CIRCULAR

Regulations on health standards and health examinations for subjects under the management of the Ministry of National Defense

 

Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulates health standards and health examinations for subjects under the management of the Ministry of National Defense, to take effect from January 1, 2024; amended and supplemented by:

Circular No. 106/2025/TT-BQP dated September 30, 2025, issued by the Minister of National Defense, amending and supplementing certain provisions of Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense, to take effect from September 30, 2025.

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999; amended and supplemented in 2008 and 2014;

Pursuant to the Law on Military Service dated June 19, 2015;

Pursuant to the Law on Professional Military Personnel, Workers, and Civil Servants of National Defense dated November 26, 2015;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Logistics Department;

The Minister of National Defense issues this Circular stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense[1].

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

1. This Circular stipulates health standards and health examinations for subjects under the management of the Ministry of National Defense, including:

a) Health examination criteria and classification;

b) Military service obligation health examinations;

c) Management and inspection of reserve military personnel health;

d) Military recruitment health examinations;

đ) Recruitment health examinations for cadres; training of reserve officers called up for active duty; recruitment of professional soldiers, defense workers, and defense officials;

e) Responsibilities of agencies, organizations, and individuals in conducting health examinations for subjects under the management of the Ministry of National Defense.

2. Health examination criteria and medical assessment standards for military pilots, airborne assault forces, paratroopers, submarine sailors are not within the scope of adjustment of this Circular.

3. Health standards and periodic health examinations, mission-specific health examinations for officers, professional soldiers, non-commissioned officers, enlisted personnel on active duty; defense civil servants, defense workers, and defense officials shall be implemented according to Circular No. 37/2021/TT-BQP dated April 15, 2021, issued by the Ministry of National Defense, stipulating health classification, health examinations, and health management task levels for military personnel, defense civil servants, defense workers, and defense officials.

Article 2. Applicability

Agencies, units, organizations, and individuals related to preliminary health screening, inspection, and health examinations; re-examination and medical assessment of health for subjects under the management of the Ministry of National Defense.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Preliminary military service health screening is the implementation of initial health checks and evaluations for citizens called for military service health examinations before each recruitment and conscription period according to the laws on military service obligations.

2. Military service health examination is the implementation of health examinations, classification, and health conclusions for citizens called to perform military service obligations conducted by the Regional Health Examination Board[2] following preliminary health screening.

3.[3] The Regional Health Examination Board is a specialized board operating on a part-time basis established by the Chairman of the Provincial People's Committee (hereinafter referred to as provincial level) upon the proposal of the Department of Health. The Regional Health Examination Board organizes military service health examination teams, ensuring full membership and conducting military service health examinations in accordance with regulations at Article 8 of this Circular; where the Team Leader is the Deputy Chairman of the Regional Health Examination Board.

4. Post-recruitment military service health examination is the immediate health examination of new recruits after enlistment conducted by the Post-recruitment Health Examination Board of the receiving unit to reassess their health status according to the military service health standards.

5. The Post-recruitment Health Examination Board for Military Service is a specialized board operating on a part-time basis established by the Head of the Receiving Unit (from battalion level and above) upon the proposal of the Chief Medical Officer (in charge of medical affairs).

6. Preliminary military recruitment health examination is the implementation of health examinations and evaluation of health standards for candidates (young people outside the military or military personnel) applying for military recruitment before the exam or selection at the Military Recruitment Board at the commune level[4], battalion-level units and equivalent.

7. Military recruitment health examination is the immediate post-enrollment health check of successful candidates to ensure they meet the health standards set by law.

8. The Preliminary Military Recruitment Health Examination Board is the Regional Health Examination Board[5] or the Health Examination Board of the military hospital in the area conducting preliminary health examinations for candidates applying for military recruitment.

9. The Military Recruitment Health Examination Board is a specialized board operating on a part-time basis established by the Director of the Military Hospital upon the proposal of the Directors or Principals of the academies and schools within the military (hereinafter referred to as military schools).

10. Post-recruitment health examination is the immediate health examination of civilians recruited into the military officer cadre; training of reserve officers called up for active duty; recruitment of professional soldiers, defense workers, and defense officials conducted by the Post-recruitment Health Examination Board of the military hospital to assess their health status according to recruitment health standards.

11. The Post-recruitment Health Examination Board for Recruitment is a specialized board operating on a part-time basis established by the Director of the Military Hospital upon instructions or proposals for cooperation from the Head of the Medical Office (Chief Medical Officer) of the main unit subordinate to the Ministry of National Defense.

12. Medical Assessment is the use of equipment, techniques, and procedures to examine and conclude on the health status of citizens performing military service obligations; military recruitment; recruitment into the cadre; training of reserve officers called up for active duty; recruitment of professional soldiers, defense workers, and defense officials when there are complaints about health.

Chapter II

HEALTH STANDARDS AND CLASSIFICATION

 

Article 4. Health Standards

1. Health standards for performing military service obligations

a) General standards

Reach health categories 1, 2, or 3 as prescribed at Article 5, Article 6 of this Circular;

Citizens addicted to drugs or drug precursors as defined in Decree No. 57/2022/NĐ-CP dated August 25, 2022 of the Government shall not be called up for military service.

b) Special standards: Certain specific health standards for selecting individuals to perform military service obligations shall be prescribed by the Minister of National Defense.

2. Health standards for enrolling in military training programs leading to bachelor's, college, or vocational degree levels; enrolling in military training programs for basic military fields leading to bachelor's or college degrees

a) General standards: Reach health categories 1 or 2 as prescribed at Article 5, Article 6 of this Circular;

b) Special standards: Shall be implemented according to the regulations of the Ministry of National Defense on the admission process for schools within the Military.

3. Health standards for recruitment into the cadre corps; training reserve officers to be called upon for active duty service

a) General standards: Reach health categories 1 or 2 as prescribed at Article 5, Article 6 of this Circular;

b) Special standards: For specialized technical positions that are difficult to attract human resources for the military, as prescribed by the Minister of National Defense.

