education and training.

18. School health data in educational institutions.

19. Data on specialized inspection activities in education and training.

20. Administrative procedure data in education and training.

21. Record, document, and file data in education and training.

Article 6. Educational and Training Databases

1. National Database on Education and Training.

2. Specialized databases of the Ministry of Education and Training containing one or more groups of data specified in Article 5 of this Decree; the list of these databases is issued by the Ministry of Education and Training within its authority.

3. Specialized databases of ministries, agencies, localities, Vietnam Fatherland Front Committees, and political organizations, social organizations containing one or more groups of data specified in Article 5 of this Decree.

4. Databases serving administrative management, teaching, and learning activities within the national education system institutions.

5. Databases of educational digital platforms providing online learning services domestically or cross-border.

Article 7. National Digital Education Foundation

1. The national digital education foundation includes:

a) Information system for managing the national database of education and training;

b) Information system for managing specialized databases of the Ministry of Education and Training;

c) Information system for processing administrative procedures in fields under the scope of state management by the Ministry of Education and Training;

d) Information system for managing the digital ecosystem of educational resources, open educational resources that are exploited, used within the national education system;

d) Other information systems and digital education platforms used throughout the national education system.

2. The national digital education foundation must ensure unity, synchronization, connectivity between central and local levels; comply with the overall national digital architecture framework and cybersecurity regulations, personal data protection provisions; ensure scalability, integration of digital applications and services to serve management, teaching, and learning activities.

3. The Ministry of Education and Training is the lead agency responsible for organizing the construction, management, operation, and exploitation of the national digital education foundation; educational institutions and education management agencies are responsible for updating, exploiting, using data, information in accordance with regulations.

4. The funding for the construction, operation, maintenance of the national digital education foundation is guaranteed by the state budget and other lawful sources as prescribed by law.

Article 8. Creation, acquisition, and retention of lifelong learning record data within the national education system

1. Lifelong learning record data includes:

a) Academic records information recording the entire educational process; academic performance and training results for general education and continuing education;

b) Information on certificates, diplomas issued after the completion of studies or program, or vocational training, capacity enhancement courses;

c) Information on recognition of foreign educational qualifications for use in Vietnam as prescribed by the Ministry of Education and Training;

d) Academic performance information of learners in higher education programs, vocational education programs;

d) Information on certification of assessment results of learners through examinations or tests organized by competent authorities or accredited educational evaluation organizations;

e) Information on awards, academic achievements certificates issued by competent authorities and organizations;

g) Information confirming ongoing enrollment at an educational institution.

2. Lifelong learning record data for individuals is created by the competent authority that owns or manages the data in accordance with data protection laws; must be digitally signed as per electronic transactions law. The lifelong learning record data can take the following forms:

a) Electronic document equivalent to an original when data are directly created as a data message and meet all conditions under the electronic transactions law;

b) Digital copy issued from the database in cases where data are digitized from the original or register, ensuring accurate, complete information, digitally signed and verifiable upon request.

3. Lifelong learning record data must be collected and retained on the national education and training database to facilitate sharing, exploitation, use. The retention period for lifelong learning record data of individuals is permanent.

4. The Ministry of Education and Training shall specify points d and e in paragraph 1 of this Article; define responsibilities for creating each type of lifelong learning record data.

Article 9. Lifelong Learning File Number

1. Persons enrolled in the national education system shall be issued a unique lifelong learning file number based on their personal identification number. Before issuing the lifelong learning file number, basic information of the individual must be checked and compared with the National Population Database.

2. The lifelong learning file number of an individual is used as a key to access data in the national education and training database for the learner's lifelong learning file. Information about the lifelong learning file number and related data are managed according to personal data protection laws.

3. The Ministry of Education and Training shall detail the use of the lifelong learning file number for management and data access purposes.

Article 10. Construction and Development of Educational and Training Data

1. The Ministry of Education and Training, other ministries and agencies at the same level, government agencies, political organizations, social-political organizations, people's committees at all levels, educational institutions shall construct and develop educational and training data in accordance with Article 11 and Article 12 of the Data Law and this Decree.

