Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Based on Decree No. 42/2010/NĐ-CP dated April 15, 2010, issued by the Government detailing the implementation of certain provisions of the Law on Encouragement of Competitiveness and Commendation and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement of Competitiveness and Commendation;
Based on Decision No. 227/2006/QĐ-TTg dated October 11, 2006, issued by the Prime Minister regarding the issuance of the Regulation on the organization and operation of the Steering Committee for the Movement "All People United to Build a Cultural Life";
during the period 2011-2015, with orientation towards 2020;
Implementing Decision No. 1610/QĐ-TTg dated September 16, 2011, issued by the Prime Minister approving the Program for implementing the Movement "All People United to Build a Cultural Life" for the period 2011-2015, with orientation towards 2020;
After reaching consensus with the Vietnam General Confederation of Labor through Circular No. 2176/TLĐ dated December 26, 2011, the Ministry of Culture, Sports and Tourism details the standards, procedures, and processes for examining and recognizing "Organizations meeting cultural standards", "Units meeting cultural standards", "Enterprises meeting cultural standards", with the following contents:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
2. Applicability:
This Circular stipulates detailed standards, procedures, and processes for examining and recognizing "Organizations meeting cultural standards", "Units meeting cultural standards", "Enterprises meeting cultural standards" (hereinafter referred to as organizations, units, enterprises meeting cultural standards) within the Movement "All People United to Build a Cultural Life";

a) Organizations, units, enterprises having legal personality, with grassroots trade union organizations established;

c) Organizations, units, enterprises under the People's Army and the Public Security Force shall implement this Circular according to specific regulations of the Ministry of National Defense and the Ministry of Public Security;
Article 2. Implementation Principles
The initial recognition period for standardized cultural agencies, units, and enterprises is two (02) years or more from the date of registration; re-recognition occurs five (05) years after the previous recognition.
2. Recognition of organizations, units, enterprises meeting cultural standards is linked to commendation for organizations, units, enterprises that have outstanding achievements in implementing the Movement "All People United to Build a Cultural Life";

4. Uniformly use the model Certificate of Recognition for agencies, units, and enterprises meeting cultural standards attached as an appendix to this Circular.
Article 3. Competence and recognition period
1. Competence:
a) Organizations, units, enterprises meeting cultural standards at commune, ward, town level (collectively referred to as commune level); district, county, city directly under province level (collectively referred to as district level); provincial level, city directly under central government level (collectively referred to as provincial level); central-level organizations located in provincial territory shall be recognized and re-recognized by the Chairman of the Provincial Federation of Trade Unions;
b) Central-level organizations located in Hanoi City meeting cultural standards shall be recognized and re-recognized by the Chairman of the Vietnam Civil Servants' Federation, the Chairman of the Central Industry Federations, and the Trade Union of State-owned Enterprises directly under the Vietnam General Confederation of Labor, guided by the Vietnam General Confederation of Labor according to the provisions of this Circular;
2. Time limit:
The recognition period for organizations, units, enterprises meeting cultural standards for the first time is one (01) year or more from the date of registration; re-recognition after five (05) years from the date of previous recognition;
Chapter II
STANDARDS FOR EXAMINATION AND RECOGNITION OF "ORGANIZATIONS, UNITS, ENTERPRISES MEETING CULTURAL STANDARDS"
Article 4. Criteria for recognizing "Organizations meeting cultural standards", "Units meeting cultural standards"
1. Fulfilling tasks well:
a) Having regular, practical, and effective competitive movements contributing to the excellent completion of annual work plans;
b) Seventy percent or more of cadres, civil servants, and public officials regularly self-study or attend training courses on politics, professional skills, and vocational training;
c) Fulfill obligations and adhere to the ethics of officials, civil servants, and public employees as prescribed by law;
d) Improve the quality of public service activities in accordance with assigned functions and tasks;
đ) Have management innovations and experiences applied in practice;
2. Practicing civilized lifestyles and maintaining a cultural environment:
a) Eighty percent or more of cadres, civil servants, and public officials do not violate regulations on practicing civilized lifestyles, thrift in weddings, funerals, and festivals;
