Pursuant to the Ordinance on Forest Protection adopted by the Standing Committee of the National Assembly on September 7, 1972;
Pursuant to Decree No. 196/CT dated December 11, 1989 of the Council of Ministers stipulating the tasks, powers, and responsibilities of the State management of the Ministry;
At the proposal of the Director of the People's Forest Inspection Bureau,
DECISION:
Article 1.
Now hereby promulgating with this Decision the regulations on management and protection of industrial raw material forests in the North Central region (Vinh Phu, Ha Tuyen, Hoang Lien Son, Bac Thai).
Article 2.
The Heads of the Ministry's Office, Director of the People's Forest Inspection Bureau, Heads of relevant Departments and Institutes, General Director of the Vinh Phu Pulpwood Joint Stock Enterprise, Directors of Agriculture and Forestry Departments, and Chiefs of People's Forest Inspection Units in the North Central raw material region shall be responsible for implementing this Decision.

REGULATIONS ON MANAGEMENT AND PROTECTION OF INDUSTRIAL RAW MATERIAL FORESTS
(Issued together with Decision No. 98-QĐ/KL dated March 15, 1991)
The North Central raw material forest region includes the provinces of Ha Tuyen, Hoang Lien Son, Vinh Phu, and Bac Thai, which are areas for planting eucalyptus, pine, acacia, bamboo, and other trees to supply raw materials for the North Central industrial sector (mainly the Bãi Bằng paper mill in Vinh Phu).
These regulations are issued to bring forest management and protection work, raw material trading and transportation into a regular system, contributing to forest protection and stabilizing raw material supply for the Bãi Bằng paper mill and other factories such as saltworks, particleboard, veneer, and other paper mills.
Article 1
Industrial raw material forests assigned to state forestry farms, cooperatives, organizations, collectives, and households (referred to as forest users) for production and business to provide raw materials for industry must comply with the regulations for production forests issued together with Decision No. 1101-QĐ dated December 30, 1986 of the Ministry of Forestry.
Article 2
Forest users must follow the supervision and inspection of forestry agencies and people's forest inspection units at all levels in implementing Directive No. 16-LN/KL dated October 16, 1987 of the Ministry of Forestry.
Article 3
Logging of industrial raw material forests can only occur when they reach technological maturity age. For forestry farms, logging must be approved by the Ministry with a harvesting design and issuance of a forest opening permit.
For organizations, cooperatives, collectives, and households logging concentrated planted forests, a harvesting design must be reviewed by the Department of Agriculture and Forestry and inspected and granted a logging permit by the people's forest inspection unit, along with transportation procedures.
Article 4
Raw material procurement must be conducted by units and collectives with forestry functions, registered to purchase raw materials, with permits from the Department of Agriculture and Forestry.
Raw materials purchased from where must be processed at the local people's forest inspection station. It is strictly prohibited to transport raw materials purchased in one locality to another for processing.
Article 5
Eucalyptus export from the industrial raw material area must be approved by the Ministry of Forestry. Forest users selling raw materials grown with budget investment and credit funds according to pulp production contracts for export must obtain confirmation from the General Director of the Vinh Phu Pulpwood Joint Stock Enterprise (if under the Joint Stock Enterprise) or the Director of the Department of Agriculture and Forestry (if under local administration) that the forest user has fulfilled their contractual obligations and sold sufficient raw materials to the paper mill.
Article 6
Transportation of raw material timber must have the following procedures:
a) For units within the forestry sector: must have the following documents:
1. Invoice and warehouse release form signed by the director.
2. Confirmation of payment of forest nurturing fees by the local people's forest inspection station (specifying the receipt number and date of payment).
b) For units outside the forestry sector: must have the following documents:
1. Timber transportation permit from the local people's forest inspection branch.
2. Receipt of forest nurturing fee from the local people's forest inspection station.
c) For units within and outside the forestry sector transporting raw timber out of the raw material area: must have the following documents:
1. Timber transportation permit from the local people's forest inspection branch (with confirmation of payment of forest nurturing fees and compliance with Clause 5).
2. Invoice and warehouse release form from the selling unit.

When transporting raw material timber, carriers must present for inspection at forest product checkpoints, secondary inspection stations (An Dao river checkpoint, northern road checkpoint near the factory). If they evade inspection and are caught, the carrier will be dealt with according to current laws.
Article 8
At forest product checkpoints, secondary inspection stations, or mobile inspection teams, after inspection (or after the party has implemented the decision), forest rangers must stamp "Inspected," record the date and sign on the transportation permit and receipt of forest nurturing fee (or confirmation of payment of forest nurturing fee).
Article 9
Violations of logging, trading, and transporting raw material timber (including goods being transported without presentation during inspection) must be documented and dealt with according to current laws.
Article 10
If a factory purchases raw material timber without proof of payment of forest nurturing fees, it must pay the fees according to Circular No. 27-TT-LB of the Ministry of Finance and Forestry dated November 30, 1988.
Article 11
People's forest inspection units with confiscated raw material timber may sell it to units with raw material trading functions at agreed prices, with proceeds from the sale of confiscated timber deposited into the State Treasury.
Article 12
Rewards for those who discover and handle violations of forestry laws and penalties for those who violate these regulations (including forest rangers) shall be carried out according to current regulations.
Article 13
The People's Forest Inspection Bureau, Vinh Phu Pulpwood Joint Stock Enterprise, Departments of Agriculture and Forestry, and people's forest inspection branches in the North Central raw material region shall guide agencies, units, and the public in strictly implementing these regulations.