2. Open educational and training data are used to provide transparent information to fulfill the autonomy rights and accountability responsibilities of educational institutions as stipulated by law; promoting scientific, technological applications, innovation and creativity in education and training.

3. The Ministry of Education and Training shall be responsible for:

a) Issuing and updating the list of data used in educational and training databases;

b) Issuing and updating the mandatory open data list to be constructed and developed within the national education system; plans for publishing open educational and training data on the National Data Portal;

c) Issuing the Data Architecture Framework; Data Governance, Management Framework of the Ministry of Education and Training; Educational Sector Data Dictionary; Data Creation Procedures; Data Cleaning Procedures.

Article 11. Processing of Educational and Training Data

1. The processing of educational and training data shall be carried out in accordance with Articles 22, 23, 24, 25, and 26 of the Data Law and this Decree.

2. Conditional access to education and training information:

a) Information related to teachers, educational administrators, learners as stipulated in Article 5 of this Decree is managed to ensure compliance with personal data protection laws;

b) Upon being provided the lifelong learning file number of a learner, educational institutions and educational management agencies may access information related to the learner's education file within the necessary scope to perform their assigned functions and duties, and must comply with personal data protection laws.

3. The data controller in an educational database containing personal information shall conduct risk assessments for core and important data processing activities as prescribed by the Data Law.

Article 12. Utilization of Educational and Training Data

1. The use of educational and training data shall be carried out in accordance with Articles 16, 17, and 21 of the Data Law and this Decree.

2. Subjects utilizing and using educational and training data:

a) Party organs, State agencies, Vietnam Fatherland Front committees, and political organizations, social-political organizations may utilize and use educational and training data in accordance with their functions and missions;

b) Educational institutions may utilize and use educational and training data containing information about learners and teachers within the scope and for the purposes of management by the unit;

c) Individuals as data subjects may utilize and use educational and training data containing personal information according to law;

d) Organizations and individuals not falling under points a, b, and c of this paragraph may utilize and use educational and training data as follows: They may access open education and training data; they may access personal data with the consent of the managing and maintaining unit and the data subject; they may access other data with the consent of the managing and maintaining unit in accordance with law.

3. Utilization of lifelong learning file data on the national identification application VNeID:

a) Authorities within the national education system, according to their authority, shall prepare or use services from service providers to create and report lifelong learning file data as prescribed by Article 8 of this Decree;

b) After receiving and lawfully storing lifelong learning file data in the National Education and Training Database, such data will be automatically shared, integrated on the national identification application VNeID;

c) Individuals have the right to access their own lifelong learning file data integrated on the national identification application for equivalent use with related paper documents.

4. The utilization of lifelong learning file data may be carried out through other applications in accordance with laws ensuring compliance with the following conditions:

a) The recipient entity capable of verifying and authenticating data according to data law;

b) Utilization must ensure that authenticated data has sufficient legal value equivalent to original data as prescribed by data and electronic transactions laws;

c) Data must be collected, provided to the data subject, and used for its intended purpose in accordance with personal data protection laws.

Article 13. Management and Protection of Educational and Training Data

1. The management and protection of educational and training data shall be carried out in accordance with the provisions of Article 15 and Article 27 of the Law on Data, and the provisions of this Decree.

2. The national database on education and training is an important information system concerning national security which is protected in accordance with the provisions of the law on cybersecurity. Prior to its operation and official use, the system must undergo a cybersecurity assessment, evaluation, and certification by the specialized cybersecurity protection force of the Ministry of Public Security.

Chapter III NATIONAL DATABASE ON EDUCATION AND TRAINING

Article 14. Principal Authority for the National Database on Education and Training

The Ministry of Education and Training is the principal authority for the national database on education and training.

Article 15. Construction, Update, Maintenance of the National Database on Education and Training

1. The Ministry of Education and Training shall organize the construction, management, and operation of the national database on education and training.

2. The national database on education and training shall be stored and operated based on the infrastructure of the national data center.

3. The updating of data into the national database on education and training shall be carried out in accordance with the principles:

a) Data is updated from ministries, sectors, localities, educational institutions, and relevant agencies or organizations according to their authority;

b) The data manager bears responsibility for the legality, accuracy, and completeness of the data before sending it for synchronization into the national database on education and training;

c) Data is updated regularly, continuously, or periodically in accordance with the provisions of the Ministry of Education and Training.

