CIRCULAR
Amending and supplementing some Articles of Circular No. 91/2012/TT-BTC dated May 30, 2012 of the Ministry of Finance on the management and use of funds for the activities of the Steering Committees of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods"
Pursuant to the Law on the Vietnam Fatherland Front dated June 9, 2015;
Implementing the Conclusion No. 107-KL/TW dated April 10, 2015 of the Central Committee of the Communist Party of Vietnam on further strengthening the leadership of the Party over the implementation of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods";
The Minister of Finance promulgates this Circular amending and supplementing some provisions of Circular No. 91/2012/TT-BTC dated May 30, 2012 of the Ministry of Finance on the management and use of funds for the activities of the Steering Committees of the Campaign "Vietnamese People Preferentially Use Vietnamese Goods".

Article 1. Amending and supplementing some provisions of Circular No. 91/2012/TT-BTC dated May 30, 2012 of the Ministry of Finance:
Pursuant to the State Budget Law on June 25, 2015;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016, issued by the Government, detailing the implementation of certain provisions of the State Budget Law;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
1. Supplement Clause 4 of Article 1 as follows:
At the proposal of the Director of the Administrative and Public Service Financial Department;
"4. The Steering Committee at district, town, city under province level (referred to collectively as the Steering Committee at district level)."
2. Point b Clause 1 of Article 2 is amended as follows:
"b)
Funds ensuring the operation of the Steering Committee at provincial level and the Steering Committee at district level shall be guaranteed by the local budget, allocated in the annual state budget estimate of the Vietnam Fatherland Front Committee at the same level according to the current budget decentralization;"
3. Amending and supplementing point b, point h, point i Clause 1 of Article 3 as follows:
"1. Contents of expenditures for the operation of the Central Steering Committee, the Permanent Secretariat of the Campaign:b) Expenditure for organizing specialized conferences, mid-year reviews, and annual summaries;
h) Expenditure for surveys serving the Campaign;
i) Other related expenses directly linked to the activities of the Steering Committee."
4. Amending and supplementing point d, point h, point i Clause 2 of Article 3 as follows:
"2. Contents of expenditures for the operation of the Steering Committee of the Campaign at provincial level:
d) Expenditure for information dissemination, propaganda, promotional events, contests, and performances promoting the Campaign;"
5. Supplement Clause 3 of Article 3 as follows:
"3. Contents of expenditures for the operation of the Steering Committee of the Campaign at district level:
a) Travel expenses (including support travel expenses for individuals not receiving salary from the state budget participating in implementing the Campaign), fuel expenses for inspection, supervision, guidance, and urging activities of the Campaign;
"2. Contents of expenditures for the operation of the Steering Committee of the Campaign at provincial level:
d) Expenditure for information dissemination, propaganda, promotional events, contests, and performances promoting the Campaign;"
b) Expenditure for organizing deployment meetings, training sessions, seminars, specialized conferences, meetings to convey instructions, meetings to commend exemplary cases, mid-year and annual summary meetings, and other meetings serving the Campaign;
c) Expenditure for information dissemination, propaganda, promotional events, contests, and performances promoting the implementation of the Campaign;
d) Expenditure for surveys serving the Campaign;
đ) Expenditure for rewarding individuals and groups with outstanding achievements in implementing the Campaign;
e) Expenditure for office supplies, overtime pay for working late hours serving the Campaign;
g) Other related expenses directly linked to the activities of the Steering Committee at district level."
6. Article 4 is amended and supplemented as follows:
"1. Travel expenses for guiding, inspecting, and supervising activities (including support travel expenses for individuals not receiving salary from the state budget participating in implementing the Campaign); expenditure for organizing mid-year and specialized summary meetings, meetings to summarize experiences in implementing the Campaign shall be implemented in accordance with Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance on travel expense regulations and meeting expense regulations.
2. Expenditure for organizing meetings of Steering Committees at all levels chaired to discuss the content of the annual activity plan of the Campaign; discussing measures to implement the Campaign:
a) Chairperson: Maximum amount of 200,000 VND/person/session;
b) Participants: Maximum amount of 100,000 VND/person/session.
3. Translation expenses for printed materials (if any), materials serving the Campaign (from foreign languages or ethnic minority languages to Vietnamese or vice versa): Implemented in accordance with the translation expense regulations stipulated in Circular No. 71/2018/TT-BTC dated August 10, 2018 of the Ministry of Finance on regulations for hosting foreign guests visiting Vietnam, organizing international conferences and seminars in Vietnam, and hosting domestic guests.
