CIRCULAR
Detailed guidance on certain provisions of the Livestock Law
Decree No. Decision No. 35/2025/NĐ-CP February 25, 2025 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
On the basis of Livestock Law dated November 19, 2018 amended and supplemented by Law Amending and Supplementing Certain Provisions of 15 Laws in the Agriculture and Environment Sector dated December 11, 2025;
At the proposal of the Director of the Livestock and Veterinary Administration;
The Minister of Agriculture and Rural Development issues this Circular providing detailed guidance on certain provisions of the Livestock Law.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular provides detailed guidance on Clauses 3, 4, 5, 6, 8, 11, 15, 16 and Point b Clause 19 Article 3 of the Law Amending and Supplementing Certain Provisions of 15 Laws in the Agriculture and Environment Sector.
Article 2. Applicability
This Circular applies to organizations and individuals in Vietnam and foreign organizations and individuals related to livestock breeding within the territory of Vietnam.
Article 3. General provisions on submission of applications
Applications may be submitted directly, through the electronic environment, or via postal services. Electronic applications shall be implemented in accordance with the Government's Decree No. 45/2020/NĐ-CP dated April 8, 2020 on implementing administrative procedures in the electronic environment.
Chapter II
LIVESTOCK BREED GENES, LIVESTOCK BREEDS, AND LIVESTOCK BREED PRODUCTS
Article 4. Procedures and formalities for approving international exchange of livestock breed genes listed in the prohibited export list for scientific research, exhibitions, and advertising; procedures and formalities for approving international exchange of rare and valuable Vietnamese livestock breed genes to third parties
1. Organizations and individuals wishing to engage in international exchange of livestock breed genes listed in the prohibited export list for scientific research, exhibitions, and advertising; or exchange of rare and valuable Vietnamese livestock breed genes to third parties shall submit one set of application documents to the Livestock and Veterinary Administration.
2. Application documents for approval of international exchange of livestock breed genes listed in the prohibited export list for scientific research, exhibitions, and advertising include:
a) Exchange registration form and gene history of the livestock breed according to Model No. 01 attached as Appendix I to this Circular;
b) Cooperation agreement for scientific research, exhibitions, and advertising on livestock breeds listed in the prohibited export list for scientific research, exhibitions, and advertising;
c) Other relevant documents concerning the exchange of livestock breed genes listed in the prohibited export list (if any).
3. Application documents for approval of exchange of rare and valuable Vietnamese livestock breed genes to third parties include:
a) Exchange registration form and gene history of rare and valuable livestock breeds according to Model No. 02 attached as Appendix I to this Circular;
b) Relevant documents concerning the exchange of rare and valuable livestock breed genes (if any).
4. Procedures and formalities:
The Livestock and Veterinary Administration will immediately respond regarding the completeness of the application documents for cases where organizations and individuals submit them directly; respond regarding the completeness of the application documents within three working days from the date of receipt of the application documents submitted through the electronic environment or via postal services in writing.
Within twelve working days from the date of receipt of valid application documents, the Livestock and Veterinary Administration will organize an assessment and report to the Minister of Agriculture and Rural Development for consideration and decision.
Within three working days from the date of receipt of the Livestock and Veterinary Administration's report, the Minister of Agriculture and Rural Development will decide on the approval of international exchange of livestock breed genes listed in the prohibited export list for scientific research, exhibitions, and advertising; approval of exchange of rare and valuable Vietnamese livestock breed genes to third parties; in case of disapproval, a written response with reasons will be provided.
Article 5. List of Livestock Breeds to be Preserved
1. Livestock breeds included in the List of Livestock Breeds to be Preserved must meet one of the following criteria:
a) Having a small number of individuals or bloodline groups leading to a high risk of inbreeding;
b) Experiencing a reduction of at least 50% in the number of individuals observed or estimated over the last five years up to the evaluation time or forecasted to decrease by at least 50% in the next five years.