b) Not engaging in social evils; not using, storing, or circulating harmful cultural products; not promoting or performing superstitious activities;
c) Organizational activities are orderly; internal regulations and working rules are strictly followed; democratic regulations at the grassroots level are implemented well; internal unity and mutual assistance for progress are maintained;
d) No smoking in offices; no drinking alcohol during working hours; neat and appropriate attire; green, clean, beautiful, and safe workplaces; office courtyards are arranged according to regulations;
3. Setting a good example in adhering to Party guidelines, policies, and state laws:
a) One hundred percent of cadres and civil servants are familiar with and strictly adhere to Party guidelines, state policies, and local regulations;
b) No violations of laws requiring punishment from warnings upwards; the organization is safe and secure; no illegal appeals or complaints;
c) Administrative reform is effectively implemented; state budget and assigned funds are managed and utilized efficiently; there is no waste or corruption; active efforts are made to combat corruption;
Article 5. Criteria for recognizing "Enterprises meeting cultural standards"
1. Stable production and business operations with gradual development:
a) Achieving annual targets for production and business development;
b) The enterprise's brand and products have a good reputation in the market;
c) Improving management, innovating technology, enhancing production and business efficiency, reducing indirect costs; rationalizing labor distribution;
d) Seventy percent or more of workers are regularly trained and their skills improved; labor discipline, productivity, quality, and efficiency are ensured;
2. Practicing civilized lifestyles and maintaining a cultural environment in enterprises:
a) Harmonious and progressive labor relations between employers and employees;
b) Establish and effectively implement labor regulations; ensure labor safety, hygiene, and fire prevention;
c) Seventy percent or more of employers and employees comply with regulations on practicing civilized lifestyles in weddings, funerals, and festivals;
d) Not engaging in social evils; not using, storing, or circulating harmful cultural products; ensuring social order, security, and safety;
đ) Strictly follow environmental protection regulations; wastewater and garbage collection and treatment systems meet legal standards; the enterprise area is green, clean, and beautiful;
e) No smoking in offices; no drinking alcohol during working hours;
3. Improving the material and spiritual life of workers:
a) Seventy percent or more of workers have stable employment and income;
b) Facilitate workers' access to workplaces, housing, kindergartens, and group activities; support workers during difficult times;
c) Providing facilities for cultural and sports activities for workers; regularly organizing cultural, artistic, sports, sightseeing, and recreational activities for workers;
4. Strictly adhering to Party guidelines, state policies, and laws:
a) 100% of employers and workers are informed about relevant policies and laws;
b) Fulfill fully obligations to the State; actively participate in the Campaign "Day for the Poor", "Humanitarianism and Charity" and other social campaigns;
c) Strictly implement all legal rights and benefits of workers according to regulations;
d) Compete fairly in production and business operations as prescribed by law.
Chapter III
PROCEDURE AND PROCEDURES FOR REVIEWING AND RECOGNIZING "ORGANIZATIONS, UNITS, ENTERPRISES MEETING THE STANDARDS OF CULTURAL DEVELOPMENT"
Article 6. Registration Procedure, Examination and Recognition
1. The head of the organization, unit, enterprise registers to build the organization, unit, enterprise meeting the standards of cultural development with the Provincial Federation of Labor Unions; the Central Executive Committee of the Trade Union of Ministries, Sectors, and Mass Organizations.
2. The head of the organization, unit, enterprise reports achievements in building the organization, unit, enterprise meeting the standards of cultural development;
3. The County Steering Committee or the Central Executive Committee of the Trade Union of Ministries, Sectors, and Mass Organizations inspect and evaluate the results of implementing the recognition criteria for organizations, units, enterprises meeting the standards of cultural development;
4. The Provincial Federation of Labor Unions or the Central Executive Committee of the Trade Union of Ministries, Sectors, and Mass Organizations cooperate with the commendation and reward agency at the same level, submit to the Provincial Federation of Labor Unions or the Vietnam Civil Servants' Trade Union, the Central Trade Union of Sectors, or the Trade Union of State-Owned Enterprises under the Vietnam General Confederation of Labor for issuing decisions on recognizing, re-recognizing, and issuing Certificates of Recognition for organizations, units, enterprises meeting the standards of cultural development.
