CIRCULAR

Announcing the port waters within the jurisdiction of Kien Giang Province

and the area under management of the Kien Giang Maritime Port Office

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;

On the basis of the opinions of the People's Committee of Kien Giang Province at Circular No. 1347/UBND-KTCN dated December 11, 2014;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

The Minister of Transport hereby issues this Circular to announce the port waters within the jurisdiction of Kien Giang Province and the area under management of the Kien Giang Maritime Port Office.

Article 1. Announcing the port waters within the jurisdiction of Kien Giang Province

The port waters of Kien Giang Province within its jurisdiction include the following water areas:

1. The port water area of Kien Giang at Hon Chong.

2. The port water area of Kien Giang at Binh Tri.

3. The port water area of Kien Giang at Ha Tien.

4. The port water area of Kien Giang at An Thoi - Duong Dong.

5. The port water area of Kien Giang at Bai Vuong - An Thoi.

6. The port water area of Kien Giang at Ganh Dau.

Article 2. Scope of the port waters within the jurisdiction of Kien Giang Province

The scope of the port waters of Kien Giang Province within its jurisdiction is defined according to the highest tidal level, as follows:

1. The scope of the port water area of Kien Giang at Hon Chong:

a) Seaward boundary: delimited by straight lines connecting points HC1, HC2, HC3, HC4, and HC5 with the following coordinates: HC1: 10°09'03" N, 104°35'59" E; HC2: 10°09'00" N, 104°34'10" E; HC3: 09°59'56" N, 104°33'36" E; HC4: 09°59'56" N, 104°35'33" E; HC5: 10°08'39" N, 104°35'56" E.

b) Landward boundary: from point HC1 running along the coastline southward to point HC5.

2. The scope of the port water area of Kien Giang at Binh Tri:

a) Seaward boundary: delimited by straight lines connecting points BT1, BT2, BT3, BT4, and BT5 with the following coordinates: BT1: 10°14'15" N, 104°35'08" E; BT2: 10°14'24" N, 104°24'00" E; BT3: 10°10'36" N, 104°24'00" E; BT4: 10°11'36" N, 104°32'36" E; BT5: 10°11'00" N, 104°35'20" E.

b) Landward boundary: from point BT1 running along the coastline southward to point BT5.

3. The scope of the port water area of Kien Giang at Ha Tien:

a) Seaward boundary: delimited by straight lines connecting points HT1, HT2, and HT3 with the following coordinates: HT1: 10°21'56" N, 104°26'36" E; HT2: 10°20'36" N, 104°27'36" E; HT3: 10°22'57" N, 104°29'00" E.

b) Landward boundary: from point HT1 running along the coastline to the mouth of To Chau River, then running along the right bank of the river (from the sea inward) to 100 meters downstream of Dong Ho Bridge, crossing the river along the left bank to the mouth of the river, and then running along the coastline to point HT3.

4. The scope of the port water area of Kien Giang at An Thoi - Duong Dong:

a) Seaward boundary: delimited by straight lines connecting points AT1, AT2, AT3, AT4, AT5, AT6, and AT7 with the following coordinates: AT1: 10°14'30" N, 103°56'47" E; AT2: 10°14'30" N, 103°50'00" E; AT3: 09°56'12" N, 104°00'00" E; AT4: 09°56'12" N, 104°02'42" E; AT5: 09°59'30" N, 104°02'24" E; AT6: 10°00'18" N, 104°01'42" E; AT7: 10°00'46" N, 104°00'54" E.

b) Landward boundary: from point AT1 running along the coastline southward to point AT7.

5. The scope of the port water area of Kien Giang at Bai Vuong - An Thoi:

a) Seaward boundary: delimited by straight lines connecting points BV1, BV2, BV3, and BV4 with the following coordinates: BV1: 10°12'48" N, 104°04'17" E; BV2: 10°12'48" N, 104°07'06" E; BV3: 10°00'19" N, 104°04'08" E; BV4: 10°00'19" N, 104°03'08" E (Mui Ong Doi).

b) Landward boundary: from point BV1 running along the coastline southward to point BV4.

6. The scope of the port water area of Kien Giang at Ganh Dau:

a) Seaward boundary: delimited by straight lines connecting points GD1, GD2, GD3, and GD4 with the following coordinates: GD1: 10°22'36" N, 103°51'36" E; GD2: 10°23'12" N, 103°51'00" E; GD3: 10°22'36" N, 103°49'12" E; GD4: 10°22'00" N, 103°49'50" E.

b) Landward boundary: from point GD1 running along the coastline southward to the tip of Ganh Dau to point GD4.

7. The boundaries of river mouths and creeks within the scope of the water areas specified in Clause 2, Clause 4, and Clause 5 of this Article are delimited by straight lines connecting the two most protruding points on either side of the river mouth or creek.

8. The boundaries of the port water areas specified in this Article are determined on Hydrographic Charts IA-100-31 published in 2008 and IA-100-32, first reprint in 2006, of the Vietnam Navy. The coordinates of the points specified in this Article are based on the VN-2000 Coordinate System and are converted to corresponding coordinate systems in the attached Appendix to this Circular.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and disembarkation zones, quarantine zones, anchorage zones, transshipment zones, and storm shelters for vessels entering and leaving the port waters within the jurisdiction of Kien Giang Province and other water areas and zones as prescribed.

Article 4. Responsibilities of the Kiên Giang Maritime Branch

1. Perform tasks and exercise powers as prescribed by the Vietnam Maritime Code and related legal documents concerning maritime activities at wharfs and port waters within the jurisdiction of Kiên Giang Province.

2. Based on actual conditions regarding weather, waves, wind, draft, tonnage of vessels, and nature of cargo, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid storms in accordance with regulations, ensuring safety, maritime security, and prevention of environmental pollution.

Article 5. State Management Responsibilities for Maritime Affairs in the Marine Area within the Jurisdiction of Kiên Giang Province

In addition to the port waters specified in Article 2 of this Circular, the Kiên Giang Maritime Branch also has the responsibility to manage state affairs concerning maritime safety, maritime security, and prevention of environmental pollution in the marine area within the jurisdiction of Kiên Giang Province.

Article 6. Effectiveness

This Circular takes effect from March 15, 2015. The Decision No. 41/2007/QĐ-BGTVT dated August 28, 2007 of the Minister of Transport promulgating the waters of ports within the jurisdiction of Kiên Giang Province and the management area of the Kiên Giang Maritime Branch is hereby abolished.

Article 7. Implementation Organization

The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Department of Transport of Kiên Giang Province, Directors of the Kiên Giang Maritime Branch, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular.