2. The List of Livestock Breeds to be Preserved is specified in Appendix II issued together with this Circular.
3. Updating the List of Livestock Breeds to be Preserved is regulated in Article 7 of this Circular.
Article 6. List of Livestock Breeds Prohibited from Export
1. Livestock breeds included in the List of Livestock Breeds Prohibited from Export must meet the following criteria:
a) Native livestock breeds carrying valuable and rare genetic resources;
b) Possessing unique and endemic characteristics of Vietnam.
2. The List of Livestock Breeds Prohibited from Export is specified in Appendix II issued together with this Circular.
3. Updating the List of Livestock Breeds Prohibited from Export is regulated in Article 7 of this Circular.
Article 7. Procedures and Formalities for Updating the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export
1. Annually, the Livestock and Veterinary Service conducts reviews and prepares files to update the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export.
2. The documents shall include:
a) Results of reviews and assessments regarding the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export;
b) Applications from organizations or individuals proposing to include or exclude livestock breeds from the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export (if applicable);
c) Information on the breed name and distribution location of the proposed livestock breeds to be included or excluded from the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export;
d) Explanation of the necessity of including or excluding livestock breeds from the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export.
3. The Livestock and Veterinary Service establishes a Review Board for updating the List of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export. The board consists of representatives from the Livestock and Veterinary Service, relevant agencies and units, and specialized experts.
4. Based on the Review Board's assessment results, the Livestock and Veterinary Service considers, decides, and submits to the Minister of Agriculture and Rural Development for issuance of the revised and supplemented Lists of Livestock Breeds to be Preserved and the List of Livestock Breeds Prohibited from Export.
Article 8. Procedures and Formalities for Importing Male Breeding Stock, Semen, and Embryos of Livestock
1. The application package includes:
a) Application for importing male breeding stock, semen, and embryos of livestock according to Model No. 03a in Appendix I issued together with this Circular.
b) Pedigree of imported male breeding stock, semen, and embryos of livestock according to Model No. 03b in Appendix I issued together with this Circular.
c) A document from the competent authority or organization authorized by the exporting country's competent authority confirming the origin, quality, and purpose of use of the breeding stock, semen, and embryos: The document is the original (paper or electronic version) and a Vietnamese translation certified by the importing entity.
2. Procedures and formalities:
a) Organizations or individuals importing male breeding stock, semen, and embryos of livestock submit one set of application documents to the Livestock and Veterinary Service.
The Livestock and Veterinary Administration will immediately respond regarding the completeness of the application documents for cases where organizations and individuals submit them directly; respond regarding the completeness of the application documents within three working days from the date of receipt of the application documents submitted through the electronic environment or via postal services in writing.
Within ten working days from the date of receiving valid application documents, the Livestock and Veterinary Service responds in writing; if rejected, the reasons must be clearly stated.
b) Organizations or individuals importing semen and embryos of livestock from the same individual for the second time onwards only need to notify in writing to the Livestock and Veterinary Service. The notification letter specifies the quantity and production year of semen and embryos of each individual breeding stock expected to be imported according to Model No. 04 in Appendix I issued together with this Circular.
c) Organizations or individuals importing male breeding stock from the same breed and production facility for the second time onwards only need to notify in writing to the Livestock and Veterinary Service. The notification letter specifies the quantity, birth year, and pedigree of each male breeding stock expected to be imported according to Model No. 04 in Appendix I issued together with this Circular.
Article 9. Procedures for registering the export or international exchange of livestock breeds or livestock breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising purposes.
1. The application package includes:
a) Application for registering the export or international exchange of livestock breeds or livestock breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising purposes according to Model No. 05a in Appendix I issued together with this Circular.
Pedigree of the livestock breeds or livestock breeding products for export or international exchange listed in the prohibited export list for scientific research, exhibitions, and advertising purposes according to Model No. 05b in Appendix I issued together with this Circular.
b) Original or certified copy of the cooperation agreement for scientific research, exhibitions, and advertising on livestock breeds or livestock breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising purposes.
c) Other relevant documents: Description of the scientific research, exhibition, and advertising tasks; Approval document from the importing country or the country exchanging livestock breeds or livestock breeding products.