4. Health standards for recruiting professional soldiers, workers, and defense civil servants

a) General standards: Reach health categories 1, 2, or 3 as prescribed at Article 5, Article 6 of this Circular;

b) Special standards: For specialized technical positions in recruiting professional soldiers, workers, and defense civil servants that are difficult to attract human resources for the military, as prescribed by the Minister of National Defense.

Article 5. Health Classification Standards

1. Physical fitness classification standards shall be implemented according to the provisions in Section I of Appendix I attached hereto.

2. Disease and health condition classification standards shall be implemented according to the provisions in Section II of Appendix I attached hereto.

Article 6. Methods for Health Classification

1. Scoring method

Each criterion, after examination, will be given an even score from 1 to 6 in the "Score" column, specifically:

a) Score 1: Indicates very good health status;

b) Score 2: Indicates good health status;

c) Score 3: Indicates fairly good health status;

d) Score 4: Indicates average health status;

đ) Score 5: Indicates poor health status;

e) Score 6: Only very poor health condition.

2. Health classification method

Based on the scores given to each criterion during the examination, health classification will be carried out as follows:

a) Category 1: All criteria achieve a score of 1;

b) Category 2: At least one criterion receives a score of 2;

c) Category 3: At least one criterion receives a score of 3;

d) Category 4: At least one criterion receives a score of 4;

đ) Category 5: At least one criterion receives a score of 5;

e) Category 6: At least one criterion receives a score of 6.

Chapter III

HEALTH EXAMINATION AND COSTS ASSURED

 

Section 1: HEALTH EXAMINATION FOR PERFORMING MILITARY SERVICE OBLIGATIONS

Article 7. Preliminary Health Screening for Military Service Obligations

1.[6] The commune health station conducts preliminary health screening for military service obligations under the guidance and supervision of the Department of Health or hospitals/sub-health centers under the Department of Health; supervised by the Commune People's Militia Command and the Regional Defense Command.

2. Content of preliminary health screening

a) Collecting personal and family medical history;

b) Identifying cases with insufficient physical strength, deformities, and abnormalities as stipulated in Sections I and II of Appendix I attached hereto; diseases exempted from military service registration as stipulated in Section III of Appendix I attached hereto.

3. Procedure for preliminary health screening

a)[7] Based on the plan for selecting and calling up citizens for military service of the Commune Military Service Council, the Commune People's Militia Command compiles a list and advises the Chairman of the Commune People's Committee to call up citizens for preliminary health screening for military service obligations within their jurisdiction;

b) Organize preliminary health screening according to the provisions of Clause 2 of this Article;

c) Complete the health information of citizens called up for preliminary health screening for military service obligations according to Form 2 of Appendix V attached hereto;

d) Compile a list of citizens suffering from diseases listed in the exemption category for military service registration as stipulated in Section III of Appendix I attached hereto, and report to the Commune Military Service Council;

đ) Summarize, compile, and report the results of preliminary health screening according to Forms 2a and 2k of Appendix VI attached hereto.

Article 8. Military Service Physical Examination

1.[8] The military service physical examination shall be conducted by the regional health examination board established in accordance with Clause 16, Article 4 of the Law Amending and Supplementing Certain Provisions of 11 Laws on National Defense and Military Affairs in 2025, including:

a) The Chairman of the Board shall be the Director of the hospital or the Director of the medical center under the Department of Health;

b) The Vice-Chairman shall be the Deputy Director of the hospital or the Deputy Director of the medical center under the Department of Health;

c) The Standing Member and Secretary of the Board shall be staff from the hospital, medical center, or health agency under the Department of Health;

d) Members shall be staff from agencies and units including hospitals, medical centers, health agencies under the Department of Health; health stations; military medical officers of the Regional Defense Command Board and representatives of related units; when necessary, provincial-level medical staff or military medical officers from the Provincial Military Command may be reinforced at the discretion of the Chairman of the Provincial Military Service Board to determine human resources;

đ) Members of the regional health examination board must ensure full departments and specialties as stipulated in Clause 5 of this Article and must have a practice certificate or a license suitable for their duties in accordance with the laws on medical examination and treatment;

2. Duties of the Regional Health Examination Board[9]

a) Be responsible to the Provincial Military Service Board[10] for implementing physical examinations, classifying, and concluding the health status of each citizen called up for military service;

b)[11] Summarize and report the results of the military service physical examination to the Provincial Military Service Board (through the Provincial Military Command) and the Department of Health; hand over all health records to the Commune Military Service Board (through the local health agency) and notify the results of the military service physical examination to the Regional Defense Command Board;

3. Duties of members of the Regional Health Examination Board[12]

a) The Chairman of the Board is responsible to the Provincial Military Service Board[13] for concluding the health status of citizens eligible for military service; managing the activities of the Board, including: developing and disseminating the health examination plan; guiding health standards; responsibilities, tasks, working principles, and assigning tasks to each member of the Board; organizing consultations and sending citizens undergoing military service physical examinations to healthcare facilities for further testing if necessary; directly classifying health status and signing the military service health record; organizing lessons learned from military service physical examinations;

The Chairman of the Board may use the seal of his/her own agency or unit during the performance of duties;

b) The Vice-Chairman of the Board substitutes for the Chairman when absent; participates in physical examinations, consultations, and chairs meetings of the Board upon authorization;

c) The Standing Member and Secretary of the Board are responsible for preparing budgets, medicines, consumables serving the military service physical examination; coordinating with other Board members to prepare equipment, infrastructure, devices, support forces, health records, and documents for the Board's tasks; participating in physical examinations, consultations, and Board meetings; registering, statistics, and reporting according to Model 2b and Model 21 of Appendix VI issued together with this Circular;

d) Board members directly examine and are responsible for the quality of examinations and conclusions on health status according to assigned tasks; propose to the Chairman to designate additional tests based on professional requirements to accurately conclude health status; participate in consultations and Board meetings when summoned;

