Pursuant to the Civil Aviation Law of Vietnam No. 66/2006/QH11 dated June 29, 2006; Law No. 61/2014/QH13 dated November 21, 2014 amending and supplementing certain articles of the Civil Aviation Law of Vietnam;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 27/2011/NĐ-CP dated April 9, 2011 of the Government on providing, utilizing, processing, and using information about passengers before entering Vietnam via air transport;
Pursuant to Decree No. 66/2015/NĐ-CP dated August 12, 2015 of the Government stipulating the Civil Aviation Authority;
Pursuant to Decree No. 92/2015/NĐ-CP dated October 13, 2015 of the Government on civil aviation security;
stipulating on air cargo transportation and common aviation activities (hereinafter referred to as Circular No. 81/2014/TT-BGTVT dated December 30, 2014), Circular No. 14/2015/TT-BGTVT dated April 27, 2015 issued by the Minister of Transport
The Minister of Transport issues this Circular detailing the Civil Aviation Security Program and the quality control of civil aviation security in Vietnam.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular specifies civil aviation security, including preventive security measures, handling of security violations, and responses to illegal interventions; the organizational system for ensuring civil aviation security; facilities, equipment, devices, means, and support weapons and tools for ensuring civil aviation security; quality control of civil aviation security; responsibilities of organizations and individuals in civil aviation security work.
Article 2. Applicability
This Circular applies to:
1. Vietnamese organizations and individuals and foreign organizations and individuals engaged in civil aviation activities in Vietnam or within airspace under Vietnamese management.
2. Vietnamese organizations and individuals engaged in civil aviation activities abroad if foreign laws do not provide otherwise.
3. Vietnamese organizations and individuals and foreign organizations and individuals using official aircraft for civilian purposes.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. Mail includes letters, parcels, and cargo items accepted, transported, and delivered legally through the postal network.
2. Support tools include:
a) Types of guns used to shoot plastic bullets, rubber bullets, tear gas, suffocating gas, toxic substances, hypnotic substances, electromagnetic waves, lasers, flares, and ammunition for these types of guns;
b) Devices for spraying tear gas, suffocating gas, toxic substances, hypnotic substances, itching substances;
c) Smoke grenades, tear gas grenades, explosive devices;
d) Electric batons, rubber batons, metal batons, handcuffs, barbed wire, spiked belts, bulletproof vests, electric gloves, knife-catching gloves, shields, bulletproof helmets;
đ) Service animals.
3. Civil aviation security checkpoints are security checkpoints established at gates, doors, and passages between public areas and restricted areas.
4. In-flight service items are items for passengers and crew to use or sell on board the aircraft, except meals; items for aircraft operation, maintenance, and repair.
5. Unclaimed property is property left at airports that cannot be identified with a rightful owner.
6. Security surveillance in civil aviation involves the use of individuals, animals, and technical equipment to manage and monitor in order to detect and prevent acts violating or suspected of violating civil aviation security.
7. Civil aviation security screener permit are is the confirmation by the Civil Aviation Administration of Vietnam that a civil aviation security screener has the necessary qualifications to perform assigned tasks.
8. Goods is property carried by aircraft except mail, baggage, in-flight service items, and meals.
9. Transiting goods and mail are goods and mail transported on two or more different flights or modes of transportation, including air transport.
10. Baggage is property of passengers or crew carried by aircraft.
11. Hand luggage is luggage carried onto the aircraft by passengers or crew members and kept under their own supervision during transportation.
12. Checked baggage is luggage of passengers or crew members carried in the cargo hold of the aircraft and supervised by the carrier during transportation.
13. Unclaimed baggage is baggage arriving at an airport but not collected or claimed by passengers or crew.
14. Lost baggage is baggage separated from passengers or crew during transportation.
15. Transit passengers, baggage, cargo, and mail are passengers, baggage, cargo, and mail reboarding the same flight at an airport they previously arrived at.
16. Connecting passengers, baggage are passengers and baggage directly involved in two or more flights in a single journey.
17. Quality control activities in civil aviation security include inspections, audits, surveys, tests, evaluations, and investigations of civil aviation security:
a) Civil aviation security inspection is specialized aviation inspection conducted according to the provisions of the law on specialized inspection;
b) Civil aviation security quality check is the verification of compliance with some or all regulations in the Security Program and Security Regulations of the airport operator, airline, or air service provider;
c) Civil aviation security test is the assessment of the effectiveness of specific security measures by openly or secretly conducting simulated security violations;
d) Civil aviation security survey is the collection of information and data to quantify security needs and identify key areas requiring protection;
đ) Civil aviation security investigation is the process of clarifying illegal interventions, security violations, or suspected violations;
e) Civil aviation security evaluation is the review of compliance with some or all international civil aviation organization standards, foreign aviation authority regulations, or airline regulations on security.
18. Secure area is the area defined from the passenger security checkpoint to the aircraft door.
19. Baggage storage area is where checked baggage awaiting loading onto the aircraft, lost baggage, or unclaimed baggage is stored.
20. The aircraft maintenance and repair area is a zone serving for the maintenance and repair of aircraft; it includes aircraft parking areas, facilities, workshops, vehicle parking lots, and internal traffic systems.
21. Internal security control is a preventive security measure aimed at eliminating factors and conditions that terrorist entities or criminals may exploit, connect with, or recruit aviation staff to assist or directly commit acts of terrorism, crimes, and other violations.
22. Aircraft security inspection is the examination of the interior and exterior of the aircraft according to a list to detect suspicious items and dangerous articles.
23. Visual inspection is the direct use of hands, eyes, and other senses by aviation security personnel to inspect individuals, vehicles, and objects to identify and detect suspicious items and dangerous articles.
24. Background check is the verification of an individual's identity to assess their suitability for employment in aviation; issuance of long-term aviation security port access cards.
25. In-flight security officer is a person authorized by the state government operating the aircraft or the state government registering the aircraft to perform duties on board the aircraft with the purpose of protecting the aircraft and passengers from illegal interference.
26. Security sealing is the confirmation of goods, articles, and vehicles that have undergone aviation security inspections or the intact condition of sealed articles and vehicles.
27. Aircraft parking area is a designated zone within the airfield for aircraft to park for passenger boarding and disembarkation, baggage, mail, cargo handling, refueling, or maintenance.
28. Meal service includes food, beverages, and utensils used for meals on board the aircraft.
29. Aviation security violation incident is a breach of aviation security that does not amount to illegal interference.
30. In-flight aircraft is an aircraft as defined in Clause 2 of Article 74 of the Civil Aviation Law of Vietnam.
31. Operational aircraft is an aircraft bearing Vietnamese or foreign nationality parked at the aircraft parking area or ramp, preparing for flight operations and under continuous aviation security surveillance to detect unauthorized access or entry.
32. Non-operational aircraft is an aircraft bearing Vietnamese or foreign nationality parked at the aircraft parking area or ramp for more than twelve hours without continuous aviation security surveillance.
33. X-ray is a form of electromagnetic wave with wavelengths ranging from 0.01 nanometers to 10 nanometers corresponding to frequencies from 30 petahertz to 30 exahertz and energy levels from 120 electron volts to 120 kiloelectron volts.
34. Security plastic bag is a specialized plastic bag for containing liquids, thick substances, and sprays purchased at stores in international quarantine zones or on international flights. The transparent bag complies with Appendix XXV attached to this Circular, inside which there is a readable document without opening the bag, indicating the following contents:
a) Date of sale (day/month/year);
b) International code of the selling place (country, airport, airline);
c) Flight number; passenger name (if applicable);
d) Quantity and list of items in the bag.
35. Isolated parking position is an area within the airport designated for aircraft parking in cases of illegal interference to isolate them from other aircraft and airport facilities, including underground structures and equipment to implement emergency plans.