2. Procedures and formalities:
Organizations or individuals exporting or engaging in international exchanges of livestock breeds or livestock breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising purposes shall submit one set of application documents to the Livestock Production and Animal Health Department.
The Livestock Production and Animal Health Department will immediately respond regarding the completeness of the application documents for cases submitted directly; respond regarding the completeness of the application documents within three working days from the date of receipt of the application documents for cases submitted through the online environment or via postal service in writing.
Within fifteen working days from the date of receiving valid application documents, the Livestock Production and Animal Health Department will examine and decide on the export or international exchange of livestock breeds or livestock breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising purposes in writing; in case of refusal, the reasons must be clearly stated.
Article 10. Content, location, time, and methods of testing livestock breeds or strains
1. Content of Testing
Monitoring specific livestock breeds or strains under certain conditions and over a specified period to determine their distinctiveness, stability, uniformity in productivity, quality, disease resistance, and assess the impact of these breeds or strains.
2. Location of Testing
The testing facility for livestock breeds or strains must meet the requirements stipulated in Article 27 of the Livestock Production Law.
3. Time of Testing
The duration of testing is determined specifically based on each type of livestock and the purpose of testing the breeds or strains, as reflected in the Testing Plan for Livestock Breeds or Strains.
4. Methods of Testing
The testing methods for livestock breeds or strains must be appropriate for each type of livestock being tested and are reflected in the Testing Plan for Livestock Breeds or Strains. The breeding process for tested livestock must ensure biosafety and disease prevention.
Article 11. Procedures and formalities for testing livestock breeds and strains
1. Review and approval of the testing outline
a) The file includes:
The application for testing livestock breeds and strains according to Model No. 06 in Appendix I issued together with this Circular; the testing outline for livestock breeds and strains according to Model No. 07a and the breeding procedure according to Model No. 07b in Appendix I issued together with this Circular.
b) Procedure and formalities:
Organizations and individuals registering for testing livestock breeds and strains submit one set of documents according to point a of this clause to the Livestock Production and Veterinary Administration.
The Livestock and Veterinary Administration will immediately respond regarding the completeness of the application documents for cases where organizations and individuals submit them directly; respond regarding the completeness of the application documents within three working days from the date of receipt of the application documents submitted through the electronic environment or via postal services in writing.
Within 15 (fifteen) working days from the date of receipt of valid documents, the Livestock Production and Veterinary Administration establishes an Evaluation Board for the testing outline. The board consists of representatives from the Livestock Production and Veterinary Administration, relevant agencies and units, and subject experts. The board is responsible for reviewing the documents and assessing the conditions of the testing facility as stated in the outline.
Within 5 (five) working days from the date of receipt of completed documents according to the Evaluation Board's opinion, the Livestock Production and Veterinary Administration examines and approves the testing outline for livestock breeds and strains according to Model No. 08 in Appendix I issued together with this Circular; in case of non-approval, it responds in writing and clearly states the reasons.
2. The Livestock Production and Veterinary Administration conducts one inspection during the testing process according to the approved outline.
3. Recognition of testing results for livestock breeds and strains
a) The file includes:
The application for recognition of testing results for livestock breeds and strains according to Model No. 10 in Appendix I issued together with this Circular;
The report on testing results according to Model No. 09 in Appendix I issued together with this Circular;
Other related documents: origin documentation for tested livestock breeds and strains, technical monitoring records.
b) Procedure and formalities:
Organizations and individuals applying for recognition of testing results for livestock breeds and strains submit one set of documents according to the provisions at point a of this clause to the Livestock Production and Veterinary Administration.
The Livestock Production and Veterinary Administration immediately responds to the completeness of the documents for organizations and individuals submitting directly; responds to the completeness of the documents within 3 (three) working days from the date of receipt of the documents for organizations and individuals submitting through the online environment or postal service in writing.
