Amending and supplementing Circular No. 06/2011/TT-BCT

dated March 21, 2011 of the Ministry of Industry and Trade on procedures for issuing certificates of origin for preferential goods

The Minister of Industry and Trade promulgates this Circular amending and supplementing Circular No. 06/2011/TT-BCT dated March 21, 2011 of the Ministry of Industry and Trade on procedures for issuing certificates of origin for preferential goods (hereinafter referred to as Circular No. 06/2011/TT-BCT of the Ministry of Industry and Trade) as follows:

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 19/2006/NĐ-CP dated February 20, 2006, promulgated by the Government detailing the Law on Commerce regarding the origin of goods;

Article 1. Amending and supplementing Clause 3, Article 3 and Article 9 of Circular No. 06/2011/TT-BCT dated March 21, 2011 of the Ministry of Industry and Trade

1. Amending Clause 3, Article 3 on the person requesting issuance of the Certificate of Origin (C/O) as follows:

"3. The person requesting issuance of the preferential C/O is a Vietnamese trader (referred to in this Circular as the person requesting issuance of the C/O), including the exporter, manufacturer, or the lawful representative of the exporter or manufacturer."

2. Supplementing Clause 9, Article 9 on the application dossier for issuance of the C/O as follows:

"9. In cases where export goods are stored in bonded warehouses, in addition to the documents and materials prescribed from Clause 1 to Clause 8 of Article 9, the person requesting issuance of the C/O shall submit the following additional documents and materials:

a. A declaration form for goods entering and leaving bonded warehouses with confirmation of arrival at the export customs checkpoint by the Customs authority and an export warehouse release note: one (1) copy certified true copy by the trader;

b. A contract or agreement signed between the Vietnamese trader and foreign customers storing goods in bonded warehouses, which stipulates that the Vietnamese trader delivers goods to importers in countries having Free Trade Agreements with Vietnam: one (1) copy certified and stamped true copy by the trader; or

c. A contract or agreement signed between foreign customers storing goods in bonded warehouses and importers in countries having Free Trade Agreements with Vietnam, which stipulates that the Vietnamese trader delivers goods to importers: one (1) copy certified and stamped true copy by the trader.

This Circular takes effect from February 16, 2013./.