36. Weapons include military weapons, hunting guns, crude weapons, sports weapons, and other types of weapons with similar characteristics and functions.
a) Military weapons consist of small-caliber firearms (pistols, rifles, submachine guns, medium machine guns, and similar firearms); light weapons (heavy machine guns, mortars under 100 millimeters, anti-aircraft guns, anti-aircraft machine guns under 23 millimeters, rocket launchers, man-portable anti-tank missiles, man-portable surface-to-air missiles), and similar light weapons; bombs, mines, grenades, ammunition, torpedoes, underwater explosives, and fire arms; weapons not listed in the weapons catalog issued by the Government but having similar characteristics and functions to military weapons.
b) Sports weapons are firearms and crude weapons used for training and sports competitions;
c) Hunting guns are firearms used for hunting, including spring guns, air guns, and similar firearms;
d) Crude weapons include knives, swords, spears, halberds, machetes, tridents, sabers, machetes, knuckle-dusters, cudgels, bows, crossbows.
37. ICAO stands for the International Civil Aviation Organization.
Article 4. Aviation Security Program, Aviation Security Regulations
1. The Aviation Security Program of the airport operator shall be established by the enterprise holding the airport operation certificate, in collaboration with the Civil Aviation Regional Airports Office and related agencies and units at the airport, and submitted to the Civil Aviation Authority of Vietnam for approval.
2. The Aviation Security Program of the airline; the Aviation Security Regulations of air navigation service providers, aircraft manufacturing, maintenance, and repair facilities, and aviation service providers at airports; and cargo handling facilities for loading onto aircraft shall be established by the airline, aircraft operator, or the management enterprise of such facilities, and submitted to the Civil Aviation Authority of Vietnam for approval or acceptance in accordance with regulations.
3. The contents of the Aviation Security Programs and Regulations of airport operators, aviation service enterprises, and Vietnamese airlines must be developed according to the outlines specified in Appendices I, II, III, and IV issued together with this Circular.
Article 5. Procedures for Approving the Aviation Security Program of Airport Operators
1. The airport operator shall submit three sets of documents in Vietnamese directly or through postal services or other appropriate means to the Civil Aviation Authority of Vietnam. The documents include:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) The Aviation Security Program of the airport.
2. In cases where all required documents are received as stipulated in Clause 1 of this Article, within ten working days from the date of receipt, the Civil Aviation Authority of Vietnam shall be responsible for reviewing the documents, conducting on-site inspections, and issuing a decision to approve the Aviation Security Program if it fully complies with the provisions of this Circular, or requesting the airport operator to supplement or amend the program if it does not fully comply with the provisions of this Circular.
3. In cases where the documents are incomplete as stipulated in Clause 1 of this Article, within three working days, the Civil Aviation Authority of Vietnam shall issue a notice requesting the airport operator to provide additional information.
Article 6. Procedures for Approving the Aviation Security Program of Vietnamese Airlines
1. The airline shall submit three sets of documents in Vietnamese directly or through postal services or other appropriate means to the Civil Aviation Authority of Vietnam. The documents include:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) The Aviation Security Program of the airline.
2. The time frame and procedures for reviewing and approving the Aviation Security Program of Vietnamese airlines shall be as specified in Clauses 2 and 3 of Article 5 of this Circular.
Article 7. Procedures for Accepting the Aviation Security Program of Foreign Airlines
1. The airline shall submit three sets of documents in English directly or through postal services or other appropriate means to the Civil Aviation Authority of Vietnam. The documents include:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) The Aviation Security Program of the airline;
c) A table comparing the differences between the airline's Aviation Security Program and Vietnamese legal requirements, along with measures to address these differences.
2. The time frame and procedures for reviewing and accepting the Aviation Security Program of foreign airlines shall be as specified in Clauses 2 and 3 of Article 5 of this Circular.
Article 8. Procedures for Approving the Aviation Security Regulations of Air Service Providers
1. Air navigation service providers; aircraft manufacturing, maintenance, and repair enterprises; air service providers at airports; cargo and mail handling enterprises for loading onto aircraft shall submit three sets of Vietnamese-language documents directly or through postal services or other appropriate means to the Civil Aviation Authority of Vietnam. The documents include:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) The aviation security regulations of the enterprise.
2. The time frame and procedures for reviewing and approving the aviation security regulations of air service providers shall be carried out as stipulated in Clause 2 and Clause 3 of Article 5 of this Circular.
Article 9. Amending and Supplementing the Aviation Security Program and Regulations
1. The aviation security program and regulations may be amended or supplemented when they no longer comply with current regulations or fail to meet requirements during implementation, upon proposal by the enterprise or by written request of the Civil Aviation Authority of Vietnam.
2. The procedures for approving and accepting amendments and supplements to the aviation security program and regulations shall be implemented according to Articles 5, 6, 7, and 8 of this Circular.
Article 10. Control of Aviation Security Documents
1. The classification level of aviation security documents shall be determined in accordance with the laws on state secrets protection.
2. Aviation security documents that are restricted include:
a) Aviation security programs and regulations approved and accepted by the Civil Aviation Authority of Vietnam;
b) Recommendations, notifications, inspection conclusions, testing results, investigations, surveys, security risk assessments, and files of security violations;
c) Coordination regulations and agreements on aviation security between civil aviation agencies and related entities;
d) Aviation security documents from ICAO or provided by foreign countries that ICAO and the foreign side have identified as restricted documents;
đ) Other aviation security documents determined by the Director of the Civil Aviation Authority of Vietnam to be restricted documents.
3. Agencies and units responsible for managing and using restricted aviation security documents must ensure their proper purpose.
4. Restricted aviation security documents can only be provided to recipients listed in the documents. Providing documents to recipients outside the list requires written consent from the head of the issuing unit and acknowledgment. For aviation security documents specified in point a, Clause 2 of this Article, the phrase "restricted document" must appear on all pages of the document.
Chapter II
MEASURES FOR AVIATION SECURITY PREVENTION
Section I
SYSTEM OF CARDS AND PERMITS FOR AVIATION SECURITY CONTROL IN AND WITHIN RESTRICTED AREAS
Article 11. System of Cards and Permits for Aviation Security Control
1. The system of cards and permits for aviation security control includes:
a) Long-term and short-term airport and airfield security access cards and permits allowing entry and operation in restricted areas of terminals and airports;
b) Long-term and short-term internal security access cards and permits allowing entry and operation in restricted areas of enterprises;
c) Long-term flight crew identification cards allowing entry and operation in restricted areas relevant to flight crew duties.
2. Aviation security cards and permits must be secure and counterfeit-resistant. The Civil Aviation Authority of Vietnam shall specify and unify security measures for each type of aviation security card and permit.
Article 12. Authority to Issue Air Security Control Cards and Permits
1. The Civil Aviation Administration of Vietnam
a) Shall issue air security control cards valid for long-term use at one airport for central-level state management agencies, political and social organizations, and foreign agencies and organizations;
b) Shall issue air security control cards valid for long-term use at multiple airports under the management of different Airport Authorities for all subjects specified in Clause 1, Article 16 of this Circular.
2. The Airport Authority
a) Shall issue cards and permits valid for long-term use at one or more airports within its jurisdiction for local-level state management agencies, political and social organizations, and enterprises, except as provided for in Clause 3 of this Article;
b) Shall issue cards and permits valid for short-term use at one airport within its jurisdiction for all subjects specified in Clause 1, Article 16 of this Circular, except as provided for in Clause 3 of this Article.
3. The airport operator authorized by the Civil Aviation Administration of Vietnam shall issue cards and permits valid for long-term and short-term use at one airport within its jurisdiction for its staff, employees, and means of transport, and for persons and means of transport hired by the airport operator to perform construction, repair, and maintenance tasks on its facilities and equipment.
4. Vietnamese and foreign airlines shall issue flight crew identification cards valid for long-term use for flight crews to perform duties during flights.
5. The main enterprise managing restricted areas shall issue internal security control cards and permits valid for long-term and short-term use in restricted areas exclusively for its own use.