Within 15 (fifteen) working days from the date of receipt of valid documents, the Livestock Production and Veterinary Administration establishes an Evaluation Board for recognizing the testing results of livestock breeds and strains. The board consists of representatives from the Livestock Production and Veterinary Administration, relevant agencies and units, and subject experts.
Within 5 (five) working days from the date of receipt of completed documents according to the Evaluation Board's opinion on recognizing the testing results of livestock breeds and strains, the Livestock Production and Veterinary Administration examines and recognizes the testing results according to Model No. 11 in Appendix I issued together with this Circular; in case of non-recognition, it responds in writing and clearly states the reasons.
Article 12. Procedures and formalities for recognizing new livestock breeds and strains
1. In cases where new livestock breeds and strains are created from recognized national-level scientific and technological tasks, they do not follow the procedures and formalities stipulated in clauses 2 and 3 of this Article.
2. For cases where new livestock breeds and strains have recognized testing results.
Organizations and individuals submit applications for recognizing new livestock breeds and strains to the Livestock Production and Veterinary Administration according to Model No. 12 in Appendix I issued together with this Circular.
After receiving the application from organizations and individuals, within 5 (five) working days, the Livestock Production and Veterinary Administration submits to the Minister of Agriculture and Rural Development for recognition of new livestock breeds and strains according to Model No. 15 in Appendix I issued together with this Circular; in case of non-recognition, it responds in writing and clearly states the reasons.
3. For cases where new livestock breeds and strains are the result of research and selection by organizations and individuals.
The Livestock Production and Veterinary Administration collaborates with the Science and Technology Department to recognize new livestock breeds and strains with the following contents:
a) Components of the application forms:
The application for recognizing new livestock breeds and strains according to Model No. 12 in Appendix I issued together with this Circular;
The explanation of research and selection of new livestock breeds and strains by organizations and individuals according to Model No. 13 in Appendix I issued together with this Circular; the breeding procedure according to Model No. 07b in Appendix I issued together with this Circular;
The report on research and selection results of new livestock breeds and strains by organizations and individuals according to Model No. 14 in Appendix I issued together with this Circular.
b) Procedure and formalities:
Organizations and individuals applying for recognition of new livestock breeds and strains submit one set of documents according to the provisions at point a of clause 2 of this Article to the Livestock Production and Veterinary Administration.
The Livestock Production and Animal Health Department will immediately respond regarding the completeness of the application documents for cases submitted directly; respond regarding the completeness of the application documents within three working days from the date of receipt of the application documents for cases submitted through the online environment or via postal service in writing.
Within 10 (ten) working days from the date of receipt of valid documents, the Livestock Production and Veterinary Administration submits to the Ministry of Agriculture and Rural Development for establishing an Evaluation Board to assess the scientific and technological tasks of organizations and individuals to recognize new livestock breeds and strains. The board includes representatives from the Livestock Production and Veterinary Administration, the Science and Technology Department, relevant agencies and units, and subject experts.
Within 5 (five) working days from the date of receipt of completed documents according to the Evaluation Board's opinion, the Livestock Production and Veterinary Administration examines and submits to the Minister of Agriculture and Rural Development for recognition of new livestock breeds and strains according to Model No. 15 in Appendix I issued together with this Circular; in case of non-recognition, it responds in writing and clearly states the reasons.
Chapter III
FEED TESTING
Article 13. Content, location, time, and method of feed testing for livestock
1. Content of feed testing for livestock
a) Evaluation of feed quality for livestock: Evaluation of product quality through sensory analysis, physical analysis, and chemical analysis;
b) Evaluation of toxicity and safety for animals and the environment: Evaluation based on safety criteria analysis;
c) Evaluation of the direct impact of feed for livestock on animals: Evaluation of the impact of tested feed on animals according to factors such as breed, age, body weight, growth stage, reproductive stage; evaluation of residues and quality of livestock products produced by animals.
