On the criteria for appointment and conditions for promotion to the rank of Inspector of

the Minister of Public Security,

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

 

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to Article 90 of the Law on the Organization of the People's Procuracy No. 63/2014/QH13;

Pursuant to Clause 3 of Resolution No. 82/2014/QH13 dated November 24, 2014 of the National Assembly on the implementation of the Law on the Organization of the People's Procuracy;

Considering the proposal of the Prosecutor General of the Supreme People's Procuracy,

RESOLUTION:

Article 1. Scope of Regulation

This Resolution stipulates the criteria for appointment and conditions for promotion to the rank of Inspector of the People's Procuracy.

Article 2. General Criteria for Inspectors

1. Being a Vietnamese citizen loyal to the Fatherland and the Constitution of the Socialist Republic of Vietnam; having good moral character, integrity, honesty; having firm political resolve; having a spirit of resolutely protecting the socialist rule of law.

2. Having a bachelor’s degree in law or higher.

3. Having been trained in prosecution business.

4. Having practical work experience as prescribed by this Resolution.

5. Possess health sufficient to fulfill assigned tasks.

Article 3. Criteria for Appointment of Inspectors

A person who meets the criteria set forth in Article 2 of this Resolution and satisfies the following conditions may be appointed as an Inspector of the People's Procuracy; if working at military procuracies, they may be appointed as Inspectors of military procuracies:

1. Currently being a civil servant.

2. Having at least three years of legal work experience.

3. Having the ability to assist Prosecutors in exercising public prosecution powers, supervising judicial activities; performing other tasks and responsibilities assigned by the Chief Prosecutor of the People's Procuracy, the Chief Prosecutor of military procuracies.

Article 4. Criteria for Appointment of Senior Inspectors

A person who meets the criteria set forth in Article 2 of this Resolution and satisfies the following conditions may be appointed as a Senior Inspector of the People's Procuracy; if working at military procuracies, they may be appointed as Senior Inspectors of military procuracies:

1. Having served as an Inspector for at least five years.

2. Having the ability to guide business operations for Inspectors and undertake positions corresponding to the rank of Senior Inspector.

3. Having passed the examination for the rank of Senior Inspector.

Article 5. Criteria for Appointment of Senior Inspectors (High Rank)

A person who meets the criteria set forth in Article 2 of this Resolution and satisfies the following conditions may be appointed as a Senior Inspector (High Rank) of the People's Procuracy; if working at military procuracies, they may be appointed as Senior Inspectors (High Rank) of military procuracies:

1. Having served as a Senior Inspector for at least five years.

2. Having the ability to guide business operations for lower-level Inspectors and undertake positions corresponding to the rank of Senior Inspector (High Rank).

3. Having passed the examination for the rank of Senior Inspector (High Rank).

Article 6. Examination Board for Selection and Promotion to Inspector Ranks

1. The Examination Board for selecting Inspectors, examining candidates for Senior Inspectors and Senior Inspectors (High Rank) is the Supervisory Committee of the People's Procuracy, the Supervisory Committee of military procuracies at all levels.

2. The Examination Board for selecting Inspectors, examining candidates for Senior Inspectors and Senior Inspectors (High Rank) has the following duties and powers:

a) Selecting persons meeting the criteria and conditions to propose to the Chief Prosecutor of the Supreme People's Procuracy, the Chief Prosecutor of the Central Military Procuracy for appointment as Inspectors;

b) Examining candidates meeting the criteria and conditions for the examination to enter the ranks of Senior Inspectors and Senior Inspectors (High Rank).

3. The Chief Prosecutor of the Supreme People's Procuracy appoints Inspectors of procuracies at all levels. The Chief Prosecutor of the Central Military Procuracy appoints Inspectors of military procuracies at all levels.

Article 7. Examination Board for Senior Inspector and Senior High Inspector

1. The Examination Board for Senior Inspector and Senior High Inspector consists of a Chairman who is one Deputy Prosecutor General of the Supreme People's Procuracy, two Vice Chairmen being representatives from the Ministry of Home Affairs and members of the Supreme People's Procuracy Supervisory Committee, two members being the Head of the Organization and Cadres Department of the Supreme People's Procuracy and a representative from the Central Military Procuracy. The list of the Examination Board for Senior Inspector and Senior High Inspector shall be decided by the Prosecutor General of the Supreme People's Procuracy upon the proposal of the Head of the Organization and Cadres Department of the Supreme People's Procuracy.

2. The Examination Board has the following duties and powers:

a) Organizing examinations for Senior Inspector and Senior High Inspector;

b) Announcing the list of successful candidates;

c) Proposing to the Prosecutor General of the Supreme People's Procuracy and the Prosecutor General of the Central Military Procuracy to appoint successful candidates as Senior Inspectors and Senior High Inspectors.

3. The operational regulations of the Examination Board for Senior Inspector and Senior High Inspector shall be stipulated by the Prosecutor General of the Supreme People's Procuracy.

Article 8. Removal and Dismissal of Inspectors

1. The removal of the Inspector position shall be carried out in the following cases:

a) An Inspector is automatically removed when retiring, resigning, or transferring to another profession;

b) An Inspector may be removed due to health reasons, family circumstances, or other reasons deemed incapable of fulfilling assigned tasks.

2. An Inspector is automatically dismissed when convicted by a court judgment that has taken legal effect.

3. Depending on the nature and severity of the violation, an Inspector may be dismissed from their Inspector position if they fall under any of the following cases:

a) Violating laws while performing duties;

b) Violating prohibitions for civil servants;

c) Violating moral and ethical standards;

d) Engaging in other illegal acts.

4. The procedures and formalities for removing and dismissing the Inspector position shall be stipulated by the Prosecutor General of the Supreme People's Procuracy.

Article 9. Effective Date

1. This Resolution takes effect from June 1, 2015.

2. The Government, the Supreme People's Procuracy, and relevant agencies shall guide the implementation of this Resolution.