4. Working Principles of the Regional Health Examination Board

a) The Board operates on a collective basis, deciding issues by majority rule;

b) In cases where Board members do not agree on health classification, the Chairman records the conclusion on the health record according to the opinion of the majority. In case of a tie vote, the decision follows the side with the Chairman's vote. Dissenting opinions must be fully recorded in the minutes, signed by each Board member;

5. Content of Physical Examinations

a) Physical examination; clinical examination according to specialties: Ophthalmology, otolaryngology, dentistry, internal medicine, neurology, psychiatry, surgery, dermatology, obstetrics and gynecology (for females);

b) Ancillary clinical examination: Blood formula; blood group (ABO); liver function (AST, ALT); kidney function (Urea, Creatinine); blood sugar; hepatitis B virus (HBsAg); hepatitis C virus (Anti-HCV); HIV; complete urinalysis (10 parameters); abdominal ultrasound; electrocardiogram; chest X-ray; drug screening test. The Chairman of the Board may order additional tests based on professional requirements to accurately conclude health status;

6. Examination Process

a) Prepare a list of citizens to be examined;

b) Announce the time and place for organizing the physical examination (Order to attend the physical examination);

c) Conduct physical examinations according to the contents stipulated in Clause 5 of this Article and implement in two rounds: Physical and clinical examination and ancillary clinical examination, HIV and drug screening. During physical and clinical examination, if a citizen does not meet one of the health standards specified in Clause 1, Article 4 of this Circular, then the Board member conducting the examination reports to the Chairman to decide to stop the examination. Only proceed with blood tests, urine tests; HIV and drug screening tests for citizens who meet health standards after physical and clinical examinations, ultrasound, electrocardiogram, chest X-ray;

Organize counseling and HIV testing in accordance with the laws on prevention and control of HIV/AIDS for those who meet health standards;

đ) Complete the Military Service Health Record according to Model 3 of Appendix V issued together with this Circular;

đ) Summarize and report the results of the military service physical examination according to Model 2b of Appendix VI issued together with this Circular;

7. Time for Physical Examination: From November 1st to December 31st every year. The Ministry of National Defense may adjust the time if necessary;

8. Organization of Health Examination Rooms

a) The arrangement of clinics must follow the principle of one-way flow, closed circuit, convenient for patients, and ensuring minimum conditions for examination in each specialty: physical fitness, eyes, ears-nose-throat, oral-maxillofacial, internal medicine, neurology, psychiatry, surgery, dermatology, obstetrics-gynecology (for females). Each specialty must be allocated at least one room. Clinics for psychiatric screening, surgery, dermatology, and obstetrics-gynecology must ensure privacy, seriousness, and avoid noise.

The sequence of health examination: waiting area; registration; physical fitness examination; pulse and blood pressure measurement; electrocardiogram; ultrasound; surgery; dermatology; ophthalmology; otolaryngology; oral-maxillofacial; internal medicine; neurology; psychiatry; obstetrics-gynecology (if applicable for females); conclusion. Laboratory tests and X-ray examinations must be arranged in separate areas but must ensure results are available before the Chairman of the Examination Board concludes.

b) Minimum medical equipment and supplies of the regional health examination board[14] according to the List attached as Appendix IV issued with this Circular.

9.[15] (Repealed).

Article 9. Classification of Military Service Health Status

1. The classification of military service health status shall be carried out in accordance with the provisions of Article 5 and Article 6 of this Circular..

2. Recording of the Military Service Health Status Form

a) After examining each specialty, members of the Board shall record the examination score in the "Score" column; briefly state the reasons for the score in the "Reasons" column; sign and write their full name in the "Signature" column;

b) The Chairman of the Regional Health Examination Board[16] shall base on the scores at each criterion to conclude the health status classification, recording it both numerically and in words (in parentheses) in the "Conclusion" section.

3. Points to Note

a) In cases where acute illness or disease that may improve or worsen over time or after treatment is present, the score must be accompanied by the letter "T" (meaning "temporary"). The examiner must briefly record the name of the disease in Vietnamese next to it (which can be written in international terms between parentheses). When concluding, if the letter "T" is next to the highest scoring criterion, the letter "T" must be written in the health status classification section;

b) In cases of doubt about scoring or making a conclusion, the Regional Health Examination Board[17] shall refer the citizen to another healthcare facility for a specialized examination to obtain an accurate conclusion. The maximum time allowed is 10 days and this should only be done when necessary;

c) For cases where the health status form records the letter "T", the Regional Health Examination Board[18] shall be responsible for guiding citizens to healthcare facilities for treatment;

d) In cases where the citizen's illness or disability has not been classified under Section II of Appendix I issued with this Circular, the Regional Health Examination Board[19] shall comprehensively assess the function of the affected organ, the degree of impact on military training, work, daily life, and the prognosis of the disease or disability to conclude the health status classification. Article 10. Medical Examination of Military Service Health Status

1. The provincial medical examination board shall conduct a medical examination of military service health status when there is a complaint related to the health status of citizens called up for military service or reserve military personnel, upon request by the Military Service Council of the commune or the Local Defense Command.

2. Requirements for examination: The examination conclusion must clearly determine the condition of illness or disability and classify health status according to Section I and Section II of Appendix I issued with this Circular.[20] 3. Documents for requesting examination include:

a) Individual Request for Examination Form (according to Model 8 of Appendix V issued with this Circular);

b) Written request from the Military Service Council of the commune or the Local Defense Command;

c) A certified copy of the Military Service Health Status Form, Reserve Military Personnel Health Check Form, or Military Service Health Status Recheck Form (depending on the content of the requested examination).

4. Within 15 days from the date of receiving complete valid documents, the provincial medical examination board must issue a health status examination conclusion for citizens performing military service and send the documents and examination results to the Military Service Council of the commune or the Local Defense Command. [21];

5. The decision of the provincial medical examination board is the final conclusion regarding the health complaints of citizens performing military service.