2. Location of feed testing for livestock
The feed testing facility must meet the conditions stipulated in Clause 3, Article 37 of the Livestock Law.
3. Time of Testing
The testing period is determined specifically for each type of feed for livestock and the purpose of feed testing, as shown in the Feed Testing Outline.
4. Method of feed testing for livestock
The method of feed testing for livestock must be appropriate for each type of tested feed and reflected in the Feed Testing Outline.
Article 14. Procedure and process for registering feed testing and recognizing test results for feed for livestock
1. Registration of feed testing for livestock
a) Components of the application forms:
The application for feed testing for livestock according to Form No. 01 Appendix III issued together with this Circular; the outline of feed testing for livestock according to Form No. 08.TACN Appendix I issued together with Decree No. 13/2020/NĐ-CP dated January 21, 2020 of the Government guiding the detailed implementation of the Livestock Law; a description of the conditions of the facility conducting feed testing for livestock according to the criteria stipulated in Clause 3, Article 37 of the Livestock Law and the breeding procedures according to Form No. 07b Appendix I issued together with this Circular.
b) Procedure and formalities:
Organizations and individuals applying for feed testing for livestock submit one set of documents to the Livestock and Veterinary Administration.
The Livestock and Veterinary Administration responds immediately to the completeness of the documents for cases submitted directly; responds to the completeness of the documents within three working days from the date of receipt of the documents for cases submitted via the online environment or through postal services in writing.
Within 15 (fifteen) working days from the date of receipt of valid documents, the Livestock Production and Veterinary Administration establishes an Evaluation Board for the testing outline. The board consists of representatives from the Livestock Production and Veterinary Administration, relevant agencies and units, and subject experts. The board is responsible for reviewing the documents and assessing the conditions of the testing facility as stated in the outline.
Within five working days from the date of receiving the completed documents according to the opinion of the Council reviewing the outline of feed testing for livestock, the Livestock and Veterinary Administration considers and issues a Decision approving the outline of feed testing for livestock according to Form No. 02 Appendix III issued together with this Circular; in case of not approving the outline of feed testing, the Livestock and Veterinary Administration must respond in writing and specify the reasons.
2. The Livestock Production and Veterinary Administration conducts one inspection during the testing process according to the approved outline.
3. Recognition of feed testing results
a) Components of the application forms:
The application for recognition of feed testing results according to Form No. 03 Appendix III issued together with this Circular; the report on the results of feed testing according to Form No. 04 Appendix III issued together with this Circular.
b) Procedure and formalities:
Organizations and individuals applying for recognition of feed testing results submit one set of documents to the Livestock and Veterinary Administration.
The Livestock and Veterinary Administration responds immediately to the completeness of the documents for cases submitted directly; responds to the completeness of the documents within three working days from the date of receipt of the documents for cases submitted via the online environment or through postal services in writing.
Within fifteen working days from the date of receiving valid documents, the Livestock and Veterinary Administration establishes a Council to evaluate the results of feed testing for livestock. The Council includes representatives of the Livestock and Veterinary Administration, relevant agencies and units, and specialized experts.
Within five working days from the date of receiving the completed documents according to the opinion of the Council evaluating the results of feed testing for livestock, the Livestock and Veterinary Administration considers and issues a Decision recognizing the results of feed testing for livestock according to Form No. 05 Appendix III issued together with this Circular; in case of not recognizing the results of feed testing for livestock, the Livestock and Veterinary Administration must respond in writing and specify the reasons.
Recognized testing results serve as the basis for inclusion in the list of permitted raw materials for use as feed for livestock.
Chapter IV
REGULATIONS ON SCALE OF LIVESTOCK, DENSITY OF LIVESTOCK, AND LIST OF OTHER PERMITTED ANIMALS FOR LIVESTOCK
Article 15. Scale of Livestock Raising
1. The scale of livestock raising is determined by the number of livestock units at the same time for the types of livestock specified in Appendix IV issued together with this Circular.
