Decision No. 12/2018/QD-TTg on criteria for selecting and recognizing persons of influence and policies towards persons of influence among ethnic minority communities

ON CRITERIA FOR SELECTING AND RECOGNIZING PERSONS OF REPUTATION AND POLICIES FOR PERSONS OF REPUTATION AMONG ETHNIC MINORITY COMMUNITIES

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Government Decree No. 05/2011/NĐ-CP dated January 14, 2011 on ethnic affairs;

Pursuant to the Government Resolution No. 106/NQ-CP dated October 10, 2017 on the regular meeting of the Government in September 2017;

At the proposal of the Minister, Head of the Committee for Ethnic Minorities;

The Prime Minister issues this Decision on criteria for selecting and recognizing persons of reputation and policies for persons of reputation among ethnic minority communities.

Article 1. Scope of Regulation

This Decision stipulates criteria for selecting and recognizing persons of reputation and policies for persons of reputation among ethnic minority communities throughout the country.

Article 2. Applicability

1. Persons of reputation among ethnic minority communities (hereinafter referred to as persons of reputation).

2. Agencies, organizations, and individuals involved in managing and implementing policies for persons of reputation.

Article 3. Principles of Implementation

1. Persons of reputation are selected from villages, hamlets, neighborhoods, and equivalent units (collectively referred to as villages).

2. Policies are directly implemented for persons of reputation, ensuring transparency, fairness, correct target groups, and appropriate benefits.

3. Persons of reputation are directly managed by localities, assigned and delegated to implement policies and mobilize the role of persons of reputation within their provincial jurisdiction.

4. In cases where persons of reputation belong to multiple support policy target groups with similar characteristics, they shall only enjoy one policy with the highest level of support.

Article 4. Criteria, Target Groups, and Conditions for Selecting Persons of Reputation

1. Criteria for Selecting Persons of Reputation

a) Being a Vietnamese citizen, regardless of ethnicity, residing legally in Vietnam;

b) Personally and family-wise exemplary in complying with Party guidelines, State policies and laws, and local regulations;

c) Being a model with significant contributions to patriotic campaigns, poverty reduction, security maintenance, cultural preservation, and ethnic unity;

d) Understanding traditional culture, customs, and practices of the ethnic group; having close ties and influence within the clan, ethnic group, and community;

đ) Possessing the ability to unite and gather ethnic minority communities within a certain scope through speech and actions, gaining trust and following from the people in the community;

2. Target Groups for Selection

Persons of reputation are selected from the following groups:

a) Officials, civil servants, employees, and members of armed forces as prescribed by current laws with long-term service and contributions to the nation who have retired;

b) Village elders, village chiefs, clan leaders, or individuals frequently invited by ethnic minority communities to perform rituals for families, clans, and villages;

c) Religious officials in ethnic minority regions (Buddhism, Islam, Protestantism, Catholicism, etc.);

d) Intellectuals, entrepreneurs, educators, skilled healers, or individuals with economic means who assist and are trusted by the community.

3. Conditions for Electing Persons of Reputation

a) Each village in ethnic minority areas must have at least one-third of households or population from ethnic minorities elect one person of reputation;

b) In cases where villages do not meet the conditions specified in point a Clause 3 of this Article or have multiple ethnic groups cohabiting, based on actual circumstances and recommendations from the Chairman of the People's Committee of the district and the Chairman of the People's Committee of the province, the number of persons of reputation to be elected shall be decided, but the total number of persons of reputation elected shall not exceed the total number of villages in ethnic minority areas within the province.