Article 13. Validity Period, Effectiveness, and Sample of Air Security Control Cards and Permits
1. The Civil Aviation Administration of Vietnam shall issue sample air security control cards and permits for airports.
2. Vietnamese airlines shall issue sample flight crew identification cards, and the main enterprise managing restricted areas shall issue sample internal security control cards and permits; these samples must not resemble the sample air security control cards and permits for airports and must be reported to the Airport Authority where the airline operates for supervision.
3. Foreign airlines must report their sample flight crew identification cards to the Airport Authority where they operate for supervision.
4. Air security control cards and permits valid for long-term use issued to state agencies, political and social organizations, foreign agencies and organizations, airlines, and non-airline service providers at airports shall have a maximum validity period of two years from the date of issuance; cards and permits issued to other organizations shall have a maximum validity period of one year from the date of issuance.
5. Short-term air security control cards for airports shall have a validity period based on the request of the applicant and the result of the assessment and review of the application, including cards used once within a day (24 hours) from the effective date of issuance and cards used multiple times within a maximum period of ten days from the effective date of issuance.
6. Short-term air security control permits for airports shall have a validity period based on the request of the applicant and the result of the assessment and review of the application but shall not exceed one day (24 hours) from the effective date of issuance.
7. Long-term flight crew identification cards of Vietnamese airlines; long-term internal security control cards and permits shall have a maximum validity period of two years from the date of issuance; short-term internal security control cards and permits shall have a validity period as stipulated in Clauses 5 and 6 of this Article.
8. Subjects receiving air security control cards and permits for airports must bear the cost of issuing such cards and permits in accordance with the provisions of the law.
Article 14. Contents of the aviation security control card
1. The long-term aviation security control card for airports must contain the following basic information:
a) Card number; airport and airfield symbols permitted to enter and operate;
b) Validity period of the card;
c) Full name of the cardholder;
d) Position of the cardholder;
đ) Name of the organization or unit of the cardholder;
e) Photo of the cardholder;
g) Restricted areas permitted to enter and operate;
h) Regulations on using the card.
2. The long-term internal aviation security control card must contain the following basic information:
a) Card number; enterprise symbol;
b) Information as stipulated in points b, c, d, đ, e, g, and h of Clause 1 of this Article.
3. The short-term aviation security control card for airports must contain the basic information as stipulated in points a, b, c, g, and h of Clause 1 of this Article, along with the identification number of the citizen's identity card or passport or the long-term aviation security control card for airports or the internal aviation security control card of the cardholder.
The short-term internal aviation security control card must contain the basic information as stipulated in points a, b, g, and h of Clause 1 of this Article.
4. Each restricted area on the aviation security control card for airports and the internal aviation security control card shall be designated correspondingly by letters, numbers, colors, or encoded.
5. The crew identification card contains the following basic information:
a) Card number;
b) Validity period of the card;
c) Full name of the cardholder;
d) Position of the cardholder;
đ) Name, airline logo;
e) Photo of the cardholder.
Article 15. Contents of the aviation security control permit
1. The long-term and short-term aviation security control permits for airports, and the long-term internal aviation security control permit must contain the following basic information:
a) Permit number;
b) Validity period of the permit;
c) Type of vehicle;
d) Vehicle registration number;
đ) Restricted areas permitted to enter and operate;
e) Exit gate; entry gate;
g) Name of the managing organization or unit of the vehicle.
2. The short-term internal aviation security control permit must contain the basic information as stipulated in points a, b, and đ of Clause 1 of this Article.
3. Each restricted area on the aviation security control permit for airports and the internal aviation security control permit shall be designated correspondingly by letters, numbers, or colors.
Article 16. Objectives, conditions, scope of issuance of aviation security control cards and permits for airports
1. The subjects considered for issuance of long-term cards include:
a) Employees with indefinite-term contracts of airlines, air service providers, non-air service providers at airports;
b) Employees of enterprises engaged in tourism business; enterprises handling goods and mail by air and enterprises conducting surveys, construction, repair, maintenance of facilities at airports;
c) Employees of state agencies, political and social organizations at central and local levels;
d) Personnel of foreign diplomatic missions in Vietnam;
đ) Drivers of vehicles specified in point b, Clause 6 of this Article.
2. The Civil Aviation Administration of Vietnam shall specify the number of cards issued to personnel of foreign diplomatic missions and enterprises engaged in tourism business in accordance with the requirements of aviation security control in restricted areas of terminals and airports.
3. Conditions for the subjects specified in Clause 1 of this Article to be issued long-term cards include:
a) No criminal record as prescribed by law;
b) Being assigned tasks to work regularly in restricted areas of terminals and airports, except for drivers of vehicles specified in point c, Clause 6 of this Article;
c) Only personnel of units responsible for serving special aircraft and assigned specific regular tasks to serve special flights and delegations may be granted access to the special aircraft area.
4. The subjects considered for issuance of short-term cards include:
a) Subjects specified in Clause 1 of this Article who do not meet the conditions for issuance of long-term cards;
b) Individuals with urgent work in restricted areas of terminals and airports.
5. The subjects specified in Clause 4 of this Article must have an aviation security officer or personnel from the management agency of the restricted area supervise them; for isolated areas and airports, they must be escorted by an aviation security officer to guide and monitor.
6. Vehicles eligible for issuance of long-term permits include:
a) Vehicles operating regularly in restricted areas of airports serving special aircraft flights, airport runway areas;
b) Vehicles operating regularly in restricted areas of airports but not issued security license plates by the Air Traffic Control Authority;
c) Vehicles under the management of Party and State agencies and exclusively serving members of the Politburo, Central Committee members, Ministers, and equivalent positions; Secretaries and Deputy Secretaries of Provincial Party Committees, Municipal Party Committees directly under the Central Government; Chairpersons of People's Councils, Chairpersons of People's Committees of provinces, municipalities directly under the Central Government; Deputy Ministers of the Ministry of Transport; Deputy Ministers of the Ministry of Public Security; Deputy Ministers of the Ministry of National Defense, Deputy Chief of General Staff, Director of Operations Department of the General Staff, Director and Deputy Director of the Political Department of the Vietnam People's Army.
7. For vehicles operating regularly in restricted areas of airports, the security license plate issued by the Air Traffic Control Authority simultaneously serves as the aviation security control permit, except in cases specified in point a, Clause 6 of this Article.
8. Additional conditions for vehicles specified in point a, Clause 6 of this Article to be issued long-term permits:
a) Permission to circulate according to the provisions of the law;
b) Meeting the requirements for vehicles operating in restricted areas at airports as stipulated by the Ministry of Transport regarding the management and operation of airports.
9. Vehicles considered for issuance of short-term permits include:
a) Vehicles used to transport foreign guests from the level of Minister and above;
b) Vehicles specified in point b, Clause 6 of this Article tasked with serving special aircraft flights;
c) Vehicles tasked with urgent work: serving special individuals; performing national defense and security tasks; serving activities of airports in restricted areas.
10. The means specified in Clause 9 of this Article, after being granted a permit to operate in restricted areas, must be accompanied by means of the port operator, airport, or aviation security personnel or ground service vehicle operators authorized by the port operator or airport.
11. The scope of issuance of cards and permits is as follows:
a) Persons working at each airport shall only be issued a card valid for long-term use at the specific airport where they work;
b) Persons performing duties at multiple airports shall be issued a card valid for long-term use at those airports;
c) The subjects specified in point d, Clause 1 of this Article shall only be issued a card valid for long-term use at international airports;
d) Short-term use cards and long-term use permits shall only be valid for use at one specific airport.
12. In cases where enhanced security measures or urgent airport security measures are applied, the airport operator shall decide to restrict persons and means that have been issued security control cards and permits from entering restricted areas and must immediately notify the Civil Aviation Administration of Vietnam and the relevant Air Traffic Control Office.
Article 17. Criminal Record Check for Individuals Issued Long-Term Security Control Cards
1. The head of the agency or unit of the person applying for a long-term security control card shall be responsible for conducting a criminal record check on the applicant at the judicial authority before processing the application for the card.
2. The criminal record check for individuals issued cards must be conducted when issuing the card for the first time or renewing it upon expiration of its validity period.
