CIRCULAR

ISSUING NATIONAL TECHNICAL REGULATIONS ON SAFETY FOR AGRICULTURAL MACHINERY AND EQUIPMENT

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations, amended and supplemented by Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing certain provisions of the Law on Product Quality and Commodities, amended and supplemented by Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government; and Decree No. 154/2018/NĐ-CP dated November 9, 2018 of the Government amending and supplementing certain regulations on investment and business conditions in the field of state management by the Ministry of Science and Technology and certain inspection regulations;

The Minister of Agriculture and Rural Development issues this Circular on national technical regulations on safety for agricultural machinery and equipment.

Article 1.

Accompanying this Circular are two national technical regulations on safety for agricultural machinery and equipment under the management responsibility of the Ministry of Agriculture and Rural Development, including:

1. National technical regulation on safety for portable hand-held grass trimmers used in agriculture and forestry. Code: QCVN 89:2025/BNNMT.

2. National technical regulation on safety for combine harvesters. Code: QCVN 90/2025/BNNMT.

Article 2.

This Circular takes effect from July 1, 2026.

Article 3.

The Heads of the Ministry's Office, the Department of Science and Technology, the Department of Cooperative Economy and Rural Development, the Heads of agencies, units, organizations, and individuals concerned shall be responsible for implementing this Circular.

During the implementation process, if there are any difficulties, please report them to the Ministry of Agriculture and Rural Development for study and amendment.

National technical regulation on safety for agricultural and forestry portable hand-held grass trimmers

1 GENERAL PROVISIONS

1.1 Scope of Application

This national technical regulation specifies technical requirements and management requirements to ensure safety for portable hand-held grass trimmers powered by internal combustion engines used in agriculture and forestry (HS Code 84331100).

1.2 Applicability

This national technical regulation applies to organizations and individuals producing, assembling, importing, distributing, and trading portable hand-held grass trimmers used in agriculture and forestry; state management agencies; conformity assessment organizations; and other related organizations and individuals.

1.3 Definitions

1.3.1 Lot

Consists of unused portable hand-held grass trimmers determined in quantity, of the same type, with the same label content, produced or imported by an organization or individual at the same location and distributed or sold on the market.

1.3.2 Portable Hand-Held Grass Trimmer

A grass trimming machine held in hand for operation, equipped with a rotating cutting part (cutting blade or disc or flexible cord) to cut grass, shrubs, and small plants.

1.5 Testing Conditions and Evaluation of Results

Measuring equipment for inspection and testing must be periodically inspected and calibrated in accordance with legal provisions on measurement.

The test is considered to meet requirements when all test results are satisfactory, when conducted on samples of hand-held grass cutting machines from a batch.

2 TECHNICAL PROVISIONS

2.1 General Requirements

2.1.1 The machine must have all parts, mechanisms, and components functioning according to their intended functions; no abnormalities should be detected during operation in the test mode as specified in this National Technical Regulation.

2.1.2 Parts and components of the machine shall not be cracked, broken, perforated, torn, or deformed.

2.1.3 The machine must be accompanied by Vietnamese-language user manuals.

2.2 Vibration

The measured value of local vibration acceleration at each grip shall not exceed 85 m/s². The test method is performed at the accelerating mode according to TCVN 12826:2019 (ISO 22867:2011). If the rated speed of the engine cannot be determined, the test shall be conducted at maximum throttle setting.2The test at the acceleration mode shall be conducted according to TCVN 12826:2019 (ISO 22867:2011). If the rated speed of the engine cannot be determined, the test shall be conducted at maximum throttle position.

2.3 Noise Level

The noise level shall not exceed 115 dB(A). Hearing protection devices must be provided if the noise level exceeds 95 dB(A). The test method is performed at the accelerating mode according to TCVN 12825:2019 (ISO 22868:2011). If the rated speed of the engine cannot be determined, the test shall be conducted at maximum throttle setting.

2.4 Clutch

The machine must have a clutch to ensure that power is not transmitted to the cutting mechanism when the engine rotates at a speed less than or equal to 1.25 times the minimum unloaded running speed of the engine (speed before engaging the control mechanism to adjust the engine speed).

