DECISION

Regarding the merger of Ha Nam Ninh General Commodities Company

into Petec Trading, Engineering and Investment Company

THE MINISTER OF TRADE

Pursuant to Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;

Pursuant to Decree No. 50/CP dated August 28, 1996 of the Government on the establishment, restructuring, dissolution, and bankruptcy of state-owned enterprises, and Decree No. 38/CP dated April 28, 1997 of the Government amending and supplementing certain provisions of Decree No. 50/CP;No. Pursuant to Document No. 341/VPCP-ĐMDN dated January 19, 2004 of the Office of the Government regarding the merger of state-owned enterprises under the Ministry of Trade;

Considering the proposal of the Director of Petec Trading, Engineering and Investment Company at Document No. 10958/PTC-TCCB dated October 20, 2003, and the Director of Ha Nam Ninh General Commodities Company at Document No. 135/TT-TCCB dated November 1, 2003;

Merge Ha Nam Ninh General Commodities Company into Petec Trading, Engineering and Investment Company.

At the proposal of the Director of the Cadre and Civil Servant Department,

Article 1. The Director of Ha Nam Ninh General Commodities Company shall be responsible for transferring the current status of tasks, organizational structure, labor force, capital, assets, goods, technical facilities (land, workshops, machinery, warehouses...), and related documents to the Director of Petec Trading, Engineering and Investment Company.

Article 2. The Director of Petec Trading, Engineering and Investment Company shall be responsible for receiving and succeeding to the rights and obligations of Ha Nam Ninh General Commodities Company, continuing to resolve related issues, reorganizing the company into a subordinate unit, and arranging the use of cadres and workers to ensure stability.

- The transfer date shall be based on the inventory settlement figures up to January 31, 2004.

- Complete the transfer before March 5, 2004, and report the results to the Ministry.

The Heads of Departments under the Ministry: Finance and Accounting, Planning and Statistics, Organization and Cadre Management shall be responsible for guiding and supervising the units mentioned in Article 1 to carry out the transfer and receipt according to the regulations of the State.

Article 3. This Decision shall take effect 15 days from the date of publication in the Official Gazette, and all previous provisions contrary to this Decision shall be abolished.

Article 4. The Heads of the Ministry's Office, Department Heads of the Departments: Organization and Cadre Management, Finance and Accounting, Planning and Statistics, Heads of Departments and Committees under the Ministry, the Director of Petec Trading, Engineering and Investment Company, and the Director of Ha Nam Ninh General Commodities Company are responsible for implementing this Decision./.

Article 5. The Heads of the Ministry’s Office, Directors of the Departments: Organization and Cadres, Finance and Accounting, Planning and Statistics, Heads of Departments and Committees under the Ministry, Director of the Petec Trading and Investment Technology Company, and Director of the North Central Comprehensive Material Supply Company are responsible for implementing this Decision./.
