ISSUING REGULATIONS ON THE ORGANIZATION AND OPERATIONS OF THE JURY GROUP

                                                           

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of The Constitution of the Socialist Republic of Vietnam has been amended and supplemented by Resolution No. 203/2025/QH15;

On the basis of The Law on the Organization of People's Courts No. 34/2024/QH15 has been amended and supplemented with certain articles pursuant to Law No. 81/2025/QH15;

On the basis of The Law on the Vietnam Fatherland Front No. 75/2015/QH13 has been amended and supplemented with certain articles pursuant to Law No. 97/2025/QH15;

On the basis of Law on Local Administration Organization No. 72/2025/QH15;

RESOLUTION:

Article 1. Issuance of Regulations

These Regulations on the organization and operations of the Jury Group are hereby issued along with this Resolution.

Article 2. Responsibilities for Implementation

The Supreme People's Court, the Ministry of National Defense; Provincial People's Councils, the Standing Committee of the Vietnam Fatherland Front Provincial Committees, cities; Provincial People's Courts, city People's Courts, regional People's Courts; Central Military Court, Military Region Military Courts and equivalent courts, regional military courts; the Jury Group; relevant agencies, organizations, and individuals have the responsibility to implement this Resolution.

Article 3. Effectiveness

1. This Resolution shall take effect from October 1, 2025.

2. Resolution No. 1213/2016/UBTVQH13 dated June 13, 2016 of the Standing Committee of the National Assembly issuing the Regulations on the organization and operations of the Jury Group shall cease to be effective from the date this Resolution takes effect.

3. People's Jurors serving their term from 2021 to 2026 who are currently performing trial duties at provincial and city People's Courts, regional People's Courts according to Clause 7, Article 3 of Resolution No. 225/2025/QH15 dated June 27, 2025 of the National Assembly shall participate in activities at the People's Jury Group of the province or city where they perform their trial duties until the end of their term. The organization and operation of the People's Jury Group shall be carried out in accordance with these Regulations issued together with this Resolution./.

This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, Term XV on September 25, 2025.

 

REGULATIONS

ORGANIZATION AND OPERATIONS OF THE JURY GROUP
(Issued together with Resolution No. 99/2025/UBTVQH15

dated September 25, 2025 of the Standing Committee of the National Assembly)

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

These Regulations stipulate the organization and operations of the Jury Group (including the People's Jury Group and the Military Jury Group); the relationship between the Jury Group and the Jurors; the relationship between the Jury Group and agencies, organizations, and individuals; the responsibilities of agencies, organizations, and units of the people's armed forces towards the Jury Group; conditions ensuring the operations of the Jury Group.

Article 2. Applicability

These Regulations apply to the People's Jury Group, the Military Jury Group, agencies, organizations, units of the people's armed forces, and individuals related to the organization and operations of the Jury Group.

Article 3. Organization and Principles of Operation

1. The Jury Group is a self-governing form of organization of the Jurors, including:

a) The People's Jury Group of provinces and cities;

b) The People's Jury Group of regions;

c) The Military Jury Group of military regions and equivalents;

d) The Military Jury Group of regions.

2. The Jury Group operates based on principles of democracy, transparency, and openness; Jurors perform trial duties at which court then participate in activities at the Jury Group located there.

Chapter II
THE PEOPLE'S JURY GROUP

Article 4. Organization of the People's Jury Group

1. The People's Jury Group includes People's Jurors elected to perform trial duties at each provincial and city People's Court (hereinafter referred to as the provincial-level People's Court), regional People's Court.

2. The number of members of each People's Jury Group is determined based on the number of Judges at each Court.

At a provincial-level People's Court, for every two Judges, there are three People's Jurors, but the total number of People's Jurors at a provincial-level People's Court must not be less than twenty and not more than fifty, for the People's Jury Group of Hanoi City and Ho Chi Minh City, it must not exceed seventy.