2.5 Engine Stop Mechanism

The machine must have a complete engine stop mechanism without requiring continuous control action.

2.6 Guarding of Cutting Mechanism

2.6.1 The size of the guard for the cutting mechanism must comply with TCVN 10877:2015.

2.6.2 The durability of the guard for the cutting mechanism must comply with TCVN 8747:2011.

2.7 Protection Against Contact with Hot Parts

Protection against contact with hot parts of the hand-held grass cutter must comply with the provisions of TCVN 8746:2011.

2.8 Safety Markings

Safety markings must conform to TCVN 7020:2002 and be appropriately affixed to the hand-held grass cutter to warn users and bystanders about the risks of contact with hot parts, impact, and ejection causing bodily injury during operation, maintenance, and servicing of the machine.

3 MANAGEMENT PROVISIONS

3.1 Provisions on Conformity Assessment Methods

New hand-held grass cutters for agricultural and forestry use, produced and assembled domestically, must obtain conformity certification under Method 5 as prescribed in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Minister of Science and Technology.

New hand-held grass cutters for agricultural and forestry use, imported, must obtain conformity certification under Method 7 as prescribed in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Minister of Science and Technology.

3.2 Provisions on Declaration of Conformity

3.2.1 The declaration of conformity is based on the assessment and certification results of conformity assessment organizations.

3.2.2 Conformity certification is carried out by designated conformity assessment organizations or foreign organizations recognized for mutual recognition of conformity assessment results.

3.2.3 Testing for conformity certification is conducted by designated testing organizations or foreign organizations recognized for mutual recognition of conformity assessment results.

3.2.4 Procedures and formalities for declaring conformity and using conformity marks are stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Ministry of Science and Technology.

3.3 Test and Inspection Methods

- Vibration test method according to TCVN 12826:2019 (ISO 22867:2011).

- Noise level test method according to TCVN 12825:2019 (ISO 22868:2011).

- Inspection of guard dimensions for the cutting mechanism according to TCVN 10877:2015.

- Durability test method for the guard of the cutting mechanism according to TCVN 8747:2011.

- Test method for protection against contact with hot parts according to TCVN 8746:2011.

- Safety markings inspection according to TCVN 7020:2002.

3.4 Sampling

Samples for inspection are randomly selected from batches, the number of samples depending on the quantity of machines in a batch and specified in Table 1.

3.5 Labeling Provisions

Content and labeling methods for hand-held grass cutters are in accordance with Article 10 of Decree No. 43/2017/NĐ-CP dated April 14, 2017, or Article 10 of Decree No. 111/2021/NĐ-CP dated December 9, 2021, and Appendix I of Decree No. 111/2021/NĐ-CP.

Each machine must be clearly labeled in Vietnamese and non-erasable, containing the following minimum information:

- Machine name;

- Name and address of the organization or individual responsible for the machine;

- Origin of the machine;

- Machine code or type;

- Dimensions (DxRxH), mm;

- Weight of the machine, kg;

- Engine power, kW (or HP);

- Production serial number, if applicable;

- Year of manufacture.

4 RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

4.1 Organizations and individuals producing, assembling, importing, distributing, and trading hand-held grass cutters must ensure compliance with technical provisions in Section 2 and implement management provisions in Section 3 of this National Technical Regulation. Before releasing hand-held grass cutters into circulation, organizations and individuals must affix conformity marks on hand-held grass cutters certified in accordance with this National Technical Regulation.

4.2 Conformity assessment organizations must fulfill responsibilities as prescribed in Decree No. 107/2016/NĐ-CP dated July 1, 2016, issued by the Government, and Decree No. 74/2018/NĐ-CP dated May 15, 2018, amending and supplementing certain articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008, issued by the Government.

5 IMPLEMENTATION ORGANIZATION

5.1 The Department of Cooperative Economic Development is responsible for coordinating with relevant agencies to guide and inspect implementation.

5.2 In case the referenced documents in this National Technical Regulation are replaced or amended, the replaced or amended documents shall apply.