4. The Ministry of Education and Training shall issue regulations on technical procedures for connecting, synchronizing, checking, reconciling, cleaning, and standardizing data.

5. The funding for the construction, upgrading, operation, and maintenance of the national database on education and training shall be guaranteed from the state budget and other lawful sources in accordance with the provisions of the law.

Article 16. Utilization and Use of the National Database on Education and Training

1. The utilization and use of the national database on education and training shall be carried out in accordance with the provisions of Article 12 of this Decree.

2. The principal authority for the national database on education and training; agencies, organizations, and individuals utilizing or using data from this database bear the responsibility to apply technical measures to ensure the safe, effective, and proper utilization of data in accordance with the law, within their scope of authority, and within the prescribed scope of use.

3. The methods for utilizing and using the national database on education and training include:

a) Utilizing online through an authorized information system;

b) Connecting and sharing data through the National Data Sharing and Coordination Platform (NDOP) between the national database on education and training, other national databases, specialized databases, and other information systems;

c) Providing data in accordance with a request by written document or data message as prescribed by law;

d) Querying information and data through the National Data Portal, National Public Service Portal, National Digital Education Platform;

e) Utilizing personal identification application VNeID for lifelong learning records of learners;

f) Using devices, means, or software provided by the entity managing and maintaining the national database on education and training;

g) Other methods as approved by the Ministry of Education and Training.

4. The Ministry of Education and Training shall establish and issue regulations for the management, operation, utilization, and use of the national database on education and training.

Article 17. Sharing of the National Education and Training Database

1. The national education and training database shall interconnect, share, and synchronize information with the national integrated database; the national population database; the national business registration database; the national civil servant, public servant, and staff database in state agencies; the national insurance database; the national health database; and other national databases and specialized sectoral databases as provided by law.

2. The activities of interconnection and data sharing shall ensure effectiveness, security, cybersecurity, and be consistent with the functions, duties, and powers of the relevant authorities, organizations, and individuals as provided by law.

3. The interconnection and sharing of information between the national education and training database and other national databases and specialized sectoral databases shall be carried out in accordance with the provisions of Decree No. 278/2025/NĐ-CP dated October 22, 2025 by the Government on the interconnection and mandatory data sharing between political system agencies.

Chapter IV RESPONSIBILITIES OF ORGANIZATIONS, UNITS, ORGANIZATIONS, AND INDIVIDUALS

Article 18. Responsibilities of the Ministry of Education and Training

1. To perform the role of the principal authority, organize inspections to ensure compliance with legal provisions on data management in the national education system.

2. To take the lead and coordinate with competent authorities to develop a roadmap for implementing the national education and training database and the national digital education platform; to organize the development, management, governance, and maintenance of the national education and training database and the national digital education platform.

3. To develop and update the list of educational and training databases; to publicly disclose open data on education and training under its jurisdiction.

4. To develop and issue regulations and data standards for implementing lifelong learning records and establishing the national education and training database, as well as specialized sectoral databases related to education and training under its jurisdiction.

5. To take the lead in guiding relevant organizations in implementing work on building digital educational materials and open educational resources databases to support educational programs.

6. To develop and implement plans and solutions for ensuring cybersecurity and data security for the national education and training database.

7. To cooperate with the Ministry of Public Security to interconnect, share, and synchronize data from the national education and training database and specialized sectoral databases related to education and training with the national data center to support the creation and enrichment of the national integrated database.

Article 19. Responsibilities of the Ministry of Public Security

1. To cooperate with the Ministry of Education and Training in managing data in the field of education and training according to the provisions of the Data Law.

2. To ensure infrastructure, cybersecurity for the operation of the national education and training database based on the national data center infrastructure.

3. To take the lead in conducting cybersecurity assessments, evaluating, and certifying compliance with cybersecurity requirements before the national education and training database is put into operation and used according to the provisions of the Cybersecurity Law.

4. To organize implementation of operational measures to protect cybersecurity; to conduct cybersecurity monitoring, early warning; to command and coordinate response activities for addressing cybersecurity incidents related to the national education and training database.