At a regional People's Court area for every one Judge, there are two People's Jurors, but the total number of People's Jurors at a regional People's Court must not be less than thirty and not more than one hundred.

3. The People's Jury Group has a Chairman, Deputy Chairmen, and People's Jurors as members. The Chairman and Deputy Chairmen of the People's Jury Group are elected among the People's Jurors.

4. The number of Deputy Chairmen of the People's Jury Group is determined based on the scale of the People's Jury Group; under thirty People's Jurors, there is one Deputy Chairman; thirty People's Jurors and above, there are no more than two Deputy Chairmen.

Article 5. Responsibilities and rights of the People's Jury Association

1. Organize for jurors to exchange experience in trial proceedings, contributing to enhancing their professional competence and maintaining the moral integrity of people's jurors.

2. Propose to competent authorities, organizations, and individuals to protect the rights and legitimate interests of jurors.

3. Participate in opinions with the People's Court where the people's juror performs trial duties regarding the activities of the jury when requested.

4. Discuss and participate in opinions on cases of rewarding or disciplining jurors.

5. Coordinate with the People's Court where the people's juror performs trial duties in training and improving the professional skills of jurors.

6. Participate in opinions on draft normative legal documents when requested.

7. Propose to the authority, organization, or unit where the juror works or conducts business to create conditions for the juror to perform trial duties.

8. Propose the budget estimate for supporting the activities of the People's Jury Association.

9. Be provided with information about the socio-economic situation in the locality; related documents and materials concerning the organization and operation of the jury and the People's Jury Association when requested.

10. Organize mid-term and annual reviews or when necessary, and submit reports to the People's Council, the Standing Committee of the Vietnam Fatherland Front Provincial Committee, the Chief Justice of the Provincial People's Court; be subject to supervision by the People's Council and the Vietnam Fatherland Front Provincial Committee (hereinafter referred to as provincial level).

Article 6. Election, removal, dismissal, and term of office of the Head and Deputy Head of the People's Jury

1. A people's juror with prestige, experience in trial work, and sufficient working time may be elected as the Head or Deputy Head of the People's Jury.

2. The procedure for electing the Head and Deputy Head of the People's Jury shall be carried out as follows:

a) After electing a new term of jurors or when there is a vacancy in the Head or Deputy Head of the People's Jury, the Standing Body of the Provincial People's Council shall take the lead and coordinate with the Chief Justice of the People's Court and the Standing Committee of the Vietnam Fatherland Front Provincial Committee to convene a full meeting of the People's Jury to elect the Head and Deputy Head of the People's Jury;

b) The election of the Head and Deputy Head of the People's Jury shall be decided by the full meeting of the People's Jury, conducted through raising hands or secret ballot. The person elected as the Head or Deputy Head of the People's Jury must receive more than 50% of the total number of jurors' trust and approval, and must have the highest number of votes for each position;

c) The Standing Body of the Provincial People's Council shall recognize the results of the election of the Head and Deputy Head of the People's Jury.

3. The Head and Deputy Head of the People's Jury shall be automatically relieved of duty or dismissed when they are relieved of duty or dismissed as jurors.

The Head and Deputy Head of the People's Jury may be relieved of duty due to health reasons, family circumstances, or other valid reasons; they may be dismissed if they fail to fulfill their duties or violate moral integrity or commit acts of law violation.

4. The procedure for relieving of duty or dismissing the Head and Deputy Head of the People's Jury shall be carried out as follows:

a) When the Head or Deputy Head submits a resignation request or at least one-third of the total members of the People's Jury Association or the Standing Committee of the Vietnam Fatherland Front Provincial Committee propose the dismissal of the Head or Deputy Head of the People's Jury, the Standing Body of the Provincial People's Council shall take the lead and coordinate with the Chief Justice of the People's Court and the Standing Committee of the Vietnam Fatherland Front Provincial Committee to convene a full meeting of the People's Jury to consider the relief of duty or dismissal;

b) The relief of duty or dismissal of the Head and Deputy Head of the People's Jury shall be decided by the full meeting of the People's Jury, conducted through raising hands or secret ballot. The Head and Deputy Head of the People's Jury shall be relieved of duty or dismissed when more than 50% of the total number of jurors agree;

c) The Standing Body of the Provincial People's Council shall recognize the results of the relief of duty or dismissal of the Head and Deputy Head of the People's Jury.