Article 18. Loss of Validity of Security Control Cards and Permits and Reissuance of Security Control Cards and Permits
1. Security control cards and permits lose their validity in the following cases:
a) The card or permit is damaged; the content on the card or permit is blurred;
b) The card or permit has been erased or altered;
c) The card or permit is lost;
d) The individual holding the card no longer meets the subject criteria and conditions stipulated in Clauses 1 and 3 of Article 16 of this Circular;
đ) The means holding the permit no longer meet the conditions stipulated in Clauses 6 and 8 of Article 16 of this Circular;
e) The card or permit has expired;
g) For security reasons;
h) In case of job transfer without returning the card or permit to the issuing entity.
2. Security control cards and permits may be considered for reissue in the following cases:
a) When new models of cards or permits are issued;
b) Still within the validity period but blurred, torn, damaged, or no longer have security features;
c) Expired; lost; confiscated due to violation or disciplinary action; or due to change in job position.
Article 19. Procedures for Issuing New Long-Term Security Control Cards for Airports of the Civil Aviation Administration of Vietnam
1. The requesting agency submits one set of application documents directly or through postal services or other appropriate methods to the Civil Aviation Administration of Vietnam, including:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) For enterprises, there must be a certified copy of the document proving the legal status and functions of the enterprise, except for enterprises providing air or non-air services at airports;
c) A personal application form of the individual applying for the card according to the model prescribed in Appendix VII attached to this Circular, with a color photograph measuring 4 centimeters x 6 centimeters affixed and stamped over (the photograph must be taken against a white background and not more than six months prior to the date of submission of the application);
d) One color photograph as prescribed in point c, Clause 1 of this Article or taken directly at the issuing agency.
2. Within seven working days from the date of receipt of complete application documents, the Civil Aviation Administration of Vietnam will evaluate and review the application regarding the eligibility and conditions for issuing the card as follows:
a) Issue the card if the requirements stipulated in Clauses 1 and 3 of Article 16 of this Circular are met;
b) If the requirements stipulated in Clauses 1 and 3 of Article 16 of this Circular are not met, the Civil Aviation Administration of Vietnam will issue a written notice to the requesting agency within three working days informing them of the denial and specifying the reasons;
c) If the application contains unclear issues, the Civil Aviation Administration of Vietnam will issue a written request for additional information or documents or invite the applicant to come in for clarification within three working days.
Article 20. Procedures for Reissuing Long-Term Security Control Cards at Civil Aviation Airports of the Civil Aviation Administration of Vietnam
1. The agency requesting reissue shall submit one set of application documents directly, via postal service, or other appropriate methods to the Civil Aviation Administration of Vietnam, specifically as follows:
a) In cases of reissuance due to issuance of new card models, expiration of the validity period, the application documents shall comply with the provisions stipulated in Points a, c, and d of Clause 1, Article 19 of this Circular;
b) In cases of reissuance due to cards still within their validity period but being blurred, torn, damaged, or lacking security features, the application documents shall comply with the provisions stipulated in Points a and d of Clause 1, Article 19 of this Circular, and the submission of the blurred, torn, damaged, or security feature-deficient card;
c) In cases of reissuance due to loss of the card, the application documents shall comply with the provisions stipulated in Points a and d of Clause 1, Article 19 of this Circular, along with a confirmation document from the head of the agency or unit regarding the time, location, and cause of the loss;
d) In cases of reissuance due to confiscation of the card, the application documents shall comply with the provisions stipulated in Points a and d of Clause 1, Article 19 of this Circular, accompanied by a document detailing the results of violation handling and disciplinary measures, and a personal self-criticism report with comments and evaluations from the violation handling and disciplinary body;
đ) In cases of reissuance due to change of work position to another agency or unit, the application documents shall comply with the provisions stipulated in Clause 1, Article 19 of this Circular; in cases of change of work position within the same agency or unit, the application documents shall include a request letter according to the model in Appendix V and a brief resume according to the model in Appendix VI issued together with this Circular;
2. Within five working days from the date of receipt of complete application documents as prescribed, the Civil Aviation Administration of Vietnam shall evaluate and review the application documents concerning the eligibility and conditions for issuing the card as follows:
a) Issuing the card to the applicant if they meet the provisions stipulated in Clauses 1 and 3, Article 16 of this Circular;
b) If the requirements stipulated in Clauses 1 and 3 of Article 16 of this Circular are not met, the Civil Aviation Administration of Vietnam will issue a written notice to the requesting agency within three working days informing them of the denial and specifying the reasons;
c) In cases where the application documents contain unclear issues, within three working days from the date of receipt, the Civil Aviation Administration of Vietnam shall issue a document requesting additional information, documents, or direct meetings to clarify the issues;
Article 21. Procedures for Issuing New Long-Term Security Control Cards at Civil Aviation Airports of the Civil Aviation Port Authority
1. The agency requesting the card shall submit one set of application documents directly, via postal service, or other appropriate methods to the Civil Aviation Port Authority; the application documents shall comply with the provisions stipulated in Clause 1, Article 19 of this Circular;
2. Within seven working days from the date of receipt of complete application documents as prescribed, the Civil Aviation Port Authority shall evaluate and review the application documents concerning the eligibility and conditions for issuing the card as follows:
a) Issue the card if the requirements stipulated in Clauses 1 and 3 of Article 16 of this Circular are met;
b) In cases where the requirements stipulated in Clauses 1 and 3, Article 16 of this Circular are not met, within three working days from the date of receipt, the Civil Aviation Port Authority shall issue a document notifying the requesting agency of non-issuance and specifying the reasons;
c) In cases where the application documents contain unclear issues, within three working days from the date of receipt, the Civil Aviation Port Authority shall issue a document requesting additional information, documents, or direct meetings to clarify the issues;
Article 22. Procedures for Reissuing Long-Term Security Control Cards at Civil Aviation Airports of the Civil Aviation Port Authority
1. The agency requesting reissue shall submit one set of application documents directly, via postal service, or other appropriate methods to the Civil Aviation Port Authority, the application documents shall comply with the provisions stipulated in Clause 1, Article 20 of this Circular;
2. Within five working days from the date of receipt of complete application documents as prescribed, the Civil Aviation Port Authority shall evaluate and review the application documents concerning the eligibility and conditions for issuing the card as follows:
a) Issuing the card to the applicant if they meet the provisions stipulated in Clauses 1 and 3, Article 16 of this Circular;
b) In cases where the requirements stipulated in Clauses 1 and 3, Article 16 of this Circular are not met, within three working days from the date of receipt, the Civil Aviation Port Authority shall issue a document notifying the requesting agency of non-issuance and specifying the reasons;
c) In cases where the application documents contain unclear issues, within three working days from the date of receipt, the Civil Aviation Port Authority shall issue a document requesting additional information, documents, or direct meetings to clarify the issues.
Article 23. Procedure for Issuing Short-Term Security Control Cards for Airports and Airfields by the Civil Aviation Authority
1. The requesting agency shall submit one set of application documents directly to the Civil Aviation Authority and present one of the valid identification documents (ID card, diplomatic ID card, passport, citizen identity card, long-term air security control card). The application package includes:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) A list according to the model prescribed in Appendix IX issued together with this Circular.
2. Within no more than 60 minutes from the time of receiving complete application documents as prescribed, the Civil Aviation Authority shall review the application and issue the card; in case of non-issuance, the reason shall be directly communicated to the applicant.
Article 24. Procedure for Issuing New Long-Term Security Control Cards for Airport Operators
1. The application package includes:
a) A list of staff members applying for cards according to the model prescribed in Appendix VI issued together with this Circular;
b) Personal application forms of the applicants according to the model prescribed in Appendix VII issued together with this Circular, affixed with a color photograph measuring 4 centimeters by 6 centimeters, stamped over the back (the photograph must be taken against a white background, not older than six months from the date of submission of the application);
c) One color photograph as prescribed in point b, Clause 1 of this Article.
