REGARDING THE ESTABLISHMENT OF THE TASKFORCE AGAINST SMUGGLING AND COMMERCIAL FRAUD
AND COMMERCIAL FRAUD

- Pursuant to the Law on the Organization of the Government dated September 30, 1992. To effectively implement Directive No. 853/1997-CT-TTg dated October 11, 1997 of the Prime Minister.

Article 1. The Taskforce Against Smuggling and Commercial Fraud (referred to as Taskforce 853) is hereby established, comprising the following individuals:

Article 2. Taskforce 853 shall have the following duties and powers:
1- Assist the Prime Minister in directing relevant ministries, sectors, and provincial people's committees to effectively carry out anti-smuggling and commercial fraud activities in accordance with Directive No. 853/1997/CT-TTg of the Government. 2- Monitor, inspect, urge, and coordinate the implementation of the Prime Minister's directives among relevant ministries and sectors; propose measures to the Prime Minister for handling smuggling and commercial fraud cases that exceed the authority of ministries, sectors, or localities, or cases where there are differing opinions among ministries, sectors, or localities.
3- Summarize the situation, evaluate the results of implementation by ministries, sectors, and localities, and report and propose policies and solutions to combat smuggling and commercial fraud to the Prime Minister. Taskforce 853 shall have its permanent office at the General Department of Customs. Staff members assisting the permanent office shall be appointed by participating ministries and sectors. The working regulations of the assistance unit shall be decided by the Chairman. Taskforce 853 may establish a permanent office in Ho Chi Minh City if necessary.
In case of necessity, Taskforce 853 may establish special inspection teams to assist the Prime Minister in resolving major smuggling and commercial fraud cases. The Prime Minister.
Article 3. The Chairman shall establish the operational rules of Taskforce 853 after reaching consensus with the members to ensure the completion of tasks assigned by the Prime Minister (members of Taskforce 853 shall operate on a part-time basis). Taskforce 853 may use the seal of the General Department of Customs. The operating budget of Taskforce 853 shall be directly resolved by the Ministry of Finance based on the proposal of the Chairman.
Ministers, Heads of ministerial-level agencies and sectoral agencies under the Government, Chairmen of provincial people's committees under the central government, and individuals named in Article 1 are responsible for implementing this Decision./.
The Head of the Board shall establish the operational regulations of the Board after reaching consensus with the members of the Board to ensure the completion of the tasks assigned by the Prime Minister (the Board members shall serve on a part-time basis). The Board may use the seal of the General Department of Customs. The operating expenses of the Board shall be directly settled by the Ministry of Finance upon the request of the Head of the Board.
Article 4. This Decision takes effect from the date of signature.
Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and those named in Article 1 are responsible for implementing this Decision./.
