Regarding the transfer of the Mining and Construction Vocational Training School under the Domestic Coal Company to be under the Vietnam Coal Corporation
THE MINISTER OF INDUSTRY
Pursuant to the Education Law dated December 2, 1998;
Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Implementing the Prime Minister's opinion, the Minister of Industry decides to transfer the Mining and Construction Vocational Training School under the Domestic Coal Company to become a public service unit under the Vietnam Coal Corporation (as per the Office of the Government's letter No. 4551/VPCP-ĐMDN dated September 1, 2004)
Considering the proposal of the Chairman of the Board of Directors of the Vietnam Coal Corporation (Letter No. 2496/TTr-HĐQT dated July 22, 2004)
At the suggestion of the Director of the Department of Organization and Cadres,
DECISION:
Article 1. Transfer the Mining and Construction Vocational Training School (hereinafter referred to as the School) under the Domestic Coal Company to be under the Vietnam Coal Corporation.
The main office is located at Son Cam Commune, Phu Luong District, Thai Nguyen Province.
Article 2. The School is a vocational training public service entity with revenue, having legal personality, entitled to open accounts at State banks and treasuries, and using seals (including embossed seals and reduced seals) for operations and transactions in accordance with the law.
Article 3. The University has the following main tasks:
1. Training and upgrading technical workers in mining, drilling, iron, metal cutting, and electrical engineering; operating and repairing construction machinery, pumps, compressors, fans, electricity, boilers, turbines, and motor vehicles; driving various categories of vehicles; producing building materials.
2. Civil and industrial construction.
3. Operating and repairing cement equipment.
4. Supplementary cultural education.
5. Linking part-time technical training at various levels.
6. Upgrading production management staff at workshop level and upgrading worker ranks.
7.定向化培训,为越南劳动者在国外工作做准备。
8. Coal mining, processing, and consumption.
9. Managing organizational structure, staffing, assets allocated according to state regulations and the delegated management authority of the Vietnam Coal Corporation.
Article 4. Organizational structure and scale of training.
1. Organizational structure, including:
a) Leadership:
- President;
- Deputy Presidents.
b) Business units.
c) Departments and subjects.
d) Service, service, and production units.
2. The scale of training at the School ranges from 1,000 to 1,200 students.
Article 5. The General Director of the Vietnam Coal Corporation shall appoint and dismiss the Principal and Deputy Principals; promulgate the Charter on Organization and Operation of the School and related management regulations in accordance with the Charter on Organization and Operation of the Vietnam Coal Corporation and the Vocational School Charter issued together with Decision No. 775/2001/QĐ-BLĐTBXH dated August 9, 2001 of the Minister of Labor, Invalids, and Social Affairs.
Article 6. The Chairman of the Board of Directors of the Vietnam Coal Corporation is responsible for directing the handover and acceptance of the School's physical facilities, assets, capital, and labor from the Domestic Coal Company to the Vietnam Coal Corporation in accordance with current state procedures.
Article 7. This Decision takes effect 15 days after its publication in the Official Gazette and replaces Decision No. 18/2000/QĐ-BCN dated April 5, 2000 of the Minister of Industry regarding the transfer of the Mining and Construction Vocational Training School from being a unit under the Vietnam Coal Corporation to being under the Domestic Coal Company.
The Head of the Ministry's Office, the Inspector General, the Heads of Departments, the Heads of Bureaus, the Heads of Units under the Ministry, the Chairman of the Board of Directors, and the General Director of the Vietnam Coal Corporation, the Director of the Domestic Coal Company, and the Principal of the Mining and Construction Vocational Training School are responsible for implementing this Decision./.