2. Within five working days from the issuance date, the airport operator authorized to issue cards must send the list of cardholders according to the model prescribed in Appendix VI issued together with this Circular to the relevant Civil Aviation Authority.
Article 25. Procedure for Reissuing Long-Term Security Control Cards for Airport Operators
1. Specific application packages are as follows:
a) In cases of reissue due to issuance of new card models or expiration of the current card, the application package shall comply with the provisions of Clause 1 of Article 24 of this Circular;
b) In cases of reissue due to the card being blurred, torn, damaged, or lacking security features while still within its validity period, the application package shall comply with the provisions of points a and c of Clause 1 of Article 24 of this Circular, and the damaged card must be returned;
c) In cases of reissue due to loss of the card, the application package shall comply with the provisions of points a and c of Clause 1 of Article 24 of this Circular, along with a confirmation document from the head of the organization or unit regarding the time, place, and cause of the loss;
d) In cases of reissue due to confiscation of the card for violation or disciplinary action, the application package shall comply with the provisions of points a and c of Clause 1 of Article 24 of this Circular, accompanied by a document detailing the results of the violation handling or disciplinary action and a personal self-criticism report with comments and evaluations from the handling authority;
đ) In cases of reissue due to change in job position, the application package shall comply with the provisions of point a of Clause 1 of Article 24 of this Circular.
2. Within five working days from the issuance date, the airport operator authorized to issue cards must send the list of cardholders according to the model prescribed in Appendix VI issued together with this Circular to the relevant Civil Aviation Authority.
Article 26. Procedure for Issuing New Long-Term Security Control Permits for the Civil Aviation Authority and Airport Operators
1. The agency requesting the permit for the equipment specified in Clause 6 of Article 16 shall submit one set of application documents directly or through postal service or other appropriate means to the Civil Aviation Authority or the airport operator, including:
a) A request letter from the management agency or organization of the equipment according to the model prescribed in Appendix V issued together with this Circular;
b) A list of equipment applying for permits according to the model prescribed in Appendix VIII issued together with this Circular;
c) A copy of the Safety Technical Inspection and Environmental Protection Certificate issued by the competent authority and still valid.
2. The procedure for issuing permits with long-term validity at an airport under the jurisdiction of an airport operator for their own equipment as stipulated in points b and c of Clause 1 of this Article.
3. Within seven working days from the date of receipt of complete application documents as prescribed, the Civil Aviation Authority shall evaluate and review the application; if the requirements are met, the permit will be issued; if not, within three working days, the Civil Aviation Authority shall issue a notification to the requesting agency about the non-issuance and specify the reasons. If the application is unclear, within three working days, the Civil Aviation Authority shall issue a request for additional information or documents or invite the applicant to clarify the situation directly.
4. Within five working days from the issuance date, the authorized airport operator must send the list of equipment that has been granted permits according to the model prescribed in Appendix VIII issued together with this Circular to the relevant Civil Aviation Authority.
Article 27. Procedure for Reissuing Security Control Permits for Airports with Long-Term Validity for Civil Aviation Port Authorities and Airport Operators
1. The permit application agency shall submit one set of application files directly, via postal service, or other appropriate methods to the Civil Aviation Port Authority or the airport operator, including:
a) Reissue due to issuance of new permit templates, expiration of the current permit's validity period, or compliance with the provisions stipulated in Clause 1, Article 26 of this Circular;
b) Reissue due to the current permit still being valid but being faded, torn, damaged, or lacking security markings, in accordance with Points a and b of Clause 1, Article 26 of this Circular; the permit application agency must return the faded, torn, damaged, or non-security marked permit;
c) Reissue due to loss of the permit, in compliance with Points a and b of Clause 1, Article 24 of this Circular; the permit application agency must provide a confirmation letter from the head of the agency or unit regarding the time, location, and cause of the lost permit.
2. Within five working days from the date of receiving all required application files, the issuing authority shall evaluate and review the application files; if the requirements are met, the permit will be issued; if not, within three working days, the Civil Aviation Port Authority shall notify the application agency of the refusal to issue the permit and specify the reasons. In cases where there are unclear issues in the application files, within three working days, the Civil Aviation Port Authority shall request additional information, documents, or direct meetings to clarify the issues.
3. Within five working days from the issuance date, the authorized airport operator must submit a list of vehicles issued permits according to the template specified in Appendix VIII attached to this Circular to the relevant Civil Aviation Port Authority.
Article 28. Procedure for Issuing Security Control Permits for Airports with Short-Term Validity
1. The permit application agency shall submit one set of application files directly to the issuing authority and present the Safety Technical Inspection and Environmental Protection Certificate issued by the competent authority which remains valid. The application files include:
a) A request letter from the management agency or organization of the equipment according to the model prescribed in Appendix V issued together with this Circular;
b) A list of vehicles applying for permits according to the template specified in Appendix VIII attached to this Circular.
2. Within a maximum of sixty minutes from the date of receiving all required application files, the issuing authority shall review the application files and issue the permit; if the permit is not issued, the reason shall be directly communicated to the applicant.
Article 29. Procedure for Issuing New or Reissuing Security Control Cards for Airports with Long-Term Validity for Police Forces and Customs Officers at International Airports
1. The police force and customs officers at international airports are responsible for the application files, background checks, personal information, and duties of the card applicants, who shall submit one set of application files directly, via postal service, or other appropriate methods to the Civil Aviation Port Authority, including:
a) A request letter following the model prescribed in Appendix V issued together with this Circular;
b) A list of staff regularly working at international airports, including their full name, position, workplace, and operational area;
c) Two color photographs measuring four centimeters by six centimeters (photographed in uniform against a white background, not older than six months from the date of submission) or taken directly at the issuing authority.
2. Within seven working days from the date of receiving all required application files, the Civil Aviation Port Authority shall review the application files and issue the cards. If the cards are not issued, a response letter specifying the reasons for non-issuance shall be provided.
Article 30. Management and storage of air security control card and permit files
1. Card and permit issuance files must be stored and destroyed in accordance with the laws on record management.
2. At the place where cards and permits are issued, regulations on file management and the process for issuing air security control cards and permits must be posted, and cases of force majeure affecting the issuance procedures must be announced.
3. The Civil Aviation Authority of Vietnam shall provide specific guidance on the management work and related procedures and forms in receiving files, organizing reviews, issuing air security control cards and permits for airports and airfields, and directing the implementation thereof.
Article 31. Review and explanation in the issuance of air security control cards and permits for airports and airfields
1. The issuing authority is responsible for reviewing the files and the following contents to issue cards and permits:
a) The subjects eligible for cards and permits;
b) Conditions for issuing cards and permits;
c) Scope of cards and permits;
d) Validity period of cards and permits;
e) Airports and restricted areas covered by the cards and permits.
2. Agencies, units, and individuals applying for cards and permits have the responsibility to explain and provide documents proving the contents specified in Clause 1 of this Article during the review process.
3. The issuing authority has the right to refuse if the unit or individual applying for cards and permits refuses to explain and provide proof documents or violates regulations on managing and using cards and permits, or if dishonest acts are detected in the application files.
4. Cards and permits must be issued in accordance with the principle that they should be issued for the airport and restricted area where the holder works, and for the duration of their assigned tasks.
Article 32. Subjects, conditions, procedures for issuing and managing internal air security control cards and flight crew identification cards
1. Enterprises issuing internal air security control cards and flight crew identification cards must specify the subjects eligible for cards and permits, card and permit models, issuance procedures, responsibilities, and authorities for managing, issuing, and recalling cards and permits in the Security Program and Security Regulations approved by the Civil Aviation Authority of Vietnam.
2. Internal air security control card and flight crew identification card models must not be confused with models of airport and airfield air security control cards and permits.
Article 33. Management and use of air security control cards and permits
1. Air security control cards and permits may only be used when performing assigned duties and may not be used for other personal purposes or in violation of regulations, which will result in temporary confiscation or revocation.
