DECREE
NUMBER 95/SL ON AUGUST 13, 1949
OF THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
CHAIRMAN
SOCIALIST REPUBLIC OF VIETNAM
Pursuant to Decree No. 226 dated November 28, 1946 organizing the Ministry of Labor;
Pursuant to Article 184 of Decree No. 29-SL dated March 12, 1947 regarding the establishment of the Inspectorate and Labor Supervision branches;
Pursuant to Decree No. 169-SL dated April 14, 1948 reorganizing labor agencies throughout Vietnam;
At the proposal of the Minister of Labor;
In accordance with the resolution of the Council of Ministers after consultation with the Standing Committee of the National Assembly;
ISSUES THE DECREE:
Article 1- Now establish two branches: Labor Inspection and Labor Supervision.
Article 2- The Labor Inspector has the following duties:
a) To study working conditions of workers, recruitment conditions, and distribution of manpower;
b) To enforce and supervise the enforcement of labor laws;
c) To conduct investigations aimed at protecting workers' rights;
d) To mediate disputes arising between employers or management and workers;
e) When requested by workers, to represent them in litigation or be represented in any case related to the implementation of labor laws;
f) To propose reforms to labor laws;
g) To direct labor supervision activities.
Article 3- The Labor Inspector has the authority:
a) To enter workplaces for inspection and investigation purposes after notifying the employer or person in charge of the premises in advance;
b) To record violations of existing labor laws.
Article 4- The duties and powers of labor supervisors are defined according to Clauses b, c, d, f of Article 2 and Clauses a, b of Article 3.
Article 5- Labor Inspectors and Labor Supervisors shall be appointed by a decree of the Minister of Labor.
Article 6- The enforcement and supervision of the enforcement of labor laws in defense-related private enterprises shall be carried out by Labor Inspectors and Labor Supervisors nominated by the Ministry of Defense and appointed by the Minister of Labor.
, Clause 1, Clause 2 Article 7a of this Regulation.- Labor Inspectors and Labor Supervisors must take an oath not to disclose manufacturing secrets and professional organizational methods that they become aware of while performing their duties.
Any official who fails to keep the oath shall be punished with imprisonment from one month to one year and a fine of 1,000 to 10,000 dong. Additionally, they may also be required to compensate for damages under civil law.
If disclosure endangers national independence, the official will be prosecuted before a military court pursuant to Decree No. 33 dated September 13, 1945.
Article 8- Recruitment conditions, salaries, and promotions for Labor Inspectors and Labor Supervisors shall follow general provisions set forth in the civil service regulations.
Article 9- Detailed implementation of this decree shall be determined by a decree of the Minister of Labor.
Article 10- The Ministers of Interior, Defense, and Labor shall implement this decree.