5. The term of office of the Head and Deputy Head of the People's Jury shall be consistent with the term of office of the jurors.

Article 7. Responsibilities and rights of the Head and Deputy Head of the People's Jury Team

1. The Head of the People's Jury Team shall have the following responsibilities and rights:

a) To convene and chair meetings, conferences, seminars, and discussions of the People's Jury Team;

b) To represent the People's Jury Team and maintain relations with the Standing Body of the People's Council, the Standing Committee of the Vietnam Fatherland Front Provincial Committee, the Provincial People's Court, the People's Court where the jurors perform their adjudicative duties, and relevant agencies and organizations;

c) To attend sessions of the Provincial People's Council when invited;

d) To organize mid-term and final reviews of the work of the People's Jury Team;

đ) To exchange opinions with the Chief Judge of the People's Court where the jurors perform their adjudicative duties regarding the assignment of jurors to participate in adjudicative activities, ensuring it aligns with the requirements for case adjudication as stipulated by the Chief Judge of the People's Court;

e) To compile opinions and recommendations of the jurors on issues related to the activities of the jurors and to propose solutions to competent authorities;

g) To delegate one Deputy Head to perform the Head's duties when the Head is absent.

2. The Deputy Head of the People's Jury Team assists the Head in performing tasks assigned by the Head; performs the Head's duties when delegated by the Head.

Article 8. Responsibilities of the People's Jurors

1. To carry out activities of the People's Jury Team according to the division of labor by the Head; to report the results of such activities to the Head; to maintain regular contact with the People's Jury Team through the Head.

2. To promptly inform the Chief Judge of the People's Court where the jurors perform their adjudicative duties and the Head of the People's Jury Team if any violation of laws by agencies, organizations, or individuals is discovered during the performance of duties.

3. When there is a change in position, workplace, place of work, or residence, they must promptly notify the Head of the People's Jury Team and the Chief Judge of the People's Court. In cases where due to legitimate reasons, they cannot fulfill the adjudicative duties of the juror, they must immediately inform the Head and the Chief Judge of the People's Court where the juror performs their adjudicative duties.

Article 9. Relations between the People's Jury Team and the Standing Body of the People's Council, the Standing Committee of the Vietnam Fatherland Front Provincial Committee, and the People's Court

1. The People's Jury Team maintains regular contact with the Standing Body of the People's Council, the Standing Committee of the Vietnam Fatherland Front Provincial Committee, and the People's Court where the People's Jury performs their adjudicative duties; the People's Jury Team in regions also maintains contact with the Provincial People's Court.

2. The People's Jury Team shall report in writing to the Standing Body of the People's Council and the Standing Committee of the Vietnam Fatherland Front Provincial Committee on the activities of the People's Jury every six months, annually, or upon request.

Chapter III
PEOPLE'S JURY TEAM OF THE ARMED FORCES

Article 10. Organization of the Armed Forces People's Jury Team

1. The Armed Forces People's Jury Team consists of jurors appointed to perform adjudicative duties at Military Courts of Military Regions and equivalent courts (hereinafter referred to as Military Courts of Military Regions) and Regional Military Courts.

2. The number of members of the Armed Forces People's Jury Team is determined based on the number of Judges at each Military Court. For every 1 Judge, there are 2 jurors, but the total number of jurors at one Military Court shall not be less than 10 people and not more than 30 people.

3. The Armed Forces People's Jury Team has a Head, 1 Deputy Head, and other members who are jurors.

Article 11. Responsibilities and rights of the Military Jury Association

1. Organize for jurors to exchange experience in trial proceedings, contributing to improving their professional competence and maintaining the moral qualities of military jurors.