2. The person holding the card and the user of the vehicle holding the permit must keep and maintain the card and permit; they must not allow others to use them under any circumstances; they must not erase or alter the content on the card or permit; if the person or vehicle holding the card or permit no longer has a task in the restricted area, they must return the card or permit to the issuing unit; if the card or permit is torn or blurred, they must request a replacement. In case of loss, they must immediately report to the issuing unit and their own supervisory agency.
3. Individuals or users of vehicles holding cards or permits who violate aviation security and safety regulations, disrupt discipline at airports and airfields, or fail to meet the conditions for holding cards or permits will be temporarily confiscated or revoked.
4. The head of the unit or agency holding the card or permit is responsible for:
a) Specifying the management and use of cards and permits for individuals and vehicles within their unit to ensure proper use; cards may not be used for personal purposes;
b) Recovering and transferring to the issuing unit: cards and permits that have lost their validity as stipulated in Clause 1 of Article 18 of this Circular, except for expired cards and permits; cards and permits recalled upon request of the competent authority; immediately reporting in writing according to the form prescribed in Appendix X attached to this Circular any cases of lost cards and permits to the issuing unit;
c) Destroying expired cards and permits.
5. Staff members of state agencies responsible for immigration and import-export at border gates may use air security control cards to enter and exit restricted areas without wearing the card during work as prescribed.
6. The issuing authority must immediately report in writing according to the form prescribed in Appendix X attached to this Circular any cases of lost cards and permits issued by their unit to the air security control forces and restricted area protection forces listed on the lost cards and permits and the Civil Aviation Authority of Vietnam to promptly prevent the use of lost cards and permits.
PART II
AIR SECURITY CONTROL OF RESTRICTED AREASAND PUBLIC AREAS
Article 34. Establishment of Restricted Areas
1. Based on the actual infrastructure and civil aviation operations, the following restricted areas must be established:
a) The passenger area after security screening of persons and baggage waiting to board aircraft (the isolation area);
b) The aircraft parking area, runway, taxiway, and other areas within the airport (the airport);
c) The checked baggage service area after air cargo security inspection for loading onto aircraft (the baggage sorting area);
d) The transit area for passengers connecting flights (the transit area);
đ) The cargo and mail service area after security screening for loading onto aircraft (the cargo and mail sorting, storage, and loading area);
e) The passenger terminal serving special and priority flights;
g) The baggage claim area at the arrival terminal;
h) The aircraft maintenance, repair, and installation area;
i) The food production, processing, and supply area;
k) The fuel storage area supplying aircraft;
l) The emergency coordination center of the airport; the flight control tower; the air traffic control area; the radar station and VHF communication area;
m) The power and water supply station of the airport;
n) The area from the check-in counter to the inside of the checked baggage screening area;
o) The area for handling cargo and mail for air transport;
2. Based on Clause 1 of this Article, the airport operator shall take the lead in coordinating with the Civil Aviation Authority and relevant agencies and units to determine the restricted areas and specific boundaries of each restricted area within the terminal and airport, and the restricted areas under the exclusive management and operation of the airport operator when developing the Civil Aviation Security Program.
3. Based on Clause 1 of this Article, the air service provider at the airport shall take the lead in coordinating with the Civil Aviation Authority and relevant agencies and units to determine the restricted areas and specific boundaries of each restricted area under their management and operation outside the terminal and airport when developing the Airfield Security Regulations; the air navigation service provider, cargo and mail processing facility shall establish restricted areas for areas not within the airport.
4. In cases where enhanced civil aviation security measures are required at the airport, if it is deemed necessary to temporarily establish new restricted areas, the airport operator shall immediately establish and notify the Civil Aviation Authority and agencies and units operating regularly in that area. The temporary establishment of restricted areas must meet the following requirements:
a) It has a time limit;
b) It has a physical or soft barrier as its boundary; appropriate warning signs and signals are installed;
c) It has a security checkpoint and security personnel are deployed to conduct inspections and supervision during the establishment period;
d) Appropriate security measures are implemented;
đ) If the temporary establishment period of the restricted area exceeds 24 hours, it must be approved in writing by the Vietnam Civil Aviation Administration.
5. Establishing restricted areas and applying security inspection and supervision measures for each restricted area must be consistent with the purpose of ensuring civil aviation security and should not hinder the normal entry, exit, and activities of people and means of transportation in the restricted areas.
Article 35. Provisions on entering, exiting, and operating in restricted areas
1. Persons and means of transport entering, exiting, and operating in restricted areas must have security control cards or permits for such areas.
2. The card must be worn on the chest in a position that ensures it can be observed from the front during the entire time of operation within the restricted area, except for staff of public security and customs units at airports who are performing their duties as prescribed by law; the permit must be placed in the cockpit or in a visible location on the means of transport.
3. Persons, objects carried, and means of transport entering and exiting restricted areas must use designated gates and doors, comply with guidance and regulations on security, safety, and operations in the restricted area; they are subject to appropriate aviation security checks and supervision.
4. Persons and means of transport using short-term security control cards or permits for airports and airfields must be accompanied and guided by aviation security personnel or employees of the restricted area management unit when operating in the restricted area.
5. Means of transport operating in restricted areas must follow designated routes and speeds, stop and park in specified locations; they are subject to checks, supervision, and compliance with guidance provided by aviation security personnel and guards assigned to the area.
6. Organizing filming and photography in restricted areas not involving state secrets must be approved in writing by the managing unit.
7. In emergency and rescue situations, the heads of agencies and units whose personnel and means of transport are involved in such tasks are responsible for coordinating with aviation security forces and protective units of the restricted area management to control the activities of persons and means of transport without requiring aviation security cards or permits, or internal security controls.
8. Within restricted areas, checked baggage, cargo, and mail must be ensured intact:
a) Heads of agencies and units operating at airports are responsible for organizing measures to prevent and combat theft of property in checked baggage and cargo within their scope of responsibility. Civil Aviation Port Authorities supervise the implementation of this regulation by the units.
b) Airport operators and businesses serving cargo and ground services are responsible for organizing inspections and supervision of the implementation of procedures, formalities, and standards in the baggage and cargo service chain.
c) Airport operators shall promulgate specific regulations on the list of persons and means of transport permitted to enter and exit each designated gate, door, or passage; and specify the list of items that employees are not allowed to carry into restricted areas.
d) Airlines shall inform and publicize passengers about regulations on transporting valuable items in checked baggage; procedures for complaints, claims, and compensation in case of loss or misplacement of baggage during transportation.
e) Specific measures for preventing and combating theft of property are detailed in the Aviation Security Program and Aviation Security Regulations of enterprises.
Article 36. Provisions on Bringing Hazardous Items into Restricted Areas
1. The carrying, management, and use of hazardous items within restricted areas must be specifically stipulated in the Security Program and Air Transport Security Regulations based on the List of Prohibited or Restricted Hazardous Items for Carriage by Passengers and Baggage issued by the Civil Aviation Administration of Vietnam.
2. Units using hazardous items as tools for their work in restricted areas as specified in points a, b, c, d, đ, e, and g of Clause 1, Article 34 of this Circular shall register with the air transport security control force and bear responsibility for inspecting and supervising air transport security in that area.
3. The managing entity shall organize the management and bear responsibility for the management, use, and ensuring the security and safety of hazardous items as stipulated in Clause 2 of this Article.
Article 37. Air Transport Security Inspection Points at Gates, Doors, and Walkways between Public Areas and Restricted Areas
1. At gates, doors, and walkways from public areas to restricted areas, air transport security inspection points must be established.
2. Each air transport security inspection point must have the following documents:
a) Procedures for inspecting persons, objects, and vehicles when entering and exiting restricted areas;
b) Templates for security control permits allowing entry into the restricted area;
c) Lists of persons and vehicles whose security control permits have been lost or revoked but not returned;
d) Contact number directories and registration forms, records, and certificates for hazardous items, electronic devices, special equipment, valuable objects, and vehicles entering the restricted area;
đ) Shift handover logs recording the situation and results of security inspections and monitoring;
3. At air transport security inspection points, appropriate signs and directions must be displayed, and suitable personnel and security equipment must be arranged to ensure continuous air transport security inspections. Gates, doors, and mobile barriers at air transport security inspection points must always remain closed (locked) and may only be opened when persons and vehicles have been inspected and meet the conditions for entry and exit.