Article 5. Treatment and policies for persons of prestige

1. Provision of Information

a) Periodically or unexpectedly, persons of prestige shall be informed about new policies, guidelines of the Party, state policies and laws, economic and social development situations and tasks, national defense and public security, and the results of implementing programs, projects, and ethnic policies currently being implemented at the local level;

b) Persons of prestige shall be provided free of charge: one copy of the Ethnic Groups and Development Newspaper issued by the Committee for Ethnic Minorities Affairs; one copy of the provincial newspaper or other suitable information provision methods chosen by the locality;

c) Persons of prestige shall be trained and educated on legal knowledge, national defense, public security, ethnic policies, and mediation, propaganda, and mobilization skills;

d) Depending on the specific situation of each locality, persons of prestige may visit, study, and exchange experiences within and outside the province regarding economic and social development,新农村发展建设，保持民族文化特色和民族团结由地方确定并组织实施。

2. Material support and spiritual encouragement

In accordance with the management hierarchy to implement policies, persons of prestige shall be entitled to:

a) Visits and gifts during Tet and ethnic minority festivals not more than twice a year; expenditure not exceeding 500,000 VND per person per occasion;

b) Visits and assistance when persons of prestige fall ill not more than once a year. Expenditure: not exceeding 3,000,000 VND per person per year at the central level; not exceeding 1,500,000 VND per person per year at the provincial level; not exceeding 800,000 VND per person per year at the district level;

c) Visits and assistance to households of persons of prestige facing difficulties (natural disasters, fires). Expenditure not exceeding 2,000,000 VND per household per year at the central level; not exceeding 1,000,000 VND per household per year at the provincial level; not exceeding 500,000 VND per household per year at the district level;

d) Condolences and encouragement when persons of prestige or their family members (father, mother, spouse, children) pass away. Expenditure not exceeding 2,000,000 VND per case at the central level; not exceeding 1,000,000 VND per case at the provincial level; not exceeding 500,000 VND per case at the district level;

3. Awards

Persons of prestige who achieve outstanding results in labor production, economic and social development, national security, public order, preserving cultural identity, and ethnic unity shall be commended and rewarded according to the provisions of the Law on Competition and Rewards and current guiding documents on competition and rewards.

4. Delegations of persons of prestige organized by localities to visit and work at Party, National Assembly, State, and All-Vietnam Association for the Propagation of the Fatherland's Unity at the central and local levels shall be received and presented with souvenirs. The expenditure for presenting gifts shall not exceed 500,000 VND per delegate; reception expenses shall be carried out according to current regulations on domestic guest reception expense regimes.

Article 6. Procedures for recognizing and removing from the list of persons of prestige

1. Recognition of persons of prestige

Persons of prestige shall be selected and recognized every five years, conducted in the fourth quarter and completed before December 15 of the selection year, following the procedures below:

a) The village head shall convene a village meeting (with participation of at least two-thirds of households in the village) to disseminate the main contents of the policy, criteria, and conditions for selecting persons of prestige as stipulated in Clause 3, Article 4 of this Decision, and nominate persons of prestige (using Model No. 01 attached to this Decision) to send to the village mass organization work board head.

The village mass organization work board head shall convene a joint meeting (with participation of representatives from the Village Party Branch, local administration, village mass organization, and community organizations, and household representatives in the village), compile a list of nominations for recognition of persons of prestige to submit to the People's Committee of the commune (one set of files including: the nomination letter and the minutes of the joint meeting using Model No. 02 attached to this Decision);

b) Within five working days from the date of receiving complete valid files from the village, the People's Committee of the commune shall aggregate, inspect, and compile files (one set including: the nomination letter along with the list and minutes using Model No. 03 attached to this Decision) to send to the People's Committee of the district;

c) Within five working days from the date of receiving complete valid files from the communes, the People's Committee of the district shall aggregate, inspect, and compile files (one set including: the nomination letter, the list using Model No. 04 attached to this Decision, and the summary of nomination files from the communes) to send to the provincial ethnic affairs agency;

d) Within five working days from the date of receiving complete valid files from the districts, the provincial ethnic affairs agency shall aggregate, coordinate with the provincial police force, the provincial Vietnam Fatherland Front, and related functional agencies to complete files (one set including: the proposal, the list of nominations for recognition of persons of prestige using Model No. 04 attached to this Decision, and the summary of nomination files from the districts), to submit to the Chairman of the Provincial People's Committee for approval of the list of persons of prestige in the province.

2. Supplementing persons of prestige

a) Annually, the Chairman of the Provincial People's Committee shall consider and decide to supplement persons of prestige based on the proposal of the Chairman of the District People's Committee for the following cases:

- To replace cases as specified in point a, Clause 3, Article 5 of this Decision.