National technical regulation on safety for combine harvesters

1 GENERAL PROVISIONS

1.1 Scope of Application

This national technical regulation sets out technical requirements and management requirements to ensure safety for combine harvesters used in rice harvesting in agricultural production (HS Code 84335100).

1.2 Applicability

This national technical regulation applies to corganizations and individuals producing, assembling, importing, distributing, and trading various types of combine harvesters used for rice harvesting; state management agencies; conformity assessment organizations; and other related organizations and individuals.

1.3 Definitions

1.3.1 Lot

Including unused combine harvesters determined in quantity, of the same type, with the same labeling content, produced or imported by an organization or individual at the same location and distributed or sold on the market.

1.3.2 Combine Harvester

A combine harvester performs cutting, gathering, transferring, threshing or separating, cleaning, and transferring grains into storage compartments while leaving the remaining parts on the field.

1.3.3 Header

The part of the combine harvester that includes the gathering, cutting, and lifting mechanisms.

1.3.4 Operator Presence Control System

A system that disengages power to the drive mechanism when the operator stops activating the control system.

1.3.5 Three-Point Hitch

A system allowing a person to use both hands and one foot, or two feet and one hand simultaneously when getting on or off the machine.

1.5 Testing Conditions and Evaluation of Results

Measuring and testing equipment must be regularly calibrated according to the regulations of the law on measurement.

Testing is considered satisfactory when all test results meet the requirements when conducted on a sample combine harvester from a batch.

2 TECHNICAL PROVISIONS

2.1 General Requirements

2.1.1 The combine harvester must have all systems, mechanisms, and components functioning properly; no abnormalities should be detected during operation under the test conditions specified in this National Technical Regulation.

2.1.2 There should be no leakage of liquids at joints and connections.

2.1.3 Parts and components of the machine shall not be cracked, broken, perforated, torn, or deformed.

2.1.4 The machine must be accompanied by Vietnamese-language user manuals.

2.2 Control Systems

2.2.1 General Requirements

2.2.1.1 Must operate decisively in all designated states.

2.2.1.2 The operation methods of the control systems, if equipped on the machine, comply with the provisions of TCVN 9193:2012.

2.2.1.3 Indicating symbols comply with the provisions of TCVN 8411-1:2010 and TCVN 8411-2:2010.

2.2.1.4 Control system pedals, handles, buttons, and grips are within the reach of the operator; within the cab range for machines equipped with a cab.

2.2.1.4.1 The reach of the operator's feet is defined by a hemisphere with a radius of 800 mm centered on the seat backrest edge and pointing downwards when the seat is in the center position (see Figure 1).

2.2.1.4.2 The reach of the operator's hands is defined by a sphere with a radius of 1,000 mm, centered on the seat backrest edge 60 mm forward and 580 mm above the seat reference point (see Figure 1).

2.2.1.5 Control systems are of different colors to distinguish them in accordance with the provisions of Appendix A of TCVN 6818-7:2011 (ISO 4254-7:2008) Agricultural machinery - Safety - Part 7: Combined harvesters, forage harvesters, and cotton harvesters.

2.2.1.6 Control levers, except the operator presence control system, if equipped, must be arranged so as not to obstruct access to the operator's work position and not to be used as handrails when entering or exiting the machine, except for the steering wheel.

2.2.2 Engine Start and Stop Control Systems

2.2.2.1 Must ensure that the engine cannot start when the power transmission system is engaged.

2.2.2.2 Measures must be taken to prevent unintended and/or unauthorized engine starts.

2.2.3 Pedals

2.2.3.1 Clutch pedals, brake pedals, and accelerator pedals have anti-slip surfaces and are easy to clean.

2.2.3.2 Applies to machines with clutch pedals, accelerator pedals, and brake pedals arranged as follows:

2.2.3.2.1 The clutch pedal is positioned for easy access and control by the left foot;

2.2.3.2.2 The brake and accelerator pedals are positioned for easy access and control by the right foot.

2.3 Machine Platforms and Steps

2.3.1 Machine platforms and steps must have a non-slip surface and shall not retain water.

2.3.2 Standing surfaces must meet one of the following conditions:

2.3.2.1 Have toe boards, guardrails, and intermediate handrails around the edges of the platform, or

2.3.2.2 Have fixed machine parts that provide equivalent protection such as shields or guardrails.

2.3.3 If the height of the working platform above ground exceeds 750 mm, there must be steps/ladders for ascent and descent. This height is determined from the ground when the machine is fitted with wheels at their maximum diameter, inflated to the specified pressure, or the uppermost chain link of the machine is adjusted to its highest position.

