Guidelines on positions for civil servants in specialized foreign affairs professions within agencies and organizations under the foreign affairs sector

Circular No. 01/2023/TT-BNG dated March 30, 2023, issued by the Minister of Foreign Affairs, provides guidelines on positions for civil servants in specialized foreign affairs professions within agencies and organizations under the foreign affairs sector, which shall take effect from May 15, 2023, amended and supplemented by:

Circular No. 02/2025/TT-BNG dated June 13, 2025, issued by the Minister of Foreign Affairs, amending and supplementing certain provisions of Circular No. 01/2023/TT-BNG dated March 30, 2023, issued by the Minister of Foreign Affairs, providing guidelines on positions for civil servants in specialized foreign affairs professions within agencies and organizations under the foreign affairs sector, which shall take effect from July 29, 2025.

Pursuant to Decree No. 81/2022/NĐ-CP dated October 14, 2022, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

At the proposal of the Director of the Personnel Department;

The Minister of Foreign Affairs issues this Circular providing guidelines on positions for civil servants in specialized foreign affairs professions within agencies and organizations under the foreign affairs sector. [1]

Article 1. Scope of Regulation

This Circular guides the list of positions, job descriptions, and competency frameworks for positions of civil servants in specialized foreign affairs professions in agencies and organizations from central to district levels and Vietnamese representative offices abroad.

Article 2. Applicability

This Circular applies to administrative agencies and organizations under the foreign affairs sector from central to district levels, including:

1. Administrative agencies and organizations under the Ministry of Foreign Affairs.

2. Vietnamese representative offices abroad.

3. Specialized agencies performing advisory and assistance functions to provincial People's Committees in managing state affairs related to foreign affairs.

4. Specialized agencies performing advisory and assistance functions to district People's Committees in managing state affairs related to foreign affairs.

Article 3. Principles and bases for determining positions for civil servants in specialized foreign affairs professions

1. Positions for civil servants in specialized foreign affairs professions are determined based on the principles stipulated in Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government on positions and staffing of civil servants.

2. Bases for determining positions for civil servants in specialized foreign affairs professions are implemented according to the provisions of Clause 1, Article 4 of Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government on positions and staffing of civil servants.

Article 4. List, job descriptions, and competency frameworks for positions for civil servants in specialized foreign affairs professions

1. The list of positions for civil servants in specialized foreign affairs professions is specified in Appendix I attached hereto.

2[2]Job descriptions and competency frameworks for each position for civil servants in specialized foreign affairs professions are specified in Appendices II and III attached hereto.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Based on this Circular, the agencies and organizations listed in Article 2 shall develop their Position Plan and submit it to the agency or organization tasked with personnel organization for review and approval by the competent authority in accordance with the law.

2. In cases where the regulatory documents referred to in this Circular are changed, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 6. Transitional Provisions

In cases where civil servants currently hold a higher rank than the rank required for their position as stipulated in this Circular, they shall be retained until new guidelines on salary regulations are issued.

Article 7. Effectiveness and Responsibility for Implementation[3]

1[4]This Circular takes effect from May 15, 2023.

2. The Chairperson of the People's Committee of provinces and centrally governed cities; the Director of the Office, Heads of the Cadre and Civil Servant Organization Department, Heads of administrative agencies and organizations under the Ministry of Foreign Affairs, and the Heads of Vietnamese representative offices abroad are responsible for implementing the provisions of this Circular.

3. During the implementation process, if there are any difficulties, agencies and organizations shall report to the Ministry of Foreign Affairs for guidance and resolution.

[1] Circular No. 02/2025/TT-MFA is based on the following grounds for issuance:

"Pursuant to Decree No. 28/2025/ND-CP dated February 24, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

At the proposal of the Director of the Personnel Department;

The Minister of Foreign Affairs issues this Circular amending and supplementing certain articles of Circular No. 01/2023/TT-MFA dated March 30, 2023 of the Minister of Foreign Affairs guiding the positions of foreign affairs specialized civil servant posts in agencies and organizations within the foreign affairs sector."

[2] This Clause has been amended and supplemented according to Clause 1, Article 1 of Circular No. 02/2025/TT-MFA amending and supplementing certain articles of Circular No. 01/2023/TT-MFA dated March 30, 2023 of the Minister of Foreign Affairs guiding the positions of foreign affairs specialized civil servant posts in agencies and organizations within the foreign affairs sector, which takes effect from July 29, 2025.

[3] Article 2 of Circular No. 02/2025/TT-MFA amending and supplementing certain articles of Circular No. 01/2023/TT-MFA dated March 30, 2023 of the Minister of Foreign Affairs guiding the positions of foreign affairs specialized civil servant posts in agencies and organizations within the foreign affairs sector, which takes effect from July 29, 2025, is stipulated as follows:

"Article 2. Implementation Provisions

This Circular takes effect from July 29, 2025."

[4] This Clause has been amended and supplemented according to Clause 2, Article 1 of Circular No. 02/2025/TT-MFA amending and supplementing certain articles of Circular No. 01/2023/TT-MFA dated March 30, 2023 of the Minister of Foreign Affairs guiding the positions of foreign affairs specialized civil servant posts in agencies and organizations within the foreign affairs sector, which takes effect from July 29, 2025.
