Regulations on the level of collection, collection regime, submission, management and use of medical examination and identification fees

Pursuant to the Law on Medical Examination and Treatment No. 40/2009/QH12 dated November 23, 2009;
Based on the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
After receiving the opinion of the Ministry of Health in Circular No. 916/BYT-KHTC dated February 24, 2012;
At the proposal of the Director of the Tax Policy Department, the Minister of Finance issues this Circular stipulating the levels of collection, collection regime, submission, management and use of medical examination and identification fees as follows:
Clause 2. Any material costs, working expenses arising during the testing of fire prevention and firefighting equipment; printing and affixing of test labels requested by organizations and individuals shall be borne by them according to actual expenditures, in compliance with the law.
The person requesting medical examination and identification must pay the medical examination and identification fee to the institution conducting the medical examination and identification in accordance with the provisions of this Circular.
For war invalids, disabled veterans; persons enjoying benefits equivalent to war invalids; persons participating in the resistance movement suffering from diseases or disabilities related to exposure to toxic chemicals; persons with disabilities, the costs of medical examination and identification shall be guaranteed from the state budget and paid by the organization requesting the identification.
Article 2. Level of Collection
The level of collection of medical examination and identification fees shall be implemented in accordance with the Medical Examination and Identification Fee Schedule attached to this Circular.
In cases where the medical examination and identification fee has been collected, the identification institution will not collect hospitalization fees according to current regulations.
Article 4. Effective Date
1. The agency collecting medical examination and identification fees is the institution conducting the medical examination and identification, including: Institute of Medical Examination and Identification; Central Expert Committees for Medical Examination and Identification; Centers or Departments for Medical Examination and Identification of provinces and centrally-administered cities; Permanent Agencies of Medical Examination and Identification Committees of Ministries (Public Security, Defense, Transport).
2. The person requesting medical examination and identification must pay the medical examination and identification fee when submitting the application for medical examination and identification.
3. The agency collecting fees may retain 95% of the collected fees before submitting them to the state budget to cover the costs of identification and collection. The remaining 5% shall be submitted to the state budget according to the corresponding chapter, category, item, sub-item of the State Budget Classification currently in force.
4. Other contents related to the collection, submission, management, use, and public disclosure of the fee collection regime not specified in this Circular shall be carried out in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and charges; Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 and Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain articles of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government.
Article 4. Organization of Implementation
1. This Circular takes effect from July 20, 2012.
2. During the implementation process, if there are any difficulties, it is recommended that agencies, organizations, and individuals promptly report them to the Ministry of Finance for study and guidance.
