Decree No. 93/2023/NĐ-CP stipulates on awarding the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage.

DECREE

REGULATIONS ON THE AWARDING OF THE TITLES "PEOPLE'S ARTIST" AND "OUTSTANDING ARTIST" IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE
OUTSTANDING IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government issues this Decree on the awarding of the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the subjects, criteria, procedures, and formalities for the awarding of the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage.

Article 2. Applicability

1. Individuals who are Vietnamese citizens currently holding, practicing, teaching, and promoting the value of intangible cultural heritage in the following categories: languages, scripts; folk literature; folk performing arts; social customs and beliefs; traditional festivals; folk knowledge; traditional craft industries.

2. Organizations, individuals, and community residents related to the activities of awarding the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage.

3. This Decree does not apply to individuals who are Vietnamese citizens currently holding, practicing, teaching, and promoting the value of cultural heritage in the field of fine arts crafts.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Community residents refer to groups of Vietnamese citizens living in the same village, hamlet, ward, commune, village, tribe, quarter (hereinafter collectively referred to as village), residential area, street, block, neighborhood, small district (hereinafter collectively referred to as residential area).

2. The period of activity related to the protection and promotion of the value of intangible cultural heritage is calculated from the time the individual begins participating in the practice of intangible cultural heritage until the time they submit their application to the provincial council.

3. Traditional craft industries include cultural expressions manifested through the practice and creativity of individuals and communities in a manual form with techniques, forms, decorations, arts, materials with local elements that are passed down from generation to generation to produce unique products reflecting the cultural identity of the community.

Article 4. Principles for awarding the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage

1. Implement according to the provisions at points a, b, and c, Clause 2, Article 5 of the Law on Competition and Reward.

2. The titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage shall not be awarded to individuals who have been trained at higher education institutions or vocational training institutions regarding the type of intangible cultural heritage they hold to acquire additional skills and secrets.

3. The period during which an individual works and receives salary from the state budget; the period during which an individual withdraws from the activity of practicing intangible cultural heritage in the community shall not be counted as the period of activity related to the protection and promotion of the value of intangible cultural heritage.

4. Councils at all levels may only submit cases meeting the conditions, criteria, procedures, formalities, and documentation prescribed in this Decree to the competent authorities for consideration.

Article 5. Time for awarding, announcing, and organizing the presentation of the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage

1. The titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage shall be awarded and announced in accordance with Clause 4, Article 67 of the Law on Encouragement and Reward.

2. The People's Committee of provinces and centrally governed cities (hereinafter referred to as the Provincial People's Committee) shall organize the ceremony to present the titles to "People's Artists" and "Outstanding Artists" in the field of intangible cultural heritage residing in their locality.

Article 6. Rights and obligations of individuals awarded the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage

1. Individuals receiving the Medal, Certificate of Recognition from

2. Individuals have the obligation to maintain award certificates; continuously improve their knowledge and skills; actively practice, teach, and disseminate knowledge and skills; participate in activities to protect and promote the value of intangible cultural heritage.

Chapter II
CRITERIA FOR AWARDED THE TITLES OF "PEOPLE'S ARTIST", "OUTSTANDING ARTIST" IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE
OUTSTANDING IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE

Article 7. Criteria for awarding the title of "People's Artist" in the field of intangible cultural heritage

The title of "People's Artist" in the field of intangible cultural heritage shall be awarded to individuals specified in Clause 1, Article 2 of this Decree who meet the following criteria:

1. Loyalty to the country; strictly comply with the Party's guidelines and State laws and policies.

2. Have good moral character; set a good example in life; be passionate and dedicated to their profession; be exemplary in practicing and protecting intangible cultural heritage; be recognized and admired by colleagues and the public.

3. Possess outstanding talent or exceptional professional skills that are representative of the type of intangible cultural heritage being honored; make significant contributions recognized for the cause of protecting and promoting the value of the type of intangible cultural heritage they hold, demonstrated through their understanding, possession of knowledge, secrets, and practical skills related to the type of intangible cultural heritage; produce spiritual or material products of historical, cultural, scientific, artistic, aesthetic, and technical value, contributing to the protection and enrichment of the values of intangible cultural heritage, cultural development, and socio-economic development of the country; successfully teach many individuals who have been or are currently involved in protecting and promoting the value of intangible cultural heritage.

4. Have at least 20 years of continuous or cumulative experience related to the protection and promotion of the value of intangible cultural heritage.

5. Have been awarded the title of "Outstanding Artist" in the field of intangible cultural heritage.

Article 8. Criteria for awarding the title of "Outstanding Artist" in the field of intangible cultural heritage

The title of "Outstanding Artist" in the field of intangible cultural heritage shall be awarded to individuals specified in Clause 1, Article 2 of this Decree who meet the following criteria:

1. Loyalty to the country; strictly comply with the Party's guidelines and State laws and policies.

2. Have good moral character; set a good example in life; be passionate and dedicated to their profession; be exemplary in practicing and protecting intangible cultural heritage; be recognized and admired by colleagues and the public.

