Regarding the establishment of the Management Board of Van Phong Economic Zone in Khanh Hoa Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Pursuant to Decision No. 92/2006/QĐ-TTg dated April 25, 2006 of the Prime Minister on the establishment and issuance of the Operation Regulations of Van Phong Economic Zone in Khanh Hoa Province.

Considering the proposal of the Chairman of the People's Committee of Khanh Hoa Province and the Minister of Home Affairs,

Article 1. The Management Board of Van Phong Economic Zone in Khanh Hoa Province shall be established and the Management Board of industrial zones in Khanh Hoa Province shall be merged into the Management Board of Van Phong Economic Zone.

The Management Board of Van Phong Economic Zone is a state management agency under the People's Committee of Khanh Hoa Province responsible for managing the construction and development of Van Phong Economic Zone and industrial zones within the territory of Khanh Hoa Province according to the operation regulations, planning, plans, and implementation schedules approved by competent state authorities.

The Management Board of Van Phong Economic Zone has legal personality, bank accounts, office premises, and seals with the national emblem; it serves as the planning and budget focal point of the People's Committee of Khanh Hoa Province, and is allocated separate investment development capital from the central government budget. Operating expenses of the Management Board are funded by the state budget.

Article 2. The Management Board of Van Phong Economic Zone in Khanh Hoa Province shall have the following responsibilities:

1. Tasks and powers as stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government;

2. Tasks and powers as stipulated in Article 27 of the Operation Regulations of Van Phong Economic Zone in Khanh Hoa Province issued together with Decision No. 92/2006/QĐ-TTg dated April 25, 2006 of the Prime Minister;

3. Other duties and powers as prescribed by law.

Article 3. Organizational structure and staffing of the Management Board of Van Phong Economic Zone in Khanh Hoa Province:

1. Organizational structure:

a) The Management Board of Van Phong Economic Zone in Khanh Hoa Province shall have a Director appointed by the Prime Minister; several Deputy Directors and several members appointed by the Chairman of the People's Committee of Khanh Hoa Province upon the recommendation of the Board Director.

b) The Management Board of Van Phong Economic Zone in Khanh Hoa Province shall have an administrative support staff including an office and specialized departments.

c) Affiliated public service units.

Depending on the requirements for the development of Van Phong Economic Zone and industrial zones in Khanh Hoa Province at each specific stage, the Director of the Management Board of Van Phong Economic Zone shall submit organizational structure proposals to the Chairman of the People's Committee of Khanh Hoa Province for decision within their authority.

2. Staffing:

The staffing of the Management Board of Van Phong Economic Zone includes the Director, specialized Deputy Directors, and the staffing of the office and specialized departments are civil service positions.

The staffing of the Management Board of Van Phong Economic Zone in Khanh Hoa Province shall be decided by the Chairman of the People's Committee of Khanh Hoa Province in accordance with the provisions of laws on decentralization of civil service and public service staffing management mechanisms for state-owned public service units.

Article 4. The Director of the Management Board of Van Phong Economic Zone shall submit to the People's Committee of Khanh Hoa Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board of Van Phong Economic Zone in accordance with the law.

Article 5. This Decision shall take effect 15 days after its publication in the Official Gazette.

This Decision replaces Decision No. 153/1998/QĐ-TTg dated August 25, 1998 of the Prime Minister on the establishment of the Management Board of industrial zones under the People's Committee of Khanh Hoa Province.

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the People's Committee of Khanh Hoa Province, and the Director of the Management Board of Van Phong Economic Zone in Khanh Hoa Province are responsible for implementing this Decision. /.