2. Propose to competent authorities, organizations, and individuals to protect the rights and legitimate interests of jurors.

3. Participate in providing opinions with the Military Court where the military juror performs the duty of adjudication on the activities of the jury when requested.

4. Discuss and participate in opinions on cases of rewarding or disciplining jurors.

5. Coordinate with the Military Court where the military juror performs the duty of adjudication in training and enhancing the professional skills of the jurors.

6. Participate in opinions on draft normative legal documents when requested.

7. Propose to the unit where the juror works or operates to create conditions for the juror to perform the duty of adjudication.

8. Propose the budget estimate to support the activities of the Military Jury Association to be submitted to the Military Court where the military juror performs the duty of adjudication for consolidation, preparation of the budget estimate, and reporting according to regulations.

9. Be provided with relevant documents and materials related to the organization and operation of the jury and the Military Jury Association when requested.

10. Organize mid-term and annual reviews or when necessary, and submit reports to the Political Chief of the Military Region, Military Branch, General Department, or equivalent level where there is a Military Court, the President of the Military Court.

Article 12. Appointment, removal, and dismissal of the Head and Deputy Head of the Military Jury Association

1. A military juror with prestige and experience in adjudicating work may be appointed as the Head or Deputy Head of the Military Jury Association.

2. The Political Chief of the Military Region, Military Branch, General Department, or equivalent level where there is a Military Court appoints the Head and Deputy Head of the Military Jury Association from among the military jurors upon the proposal of the President of the Military Court.

3. The Head and Deputy Head of the Military Jury Association are automatically relieved of their positions when they are relieved of their duties as military jurors or are dismissed as military jurors.

The Head and Deputy Head of the Military Jury Association may be relieved of their positions due to health reasons, family circumstances, or other valid reasons; they may be dismissed if they fail to fulfill their duties or violate moral qualities or engage in acts that contravene the law.

The President of the Military Court proposes to the Political Chief of the Military Region, Military Branch, General Department, or equivalent level where there is a Military Court to issue a decision to relieve or dismiss the Head and Deputy Head of the Military Jury Association.

Article 13. Responsibilities and rights of the Head and Deputy Head of the Military Jury Association

1. The Head of the Military Jury Association has the following responsibilities and rights:

a) Summoning and chairing meetings, conferences, seminars, and discussions of the Military Jury Association;

b) Maintaining contact and representing the Military Jury Association in relations with the Political Chief of the Military Region, Military Branch, General Department, or equivalent level, the head of the unit where the juror works, the Military Council where the juror participates, the Military Court where the military juror performs the duty of adjudication, and related agencies and organizations;

c) Exchanging opinions with the President of the Military Court where the military juror performs the duty of adjudication regarding the assignment of military jurors to participate in adjudicative activities, ensuring compliance with the requirements of case adjudication as required by the President of the Military Court;

d) Organizing mid-term and annual reviews of the work of the Military Jury Association;

đ) Compiling opinions and proposals of military jurors on issues related to the activities of the jury and proposing competent authorities to resolve them;

e) Delegating one Deputy Head to perform the duties of the Head when the Head is absent.

2. The Deputy Head of the Military Jury Association assists the Head in performing tasks assigned by the Head; performs the duties of the Head when delegated by the Head.

Article 14. Responsibilities of Military Lay Judges

1. Carry out activities of the Lay Judge Panel according to the division of labor assigned by the Head of the Panel; report the results of such activities to the Head of the Panel; maintain regular contact with the Military Lay Judge Panel through the Head of the Panel.

2. Promptly notify the Chief Justice of the Military Court where the Military Lay Judge performs adjudication duties, and the Head of the Military Lay Judge Panel if any violation of laws by agencies, organizations, or individuals is discovered during the performance of duties.