4. There must be security surveillance cameras, X-ray machines, metal detectors, and handheld metal detectors installed to inspect and screen persons, objects, and baggage from public areas into the restricted areas as specified in points a, b, c, d, đ, e, h, i, and k of Clause 1, Article 34 of this Circular and the Air Traffic Control Center (excluding temporary gates, doors, and walkways).
Article 38. Security Surveillance, Patrols, and Guarding in restricted areas
1. The air transport security control force must continuously monitor passengers, persons, and vehicles operating in restricted areas through appropriate measures to detect suspicious behavior, promptly prevent violations; inspect and handle unclaimed baggage and objects, and implement other air transport security measures.
2. The air transport security control force must organize patrols and guarding to promptly prevent persons, vehicles, and livestock from entering restricted areas or violating regulations to ensure air transport security and safety.
3. At civil-military joint-use airports, the air transport security control force shall agree in writing with military units stationed at the airport to conduct patrols, guarding, and protection of the border area between the civilian aviation operation zone and the military operation zone.
4. The organization of security surveillance, patrols, and guarding is detailed in the Security Program and relevant Air Transport Security Regulations.
Article 39. Security checks and supervision for persons, means of transport, and objects when entering, exiting, and operating in restricted areas that are not passengers, baggage, cargo, mail, or items loaded onto aircraft.
1. Aviation security officers and guards are responsible for conducting security checks and supervision on persons, means of transport, and objects entering, exiting, and operating in restricted areas.
2. Persons, means of transport, and objects entering restricted areas other than those specified in Points n and o of Clause 1, Article 34 must undergo aviation security checks on the following contents:
a) Aviation security control cards, permits;
b) Persons and accompanying objects;
c) Means of transport and objects on such means of transport;
d) Hazardous items.
3. Persons, means of transport, and objects entering and operating in restricted areas specified in Points n and o of Clause 1, Article 34 must be subject to aviation security supervision through appropriate measures.
4. Persons, means of transport, and objects exiting restricted areas shall be inspected by aviation security forces if there are signs of suspicion such as theft, smuggling, and commercial fraud, or in cases where enhanced aviation security assurance is required, or as directed by competent state management agencies. The inspection contents include:
a) Aviation security control cards, permits;
b) Persons and accompanying objects;
c) Means of transport and objects on such means of transport;
d) Hazardous items.
5. The procedure for inspecting persons is as follows:
a) Inspect aviation security control cards, observe and compare with actual conditions;
b) Inspect persons using metal detectors and handheld metal detection devices at locations equipped with these devices. If the metal detector or handheld metal detection device alarms, further visual inspection must be conducted. Random visual inspections must be conducted at least 5% of the time when there is no alarm from the metal detector or handheld metal detection device. Visual inspections should also be conducted at locations without metal detectors or handheld metal detection devices;
c) The sequence and actions for inspecting cards, conducting visual inspections, and using handheld metal detection devices; the procedure for inspecting using metal detectors is specifically defined in the Airports and Airfields Security Program of the airport operator and the Air Service Provider's Security Regulations.
6. The procedure for inspecting objects is as follows:
a) Pass objects through X-ray machines at locations equipped with them. If there are suspicions after passing through the X-ray machine, further visual inspection must be conducted;
b) Conduct visual inspections of objects at locations without X-ray machines;
c) The sequence and actions for conducting visual inspections and using X-ray machines are specifically defined in the Airports and Airfields Security Program of the airport operator and the Air Service Provider's Security Regulations.
7. The procedure for inspecting means of transport is as follows:
a) Require the driver and accompanying persons to leave the means of transport;
b) Inspect the permit of the means of transport;
c) Observe and conduct external inspections of the means of transport;
d) Use mirrors to inspect the underside and upper surface of the means of transport;
đ) Conduct visual inspections inside the driver's cabin of the means of transport;
e) Inspect passenger compartments and cargo compartments of the means of transport (except in cases where cargo compartments are sealed according to regulations);
g) Inspect the seals of the means of transport and goods transported on it;
h) The sequence and actions for conducting visual inspections and using mirrors to inspect the underside and upper surface of the means of transport are specifically defined in the Airports and Airfields Security Program and the Air Service Provider's Security Regulations.
8. Provisions regarding the control of items brought into and out of restricted areas:
a) At security checkpoints, declaration forms prescribed in Appendix XXVI of this Circular must be retained;
b) Persons bringing hazardous items, special equipment, and high-value items into restricted areas must declare them on the form prescribed in Appendix XXVI of this Circular; they must exit through the same gate they entered;
c) Aviation security officers at security checkpoints must collect declaration forms, compare them with the items brought in and out, and record any changes in quantity if used within the restricted area, except in cases where aviation security officers carry support tools provided while performing aviation security assurance duties at airports;
d) Records and documents related to the control of items brought into and out of restricted areas must be managed and retained in accordance with regulations on archives and records management.
9. The procedures for conducting security checks and supervision in specific restricted areas must be detailed in the Security Program and Security Regulations of the unit.
Article 40. Signs and directions at public areas of civil airports public areas of airports, airfields
Clause 1. Air security control forces shall coordinate with airport operators, air service providers, traffic police, and other relevant agencies to delineate traffic lanes and install various types of signs and directions on public roads, parking lots, passenger pick-up and drop-off zones, and other public areas within civil airports.
Clause 2. Individuals, vehicles, and activities in public areas must comply with road traffic laws, regulations of the airport, follow the guidance of air security control forces, and adhere to aviation security and safety regulations, social order, and civilized behavior.
Article 41. Security inspection and supervision in public areas of civil airports, airfields
Clause 1. Air security control forces shall take the lead and coordinate with police agencies to establish checkpoints, deploy air security personnel and appropriate equipment for patrols, supervision, and guidance of individuals and vehicles participating in traffic; maintain order in public areas of civil airports; collaborate with related Civil Aviation Authorities, police forces, military units, and local authorities when additional aviation security measures are required.
Clause 2. The deployment of patrol forces, specialized equipment, and procedures for security inspections and supervision must ensure timely detection and handling of unclaimed items, luggage, goods, vehicles, disruptive behaviors, and violations in public areas of civil airports, and must be detailed in the Aviation Security Program and Regulations.
Clause 3. In cases where enhanced aviation security measures are needed or when the terminal or public areas of the airport cannot meet operational requirements, air security control forces shall establish security checkpoints in public areas to limit and regulate the number of people and vehicles entering and operating in the terminal and public areas of the airport, and notify the Civil Aviation Authority for monitoring.
Clause 4. Items, luggage, and property of passengers or senders left in storage areas in public areas of the passenger terminal must undergo aviation security checks before acceptance through appropriate measures.
Article 42. Ensuring security in areas adjacent to civil airports
Clause 1. Civil Aviation Authorities shall lead and coordinate with airport operators to work with local People's Committees to promote awareness of aviation security and safety regulations among residents in areas adjacent to civil airports.
Clause 2. Civil Aviation Authorities, together with air security control forces, have the responsibility to coordinate with local authorities to ensure compliance with aviation security regulations; prevent illegal acts in areas adjacent to civil airports.
Clause 3. Civil Aviation Authorities and air security control forces shall cooperate with defense agencies and related units at the local level to assess positions at risk of shoulder-fired missile attacks on aircraft.
Clause 4. Civil Aviation Authorities and air security control forces shall collaborate with local police forces in areas adjacent to civil airports to develop and implement preventive measures against unlawful interference with aircraft, the use of shoulder-fired missiles, and other weapons to attack aircraft during takeoff and landing phases.
Clause 5. Air security control forces and protective forces from related agencies and units shall cooperate with local police forces in adjacent areas to patrol areas adjacent to civil airports and restricted areas outside the airport upon request to promptly detect and handle violations.