2.3.4 The minimum width of the entrance to the driver's seat is 300 mm. Equipment, including control devices, must be arranged so they do not obstruct the driver's entry, except where such a part is intentionally designed to prevent the driver from being endangered during operation.

2.3.5 There must be shielding behind the steps when feet or hands could extend and come into contact with dangerous parts of the machine.

2.3.6 On tracked machines where track shoes and track shoe cushion surfaces can be used as stepping points, there must be three-point supports to ensure safety for the operator.

2.3.7 Guardrails or handrails must be provided on both sides of the steps and must be designed so that the operator can always maintain three-point contact. The cross-sectional width of the guardrail or handrail must be between 25 mm and 38 mm. The lowest part of the guardrail/handrail must be positioned no higher than 1,600 mm above ground level. A minimum gap of 50 mm must be maintained between the guardrail/handrail and adjacent parts for the hand.

2.4 Shielding Parts

2.4.1 There must be a bar or plate shield used to prevent falling risks for operators performing bagging operations and capable of withstanding a lateral load of 1,000 N.

2.4.2 Shielding parts with a height of 550 mm or less from the ground that cannot prevent them from being used as stepping points during operation must be designed to withstand a vertical load of 1,200 N.

2.4.3 Shielding must be provided for all drive components on both sides of the machine to ensure prevention of unintended contact with dangerous parts from all directions.

2.5 Visibility

2.5.1 The operator's workplace must have adequate visibility to operate the machine and observe the work area. The machine must be equipped with at least two rearview mirrors, one on each side of the machine.

2.5.2 Windshield wipers must be provided if a cab is installed.

2.5.3 An automatic warning horn must be installed to emit a sound when the machine is reversing.

2.6 Header

2.6.1 All drives connected to the main drive of the header must be separated by the same control and activated simultaneously with the main drive of the header.

2.6.2 Control mechanisms for the header drive must be arranged or shielded to avoid accidental activation. Single-hand lift controls must require two separate actions.

2.6.3 There must be a locking mechanism for the header to prevent it from lowering unintentionally while the machine is moving or during repair and maintenance of the header.

2.7 Hydraulic System

Pipes and pressurized components must be arranged or shielded so that, if they break, they will not spray directly onto the operator in the operating position.

2.8 Electrical System

2.8.1 Electrical cables must be protected against abrasion with surfaces and must be able to withstand or be protected from contact with lubricants or fuel. Electrical cables must be arranged so that none of them come into contact with exhaust systems, moving parts, or sharp edges.

2.8.2 Batteries must be positioned so they can be securely held and replaced. Unearthed battery terminals must be protected to prevent unintended contact and short circuits with earth.

2.8.3 It must be ensured that the battery circuit can be easily disconnected.

2.9 Fuel System

2.9.1 The fuel tank opening must be located outside the cab and no more than 1,500 mm above ground or standing surface and must be arranged so that spilled fuel does not come into contact with hot surfaces.

2.9.2 The structure of the fuel tank cover must ensure that fuel does not leak and does not drip through the cover in any working position of the machine.

2.10 Noise Level

The noise level must be determined by the sound pressure level emitted not exceeding 115 dB(A). Hearing protection equipment must be provided for the operator if the noise level exceeds 95 dB(A).

2.11 Safety Symbols

2.11.1 Safety symbols conforming to the provisions of TCVN 7020:2002 must be appropriately affixed to the machine to warn the operator and others about bodily injury hazards during operation and maintenance.