3. When there is a change in position, workplace, place of work, or place of residence, promptly inform the Head of the Military Lay Judge Panel and the Chief Justice of the Military Court where the Military Lay Judge performs adjudication duties. In cases where due to objective and justifiable reasons it is impossible to perform the adjudication duty of a lay judge, immediately inform the Head of the Panel and the Chief Justice of the Military Court where the Military Lay Judge performs adjudication duties.

Article 15. Relationship between the Military Lay Judge Panel and Political Agencies of Military Zones, Services, General Departments, or Equivalent Levels and Military Courts

1. The Military Lay Judge Panel maintains regular contact with political agencies of military zones, services, general departments, or equivalent levels and military courts where the Military Lay Judge performs adjudication duties.

2. Every six months, annually, or upon request, the Military Lay Judge Panel has the responsibility to submit written reports to political agencies of military zones, services, general departments, or equivalent levels regarding the activities of the Military Lay Judge Panel.

Chapter IV
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS TOWARDS THE ACTIVITIES OF THE LAY JUDGE PANEL

Article 16. Responsibilities of the Provincial People's Council

1. Supervise the activities of the Provincial People's Lay Judge Panel, the Regional People's Lay Judge Panel.

2. The Standing Body of the Provincial People's Council is responsible for chairing, coordinating with the Chief Justice of the People's Court, the Standing Committee of the Vietnam Fatherland Front Committee at the same level to organize the election, appointment, and removal of the Head and Deputy Head of the Provincial People's Lay Judge Panel, the Head and Deputy Head of the Regional People's Lay Judge Panel as stipulated in Clause 2, Clause 4 of Article 6, Point a of Clause 1 of Article 18 and Clause 1 of Article 19 of this Regulation.

3. Examine and decide on financial support for the People's Lay Judge Panel and training costs, professional development for lay judges as prescribed in Clause 2 of Article 133 of the Law on Organization of the People's Courts and provisions of state budget law.

Article 17. Responsibilities of the Ministry of National Defense, Political Agencies of Military Zones, Services, General Departments, or Equivalent Levels

1. Annually, the Ministry of National Defense collaborates with the Supreme People's Court to prepare the budget for supporting the activities of Military Lay Judge Panels within the budget for the activities of military courts, and propose to the Government to submit to the National Assembly for decision.

2. Political agencies of military zones, services, general departments, or equivalent levels where there are military courts have the responsibility to inspect activities and provide working tools for the Military Lay Judge Panels.

Article 18. Responsibilities of the People's Court and Military Court

1. Responsibilities of the Provincial People's Court and Regional People's Court:

a) The Chief Justice of the Provincial People's Court coordinates with the Standing Body of the Provincial People's Council, the Standing Committee of the Vietnam Fatherland Front Committee at the same level to organize the election, appointment, and removal of the Head and Deputy Head of the Provincial People's Lay Judge Panel, the Head and Deputy Head of the Regional People's Lay Judge Panel;

b) Maintain contact with the Provincial People's Lay Judge Panel, the Regional People's Lay Judge Panel;

c) Examine and resolve recommendations from the People's Lay Judge Panel; examine and resolve recommendations from the Head of the People's Lay Judge Panel regarding the assignment of lay judges to participate in trials;

d) Annually, coordinate with the People's Lay Judge Panel to prepare the budget for supporting the activities of the People's Lay Judge Panel. The Provincial People's Court compiles and prepares the budget for supporting the activities of the People's Lay Judge Panel to be submitted to the competent authority as prescribed by law; đ) Implement management, payment, and settlement of funds supporting the activities of the People's Lay Judge Panel;

e) Ensure conditions for operation, arrange office space for the People's Lay Judge Panel; guide and inspect the use of funds supporting the activities of the People's Lay Judge Panel in accordance with the law.