The processing time limit is ten (10) working days, starting from the date of receiving complete and valid dossiers.
5. Conditions for recognition
a) Meeting the standards prescribed in Article 4 and Article 5 of this Circular and additional criteria according to the regulations of the Provincial People's Committee; Central Ministries, Departments, and Mass Organizations (if applicable);
b) The time for registering to build the organization, unit, enterprise meeting the standards of cultural development is one (01) year or more (for initial recognition) and five (05) years or more since being recognized (for re-recognition).
Article 8. Recognition Procedures
1. Report on achievements in building the organization, unit, enterprise meeting the standards of cultural development by the head of the organization, unit, enterprise, confirmed by the head of the superior organization or unit:
- A report for one (01) year for initial recognition;
- A report for five (05) years for re-recognition.
2. A letter of request from the Chairman of the Provincial Federation of Labor Unions or the Chairman of the Central Executive Committee of the Trade Union of Ministries, Sectors, and Mass Organizations;
One (01) set of application files must be submitted directly to the Provincial Federation of Labor Unions or the Vietnam Civil Servants' Trade Union, the Central Trade Union of Sectors, or the Trade Union of State-Owned Enterprises under the Vietnam General Confederation of Labor.
3. Based on the application file and the Inspection Record of the County Steering Committee or the Central Executive Committee of the Trade Union of Ministries, Sectors, and Mass Organizations, the Chairman of the Provincial Federation of Labor Unions or the Chairman of the Vietnam Civil Servants' Trade Union, the Central Trade Union of Sectors, or the Trade Union of State-Owned Enterprises under the Vietnam General Confederation of Labor issues a decision recognizing the organization, unit, enterprise meeting the standards of cultural development and presents the Certificate of Recognition "Organization Meeting the Standards of Cultural Development", "Unit Meeting the Standards of Cultural Development", "Enterprise Meeting the Standards of Cultural Development". In cases where recognition is not granted, a written response must be provided with clear reasons.
Article 9. Awards
1. Encourage localities, sectors, mass organizations to base on their budget capabilities and socialized resources; provide material incentives in the form of benefits for organizations, units, enterprises meeting the standards of cultural development; support equipment for cultural and sports activities for organizations, units, enterprises meeting the standards of cultural development.
2. Outstanding organizations, units, enterprises meeting the standards of cultural development are commended by the Steering Committee of the "All-People Solidarity Cultural Life Construction Movement" at the provincial and central levels according to their authority and are recommended for commendation by competent authorities.
Chapter IV
IMPLEMENTATION
Article 9. Responsibility for Implementation
1. On the basis of the recognition criteria for organizations, units, enterprises meeting the standards of cultural development stipulated in this Circular, the People's Committees of provinces; members of the Central Steering Committee shall concretize and supplement appropriate criteria.
2. The Steering Committee of the "All-People Solidarity Cultural Life Construction Movement" at the provincial level and members of the Central Steering Committee shall direct the implementation, inspection, and enforcement of this Circular.
3. At all levels, the Federation of Labor Unions shall take the lead in developing plans and coordinate with relevant agencies and organizations to guide and implement this Circular; annually prepare budgets for directing implementation, inspection, evaluation, printing, and organizing the presentation of Certificates of Recognition for organizations, units, enterprises meeting the standards of cultural development, and report to the financial department at the same level for approval by competent authorities.
Article 10. Handling of violations
1. Organizations, units, enterprises meeting the standards of cultural development that fail to maintain the recognition criteria will not be re-recognized. If they seriously violate the standards, they will be removed from the list; the level that issued the recognition decision shall issue the decision to remove them from the list.
2. Individuals and collectives with authority during the process of recognizing organizations, units, enterprises meeting the standards of cultural development who commit violations leading to false achievements of organizations, units, enterprises shall be dealt with according to the provisions of the law depending on the nature and degree of violation.
Article 11. Implementation Provisions
This Circular takes effect forty-five (45) days from the date of signature.
During the implementation, if there are any arising issues or difficulties, please reflect them to the Ministry of Culture, Sports and Tourism for research and appropriate amendments and supplements./.