4. Within fifteen days from the date of receiving all valid documents, the Provincial Medical Appraisal Board must issue a health appraisal conclusion for citizens fulfilling military service obligations and submit the health appraisal file and results to the Commune Military Service Council or the Civil Defense Command.[22].

5. The decision of the Provincial Medical Appraisal Board is the final conclusion regarding the health complaints of citizens fulfilling military service obligations.

Article 11. Military Service Physical Fitness Recheck Examination

1. The military service physical fitness recheck examination shall be conducted by the Military Service Physical Fitness Recheck Examination Board at regiment level and above; the members of the Board include:

a) The Chairman of the Board is the Medical Department Head (responsible for medical affairs) of the regiment-level unit or higher;

b) The Vice-Chairman of the Board is an internist or surgeon;

c) The Permanent Member and Secretary of the Board is a doctor or medical staff member of the unit receiving new recruits;

d) Members are medical officers and staff of the unit receiving new recruits; reinforced medical officers and staff; medical officers and staff or civilian medical personnel from healthcare facilities within the area where the unit is stationed;

đ) Board members must ensure they have all necessary departments and specialties as stipulated in Clause 5 of this Article and possess a valid practice certificate or license in accordance with the laws on medical examination and treatment.

2. Responsibilities of the Military Service Physical Fitness Recheck Examination Board

a) To be responsible to the Unit Commander for organizing the recheck examination, classifying, and concluding the health status of each new recruit received by the unit;

b) To compile the results of the recheck examination, report to the Unit Commander and the superior medical department.

3. Responsibilities of the members of the Military Service Physical Fitness Recheck Examination Board

a) The Chairman of the Board is responsible to the Unit Commander for concluding the health status of new recruits; managing the activities of the Board, including: developing and disseminating the plan for the recheck examination; guiding standards for health status; duties, responsibilities, working principles, task assignments for Board members; organizing consultations and sending new recruits to medical facilities when necessary; classifying health status and signing the military service physical fitness recheck form; organizing meetings to review the work of the recheck examination; reporting to the Unit Commander and the superior medical department;

b) The Vice-Chairman of the Board substitutes for the Chairman when absent; participates in health examinations, consultations; organizes Board meetings when authorized;

c) The Permanent Member and Secretary of the Board is responsible for budgeting, compiling, and settling expenses, medicines, consumables serving the recheck examination; leading and coordinating with other Board members to prepare equipment, infrastructure, devices, support forces, health records, and documents for the Board's tasks; participating in health examinations, consultations, Board meetings; registering, statistics, and reporting according to Model 2i Appendix VI issued together with this Circular;

d) Board members directly conduct examinations; are responsible for the quality of examinations and health conclusions according to assigned tasks; propose additional tests to the Chairman based on professional requirements for accurate health conclusions; participate in consultations and Board meetings when summoned.

4. Working principles of the Military Service Physical Fitness Recheck Examination Board are implemented as stipulated in Clause 4, Article 8 of this Circular.

5. Content of the Military Service Physical Fitness Recheck Examination

The content of physical strength examination; clinical examination; paraclinical examination is carried out as stipulated in Clause 5, Article 8 of this Circular.

6. Procedure for the Military Service Physical Fitness Recheck Examination

a) The procedure for the Military Service Physical Fitness Recheck Examination is carried out as stipulated in Clause 6, Article 8 of this Circular;

b) Complete the Military Service Physical Fitness Recheck Form according to Model 4 Appendix V issued together with this Circular;

c) Compile and report the results of the Military Service Physical Fitness Recheck Examination according to Model 2i Appendix VI issued together with this Circular.

7. Timeframe for the Military Service Physical Fitness Recheck Examination: Completed within 10 days from the date of troop transfer.

8. Organizing recheck examination rooms as stipulated in Clause 8, Article 8 of this Circular.

9. Classifying health status of the Military Service Physical Fitness Recheck Examination as stipulated in Clause 1 and Clause 2, Article 9 of this Circular.

Article 12. Health Examination in the Military after Military Service Physical Examination Review

1. The health examination for military service in the Military shall be conducted by the Medical Examination Board of the lower-tier military hospitals receiving new recruits upon complaints about their health status, at the request of the unit commander receiving new recruits.

2. The Medical Examination Board of Military Hospital 103 shall examine individuals from units in the Northern region starting from Military Region 4; the Medical Examination Board of Military Hospital 175 shall examine individuals from units in the Southern region starting from Military Region 5.

b) Written request from the Military Service Council of the commune or the Local Defense Command;

a) An individual's request for examination (in Model 8 of Appendix V issued together with this Circular);

b) A written request from the unit commander receiving new recruits;

c) A valid copy of the Military Service Health Status Form and the Military Service Physical Examination Review Form.

4. Within fifteen days from the date of receipt of complete and valid files, the Medical Examination Board must complete the health examination as stipulated in Clause 2, Article 10 of this Circular and issue a conclusion; compile and report according to Model 2m of Appendix VI issued together with this Circular.

5. The decision of the Medical Examination Board of Military Hospital 103 or the Medical Examination Board of Military Hospital 175 is the final conclusion within the Military regarding the health complaints of newly enlisted soldiers.

Article 13. Military Service Health Status Form

1. Contents of the Military Service Health Status Form

a) The brief biography and medical history section: The brief biography is recorded and responsible for by the People's Militia Committee of the commune; the medical history is recorded and responsible for by the commune health station;

b) The health examination section is recorded and responsible for by the Regional Health Examination Board.[23] record and bear responsibility.

2. Management of the Military Service Health Status Form

a) Before enlistment, the Military Service Health Status Form is managed by the Regional Defense Command;[24] b) Upon enlistment, the Military Service Health Status Form is handed over to the receiving unit and managed at the division-level military hospital and equivalent level;

c) Upon discharge, the Military Service Health Status Form is returned to the Regional Defense Command

for management.[25] management.

