 PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 57/2010/QH12 of the National Assembly on the results of supervision of administrative procedure reform in certain fields directly related to citizens and businesses under the overall program for administrative reform of the State for the period 2001-2010;

Pursuant to Resolution No. 02/NQ-CP dated January 9, 2011 of the Government on measures to guide and manage the implementation of the socio-economic development plan and state budget estimate;

Considering the proposal of the Minister, Chairman of the Government Office,

Pursuant to …;

Article 1. Assign ministries, ministerial-level agencies, institutions: Vietnam Development Bank, Vietnam Social Policy Bank, Vietnam Social Security, People's Committees of provinces and centrally governed cities to perform the following tasks:

1. Regularly review regulations and administrative procedures that are obstacles to national and local socio-economic development according to criteria of necessity, rationality, legality, and effectiveness; promptly amend or supplement these regulations within their authority or propose higher authorities to amend or supplement relevant legal documents to improve the legal system to meet the requirements of administrative procedure reform; comprehensively study all aspects to issue comprehensive and specific policies, standards, technical norms, economic quotas tied to the handling of administrative procedures across all socio-economic fields, creating a transparent legal framework for organizations and individuals to follow.

2. Implement Decree No. 63/2010/ND-CP dated June 8, 2010 of the Government on administrative procedure control and Decree No. 20/2008/ND-CP dated February 14, 2008 of the Government on receiving and processing complaints and suggestions from individuals and organizations regarding administrative regulations related to business operations and people's lives to ensure strict control over administrative procedures from the drafting stage to actual implementation, while enhancing discipline and order in handling administrative procedures for individuals and organizations.

3. Strengthen the organization of the Administrative Procedure Control Department and establish a system of focal points at departments, bureaus, provincial-level departments, district-level People's Committees, and commune-level People's Committees in accordance with Circular Joint No. 01/2011/TTLT-VPCP-BNV. Emphasize training and capacity building to enhance professional skills, sense of responsibility, and ethical conduct of civil servants involved in policy formulation and administrative procedure handling for individuals and organizations; ensure timely, complete, and detailed public disclosure of administrative procedure regulations to facilitate access, implementation, and oversight by individuals and organizations.

4. Intensify inspection and supervision of administrative procedure implementation at all levels of government; strictly and promptly deal with civil servants and employees who engage in corruption, fail to comply with or improperly execute administrative procedure regulations, and organizations that do not seriously disclose administrative procedures in a transparent manner when handling matters for individuals and organizations, as well as delays in amending unnecessary, unreasonable, illegal, and ineffective administrative procedure regulations according to directives from state agencies and authorized persons.

5. Maintain and utilize the national database on administrative procedures on the Internet at www.thutuchanhchinh.vn in management and provision of public services to individuals and organizations through regular updates, sharing, and exploitation of information in accordance with guidelines from the Government Office. Ministries, sectors, and localities shall not establish separate databases on administrative procedures within their functional management scope, which would lead to unnecessary waste and costs.

6. Timely allocate sufficient funds for administrative procedure control activities and for receiving and processing complaints and suggestions from individuals and organizations regarding administrative regulations in accordance with Decree No. 63/2010/ND-CP and Decree No. 20/2008/ND-CP.

7. Include the results of administrative procedure reform as one of the annual performance appraisal and award criteria for individuals and units; as one of the criteria for promotion and appointment of leaders at various levels and for evaluating the performance of heads of state agencies.

8. Ministries, ministerial-level agencies, institutions: Vietnam Development Bank, Vietnam Social Policy Bank, Vietnam Social Security concentrate resources to complete the execution of simplified administrative procedure schemes approved by the Government in resolutions on simplifying administrative procedures within their functional management scope in accordance with Government directives,

9. People's Committees of provinces and centrally governed cities organize the final execution of simplified administrative procedure schemes approved within their authority; at the same time, based on central-level regulatory documents issued by relevant agencies, they shall implement simplified administrative procedure schemes approved by the Government in resolutions on simplifying administrative procedures within the functional management scope of ministries and sectors, promptly amending, supplementing, replacing, or abolishing related provisions to ensure immediate implementation upon the effectiveness of the aforementioned central-level documents.