- Areas without persons of prestige and meeting the conditions stipulated in Clause 3, Article 4 of this Decision.

b) The procedure for supplementing persons of prestige shall be carried out in accordance with the provisions of Clause 1 of this Article.

3. Removing from the list of persons of prestige

a) Cases for removal from the list of persons of prestige:

- The person of prestige has passed away.

- The person of prestige has moved to live elsewhere or due to poor health, voluntarily requests to be removed from the list of persons of prestige (using Model No. 05 attached to this Decision).

- The person of prestige violates the law.

- The person of prestige loses civil capacity according to current laws.

- The person of prestige loses prestige and does not meet the criteria stipulated in Clause 1, Article 4 of this Decision.

b) Procedure for removing from the list of persons of prestige:

- When the cases specified in point a Clause 3 of this Article occur, the Head of the Village Mass Mobilization Work Committee shall convene a joint meeting (with the participation of representatives from the Party Branch, local administration, Village Mass Mobilization Work Committee, mass organizations, and representatives of households in the village), prepare a proposal to remove from the list of persons of influence, and submit it to the People's Committee of the commune (one set including: the proposal document, the minutes of the meeting according to Form No. 06 attached to this Decision, and related documents).

- Within five working days from the date of receipt of the village's proposal document, the People's Committee of the commune shall examine and prepare a file (one set including: the proposal document, the minutes according to Form No. 07 attached to this Decision, and related documents) and submit it to the People's Committee of the district.

- Within five working days from the date of receiving complete and valid files from the commune, the People's Committee of the district shall consolidate, examine, and prepare a file (one set including: the proposal document accompanied by a list and a summary of the proposal files from the commune) for submission to the Chairman of the People's Committee of the district to send to the provincial ethnic affairs agency.

- Within five working days from the date of receiving complete and valid files from the district, the provincial ethnic affairs agency shall consolidate and coordinate with the provincial public security agency, the Provincial Vietnam Fatherland Front Committee, and relevant functional agencies to complete the file (one set including: the report accompanied by the list of proposals to remove from the list of persons of influence and a summary of the proposal files from the districts) for submission to the Chairman of the People's Committee of the province to decide on removing from the list of persons of influence within the provincial territory.

Article 7. Funding for Implementation of Policies

1. The funding for implementing policies towards persons of influence shall be guaranteed by the state budget.

2. Central Budget

a) Allocate funds in the annual budget of the National Ethnic Minorities Commission and relevant central agencies to implement activities as prescribed in Article 8 of this Decision;

b) Support funding for difficult areas that have not yet achieved budget self-sufficiency under the mechanism stipulated in Decision No. 579/QĐ-TTg dated April 28, 2017 of the Prime Minister regarding the principles of targeted support from the central budget to local budgets for implementing social welfare policies during the period 2017-2020, as provided for in point b Clause 1 and Clause 2 of Article 5 of this Decision.

3. Local Budget

a) Allocate and balance in the annual budget of provinces and cities according to the provisions of the State Budget Law to implement remaining systems and policies as prescribed in this Decision and manage and organize the implementation of policies at the local level;

b) Based on the content of the policies prescribed in this Decision, localities may provide support and create conditions for persons of influence to perform their assigned tasks in accordance with the actual conditions of the locality.

4. The preparation, execution, and settlement of funding for implementing policies as prescribed in this Decision shall be carried out in accordance with the State Budget Law and related guiding documents.

Article 8. Implementation organization

1. The National Ethnic Minorities Commission shall take the lead and coordinate with relevant ministries, sectors, and agencies:

a) Guide, urge, inspect, summarize, evaluate, and report on the results of implementing this Decision;

b) Implement the issuance of the Ethnic Minority and Development Report for persons of influence; organize training, provide information, and materials for agencies, organizations, and units responsible for managing and implementing policies and mobilizing persons of influence in localities;

c) Organize receptions, visits, exchanges, meetings, seminars, discussions, commendations, and rewards for outstanding and excellent persons of influence in ethnic minority regions across the country.

2. The Ministry of Finance shall guide the financial management mechanisms for using funds to implement policies as prescribed in this Decision; allocate funds to implement policies as prescribed in Clause 2 of Article 7 of this Decision.