3. The Military Service Health Status Form is only valid when:

a) It conforms to the prescribed model;

b) It is written in blue ink pen, not pencil;

c) The handwriting is clear, without erasures or abbreviations;

d) All contents in the Military Service Health Status Form are fully recorded;

e) It does not exceed six months from the date the Regional Health Examination Board[26] concludes on the health status, except in cases of special health developments.

4. Handover of the Military Service Health Status Form for Enlisted Citizens

a)[27] Within fifteen days from the end of the Military Service Physical Examination, the commune health authority shall cooperate with the Regional Health Examination Board to complete the list of citizens meeting the health requirements stipulated in this Circular, finalize the Military Service Health Status Form, and hand it over to the Military Service Committee of the commune;

b) Based on the agreement plan between the receiving unit and the locality, the Regional Defense Command[28] hands over the Military Service Health Status Form of eligible citizens to the receiving unit;

c) Citizens who do not meet the health standards after the Military Service Physical Examination Review are returned to their place of origin according to the regulations of the Ministry of National Defense. The health records of citizens returned to their place of origin due to non-compliance with health standards must include the Military Service Health Status Form of the Regional Health Examination Board[29] of the locality and the health review form of the unit's health examination review board.

Section 2: MANAGEMENT AND HEALTH CHECKS OF RESERVE MILITARY PERSONNEL

Article 14. Management of Reserve Military Personnel's Health

1. Before returning to their place of origin (discharge, retirement, transfer to civilian work), the military medical unit shall be responsible for providing a valid copy of the annual health examination form to be kept in the military personnel file. Upon returning to their place of origin, reserve military personnel within the age range for reserve service shall be responsible for submitting a copy of the annual health examination form to the Regional Defense Command Board for management.[30] for management.

2. Reserve military personnel shall undergo health checks before each training session, drill, readiness inspection, pursuant to the decision on training quotas, drills, and readiness inspections issued annually by the competent authority.

a) Reserve military personnel who meet the health standards shall continue to be assigned to reserve mobilization units.

b)[31] In cases where they do not meet the health standards, the Department of Health shall instruct hospitals or healthcare centers under its jurisdiction to notify the Regional Defense Command Board in writing to remove them from the list of reserve service personnel in the locality.

3. During training sessions, exercises, and concentrated readiness checks for reserve military personnel, the medical staff of the reserve mobilization unit shall be responsible for closely monitoring the health of the reserve military personnel.

3. During training sessions, drills, and readiness inspections of reserve military personnel, the medical staff of the reserve mobilization unit shall closely monitor the health of the reserve military personnel.[32] shall be responsible for transferring the entire health file of the reserve military personnel to the receiving unit for management.

Article 15. Health Checks of Reserve Military Personnel

1.[33] The health check team for reserve military personnel shall be established by a decision issued by the Department of Health assigning hospitals, healthcare centers, or healthcare agencies under its jurisdiction. The health check team shall consist of at least three members: one doctor as the team leader and two healthcare staff from hospitals, healthcare centers, or healthcare agencies under the Department of Health, or health stations, with the responsibility to conduct health checks, issue health forms, and compile and report results to the hospitals, healthcare centers, or healthcare agencies under the Department of Health and the Regional Defense Command Board; and inform the results to the healthcare agency at the commune level according to regulations.

2. The health examination includes:

a) Collecting personal and family medical history;

b) Physical fitness test;

c) Pulse and blood pressure measurement;

d) Internal medicine, surgery, and specialty examinations.

a) Based on the training plan for reserve military personnel, the Health Examination Team shall prepare a health examination form for 100% of the reserve military personnel according to Model 1 of Appendix V issued together with this Circular;

3. Health Check Process:

a) Based on the training plan for reserve military personnel, the health check team shall issue health check forms for 100% of reserve military personnel according to Model 1 of Appendix V attached to this Circular;

b) Develop plans and conduct health checks according to the content stipulated in Clause 2 of this Article;

c) Compile, statistically analyze, and report results according to Models 1a and 1c of Appendix VI attached to this Circular.

Section 3: HEALTH EXAMINATIONS FOR MILITARY ADMISSIONS

Article 16. Preliminary Health Examinations for Military Admissions[34] 1. Preliminary health examinations for military admissions shall be conducted as follows: a) The regional health examination board shall conduct preliminary health examinations for candidates who are young people outside the military or military personnel stationed in the area; the composition of the board shall comply with the provisions of Clause 1 of Article 8 of this Circular;;

b) The hospital military health examination board shall conduct preliminary health examinations for candidates who are young people outside the military in the area or military personnel stationed in the area or in the line; the board shall consist of: the Chairman of the Board being the Director of the hospital military; the Vice-Chairman of the Board being the Deputy Director in charge of professional matters of the hospital military; the Permanent Member and Secretary of the Board being the commander or staff member in charge of planning and consolidation work of the hospital military; other members of the board shall be undertaken by staff members of the hospital military. Members of the board shall comply with the provisions of Point d of Clause 1 of Article 8 of this Circular. point d clause 1 Article 8 of this Circular.

2. Responsibilities of the Preliminary Health Examination Board for Military Admissions

a) Be responsible for conducting health examinations, classifying, and concluding on the health status of candidates (young people outside the military, military personnel) applying for military admissions;

b) Compile health examination results and hand over health records to the local military admissions board for candidates who are young people outside the military or hand over to the requesting unit for candidates who are military personnel.[35] for candidates who are young people outside the military in local areas or transfer them to the requesting unit for preliminary health screening if the candidate is a military personnel.

3. Responsibilities of board members and principles of operation of the board shall be implemented in accordance with the provisions of Clause 3 and Clause 4 of Article 8 of this Circular. clause 3, clause 4 Article 8 of this Circular.