4. Expenditure for information dissemination and propaganda about the Campaign: Implemented in accordance with Circular Jointly Issued No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice on the preparation, management, use, and settlement of state budget funds to ensure the work of popularizing laws and standard access to laws for people at the grassroots level.
5. Reward expenditure:
a) Expenditure for organizing the assessment and awarding of titles and prizes to business leaders and enterprises: Implemented in accordance with Decision No. 51/2010/QD-TTg dated July 28, 2010 of the Prime Minister on the issuance of regulations on the management of the assessment and awarding of titles and prizes to business leaders and enterprises;
b) Expenditure for rewarding units and individuals with outstanding achievements during review periods: Implemented in accordance with Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Encouragement and Commendation.
6. Survey expenditure serving the Campaign: Applied according to the expenditure regulations stipulated in Circular No. 109/2016/TT-BTC dated June 30, 2016 of the Ministry of Finance on the preparation, management, use, and settlement of funds for conducting surveys and national censuses.
7. Contest and performance expenditure serving the Campaign: Applied according to the expenditure regulations for organizing contests stipulated in Circular Jointly Issued No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice on the preparation, management, use, and settlement of state budget funds to ensure the work of popularizing laws and standard access to laws for people at the grassroots level.
b) Reward for units and individuals with outstanding achievements during mid-term and final reviews: Implemented according to the detailed regulations set forth in Decree No. 91/2017/NĐ-CP dated July 31, 2017, of the Government on the implementation of certain provisions of the Law on Competition and Rewards.
6. Expenses for investigation serving the Campaign: Apply the expenditure levels prescribed in Circular No. 109/2016/TT-BTC dated June 30, 2016, of the Ministry of Finance regarding the preparation of budgets, management, utilization, and settlement of funds for conducting surveys and national censuses.
7. Expenses for competitions and performances serving the Campaign: Apply the expenditure levels for organizing competitions as stipulated in Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014, of the Ministry of Finance and the Ministry of Justice concerning the preparation of budgets, management, utilization, and settlement of state budget funds to ensure legal education and public legal awareness at the grassroots level.
8. Paying night shift and overtime wages: Implemented according to the joint Circular No. 08/2005/TTLT-BNV-BTC dated January 5, 2005, issued by the Ministry of Home Affairs and the Ministry of Finance guiding the payment system for night work and overtime for cadres, civil servants, and public officials.
9. Expenditure on office supplies and other expenses directly related to the Campaign but not specified in terms of expenditure limits: Based on valid invoices and documents and must be approved by the competent authority within the allocated budget.
7. Clause 3 of Article 5 is amended as follows:
“3. For the Provincial Steering Committee and the District Steering Committee of the Campaign: Annually, based on assigned tasks, they are responsible for developing the content of the activity plan and the budget estimate for implementation, submitting it to the Standing Committee of the People's Committee at the same level for consideration to be included in the overall budget of the People's Committees at all levels, sending it to the financial agency at the same level for consolidation and submission to the competent authority in accordance with the State Budget Law and its guiding documents.”
2. The Director of the Office, the Director of the Telecommunications Department; Heads of agencies and units under the Ministry; Directors of Provincial Departments of Information and Communications; General Directors, Directors of telecommunications enterprises and organizations and individuals related to this matter are responsible for implementing this Circular.
1. This Circular takes effect from November 15, 2018. For the 2018 budget, ministries, sectors, and localities shall allocate within the scope of the 2018 state budget already assigned by the competent authority for implementation.
2. When regulations and standards for expenditure referred to for application in this Circular are amended, supplemented, or replaced by new documents, they shall be implemented according to the amended, supplemented, or replacing documents.
3. The expenditure level for organizing meetings of steering committees at all levels as stipulated in Clause 6 of Article 1 of this Circular shall be implemented until the end of 2020. From 2021 onwards, it shall be implemented according to the general wage system as prescribed in Resolution No. 27-NQ/TW dated May 21, 2018 of the Central Committee of the Communist Party of Vietnam on salary policy reform for cadres, civil servants, public officials, armed forces personnel, and workers in enterprises.
4. In case difficulties arise during implementation, agencies and units are requested to report to the Central Steering Committee of the Campaign, the Standing Committee of the Vietnam Fatherland Front Central Committee, and the Ministry of Finance for research and resolution./.