3. Possess outstanding talent or exceptional professional skills that are representative of the type of intangible cultural heritage being honored; make significant contributions recognized for the cause of protecting and promoting the value of intangible cultural heritage held by the individual, demonstrated through their understanding, possession of knowledge, secrets, and practical skills related to the type of intangible cultural heritage; produce spiritual or material products of historical, cultural, scientific, artistic, aesthetic, and technical value, contributing to the protection and enrichment of the values of intangible cultural heritage, cultural development, and socio-economic development of the local community; successfully teach many individuals who have been or are currently involved in protecting and promoting the value of intangible cultural heritage.

4. Have at least 15 years of continuous or cumulative experience related to the protection and promotion of the value of intangible cultural heritage.

Chapter III
BOARD FOR AWARDING THE TITLES OF "PEOPLE'S ARTIST", "OUTSTANDING ARTIST" IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE
OUTSTANDING IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE

Article 9. Operation of the Council for Awarding the Titles "People's Artist" and "Outstanding Artist" in the Field of Intangible Cultural Heritage

1. The Council for Awarding the Titles "People's Artist" and "Outstanding Artist" in the Field of Intangible Cultural Heritage shall be established for each awarding session. The Council shall dissolve itself upon completion of its tasks.

2. Levels of the Council

a) Provincial-level Councils (hereinafter referred to as Provincial Councils);

b) Sectoral Council at the Ministry level;

c) National-level Council.

Article 10. Provincial Council

1. The Provincial Council shall be established by the Chairman of the People's Committee of the province based on the proposal of the Director of the Department of Culture, Sports and Tourism or the Department of Culture and Sports.

2. The number of members of the Provincial Council: from nine to eleven members.

3. Composition of the Council

a) Chairperson of the Council: A representative of the leadership of the People's Committee of the province;

b) Vice-Chairperson of the Council: The Director or Deputy Director in charge of the field of intangible cultural heritage of the Department of Culture, Sports and Tourism or the Department of Culture and Sports;

c) Members of the Council: Representatives of the leadership of the Department of Home Affairs, the Association (Sub-association) of Local Cultural Heritage; representatives of the leadership of the department in charge of the field of intangible cultural heritage within the Department of Culture, Sports and Tourism or the Department of Culture and Sports; reputable experts with deep knowledge about local intangible cultural heritage; "People's Artists" or "Outstanding Artists" in the field of local intangible cultural heritage (if any).

4. Principles of Operation of the Council

a) Individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage shall not participate in the Council;

b) The Council operates according to the principle of democratic centralism, transparency, and secret ballot;

c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;

d) The Council considers the continuous or cumulative time related to the protection and promotion of the value of intangible cultural heritage; evaluates the reputation, professional skills, and influence of individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the standards prescribed in Article 7 or Article 8 of this Decree. Council members are responsible for studying the files, exchanging opinions, and discussing at the Council;

đ) The Provincial Council only examines files submitted by individuals in accordance with Article 13 of this Decree.

5. The Provincial Council uses the seal of the People's Committee of the province.

6. The Department of Culture, Sports and Tourism or the Department of Culture and Sports is the permanent office of the Provincial Council. The permanent office of the Provincial Council may use its own seal to carry out certain activities under the authorization of the Chairman of the Provincial Council.

7. The Provincial Council has a Secretariat established by the Chairman of the Provincial Council.

Article 11. Sectoral Council at the Ministry Level

1. The Sectoral Council at the Ministry Level shall be established by the Minister of Culture, Sports and Tourism based on the proposal of the head of the specialized agency in charge of commendation and reward work within the Ministry of Culture, Sports and Tourism.

2. The number of members of the Sectoral Council at the Ministry Level: from eleven to fifteen members.

3. Composition of the Council

a) Council Chairman: Representative of the leadership of the Ministry of Culture, Sports and Tourism;

b) Vice-Chairperson of the Council: The head of the specialized agency in charge of commendation and reward work and the head of the specialized agency in charge of cultural heritage within the Ministry of Culture, Sports and Tourism;

c) Members of the Council: Representatives of the leadership: Central Associations of Literature and Art related to the field; some relevant specialized agencies; reputable experts with deep knowledge about the field of intangible cultural heritage.

4. Principles of Operation of the Council

a) Individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage shall not participate in the Council;

b) The Council operates according to the principle of democratic centralism, transparency, and secret ballot;

c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;

d) The Council considers the files, procedures, and processes of the Provincial Council; evaluates the reputation, professional skills, and influence of individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the standards prescribed in Article 7 or Article 8 of this Decree. Council members are responsible for studying the files, exchanging opinions, and discussing at the Council;

đ) The Sectoral Council at the Ministry Level only examines files submitted by the Provincial Council according to the procedures, processes, and files prescribed in Articles 13 and 14 of this Decree.