4. Content of examinations, organization of examination rooms, and preliminary health examination procedures for candidates applying for military admissions shall be carried out in accordance with the provisions of Clauses 5, 6, and 8 of Article 8 of this Circular; complete the preliminary health examination form for military admissions according to Model 5 of Appendix V and compile and report according to Model 3a of Appendix VI attached to this Circular.; complete the preliminary health screening form for military recruitment according to Model 5 of Appendix V and report statistics according to the regulations stipulated in Model 3a of Appendix VI issued together with this Circular.

Article 17. Military Recruitment Health Examination

1. The military recruitment health examination shall be conducted by the Medical Examination Board of the Military Hospital pursuant to the assignment of the Military Medicine Department under the General Logistics and Technical Department.[36].

a) The composition of the Medical Examination Board shall be established by the Director of the Military Hospital, including staff from the Military Hospital and the Military Chief (responsible for military medicine) of the military recruitment school.

b) The Chairman of the Board shall be assumed by the Director or Deputy Director of the hospital.

c) Two Vice Chairmen of the Board: The permanent Vice Chairman shall be the hospital commander; the other Vice Chairman shall be the Military Chief (responsible for military medicine) of the military recruitment school.

d) The Standing Member兼任秘书由医院指挥官或负责医院计划综合工作的干部担任。

e) Members of the Board shall be staff from the Military Hospital.

e) Members of the Board shall act in accordance with the provisions set forth in point d clause 1 Article 8 of this Circular.

2. Duties of the Medical Examination Board

a) To be responsible before the Military Recruitment Board of the school for conducting health examinations, classifying, and concluding on the health status of successful candidates admitted to the school.

b) To compile and report the results of the military recruitment health examination and hand over the health records to the Military Recruitment Board of the school.

3. Duties of members of the Medical Examination Board

a) The Chairman of the Board shall be responsible before the Military Recruitment Board of the school for the conclusion on the health status of successful candidates admitted; to direct the activities of the Board, including: drafting and disseminating the health examination plan; guiding regulations on health standards; responsibilities, duties, principles of work, task assignments for Board members; organizing consultations and sending for further medical checks at other healthcare facilities when necessary; classifying health status and signing the military recruitment health form; organizing meetings to review experiences in conducting military recruitment health examinations.

The Chairman of the Board may use the seal of his/her own agency or unit during the performance of duties;

b) The permanent Vice Chairman shall replace the Chairman when absent; participate in health examinations and consultations; chair Board meetings when authorized.

c) The Vice Chairman of the Board: To direct the activities of successful candidates admitted participating in health examinations according to the approved plan; participate in concluding and classifying health status.

d) The Standing Member兼任秘书shall be responsible for preparing budgets, compiling, and settling accounts for funds, medicines, and consumables serving the military recruitment health examination; to lead coordination with other members to prepare equipment, facilities, support personnel, health records, and materials for the Board to perform its tasks; participate in health examinations, consultations, and Board meetings; register, statistics, and report according to Model 3c Appendix VI issued together with this Circular.

e) Members of the Board directly conduct health examinations, bear responsibility for the quality of examinations and conclusions on health status according to assigned tasks; propose additional specialized tests to the Chairman to ensure accurate health conclusions; participate in consultations and Board meetings when summoned.

4. Principles of operation of the Medical Examination Board of the Military Hospital shall be implemented in accordance with the provisions set forth in Clause 4, Article 8 of this Circular.

5. Content of health examinations, organization of examination rooms, and procedures for health examinations for successful candidates admitted shall be carried out in accordance with the provisions set forth in the complete the preliminary health examination form for military admissions according to Model 5 of Appendix V and compile and report according to Model 3a of Appendix VI attached to this Circular.; complete the military recruitment health form according to Model 6 Appendix V and statistics and report according to the provisions set forth in Models 3b, 3c Appendix VI issued together with this Circular.

6. Timeframe for military recruitment health examinations: Completed within ten days from the date of admission of successful candidates (as stated in the admission notice).

Article 18. Medical Examination for Military Recruitment Candidates

1. Provincial Medical Examination Board

a) The provincial medical examination board shall conduct health examinations for military recruitment candidates when there are complaints related to the health of civilian candidates for military recruitment from the local military recruitment board.[37] b) The application file for health examination for military recruitment candidates includes: The candidate's application form (in accordance with Model 8 Appendix V issued together with this Circular); the request for examination letter from the local military recruitment board;

c) Within fifteen days from the date of receiving the complete application file for health examination, the provincial medical examination board must issue a conclusion on the health examination of civilian candidates for military recruitment and send the examination file and results to the local military recruitment board.[38]d) The decision of the provincial medical examination board is the final conclusion outside the military regarding the health complaints of civilian candidates for military recruitment.

2. Medical Examination Board of Military Hospital[39];

a) The medical examination boards of Military Hospital 103 and Military Hospital 175 shall accept and examine the health of candidates upon request from the military recruitment boards of military schools or unit heads for preliminary health examinations of military personnel. The medical examination board of Military Hospital 103 shall examine for schools, units, or candidates residing in areas northward from Military Region 4; the medical examination board of Military Hospital 175 shall examine for schools, units, or candidates residing in areas southward from Military Region 5.

b) The application file for health examination for military recruitment candidates includes: The candidate's application form (in accordance with Model 8 Appendix V issued together with this Circular); the examination request document from the military recruitment boards of military schools or units with military personnel; a valid copy of the candidate's health record.

c) Within fifteen days from the date of receiving the complete application file for health examination, the medical examination boards of Military Hospitals 103 and 175 must issue a conclusion on the health examination of military recruitment candidates and send the examination file and results to the military recruitment boards of military schools or units with military personnel; compile and report according to Model 2m Appendix VI issued together with this Circular. d) The decisions of the medical examination boards of Military Hospitals 103 and 175 are the final conclusions within the military regarding the complaints of candidates during the health examination for military recruitment.

3. The examination conclusion must clearly determine the state of illness and classify health according to Section I, Section II Appendix I issued together with this Circular.

