Guidelines for criteria to evaluate and classify cooperatives

Pursuant to the Law on Cooperatives 2003;
Pursuant to Decree No. 177/2004/NĐ-CP dated October 12, 2004 of the Government detailing certain provisions of the Law on Cooperatives 2003;
Pursuant to Directive No. 22/2003/CT-TTg dated October 3, 2003 of the Prime Minister on continuing to promote the implementation of Resolution No. 5 of the Ninth Plenum of the Party Central Committee on collective economic development;
Pursuant to the Government Decree No. 61/2003/NĐ-CP dated June 6, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
The Ministry of Planning and Investment provides guidelines for criteria to evaluate and classify cooperatives as follows:
I. OBJECTIVES AND APPLICABLE SUBJECTS
1. Objective
a. Evaluation criteria for cooperatives help cooperative members and state management agencies uniformly assess the results of implementing the Law on Cooperatives 2003 and the activities of cooperatives.
b. Classification criteria for cooperatives help improve the effectiveness of state management over cooperatives, contributing to the implementation of support policies that encourage the development of cooperatives in the right target groups.

a. Cooperatives (including People's Credit Funds) registered to operate under the Law on Cooperatives 2003. For People's Credit Funds, the evaluation and classification shall be carried out in accordance with the regulations of the State Bank of Vietnam;
b. Ministries, ministerial-level agencies, and local People's Committees at all levels performing state management functions over cooperatives as stipulated in Article 24.
II. CRITERIA FOR EVALUATING COOPERATIVES
1. Evaluation Criteria
Cooperatives are evaluated based on the following six criteria:
a. Degree of democracy and member participation in drafting and implementing the Charter of the cooperative;
b. Degree of completion of production and business plan targets set forth in the Members' Congress Resolution;
c. Degree of meeting the needs of economic activities and the living standards of members;
d. Degree of trust of members in the cooperative;
e. Degree of general welfare created by the cooperative for all members;
g. Degree of solidarity and cooperation among members and community building within the cooperative.
2. Methods of evaluation
a. Members directly evaluate the cooperative;
b. The Management Board and Supervisory Board of the cooperative disseminate to members a clear understanding of the basic contents of the Law on Cooperatives 2003, Decree No. 177/2004/NĐ-CP dated October 12, 2004, and Decree No. 77/2005/NĐ-CP dated June 9, 2005 through appropriate forms during the annual Members' Congress;
c. Each criterion is evaluated using a scoring method as follows:
Criterion 1: Criterion regarding The degree of democracy and member participation in drafting and implementing the Charter of the cooperative is evaluated from 0 points to 10 points.
A higher score indicates a higher degree of democracy and more active member participation in drafting and implementing the Charter of the cooperative.
Criterion 2: Criterion regarding The degree of completion of production and business plan targets set forth in the Members' Congress Resolution is evaluated from 0 points to 10 points.
A higher score indicates a higher degree of completion of production and business plan targets.
Criterion 3: Criterion regarding The degree of meeting the needs of economic activities and the living standards of members is evaluated from 0 points to 10 points.
A higher score indicates a higher degree of meeting the needs of economic activities and the living standards of members.
Criterion 4: Criterion regarding The degree of trust of members in the cooperative is evaluated from 0 points to 10 points.
A higher score indicates a higher degree of trust of members in the cooperative.
Criterion 5: Criterion regarding The degree of general welfare created by the cooperative for all members is evaluated from 0 points to 5 points.
General welfare includes contributions to building cultural houses, schools, health stations, information centers, organizing tours, tourism, cultural activities, entertainment, rest, etc...
A higher score indicates a higher degree of contribution of the cooperative in building welfare facilities or organizing welfare activities for the community of members.
Criterion 6: Criterion regarding The degree of solidarity and cooperation among members and community building within the cooperative is evaluated from 0 points to 5 points.
A higher score indicates a higher degree of solidarity and cooperation among members within the cooperative.
3. Aggregating Evaluation Results
a. Reviewing evaluation forms and summing up member scores
The Supervisory Board reviews each member's evaluation form according to Clause 2, Section II of this Circular, identifies any incorrect or incomplete forms to guide members to re-evaluate; collects valid evaluation forms.
b. Calculating average member scores
The Supervisory Board sums up the scores of valid forms, then divides the total score by the number of members with valid forms to calculate the average overall score of cooperative members and the average score of members for each criterion.
Example: At the Members' Congress, after distributing and guiding members to evaluate and score, the Supervisory Board collects 100 valid forms.
* Average score for each criterion = (Total score of 100 members for that criterion): 100 members.
