OF THE GOVERNMENT DECREE NO. 95/CP DATED AUGUST 27, 1994 ON THE COLLECTION OF A PORTION OF HOSPITAL FEES
TO COLLECT A PORTION OF HOSPITAL FEES
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister of Health,
DECREE:
Article 1
Medical establishments under the state health system are permitted to collect a portion of hospital fees to increase funding for ensuring the quality of medical examinations and treatments for the people.
Article 2
A portion of hospital fees is a part of the cost for medical examination and treatment services charged on a service-by-service basis for outpatients and on a daily bed rate basis for inpatients.
Article 3
1- Persons required to pay a portion of hospital fees:
a) Persons without a Health Insurance card and not falling within the category exempt from paying a portion of hospital fees;
b) Persons with a Health Insurance card but wishing to receive medical examination and treatment services according to their own requirements.
2- Persons exempt from paying a portion of hospital fees:
a) Disabled persons, orphaned children, and elderly persons without support;
b) Children under six years old;
c) Persons suffering from schizophrenia, epilepsy, leprosy, pulmonary tuberculosis with positive bacilli;
d) Patients residing in communes recognized as mountainous areas by the Committee for Ethnic Minorities and Mountainous Areas;
e) Ethnic minorities engaged in land reclamation and economic new zones for three years from the date of arrival;
g) Patients who are extremely poor.
3- Persons holding a Health Insurance card shall be reimbursed a portion of hospital fees by the Health Insurance agency for medical establishments.
4- Policy beneficiaries receiving monthly allowances shall have the State allocate funds for the Department of Labor, Invalids, and Social Affairs to directly purchase Health Insurance cards for them.
Article 4
Medical establishments have the responsibility to ensure essential medicines, blood, intravenous fluids, chemicals, and consumables according to the list prescribed by the Ministry of Health, and shall not allow patients to purchase these items themselves.
Article 5
1- The Government assigns the Ministry of Health, the Ministry of Finance, and the Government Price Control Board to establish a framework for the portion of hospital fees. Based on the inter-ministerial framework, the Chairman of the People's Committees at provincial and centrally-administered city levels shall set the portion of hospital fees for medical establishments under local management, while the Minister of Health shall set the portion of hospital fees for medical establishments under central ministry management.
2- The fee schedule for the portion of hospital fees shall be calculated based on service charges for outpatients and daily bed rates for inpatients.
Article 6
1- Revenue from the collection of a portion of hospital fees constitutes a source of income for the State budget, to be used as follows:
- 85% shall be used by the medical establishment that collected the hospital fees to supplement funding for purchasing medicines, blood, intravenous fluids, chemicals, X-ray films, supplies, equipment, and medical instruments to serve patient needs promptly.
- 15% shall be allocated for rewarding staff members who demonstrate high responsibility towards patients and successfully complete their professional tasks.
2- The revenue and expenditure stipulated in Clause 1 of this Article must be recorded through the State budget. However, this expenditure shall not be deducted from the annual budget allocation provided by the State budget for the health sector.
3- Receipts and invoices for the collection of a portion of hospital fees must follow the model issued by the Ministry of Finance. All revenues must be handled by the Financial and Accounting Office of the medical establishment. Quarterly and annually, medical establishments must settle accounts for hospital fees with their supervisory bodies and financial counterparts in accordance with the accounting period.

Any person violating the provisions of this Decree shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the severity of the violation.
Article 8
This Decree takes effect from the date of issuance and replaces Decision No. 45-HĐBT dated April 24, 1989 of the Council of Ministers on the collection of a portion of hospital fees.
Article 9
The Minister of Health, the Minister of Finance, the Minister of Labor, Invalids, and Social Affairs, and the Director of the Government Price Control Board are responsible for guiding and organizing the implementation of this Decree.
Article 10
Ministers, Heads of ministerial-level agencies, and Chairpersons of provincial and centrally-administered city People's Committees are responsible for enforcing this Decree.