Chapter 4: HEALTH REEXAMINATION AND MEDICAL EXAMINATION IN RECRUITING INTO THE OFFICER RANKS; TRAINING OF RESERVE OFFICERS FOR MILITARY SERVICE; RECRUITING OF PROFESSIONAL SOLDIERS, MILITARY WORKERS AND DEFENSE CIVIL SERVANTS

Article 19. Health Reexamination for Recruiting into Officer Ranks; Training of Reserve Officers for Military Service; Recruiting of Professional Soldiers, Military Workers and Defense Civil Servants.

1. The Military Medicine Department under the Ministry of National Defense shall organize health reexaminations for recruitment candidates into officer ranks; training of reserve officers for military service; recruiting of professional soldiers, military workers and defense civil servants at the hospital medical examination board, following the provisions of Clauses 1, 2, 3, and 4 of Article 17;

2. The content, examination procedures, and organization of examination rooms shall be carried out according to Clause 5 of Article 17;

complete the health reexamination form according to Model 7 Appendix V and compile statistics and reports according to the regulations in Model 4b Appendix VI issued together with this Circular.

1. The Military Medical Department under the Ministry of National Defense organizes re-examinations for health for recruitment into the cadre corps; training reserve officers called up for active duty service; recruitment of professional military personnel, civilian workers, and defense civil servants at the Medical Examination Board of the military hospital, in accordance with the provisions of the clause 1, 2, 3 and 4 Article 17; compile, report according to Model 4a of Appendix VI issued together with this Circular.

2. The content, procedures for examination, organization of examination rooms are carried out in accordance with the provisions of the clause 5 Article 17; complete the Re-examination Health Form according to Model 7 of Appendix V and compile, report according to the regulations stipulated in Model 4b of Appendix VI issued together with this Circular.

Article 20. Medical examination for recruitment into the cadre corps; training of reserve officers called up for active service; recruitment of professional soldiers, workers, and defense civil servants.

1. The Medical Examination Board of Military Hospital 103 and the Medical Examination Board of Military Hospital 175 shall accept and conduct medical examinations for recruitment into the cadre corps; training of reserve officers called up for active service; recruitment of professional soldiers, workers, and defense civil servants when there are health complaints related to these processes, upon the request of the recruiting or training units. The Medical Examination Board of Military Hospital 103 shall examine cases from Military Region 4 and northward; the Medical Examination Board of Military Hospital 175 shall examine cases from Military Region 5 and southward.

2. The application for medical examination shall include: An individual's application form (in accordance with Form 8 of Appendix V issued together with this Circular); the examination request document from the recruiting or training unit; a valid copy of the health re-examination file at the military hospital.

3. The examination conclusion must clearly determine the state of illness and classify health according to Section I and Section II of Appendix I issued together with this Circular. Within fifteen working days from the date of receiving complete and valid files, the Medical Examination Board must issue a health examination conclusion and send the file and examination results to the recruiting or training unit; compile a report according to Form 2m of Appendix VI issued together with this Circular.

4. The decision of the Medical Examination Board of Military Hospital 103 and the Medical Examination Board of Military Hospital 175 is the final conclusion on health complaints for recruitment into the cadre corps; training of reserve officers called up for active service; recruitment of professional soldiers, workers, and defense civil servants.

Section 5: HEALTH EXAMINATION FEES

Article 21. Consumption quotas and costs for conducting health examinations

The consumption quotas and costs for conducting health examinations for fulfilling military service obligations, military recruitment, and reserve military personnel; health examinations for recruitment into the cadre corps, training of reserve officers called up for active service, recruitment of professional soldiers, workers, and defense civil servants shall be implemented in accordance with the provisions set out in Appendix II issued together with this Circular.

Article 22. Sources of funding assurance

1. Funding for local health examinations for fulfilling military service obligations and health checks for reserve military personnel shall be carried out in accordance with Article 53 of the 2015 Military Service Law.

2. Funding for re-examination and post-re-examination medical examination costs for fulfilling military service obligations; preliminary health examinations and military recruitment health examinations; re-examinations and medical examinations for recruitment into the cadre corps, training of reserve officers called up for active service, recruitment of professional soldiers, workers, and defense civil servants shall be covered by the regular national budget for defense. Accounted under Item 7000; Sub-item 7001; Detail Item 10 (Medicines and bandages), Detail Item 30 (Equipment), Detail Item 90 (Other); Department 53.

Chapter IV

RESPONSIBILITIES OF THE ORGANIZATIONS AND UNITS UNDER THE MINISTRY OF NATIONAL DEFENSE

 

Article 23. General Staff Department

1. Coordinate with the Ministry of Health to direct military agencies at all levels to cooperate with local health agencies to plan and implement medical examinations for fulfilling military service obligations as prescribed.

2. Assign the Military Affairs Department, the Training and Education Department, and the Self-Defense Militia Department to direct and guide agencies and units to organize the implementation of regulations on health standards, medical examinations for fulfilling military service obligations; military recruitment; hiring professional soldiers, workers, and defense civil servants.[40], the General Logistics and Technical Department directs and guides agencies and units to organize the implementation of health standards, health examinations for fulfilling military service obligations; military recruitment; recruitment of professional military personnel, civilian workers, and defense civil servants.

Article 24. Political General Department

1. Assign the Cadre Department to direct and guide agencies and units to organize the implementation of regulations on health standards, medical examinations for military recruitment, and hiring into the cadre corps, training reserve officers called up for active duty.

2. Assign the Propaganda Department to direct and guide agencies and units to organize extensive propaganda work on health standards and medical examinations for subjects under the management of the Ministry of National Defense.

Article 25. The General Logistics and Technical Department [41]

Article 25. Logistics and Technical General Department

1. Take the lead and coordinate with relevant agencies and units to advise the Minister of National Defense on amending, supplementing, or replacing health standards and medical examinations for subjects under the management of the Ministry of National Defense if difficulties arise during the implementation of this Circular.