5. To organize inspections and supervision of compliance with legal provisions on cybersecurity and protection of personal data in the field of education and training.

6. To take the lead, cooperate with relevant agencies in investigating and handling violations of laws on cybersecurity, protection of personal data, and crimes that infringe upon cybersecurity and order management related to the national education and training database.

7. To guide the Ministry of Education and Training in developing and issuing technical regulations and standards for secure interconnection in sharing educational and training data with the national population database and integrating information into the national identity application VNeID.

Article 20. Responsibilities of Ministries, Sectoral Bodies, and Government Agencies

1. The principal authorities responsible for the National Business Registration Database; the National Civil Servant, Public Servant, and Staff Database in State Organs; the National Insurance Database; the National Health Database; and databases containing financial support information for students shall be responsible for connecting, sharing, and synchronizing information with the National Education and Training Database.

2. To construct, update, connect, share, and synchronize data related to education and training from managing authorities with the National Education and Training Database, as well as specialized databases on education and training of the Ministry of Education and Training, including serving statistical data on employment status of graduates after graduation.

3. To develop an annual plan ensuring partial or full funding for activities involving the collection, updating, management, utilization, and application of educational and training data within their jurisdiction.

Article 21. Responsibilities of People's Committees of Provinces and Municipalities

1. To promulgate and update lists of data used in specialized databases on education and training, open educational data under their authority.

2. To carry out the creation and collection of educational and training data to form specialized databases on education and training for local management and utilization purposes.

3. To connect, share, and synchronize data related to education and training managed by the locality with the National Education and Training Database and specialized databases on education and training of the Ministry of Education and Training in accordance with regulations.

4. To develop an annual plan ensuring partial or full funding for activities involving the collection, updating, management, utilization, and application of educational and training data within their jurisdiction.

Article 22. Responsibilities of Educational Institutions

1. To create, collect, standardize data, and build databases serving various management, governance, teaching, and learning activities under the institution's responsibility; to ensure quality control over input data, ensuring accuracy, completeness, and timeliness.

2. To have the right to choose to use proprietary systems provided by enterprises that comply with technical standards, data format, security, and confidentiality requirements set by the Ministry of Education and Training; to utilize shared systems provided by the Ministry of Education and Training or local education management authorities for creating educational and training data.

3. To connect, share, and synchronize institution-specific data created with the National Education and Training Database, specialized databases on education and training of the Ministry of Education and Training, and local education and training databases.

4. To ensure cybersecurity for the databases and processes involved in connecting, sharing, and synchronizing data.

Chapter V CONDITIONS OF IMPLEMENTATION

Article 23. Effective Date

This Decree shall take effect from May 15, 2026.

Article 24. Transitional Provisions

1. Authorities responsible for issuing certificates and credentials are required to digitize and issue lifelong learning record data for all previously issued certificates and credentials before the effective date of this Decree.

2. The Ministry of Education and Training shall be responsible for developing a system, business guidance, procedures, and plans to serve the digitization and creation of lifelong learning record data for certificates and credentials issued from 1990 onwards.

Article 25. Implementation Responsibility

1. The Ministry of Education and Training shall bear the responsibility for guiding, inspecting, and urging the implementation of this Decree.

2. The Ministry of Education and Training shall complete the issuance of lifelong learning file codes in the National Education and Training Database for all relevant individuals within the national education system by January 1, 2027.

3. Data owners and data managers must establish lifelong learning file data for learners in accordance with the provisions of Article 8 of this Decree starting from January 1, 2027.

4. Agencies, units, organizations, and individuals shall bear the responsibility to promptly notify the competent authority of education and training when errors are found concerning their own agencies, units, organizations, or individuals.

5. Authorities, units acting within their powers may consider using appropriate funding sources of their own or propose relevant management authorities to allocate state budget funds for the digitization of academic credentials and certificates from original records.

6. The Minister, Heads of agencies at the same level as ministries, heads of agencies under the Government, Chairmen of People's Committees of provinces and cities, and related agencies, units, organizations, and individuals shall bear the responsibility for implementing this Decree.