2.11.2 Safety symbols must be provided on the machine at appropriate locations to prevent the following risks:

2.11.2.1 Risks existing due to maintenance and servicing of raised parts without securing locking devices;

2.11.2.2 Risk of coming into contact with overhead power lines visible from the operator's position;

2.11.2.3 Risks existing due to cutting and pinching by gathering and/or cutting mechanisms;

2.11.2.4 Risks existing due to operation of rear working parts such as chaff spreaders, raw chaff spreaders, and chopped chaff spreaders;

2.11.2.5 Risks existing due to objects flying out from the rear of chaff spreaders, raw chaff spreaders, and chopped chaff spreaders;

2.11.2.6 Risks existing due to moving parts while unloading the container.

3 MANAGEMENT PROVISIONS

3.1 Provisions on Conformity Assessment Methods

Unused combine harvesters produced and assembled domestically must comply with conformity assessment procedures according to method 5 as stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology.

Unused imported combine harvesters must comply with conformity assessment procedures according to method 7 as stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology.

3.2 Provisions on Declaration of Conformity

3.2.1 The declaration of conformity is based on the assessment and certification results of conformity assessment organizations.

3.2.2 Conformity certification is carried out by designated conformity assessment organizations or foreign organizations recognized for mutual recognition of conformity assessment results.

3.2.3 Testing for conformity certification is conducted by designated testing organizations or foreign organizations recognized for mutual recognition of conformity assessment results.

3.2.4 Procedures and formalities for declaring conformity and using conformity marks are stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012, amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Ministry of Science and Technology.

3.3 Test and Inspection Methods

3.3.1 Operation methods of control mechanisms (if equipped) according to TCVN 9193:2012.

3.3.2 Indicating symbols according to TCVN 8411-1:2010 and TCVN 8411-2:2010.

3.3.3 Safety symbols according to TCVN 7020:2002.

3.3.4 Method for testing the lateral load capacity of bars/shields according to Appendix C of TCVN 6818-1:2010.

3.3.5 Method for testing the vertical load capacity of shielding parts according to Appendix C of TCVN 6818-1:2010.

3.3.6 Method for testing noise levels according to Appendix B of TCVN 6818-1:2010 and Appendix B of TCVN 6818-7:2011.

3.4 Sampling

Samples for inspection are randomly selected from batches, the number of samples depending on the quantity of machines in a batch and specified in Table 1.

3.5 Labeling Provisions

For combine harvesters specified in Clause 1 and Clause 2 of Article 7 of Decree No. 43/2017/NĐ-CP dated April 14, 2017, produced and circulated domestically.

For imported combine harvesters, the labeling requirements for goods are applied as stipulated in Clause 3 of Article 7 and Article 8 of Decree No. 43/2017/NĐ-CP dated April 14, 2017; Article 10 of Decree No. 111/2021/NĐ-CP dated December 9, 2021.

Each machine must be clearly labeled in Vietnamese and not erasable, containing at least the following information:

- The trademark of the manufacturer;

- Country of production/place of origin (if imported);

- Trademark;

- Model;

- Engine power, kW (or HP);

- Dimensions (DxRxH), mm;

- Weight, kg.

4 RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

4.1 Organizations and individuals producing, assembling, importing, distributing, and trading combine harvesters must ensure technical regulations set out in Section 2 and comply with management regulations set out in Section

3 of this National Technical Regulation. Before putting combine harvesters into circulation on the market, organizations and individuals must affix conformity marks on machines that have been certified as conforming according to the provisions of this National Technical Regulation.

4.2 Accreditation bodies must fulfill responsibilities as prescribed in Government Decree No. 107/2016/NĐ-CP dated July 1, 2016, and Government Decree No. 74/2018/NĐ-CP dated May 15, 2018 amending and supplementing certain articles of Government Decree No. 132/2008/NĐ-CP dated December 31, 2008.

5 IMPLEMENTATION ORGANIZATION

5.1 The Department of Cooperative and Rural Development Economy shall coordinate with relevant competent authorities to guide and inspect implementation.

5.2 In case the referenced documents in this National Technical Regulation are replaced or amended, the replaced or amended documents shall apply.