2. Direct the Military Medical Department

a) Guide agencies and units to organize the implementation of regulations on health standards, conduct medical examinations, re-examinations, and health assessments throughout the military;

b) Monitor and inspect the implementation of health standards, medical examinations, re-examinations, and health assessments in military medical agencies in managing the health of military personnel, defense civil servants, workers, and defense civil servants;

c) Summarize and evaluate the situation of conducting medical examinations for subjects under the management of the Ministry of National Defense and promptly report arising difficulties and obstacles during the implementation, proposing solutions.

1. Directs the Provincial Military Command to advise the People's Committee of the province to direct the Department of Health and[42]  Article 26. Military Regions and the Command of Hanoi Capital City 1. Direct provincial military commands to advise provincial People's Committees to direct provincial Health Departments and, People's Committees of communes to organize medical examinations for fulfilling military service obligations, preliminary medical examinations for military recruitment, and health checks for reserve military personnel as stipulated in Articles 7, 8, 9, 13, 14, 15, and 16 of this Circular[43].

2. Assign provincial military commands to coordinate with provincial Health Departments a) Coordinate with provincial Medical Examination Boards to organize medical examinations for fulfilling military service obligations and military recruitment as stipulated in;

b)[44] Article 10 and Article 18 of this Circular 1. Direct provincial military commands to advise provincial People's Committees to direct provincial Health Departments and, Direct and authorize Regional Defense Command Headquarters to supervise the provincial military command headquarters, commune health stations in conducting preliminary medical examinations for fulfilling military service obligations; supervise the Regional Medical Examination Board in implementing medical examinations for fulfilling military service obligations and preliminary medical examinations for military recruitment as stipulated in Articles 13 and 16 of this Circular Article 14, Article 15 of this Circular;

c) Direct the Military Command Board at the commune level to coordinate with the health agency at the same level to organize preliminary health screening for military service obligations in accordance with the provisions of Article 7, Article 13 of this Circular; manage and check the health status of reserve military personnel in accordance with the provisions of Article 14, Article 15 of this Circular.

3. Direct the units receiving troops to organize re-examination of health status and health assessment after the re-examination of health status for performing military service obligations in accordance with the provisions of Article 11, Article 12 of this Circular.

4. Direct the General Staff, Political Department to cooperate with the Logistics and Technical Department to organize re-examination of health status and health assessment for recruitment into the cadre ranks; training reserve officers called up for active duty service; recruitment of professional soldiers, workers, and defense civil servants in accordance with the provisions of Article 19, Article 20 of this Circular.

Article 27. Other agencies and units directly under the Ministry of National Defense

1. Direct, guide, and inspect the units receiving troops under their authority to implement re-examination of health status and health assessment in accordance with the provisions of Article 11, Article 12 of this Circular.

2. Coordinate with military hospitals to organize re-examination of health status for recruitment candidates; examine health status for successful military recruitment candidates; resolve health assessments for cases of complaints about health status in accordance with the provisions of Articles 17, 18, 19 and 20 of this Circular.

Article 28. Military academies and schools

1. Coordinate with military hospitals to organize health examinations and health assessments for successful military recruitment candidates in accordance with the provisions of Article 17, Article 18 of this Circular.

2. For cases that do not meet the health requirements for military recruitment, the Military Recruitment Examination Boards of military academies and schools shall handle the rejection according to the regulations of the Ministry of National Defense, without affecting the rights of the candidates.

Article 29. Military hospitals

1. Organize and implement health examinations for subjects within the management scope of the Ministry of National Defense in accordance with the provisions of Articles 11, 12, 16, 17, 18, 19 and 20 of this Circular and provide guidance and assign tasks based on the directives of the Military Health Department/Logistics and Technical General Department[45].

2. Military Hospital 103, Military Hospital 175 organize and implement health assessments after re-examination of health status for performing military service obligations as stipulated in Article 12; health assessments for military recruitment as stipulated in Article 18 and health assessments for recruitment and training of reserve officers as stipulated in Article 20 of this Circular.

3. Annually, prepare the budget for ensuring health examinations for the subjects as stipulated in this Circular, submit to the financial department of the direct superior unit up to the Financial Department of the Ministry of National Defense for consolidation and reporting to the Ministry of National Defense to ensure funding; manage and use funds in accordance with current regulations.  ensure funding; manage and use funds in accordance with current regulations. 

Article 30. Financial Department/Ministry of National Defense

Consolidate and review the health examination budget as stipulated in Clause 2, Article 22 of this Circular, report to the Ministry of National Defense to ensure funding for agencies and units for management, use, and settlement in accordance with state regulations and those of the Ministry of National Defense.

Chapter V

IMPLEMENTING PROVISIONS[46]

 

Article 31. Implementation organization

1. Ministries, sectors, localities coordinate with the Ministry of National Defense to monitor and inspect the implementation of this Circular. Timely identify issues during implementation to amend and supplement.

2. Provincial People's Committees implement in accordance with the provisions of Article 58 of the 2015 Law on Military Service Obligations; direct functional departments and localities under their authority to carry out health examination work for performing military service obligations; preliminary health screening for military recruitment; checking the health status of reserve military personnel; health assessments in accordance with the provisions of the following articles Article 7, 8, 9, 10, 14, 15, 16, Articles 18, 21 and 22 of this Circular.

Article 32. Transitional Provisions

1. The results of preliminary health screening, health examination, re-examination, and pre-service health assessment before the effective date of this Circular shall continue to be implemented in accordance with the provisions of Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016 of the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations.

2. The preliminary health screening, health examination, re-examination, and pre-service health assessment after the effective date of this Circular shall be carried out in accordance with the provisions of this Circular.

Article 33. Effective Date

1. This Circular takes effect from January 1, 2024.

2. Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016 of the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations ceases to be effective from the date this Circular takes effect.

Article 34. Responsibility for Implementation