2. The scale of livestock raising is defined as follows:
a) Large-scale farm livestock raising: 300 livestock units or more;
b) Medium-scale farm livestock raising: From 30 to less than 300 livestock units;
c) Small-scale farm livestock raising: From 10 to less than 30 livestock units;
d) Household livestock raising: Less than 10 livestock units.
3. The livestock unit coefficient is defined as follows:
a) The livestock unit coefficient serves as the basis for converting the quantity of livestock into livestock units;
b) The livestock unit coefficient and the formula for converting the quantity of livestock into livestock units are specified in Appendix IV issued together with this Circular.
Article 16. Density of Livestock Raising
1. The provinces and centrally governed cities shall be divided into regions as follows to determine the density of livestock raising:
a) The Northern Midland and Mountainous Region includes nine provinces: Lang Son, Cao Bang, Thai Nguyen, Tuyen Quang, Phu Tho, Lao Cai, Lai Chau, Dien Bien, Son La;
b) The Red River Delta Region includes six provinces and cities: Hanoi, Hai Phong, Ninh Binh, Hung Yen, Bac Ninh, Quang Ninh;
c) The North Central Coast Region includes five provinces and cities: Thanh Hoa, Nghe An, Ha Tinh, Quang Tri, Hue;
d) The South Central Coast and Central Highlands Region includes six provinces and cities: Da Nang, Quang Ngai, Gia Lai, Dak Lak, Khanh Hoa, Lam Dong;
đ) The Southeast Region includes three provinces and cities: Ho Chi Minh City, Dong Nai, Tay Ninh;
e) The Mekong Delta Region includes five provinces and cities: Can Tho, Vinh Long, Dong Thap, An Giang, Ca Mau.
2. The livestock raising density applicable to localities within each region is specified in Appendix V issued together with this Circular.
Article 17. List of Other Animals Permitted for Livestock Raising
1. The list of other animals permitted for livestock raising is specified in Appendix VI issued together with this Circular.
2. Periodically every two years or when there is a written request from organizations or individuals, the Department of Livestock Production and Animal Health will review and assess and submit to the Minister of Agriculture and Rural Development for decision on amending and supplementing the list of other animals permitted for livestock raising.
Chapter V
IMPLEMENTING PROVISIONS
Article 18. Effective Date
1. This Circular takes effect from January 1, 2026.
2. This Circular abolishes:
a) Article 4, Article 5, Article 6 of Circular No. 22/2019/TT-BNNPTNT dated November 30, 2019 of the Ministry of Agriculture and Rural Development guiding certain provisions of the Livestock Law on the management of livestock breeds and breeding products;
b) Clause 2, Article 1 of Circular No. 21/2024/TT-BNNPTNT dated December 11, 2024 of the Minister of Agriculture and Rural Development amending and supplementing certain provisions of Circular No. 22/2019/TT-BNNPTNT dated November 30, 2019 of the Minister of Agriculture and Rural Development guiding certain provisions of the Livestock Law on the management of livestock breeds and breeding products;

Article 19. Transitional Provisions
1. International exchange approval documents for genetic resources of livestock breeds listed in the prohibited export list for scientific research, exhibitions, advertising, and international exchange of rare and valuable genetic resources of Vietnam; Export approval documents or international exchange approval documents for livestock breeds and breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising; Approval documents for importing male breeding stock, semen, and embryo breeding stock of livestock that were approved by competent authorities before the effective date of this Circular shall continue to be implemented until their validity period expires.
2. Administrative procedures' files that have been accepted by competent authorities before the effective date of this Circular shall continue to be processed according to the legal regulations in effect at the time of file acceptance.
Article 20. Responsibility for Implementation
The Director of the Department of Livestock Production and Animal Health, heads of relevant units, organizations, and individuals are responsible for implementing this Circular.
In the course of implementation, if there are difficulties or obstacles, please report to the Ministry of Agriculture and Environment for consideration and amendment.