Article 2. The Ministries of Planning and Investment, Science and Technology, Home Affairs, Finance, Natural Resources and Environment, Information and Communications, Construction, and the Government Office, in addition to performing the tasks specified in Article 1 of this Decision, have the responsibility to perform the following specific tasks:

1. The Ministry of Planning and Investment:

a) Allocate capital for the construction of material infrastructure and equipment in state agencies in accordance with current regulations to ensure the implementation of administrative procedure reform in certain areas related to citizens and businesses;

b) Mobilize international resources to serve administrative reform and administrative procedure reform.

2. The Ministry of Science and Technology shall take the lead and coordinate with relevant ministries, sectors, and localities to effectively implement the application of the ISO 9001:2000 quality management system in the activities of state administrative agencies in accordance with the Government's and Prime Minister's directives.

3. Ministry of Home Affairs

a) Take the lead and coordinate with relevant ministries, sectors, and localities to study and effectively implement the single-window mechanism and the interlinked single-window mechanism at ministries, sectors, and localities in accordance with the Government's directives,

b) Study to fundamentally reform the salary system, ensuring that the state budget expenditure on salaries is truly an investment factor for development and a driving force for development. Organize the effective implementation of the Civil Servant Law and detailed and guiding regulations;

c) Coordinate with the Ministry of Finance to allocate funds for administrative reform activities, especially administrative procedure reform.

4. The Ministry of Finance

a) Study the recommendations regarding tax and customs matters mentioned in Report No. 378/BC-UBTVQH12 dated October 18, 2010, of the Standing Committee of the National Assembly to implement and apply them;

b) Ensure sufficient and timely funding to accelerate administrative reform work, particularly administrative procedure reform related to business organization and operation and people's livelihood.

5. The Ministry of Natural Resources and Environment

Study the recommendations regarding land matters mentioned in Report No. 378/BC-UBTVQH12 dated October 18, 2010, of the Standing Committee of the National Assembly to implement and apply them.

7. Provincial People's Committees

a) Take the lead and coordinate with relevant ministries, sectors, and localities to study, develop mechanisms and policies, and implement the application of information technology in handling administrative procedures at state agencies, focusing on leveraging the results of administrative procedure reform;

b) Take the lead and coordinate with the Office of the Government to direct and guide news agencies and press organizations to participate in supporting communication efforts to effectively attract active and positive participation from individuals and organizations in monitoring administrative procedures and receiving and processing complaints and suggestions about administrative regulations;

7. Ministry of Construction

Study the recommendations regarding housing and housing construction matters mentioned in Report No. 378/BC-UBTVQH12 dated October 18, 2010, of the Standing Committee of the National Assembly to implement and apply them.

8. The Office of the Government

a) Draft and issue Circulars guiding the methodology for impact assessment, review, and calculation of compliance costs for administrative procedures based on criteria of necessity, rationality, legality, and effectiveness. Ministries, sectors, and localities shall conduct impact assessments of administrative procedures stipulated in draft regulatory documents according to the temporary guidance of the Office of the Government until this Circular takes effect;

b) Take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to draft and issue joint Circulars providing detailed guidelines on the subjects, forms, standards, and monetary rewards for implementing administrative procedure control and receiving and processing complaints and suggestions from individuals and organizations regarding administrative regulations as prescribed in Decree No. 63/2010/NĐ-CP and Decree No. 20/2008/NĐ-CP.

Article 3. Relevant agencies: Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency, the Government's electronic portal, and other news agencies and press organizations have the responsibility to allocate resources and dedicate appropriate time to inform and publicize to citizens, businesses, and the entire society about the content and progress and results of implementing Decree No. 63/2010/NĐ-CP and Decree No. 20/2008/NĐ-CP at ministries, sectors, and localities; highlight exemplary civil servants, individuals, and organizations who have innovative ideas for administrative procedure reform and are dedicated to serving the people.

Article 5. Ministries, sectors, and localities shall regularly report to the Office of the Government every quarter (before the 15th day of the last month of each quarter) on their evaluation and accountability in implementing assigned administrative procedure reform tasks under this Decision so that the Office of the Government can compile and report to the Government and Prime Minister and include the content in the annual report to the National Assembly.

The Office of the Government assists the Prime Minister in overseeing, urging, and inspecting ministries, sectors, and localities in implementing this Decision; compiling and reporting the situation regularly every quarter to the Government and Prime Minister.

Article 6. This Decision takes effect from the date of issuance.

Ministers, Heads of ministerial-level agencies, Heads of the following agencies: Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency, Vietnam Development Bank, Vietnam Social Policy Bank, Vietnam Social Security, Chairmen of People's Committees of provinces and centrally-administered cities, and related agencies are responsible for implementing this Decision./.
