CIRCULAR
Guidelines on certain aspects of postal services provided by Vietnam Post
Pursuant to the Ordinance on Posts and Telecommunications dated May 25, 2002;
Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Pursuant to Decree No. 157/2004/NĐ-CP dated August 18, 2004 of the Government detailing the implementation of certain provisions of the Ordinance on Posts and Telecommunications regarding postal services;
Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on price management for postal and telecommunications service charges;
The Ministry of Posts and Telecommunications provides guidelines on certain aspects of postal services provided by Vietnam Post as follows:
1. The provisions on postal services under Article 15 of the Ordinance on Posts and Telecommunications shall be implemented as follows:
1.1. Basic postal services include the receipt, transfer, and delivery of mail items and parcels.
a) Mail items include letters, postcards, small packages, publications, and educational materials for the blind sent through the public postal network.
- Letters are information exchanged in written form, packaged, sealed, and addressed.
- Postcards are hardcover items sent without packaging and addressed.
- Small packages contain goods or merchandise.
- Publications are information in written form, printed or written on materials commonly used for printing and reproduced in multiple identical copies, sent without packaging.
- Educational materials for the blind are information written or printed in raised characters sent without packaging or printed sheets in raised characters for the blind. Audio recording devices for the blind are also considered educational materials for the blind if they are sent by schools for the blind, associations for the blind, or sent to such institutions.
Letters, postcards, publications, and small packages have a single-piece weight not exceeding two kilograms, while educational materials for the blind have a single-piece weight not exceeding seven kilograms.
b) Parcels are goods or merchandise packed and sent through the public postal network. Parcels have a single-piece weight not exceeding fifty kilograms.
c) Vietnam Post, based on the operating conditions of the enterprise and domestic and international regulations, specifies details regarding the size, packaging methods, acceptance conditions, and related instructions for mail items and parcels.
1.2. Additional postal services are supplementary services provided alongside basic postal services to meet user requirements. Additional postal services include:
a) Numbering service, where each mail item or parcel is assigned a unique number, and the sender receives a receipt indicating the number of the postal item;
b) Declaration service, where the sender declares the value of the mail item or parcel to receive corresponding compensation in case of loss or damage;
c) Notification service, where the sender receives a notification confirming the delivery of the mail item or parcel to the recipient's address;
d) Hand delivery service, where the sender requests the delivery of the mail item or parcel directly to the recipient at the specified address;
đ) Express delivery service, where the mail item or parcel or notice of its availability is delivered to the recipient's address immediately upon arrival at the delivery office;
e) Collect on delivery service, where the sender of the mail item or parcel requests Vietnam Post to collect payment from the recipient when delivering the mail item or parcel to the recipient or the recipient's address;
g) Prepaid commercial reply service, where the sender pays the postal charges in advance for reply mail items sent back in response to those they have sent;
h) Other additional postal services as prescribed by Vietnam Post.
1.3. Vietnam Post has the responsibility to guide users in selecting appropriate services and avoid conflicting service requirements.
2. The provisions on the delivery of mail items and parcels under Clause 2 of Article 17 of the Ordinance on Posts and Telecommunications shall be implemented as follows:
2.1. Mail items and parcels are deemed to have been delivered to the recipient when:
a) They are placed in a family mailbox or personal mailbox if a mailbox is installed at the recipient's address;
b) They are handed over to the recipient or a resident at the same address as the recipient;
c) They are placed in a rented mailbox if the recipient uses the rented mailbox service at the post office or service point;
d) They are handed over to administrative, clerical, or other departments responsible for receiving official documents and materials in cases where the recipient is an organization or an individual working at that organization;
đ) They are handed over to the recipient or a person authorized by the recipient at the post office or service point.
2.2. Vietnam Post shall specify and notify customers of situations requiring the presentation of identity documents when collecting mail items and parcels.
Identity documents include passports, identification cards, National Assembly representative cards, certificates and credentials issued by armed forces, and other types of identity documents issued by competent authorities as prescribed by law.
3. The provisions on prohibited items in mail items and parcels under Article 18 of the Ordinance on Posts and Telecommunications shall be implemented as follows:
3.1. Vietnam Post bases its guidance to customers on the documents and notifications of the Universal Postal Union, international treaties to which Vietnam is a party, and legal regulatory documents of other countries to implement the prohibition on sending certain items in mail items and parcels when sending internationally.
3.2. Vietnam Post bases its implementation and guidance to customers on legal regulatory documents of Vietnam in areas of security, import-export, cultural information, fire prevention and fighting, environment, and other relevant legal regulatory documents to implement the prohibition on sending certain items in mail items and parcels when sending domestically.
3.3. Vietnamese currency as stipulated in Clause 3 of Article 18 of the Ordinance on Posts and Telecommunications includes Vietnamese currency (paper money, metal coins, polymer money), banknotes, and negotiable instruments (stocks, bonds, bills, promissory notes) valued in Vietnamese currency.
3.4. Foreign exchange as defined in Clause 3, Article 18 of the Ordinance on Posts and Telecommunications shall be understood to include foreign currency (paper money, metal coins, polymer money), banknotes, securities (stocks, bonds, promissory notes, bills of exchange) valued in foreign currency.
3.5. The Vietnamese Post regulations concerning conditional sending cases for items not prohibited from being sent according to Article 18 but which require certain conditions regarding accompanying documents and packaging methods to be sent through the public postal network.
4. The provisions on not charging for postal service usage fees at Clause 4, Article 32 of Decree No. 157/2004/ND-CP and Point d, Clause 2, Article 4 of Decision No. 217/2003/QĐ-TTg shall be implemented as follows:
4.1. Not charging for basic postal services and additional postal services for domestic and international parcels and letters sent for the purpose of exchange between postal management and operational agencies at various levels.
4.2. Not charging for basic domestic and international postal services for:
a) Educational materials for the blind;
b) Parcels and letters sent to prisoners of war and civilians detained during wartime, directly or through authorized agencies.
4.3. The Ministry of Posts and Telecommunications decides on not charging for postal service usage in other specific cases.
5. This Circular takes effect fifteen days after its publication in the Official Gazette.