5. The Sectoral Council at the Ministry Level uses the seal of the Ministry of Culture, Sports and Tourism.

6. The specialized agency in charge of commendation and reward work within the Ministry of Culture, Sports and Tourism is the permanent office of the Sectoral Council at the Ministry Level.

7. The Sectoral Council at the Ministry Level has a Secretariat established by the Chairman of the Sectoral Council at the Ministry Level.

Article 12. National Council

1. The National Council is established by

2. The number of members of the National Council: from fifteen to nineteen members.

3. Composition of the Council

a) Chairman of the Council: The Minister of Culture, Sports and Tourism;

b) Vice-Chairperson of the Council: The Chairperson of the Sectoral Council at the Ministry Level; a representative of the Ministry of Home Affairs (Head of the Central Commendation and Reward Board);

c) Members of the Council: Representatives of the leadership: the Department of Culture and Arts under the Central Propaganda and Education Board; Central Associations of Literature and Art related to the field; some agencies related to the work of awarding the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage; the head of the specialized agency in charge of commendation and reward work within the Ministry of Culture, Sports and Tourism; reputable experts with deep knowledge about the field of intangible cultural heritage.

4. Principles of Operation of the Council

a) Individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage shall not participate in the Council;

b) The Council operates according to the principle of democratic centralism, transparency, and secret ballot;

c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;

d) The Council considers the files, procedures, and processes of the Sectoral Council at the Ministry Level; evaluates the reputation, professional skills, and influence of individuals with applications for awarding the titles "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the standards prescribed in Article 7 or Article 8 of this Decree. Council members are responsible for studying the files, exchanging opinions, and discussing at the Council;

đ) The National Council only examines files submitted by the Sectoral Council at the Ministry Level according to the procedures, processes, and files prescribed in Articles 13 and 15 of this Decree.

5. The Ministry of Culture, Sports and Tourism is the permanent office of the National Council.

6. The National Council uses the seal of the Ministry of Culture, Sports and Tourism.

7. The National Council has a Secretariat established by the Chairman of the National Council.

Chapter IV
APPLICATIONS, PROCEDURES, AND PROCESSES FOR PROPOSING AWARDS OF THE TITLES "PEOPLE'S ARTIST", "OUTSTANDING ARTIST" IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE
PEOPLE'S ARTISTS, OUTSTANDING ARTISTS IN THE FIELD OF INTANGIBLE CULTURAL HERITAGE
NON-MATERIAL HERITAGE

Article 13. Documents, methods for submitting documents, and agencies receiving applications for awarding the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage

Clause 1. The application documents for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage include:

Point a) Application form for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 1a or Model 1b attached as an appendix to this Decree;

Point b) Documents proving knowledge, skills, practices, teaching, protection, and promotion of the value of intangible cultural heritage, including tapes, discs, photos, descriptions of knowledge and skills currently possessed, or other related documents (if available);

Point c) Photocopies from original books or certified photocopies or photocopies with the original presented for verification (in case of direct submission of documents); photocopies from original books or certified photocopies (in case of submission through postal service or online) of decisions on commendations from certificates of merit and above (if available).

Clause 2. Individuals specified in Clause 1, Article 2 of this Decree may themselves or authorize in writing according to the provisions of the law another individual or organization to prepare the application documents for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage, and submit directly or through postal service or online one set of documents to the Department of Culture, Sports and Tourism or the Department of Culture and Sports where the individual resides.

Clause 3. In cases where the individual's application documents are not valid, need supplementation, or correction, the agency receiving the documents will guide the individual to complete the documents. Within seven days from the date of receiving the completed documents, the individual must resubmit the completed documents to the agency receiving them.

Article 14. Procedures and processes for awarding the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the provincial council

Clause 1. Publicize the list of individuals applying for the awarding of the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage on the provincial People's Committee's electronic portal or local newspaper for a period of fifteen days from the end date of the deadline for individuals to submit their application documents to solicit public opinion.

Clause 2. Receive and process public petitions within fifteen days from the end date of the public announcement of the list of individuals applying for the awarding of the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage on the provincial People's Committee's electronic portal or local newspaper.

Clause 3. Organize solicitation of opinions from the community where the individual applying for the awarding of the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage resides within thirty days from the date of the public announcement of the list on the provincial People's Committee's electronic portal or local newspaper.

Clause 4. Examine and evaluate each application document for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the provisions of Article 7 or Article 8 of this Decree within ten days from the date the standing body of the Council reports to seek opinions from Council members about the documents.

