Regarding the preferential allowance system for teachers directly teaching in state public schools

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 25/CP dated May 23, 1993 of the Government providing temporarily the new salary system for civil servants, administrative and public service officials, and armed forces personnel;

At the proposal of the Minister, Head of the Civil Service Administration under the Government, and the Minister of Finance;

Pursuant to …;

Article 1: Teachers who are currently directly teaching in public schools within the national education system and in institutions under state agencies and social organizations, meeting the established professional standards to be transferred to new salary grades under the education and training salary table issued with Decree No. 25/CP dated May 23, 1993 of the Government, shall enjoy the preferential allowances stipulated in Article 2 of this Decision.

Article 2: The level of preferential allowances for the subjects specified in Article 1 of this Decision shall be as follows according to each educational level and region:

+ A 30% allowance based on the current salary grade and position allowance (if applicable) shall apply to teachers at universities, colleges, and equivalent institutions (excluding teachers at teacher training institutions).

+ A 35% allowance based on the current salary grade and position allowance (if applicable) shall apply to teachers at secondary general schools, secondary schools in plains, cities, and towns, and teachers at vocational secondary schools and technical schools.

+ A 40% allowance based on the current salary grade and position allowance (if applicable) shall apply to teachers at primary schools, kindergartens in plains, cities, and towns; teachers at secondary general schools, secondary general schools in mountainous areas, islands, remote areas, and far-flung regions.

+ A 50% allowance based on the current salary grade and position allowance (if applicable) shall apply to teachers at all levels of teacher training institutions (university, college, secondary teacher training).

+ A 70% allowance based on the current salary grade and position allowance (if applicable) shall apply to teachers at primary schools, kindergartens in mountainous areas, islands, remote areas, and far-flung regions, and teachers at schools for children with disabilities.

The above preferential allowance shall only apply to teachers who are currently directly teaching; when they cease to be teachers, they will not be entitled to this allowance and it will not be used to calculate overtime allowances or social insurance and health insurance benefits.

The funding source shall be included in the annual budget estimate of the Ministry of Education and Training.

Article 3: Abolish the preferential allowance system for teachers at 20% of their salary grade as stipulated in Decision No. 779/TTg dated December 1, 1995 of the Prime Minister regarding the use of tuition fees to support teachers' living expenses as stipulated in Decision No. 241/TTg dated May 24, 1993 of the Prime Minister.

Article 4: Assign the Minister of Education and Training, the Minister of Finance to coordinate with relevant sectors and People's Committees of provinces and centrally-administered cities to manage and reorganize financial revenue and expenditure in schools.

Article 5: The Minister, Head of the Civil Service Administration under the Government, the Minister of Finance, the Minister of Labor, Invalids and Social Affairs, and the Minister of Education and Training shall be responsible for guiding the implementation of this Decision.

Article 6: This Decision takes effect from November 1, 1997.

Article 7: Ministers of ministries equivalent to ministerial-level agencies, ministers of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