2. Responsibilities of the Military Court at the Military Zone Level and Regional Military Court:

a) The Chief Justice of the Military Court

proposes the Political Chief of the Military Zone, Service, General Department, or Equivalent Level to appoint, appoint, and remove the Head and Deputy Head of the Military Lay Judge Panel; b) Maintain contact with the Military Lay Judge Panel;

c) The Chief Justice of the Military Court examines and resolves recommendations from the Military Lay Judge Panel; examines and resolves recommendations from the Head of the Military Lay Judge Panel regarding the assignment of military lay judges to participate in trials;

d) Annually, coordinate with the Military Lay Judge Panel to prepare the budget for supporting the activities of the Military Lay Judge Panel. The Military Court at the Military Zone Level compiles and prepares the budget for supporting the activities of the Military Lay Judge Panel to be reported to the Central Military Court to be submitted to the Ministry of National Defense as prescribed;

d) Annually, coordinate with the People's Lay Judge Panel to prepare the budget for supporting the activities of the People's Lay Judge Panel. The Provincial People's Court compiles and prepares the budget for supporting the activities of the People's Lay Judge Panel to be submitted to the competent authority as prescribed by law; đ) Implement management, payment, and settlement of funds supporting the activities of the Military Lay Judge Panel;

e) The Chief Justice of the Military Court ensures conditions for operation, arranges office space for the Military Lay Judge Panel, guides and inspects the use of funds supporting the activities of the Military Lay Judge Panel in accordance with the law.

3. Responsibilities of the Supreme People's Court:

Annually, the Supreme People's Court is responsible for compiling the budget for supporting the activities of the People's Lay Judge Panels within the total budget for the activities of the People's Courts at all levels, and proposing to the Government to submit to the National Assembly for decision in accordance with the law. Based on the allocated budget, the Supreme People's Court allocates funds for supporting the activities of the People's Lay Judge Panels.

Annually, the Supreme People's Court is responsible for compiling the budget estimate of financial support for the activities of the People's Assessors' Groups into the overall budget estimate of the operations of courts at all levels, and proposing to the Government to submit to the National Assembly for decision in accordance with the provisions of the law. Based on the allocated funds, the Supreme People's Court allocates the financial support for the activities of the People's Assessors' Groups.

Article 19. Responsibilities of the Standing Board of the Vietnam Fatherland Front Provincial Committee

1. Coordinate with the Standing Board of the People's Council and the Chief Justice of the People's Court at the provincial level in the election, appointment, and removal of the President and Vice-President of the People's Censorship Delegation.

2. Coordinate with the People's Council at the provincial level to supervise the activities of the People's Censorship Delegation.

3. Attend summary and final meetings on the work of the People's Censorship Delegation.

Article 20. Responsibilities of agencies, organizations, units, and individuals

Within their respective functions and tasks, agencies, organizations, units, and individuals have the responsibility to assist and create favorable conditions for the People's Censorship Delegation to carry out its activities.

Chapter V
CONDITIONS TO ENSURE THE ACTIVITIES OF THE PEOPLE'S CENSORSHIP DELEGATION

Article 21. Funding for the Activities of the People's Censorship Delegation

1. The funding for the activities of the People's Censorship Delegation includes funds for organizing conferences, seminars, and discussions to fulfill the responsibilities and rights of the People's Censorship Delegation as stipulated in Articles 5 and 11 of this Regulation, and monthly activity allowances for the President and Vice-Presidents of the People's Censorship Delegation as specified in Article 22 of this Regulation.

The funding for the activities of the People's Censorship Delegation shall be guaranteed from the state budget and allocated as a separate item within the operating budget of the People's Court and Military Court where the People's Censor performs judicial duties.

2. The management and utilization of the funding for the activities of the People's Censorship Delegation shall be carried out in accordance with the provisions of the law.

Article 22. Activity Allowances for the President and Vice-Presidents of the People's Censorship Delegation

The President of the People's Censorship Delegation and the President of the Military People's Censorship Delegation shall receive a monthly activity allowance equal to 40% of the basic salary. The Vice-Presidents of the People's Censorship Delegation and the Vice-Presidents of the Military People's Censorship Delegation shall receive a monthly activity allowance equal to 30% of the basic salary.