3. The Ministry of Public Security and the Ministry of Defense shall take the lead and coordinate with the National Ethnic Minorities Commission to implement policies as prescribed in this Decision for persons of influence assigned to management.

4. The Ministry of Information and Communications shall take the lead and coordinate with the National Ethnic Minorities Commission, relevant ministries, sectors, and localities to direct news agencies, press, and grassroots information systems to strengthen information dissemination and propaganda on policy implementation and mobilization efforts to leverage the role of persons of influence in diverse and appropriate forms for ethnic minorities.

5. Relevant ministries and sectors shall, according to their assigned functions and responsibilities, cooperate with the National Ethnic Minorities Commission to guide, urge, inspect, and support localities in effectively implementing policies as prescribed in this Decision.

6. Request the Central Vietnam Fatherland Front Committee and its member organizations to direct levels along the vertical line to coordinate in implementation and participate in supervising policy implementation as prescribed.

7. Provincial People's Committees

a) Shall directly and comprehensively be responsible for compiling lists,分级任务以确保准确翻译每个部分。以下是第1到第4段的翻译：

b) Entrust the provincial ethnic work agency, which serves as the permanent office assisting the provincial People's Committee in directing, guiding, and organizing the implementation of this Decision;

Direct the relevant local agencies to regularly inspect and supervise to ensure that policies are implemented correctly according to target groups, regulations, and in a timely manner; periodically summarize, evaluate, and report on the implementation results of the policies to the National Ethnic Committee for consolidation and reporting.

Article 9. Transitional Provisions

In 2018, localities shall review the current list of people with prestige, unify the beneficiary subjects, and approve a list of people with prestige within their province according to Clause 1 of Article 6 of this Decision. Subsequent years shall be implemented in accordance with Article 6 of this Decision.

Article 10. Implementation Provisions

1. This Decision takes effect from April 24, 2018.

2. This Decision replaces the following documents and relevant provisions: Decision No. 18/2011/QĐ-TTg dated March 18, 2011 of the Prime Minister on policies for people with prestige among ethnic minorities; Decision No. 56/2013/QĐ-TTg dated October 7, 2013 of the Prime Minister amending and supplementing certain Articles of Decision No. 18/2011/QĐ-TTg dated March 18, 2011 of the Prime Minister; Point a, Clause 4, Article 1 of Decision No. 2561/QĐ-TTg dated December 31, 2016 of the Prime Minister approving the Project "Strengthening the role of people with prestige in ethnic minority areas"; Circular Joint No. 01/2014/TTLT-UBDT-BTC dated January 10, 2014 of the Committee for Ethnic Minorities and the Ministry of Finance detailing and guiding the implementation of policies for people with prestige among ethnic minorities; Section I (identifying people with prestige in ethnic minorities) and Clause 1, Section II (establishing a list of people with prestige) of Guidance No. 04/HD-BCA(A11) dated March 16, 2009 of the Ministry of Public Security guiding the implementation of Directive No. 06/2008/CT-TTg dated February 1, 2008 of the Prime Minister on promoting the role of people with prestige among ethnic minorities in the cause of building and defending the country.

3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./

* Note:

- Secret ballot or raising hands vote as decided by the meeting. The person selected and recommended as a person with prestige must obtain over 50% agreement from the total number of representatives attending the meeting and have the highest percentage of votes.

Note: - In case the person of reputation dies: no joint meeting will be organized. The Village Head shall prepare a document proposing removal from the list of persons of reputation to be submitted to the People's Committee of the commune;

Based on the proposals from the communes and the verification results, based on the provisions of Decision No. 12/2018/QĐ-TTg dated March 6, 2018 of the Prime Minister and the opinions of representatives of the departments, organizations, and associations attending the meeting, the meeting unanimously proposes that the People's Committee of the district/county/city consider removing from the list of persons of reputation the following cases:

- Secret ballot must be conducted, and the person proposed for removal from the list of persons of reputation must receive more than 50% of the total number of attendees' votes in favor.

- Specify the reasons for proposing removal or not proposing removal from the list of persons of reputation.