Clause 5. Within ten days from the end date of the meeting, the Council is responsible for notifying in writing the results of the awarding to the individual applying for the awarding of the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage.

Clause 6. Receive and process petitions within twenty days from the date of the Council's notification of the results of the awarding.

Clause 7. Within fifteen days from the end date of the petition receipt and processing period, complete the application documents for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage that have received at least seventy-five percent agreement from the community where the individual resides and at least eighty percent approval from the total number of Council members present at the meeting, and submit them to the standing body of the specialized ministry-level Council. The documents (one set) include:

Point a) Petition for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 2a or Model 2b attached as an appendix to this Decree;

Point b) Summary of achievements for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 3a or Model 3b attached as an appendix to this Decree;

Point c) Minutes of the Council meeting for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 4a or Model 4b attached as an appendix to this Decree;

Point d) Minutes of the voting record for awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 5a or Model 5b attached as an appendix to this Decree;

Point đ) Report on the process of awarding the title of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to Model 6a or Model 6b attached as an appendix to this Decree;

Point e) Minutes of the meeting to solicit opinions from the community where the individual resides according to Model 8 attached as an appendix to this Decree;

Point g) Documents specified in Clause 1, Article 13 of this Decree;

Point h) Decision on establishing the provincial council.

Clause 8. The time for organizing activities for awarding the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the provincial council shall not exceed ninety days.

Article 15. Procedures for awarding the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the Ministry-level specialized council

1. Publicize the list of individuals proposed for the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage on the Ministry of Culture, Sports and Tourism’s Official Website for a period of 15 days from the end date of the submission deadline set by the provincial council for receiving application files.

2. Receive and process public opinions within 15 days from the end date of the publicizing of the list of individuals proposed for the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage on the Ministry of Culture, Sports and Tourism’s Official Website.

3. Review and evaluate each application file for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the provisions of Article 7 or Article 8 of this Decree within 15 days from the date the permanent office of the council reports to seek opinions from council members regarding the application files.

4. Within 20 days from the end date of the meeting of the council, the permanent office shall be responsible for notifying in writing the results of the awarding of the titles of "People's Artist" and "Outstanding Artist" by the Ministry-level specialized council to the provincial council. Within 5 days from the date the provincial council receives the notification letter of the results from the Ministry-level specialized council, the permanent office of the provincial council shall be responsible for notifying in writing the individuals with application files proposed for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage.

5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.

6. Within 30 days from the end date of the receipt and processing of public opinions, complete the application files for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage that have received at least 80% approval votes from the total number of council members present at the meeting, and submit them to the permanent office of the state-level council. The file (one set) includes:

a) Documents stipulated in points a, b, c, d, đ, e, and g of Clause 7, Article 14 of this Decree;

b) Decision establishing the Ministry-level specialized council.

7. The time for organizing the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the Ministry-level specialized council shall not exceed 120 days.

Article 16. Procedures for awarding the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the State-level council

1. Publicize the list of individuals proposed for the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage on the Government Portal and the Ministry of Culture, Sports and Tourism’s Official Website for a period of 15 days from the end date of the submission deadline set by the Ministry-level specialized council for receiving application files to solicit public opinions.

2. Receive and process public opinions within 15 days from the end date of the publicizing of the list of individuals proposed for the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage on the Government Portal and the Ministry of Culture, Sports and Tourism’s Official Website.

3. Review and evaluate each application file for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage according to the provisions of Article 7 or Article 8 of this Decree within 15 days from the date the permanent office of the council reports to seek opinions from council members regarding the application files.

4. Within 20 days from the end date of the meeting of the council, the permanent office shall be responsible for notifying in writing the results of the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage by the State-level council to the provincial council. Within 5 days from the date the provincial council receives the notification letter of the results from the State-level council, the permanent office of the provincial council shall be responsible for notifying in writing the individuals with application files proposed for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage.

5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.

6. Within 30 days from the end date of the receipt and processing of public opinions, complete the application files for the awarding of the titles of "People's Artist" or "Outstanding Artist" in the field of intangible cultural heritage that have received at least 80% approval votes from the total number of council members present at the meeting, and submit them to the Ministry of Home Affairs (Central Board for Awards and Commendations) for consolidation and submission.

a) Documents stipulated in points a, b, c, d, đ, and e of Clause 7, Article 14 of this Decree;

b) Decision establishing the State Council.

7. The time for organizing the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage at the State-level council shall not exceed 120 days.

Chapter V
IMPLEMENTING PROVISIONS

Article 17. Effective Date

1. This Decree takes effect from February 15, 2024.

2. Decree No. 62/2014/NĐ-CP dated June 25, 2014 of the Government on the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage shall cease to be effective from the date this Decree takes effect.

Article 18. Responsibility for Implementation

1. The Ministry of Culture, Sports and Tourism shall be responsible for organizing the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.
