CIRCULAR

Issuing Rules for Detention Facilities

Pursuant to the Criminal Enforcement Law No. 127/2025/QH15;

Pursuant to Decree No. 02/2025/NĐ-CP on the functions, tasks, powers, and organizational structure of the Ministry of Public Security amended and supplemented by Decree No. 11/2025/NĐ-CP;

At the proposal of the Director of the Prison Management Police Department, the Compulsory Educational Institution Management Department, and the Rehabilitation School;

The Minister of Public Security issues this Circular on the Rules for Detention Facilities.

Article 1. These Rules for Detention Facilities are promulgated together with this Circular.

Article 2. Scope of Regulation

This Circular stipulates the Rules for Detention Facilities managed by the People's Public Security Forces.

Article 3. Effectiveness

1. This Circular shall take effect from July 1, 2026.

2. Circular No. 17/2020/TT-BCA dated February 18, 2020 of the Minister of Public Security on the Rules for Detention Facilities shall be repealed upon the effective date of this Circular.

Article 4. Responsibilities for Implementation

1. Heads of criminal enforcement agencies under the Ministry of Public Security, Heads of provincial criminal enforcement agencies, Wardens of prisons, Wardens of temporary detention centers within the People's Public Security Forces, and related agencies, organizations, and individuals are responsible for implementing this Circular.

2. The Prison Management Police Bureau is responsible for monitoring, guiding, inspecting, and urging the implementation of this Circular.

3. In the process of implementing this Circular, if there are difficulties or obstacles, public security units and localities shall report to the Ministry of Public Security (through the Prison Management Police Bureau) for guidance.