** Overall average score for all six criteria = (Total score of 100 members for all six criteria): 100 members.
The results of checking and averaging the evaluation scores for each criterion and the overall average score of members are filled in Form DGHTX-2.
c. Classifying cooperatives
Based on the average overall score of cooperative members, the Supervisory Board classifies the cooperative into one of four levels according to the following scale:
(1). Excellent level: average score reaches from 45 to 50 points;
(2). Good level: average score reaches from 35 to less than 45 points;
(3). Average level: average score reaches from 25 to less than 35 points;
(4). Average level: average score reaches from 25 to less than 35 points;
d. Announcing the classification results of cooperatives
The classification results of cooperatives into four levels and for each criterion are publicly announced at the annual Members' Congress.
Cooperative Members' Congress bases the results of cooperative classification to identify strengths and limitations of the cooperative to formulate plans for the next year.
Members have the right to check the classification results.
e. Retaining the classification results of cooperatives
All evaluation forms of members and the classification results of the cooperative shall be kept together with the member assembly file.
III. CRITERIA AND METHODS FOR CLASSIFYING COOPERATIVES
1. Criteria for classifying cooperatives by industry and profession
The classification of cooperatives according to their industry and profession is carried out based on the following two criteria:
a. Cooperatives are classified according to the industries and professions specified in Decree No. 75/CP of the Government dated October 27, 1993 (hereinafter referred to as Decree No. 75/CP) on the issuance of the national economic sector system.
b. In cases where a cooperative operates in multiple industries and professions, the cooperative will be classified according to the industry or profession with the highest revenue share.
2. Methods for classifying cooperatives by industry and profession
a. At the time of classifying cooperatives, the business registration authority shall classify cooperatives into the following twelve groups of industries and professions:
(1). Group of agricultural, forestry, and salt-making cooperatives (the first industry according to Decree No. 75/CP and additionally including salt-making).
(2). Group of fisheries cooperatives (the second industry according to Decree No. 75/CP).
(3). Group of industrial cooperatives (the third and fourth industries according to Decree No. 75/CP).
(4). Group of electricity production and distribution, gas, and water cooperatives (the fifth industry according to Decree No. 75/C).
(5). Group of construction cooperatives (the sixth industry according to Decree No. 75/CP).
(6). Group of trade cooperatives (the seventh industry according to Decree No. 75/CP).
(7). Group of transportation, warehousing, and telecommunications cooperatives (the ninth industry according to Decree No. 75/CP).
(8). Group of financial and credit cooperatives (the tenth industry according to Decree No. 75/CP).
(9). Group of science and technology cooperatives (the eleventh industry according to Decree No. 75/CP).
(10). Group of real estate trading and consulting service cooperatives (the twelfth industry according to Decree No. 75/CP).
(11). Group of education and training cooperatives (the fourteenth industry according to Decree No. 75/CP).
(12). Group of health, social assistance, personal and community service cooperatives (the fifteenth industry according to Decree No. 75/CP).
b. For cooperatives operating in multiple industries and professions among the twelve groups mentioned in point a, section of this article and having reports on business operation results, the cooperative will be classified according to the industry with the highest revenue share.
c. For newly established cooperatives that have registered for multiple industries and professions but have not yet reported business operation results, the business registration authority will classify the cooperative according to one (01) industry or profession from those registered by the cooperative and stipulated in Decree No. 75/CP, based on consultations with the cooperative.
3. State management division for cooperatives
Cooperatives assigned to a specific group of industries and professions according to the provisions of Government Decree No. 75/CP will be managed by the relevant Ministry, Department, or Agency as the lead agency responsible for state management of such cooperatives.
IV. IMPLEMENTATION
1. People's Committees at all levels shall disseminate this Circular to each cooperative and guide the Management Board and Supervisory Board of the cooperative to implement member evaluations and compile evaluation results at the member assembly.
2. Relevant Ministries and Departments shall further specify evaluation and classification criteria for cooperatives suitable to the characteristics of the industries they manage if necessary. The State Bank of Vietnam shall provide guidance on the content and format of evaluations and classifications for Credit Cooperative Funds.
3. The Management Board shall organize the implementation of evaluations on the performance of the Law on Cooperatives 2003 and the activities of the cooperative at the annual member assembly.
4. Reporting System:
a. The Management Board shall report the classification results using Form DGHTX-2 along with the business operation results of the cooperative to the district-level business registration authority and the commune-level People's Committee where the cooperative's main office is located, no later than February 28th of each year.
b. The district-level business registration authority shall compile the evaluation and classification results of cooperatives using Form DGHTX-3, report to the provincial-level business registration authority, and send them to related state management agencies at the same level, no later than March 15th of each year.
d. The provincial-level People's Committee shall submit a consolidated report on the evaluation and classification results of cooperatives using Form DGHTX-3 within its jurisdiction to the Ministry of Planning and Investment and related ministries and departments no later than March 31st of each year.
The Minister, Heads of ministerial-level agencies equivalent to ministries, and Chairpersons of provincial-level People's Committees directly under the central government shall direct the implementation of the guidelines set forth in this Circular. Any issues encountered during implementation should be promptly reflected to the Ministry of Planning and Investment for study and amendment.
This Circular takes effect fifteen days after its publication in the Official Gazette./.
