JOINT CIRCULAR

Regulations on Increasing the Scale of Allowances for Extra Hours, Sessions, and Days for Teachers at General Education Schools

 Implementing Decision No. 15-CP dated January 14, 1981 of the Council of Ministers, the Joint Ministry of Education-Labour-Finance hereby stipulates the regulations on increasing the scale of allowances for extra hours, sessions, and days for teachers at general education schools nationwide as follows:

I. SCALE

Teachers assigned to teach more hours (for secondary and high school teachers), more sessions (for primary school teachers), or more days (for kindergarten teachers) beyond the prescribed working schedule for each educational level shall be paid allowances as follows:

- Kindergarten: 4.50 dong per day.

- Primary School: 4.50 dong per session.

- Secondary School and Initial Teacher Training: 1.60 dong per hour.

- High School: 2 dong per hour.

- Secondary Teacher Training for Primary and Secondary School Teachers: 2.50 dong per hour.

II. PRINCIPLES AND PROCEDURES FOR PAYING ALLOWANCES FOR EXTRA TEACHING

1. Regulation on the number of extra teaching hours, sessions, and days for each teacher:

First, it is necessary to assign and arrange for each teacher to teach the full number of days, sessions, and hours according to the established workload standards.

When assigning extra teaching duties, the principal should arrange so that the number of extra teaching hours, sessions, and days for each teacher does not regularly exceed 50% of the standard number of hours, sessions, and days prescribed.

The regulation on the number of extra teaching hours, sessions, and days as stated above is intended to ensure that teachers do not teach too many hours, sessions, or days, which could affect their health, the quality of classroom teaching, and the completion of their tasks.

2. Principles of payment:

b) Payment of extra teaching fees to individual teachers.

Any teacher who teaches additional hours, sessions, or days in a month shall be promptly paid the allowance in the following month, to provide the necessary conditions for replenishing the labor costs incurred due to the additional teaching. The extra teaching allowance paid directly to each teacher assigned to teach beyond the standard hours is based on the actual hours worked by that teacher, not the average hours of all teachers in the school or the ratio of teachers in that school (as this also depends on various other conditions such as having more female teachers than male, different rates of illness and childbirth...).

c) Regardless of the level of teacher training (initial, secondary...) a teacher is assigned to teach at a certain educational level, they shall receive the extra teaching allowance according to the scale specified for that educational level.

3. Determination of extra teaching hours, sessions, and days:

The hours, sessions, and days that a teacher is assigned to substitute for another teacher who is absent due to illness, childbirth, attending meetings, leave, further study, specialized topic training, guiding professional subjects, or conducting professional supervision work, or because the school lacks teachers and the teacher is required to teach beyond their standard hours, shall be considered as extra teaching hours, sessions, and days for that teacher.

For example, a secondary school teacher at a general education primary school is assigned to teach 16 hours per week and act as the class advisor (counted as 4 hours). If another teacher is absent for 4 weeks due to illness and this teacher is assigned to substitute for 2 hours per week, the calculation would be as follows:

16 hours + 4 hours as class advisor + 2 hours substituting = 22 hours per week.

Compared to the standard weekly hours for a secondary school teacher (20 hours), this teacher is considered to have taught 2 extra hours per week, totaling 8 extra hours over 4 weeks, and will be paid 1.60 dong x 8 = 12.80 dong.

If a teacher re-teaches a lesson that did not meet requirements in the previous class or helps another teacher who is absent for personal reasons, these hours are not counted as extra teaching hours.

1. Departments of Education, Labour, and Finance need to closely coordinate to supervise, guide, and inspect the implementation of the allowance payment system for extra teaching by teachers according to the provisions of this circular, while planning the budget from the beginning of the academic year to ensure timely and full payment to teachers.

2. This circular takes effect from April 1, 1981. Extra teaching hours and sessions before April 1, 1981, will still be paid according to the old scale specified in Circular No. 1-TT/LB dated January 13, 1978 of the Joint Ministry of Education and Finance. All regulations regarding the allowance system for extra teaching hours and sessions for teachers at general education levels, kindergartens, supplementary education, initial teacher training, and secondary teacher training that contradict this circular are null and void.

III. IMPLEMENTATION PROVISIONS

1. Departments of Education - Labor - Finance shall closely coordinate to urge, guide, and inspect the education boards, finance departments at districts, cities, and subordinate units to implement the additional teaching allowance system for teachers in accordance with the provisions of this Circular, while planning to budget funds from the beginning of the school year to ensure timely and full payment to female and male teachers.

2. This Circular takes effect from April 1, 1981. Additional teaching hours and sessions before April 1, 1981 shall still be paid according to the old rate specified in Circular No. 1-TT/LB dated January 13, 1978 issued by the Ministry of Education and Finance. All regulations on additional teaching hour and session allowances for teachers at all levels of general education, kindergarten, remedial education, primary teacher training, and secondary teacher training that conflict with this Circular shall become void.