Section III
AIRCRAFT SECURITY INSPECTION AND SUPERVISION PRIOR TO COMMERCIAL FLIGHTS
Article 43. Security Sealing
1. Cargo containers, mail packages, loose cargo items, lost luggage, unclaimed luggage, cabinets, meal trays, service item boxes, and fueling equipment for aircraft, except for items used for aircraft maintenance and repair and those specified in Clause 5 of Article 56 of this Circular, must be security sealed after being inspected for aviation security; fueling equipment for aircraft must be security sealed at the fueling and draining ports after receiving fuel; non-operational aircraft must be security sealed at all doors.
2. Security seals must ensure that they cannot be removed without damage after sealing, or if removed, they cannot be resealed; the size and type of seal must be appropriate for the object being sealed.
3. The model of security seal, management regulations, statistics, issuance, distribution, and usage of security seals must be specifically defined in the Aviation Security Program and Regulations related to this matter. Requirements for security seals as stipulated in Appendix XII attached to this Circular.
Article 44. Security Inspection and Supervision for Departing Passengers and Cabin Baggage
1. Airlines may only accept transportation and allow passengers to board aircraft when the passenger has a ticket, boarding pass, and personal identification documents as prescribed in Appendix XIII attached to this Circular, and has undergone aviation security inspection; checked baggage of each passenger must be processed separately, not collectively for multiple people. Before allowing passengers to board the aircraft, check-in staff must verify and cross-check passengers with their personal identification documents and boarding passes to ensure consistency between the passenger and the documents and flight.
2. Passengers with checked baggage, except in cases specified in Clause 3 of this Article, must be present at the check-in counter to process their baggage. Check-in staff must verify and cross-check passengers with tickets and personal identification documents, interview passengers about their baggage; if there are doubts, they must report to the security supervisor at the aviation security checkpoint.
3. Passengers may authorize representatives to handle check-in procedures on their behalf in the following cases:
a) Work delegations including Comrades Politburo members, Central Committee members, Ministers, and equivalent positions or higher; Secretaries and Deputy Secretaries of Provincial Party Committees, Municipal Party Committees under the Central Government; Chairpersons of People's Councils, Chairpersons of People's Committees of provinces, municipalities under the Central Government; Deputy Ministers of the Ministry of Transport, Ministry of Public Security, Ministry of National Defense; Deputy Chief of General Staff, Director of Operations Department of the General Staff, Director and Deputy Director of the Political Department of the Vietnam People's Army; b) Emergency situations decided and responsible by the Air Port Authority Director.
4. Passengers without checked baggage can self-process through online check-in systems or self-service counters approved by airlines and relevant authorities without needing to be present at the check-in counter.
5. Passengers and cabin baggage must undergo 100% aviation security screening; passengers refusing aviation security screening will be denied transport.
6. At each aviation security checkpoint, there must be a room to conduct security searches; there must be X-ray machines, metal detectors, handheld metal detectors, explosive detection devices, communication equipment, and other necessary devices and tools.
7. At each aviation security checkpoint, sufficient aviation security control personnel must be arranged to fully and effectively perform the following tasks:
a) Verify and cross-check passengers' personal identification documents with
tickets, paper boarding passes, or electronic devices (phones, computers...) and passengers; b) Guide passengers to remove personal items, place luggage and objects on the X-ray conveyor belt;
c) Inspect passengers using handheld metal detectors, explosive detection devices, visual inspections, and security searches;
d) Monitor the X-ray machine screen; this task must be continuously performed for no more than 30 minutes and then resumed after a minimum of 30 minutes;
đ) Receive luggage and objects requiring inspection according to the request of the X-ray monitor and transfer them to the visual inspection and search staff;
e) Conduct visual inspections and security searches of cabin baggage and objects;
g) The shift leader is responsible for directing, managing, and supervising all work at the aviation security checkpoint; rotating the working positions of staff during the shift; handling issues and violations reported by staff; not directly performing the tasks listed in points a, b, c, d, and đ of this clause.
8. Passengers must comply with all instructions and requirements of aviation security control staff and follow the security screening procedures for persons and cabin baggage as follows:
a) Passengers must remove coats, hats, shoes, belts, personal items, and other items carried; place items, liquids, and electronic devices in trays to pass through the X-ray machine before going through the metal detector;
b) Passengers go through the metal detector; if the metal detector alarms, aviation security control staff will use handheld metal detectors and conduct visual inspections;
c) Passengers place cabin baggage on the conveyor belt to pass through the X-ray machine; if there are suspicions, aviation security control staff must conduct visual inspections or security searches according to regulations.
9. Passengers and cabin baggage that have completed aviation security inspection procedures must be continuously monitored by appropriate measures until boarding the aircraft.
10. Security inspections for disabled passengers, war veterans, patients using wheelchairs, stretchers, and medical auxiliary devices attached to their bodies shall be conducted visually or by other appropriate methods at suitable locations.
10. Security screening for disabled passengers, war invalids, patients using wheelchairs, stretchers, or medical equipment attached to their persons shall be conducted visually or through other appropriate measures at suitable locations.
11. Visual inspection of passengers and carry-on luggage shall be conducted at aviation security checkpoints or search rooms. At aviation security checkpoints, visual inspections of passengers shall be carried out by personnel of the same gender, and female staff may inspect male passengers if necessary. In search rooms, visual inspections must be performed by personnel of the same gender, with a third person of the same gender present to witness and a record of the visual inspection must be made.
12. In cases where dangerous items not permitted on board aircraft are discovered according to regulations, aviation security control officers shall implement procedures as stipulated in Article 65 of this Circular.
13. A minimum of 10% additional random visual inspections shall be conducted post-aviation security screening for passengers and carry-on luggage. Such random visual inspections may take place at aviation security checkpoints or in search rooms upon request.
Article 45. Security Inspection and Supervision of Transit, Connecting, and Domestic Stopover Passengers and Carry-on Luggage
1. In cases where transit or domestic stopover passengers remain on board the aircraft, the aircraft must be continuously monitored by appropriate measures until departure, and passengers are not allowed to disembark.
2. Connecting, transit, and domestic stopover passengers who disembark must carry their personal belongings and carry-on luggage off the aircraft and may not leave them onboard.
3. The aircraft operator is responsible for ensuring that connecting, transit, and domestic stopover passengers' personal belongings and carry-on luggage are removed from the aircraft before disembarking.
4. Connecting, transit, and domestic stopover passengers and their carry-on luggage must undergo aviation security screening using scanning methods prior to reboarding the aircraft, except in the following circumstances:
a) Passengers are tagged with transit, connecting, or transit passenger tags;
b) From the moment they disembark, passengers follow a separate pathway without mingling with any other passenger flow and are subject to continuous security supervision.
Article 46. Security Inspection and Supervision of Aircraft Crew Members
1. The aircraft operator must provide the flight crew list to the aviation security control force before the crew undergoes security screening procedures. The crew must wear prescribed attire, pack their own luggage, and only be allowed to carry luggage as permitted by relevant laws.
2. Crew members must present their flight crew identification cards at aviation security checkpoints. Aviation security control officers shall check and compare the flight crew list provided by the aircraft operator with the flight crew identification cards.
3. Security screening, monitoring, and searches of crew members and their luggage shall be conducted in the same manner as for departing passengers and their carry-on luggage.
4. Airlines shall detail the procedures for controlling crew members' luggage and items when boarding in their airline's Security Program.
Article 47. Security Check for Checked Baggage
1. Staff handling transportation procedures must require each passenger to identify their checked baggage correctly before allowing them to proceed with the transportation procedures, not group processing (except in cases provided for in Clause 3, Article 44 of this Circular); if there are suspicious signs, they must notify security personnel to enhance inspection.
2. Checked baggage of departing and connecting passengers must be inspected using X-ray machines; if there are doubts, it must be further visually inspected, using explosive detection devices, or other appropriate measures. If there are signs or information threatening the security and safety of the flight, the checked baggage must be subjected to a security search.
3. At each security checkpoint, sufficient aviation security personnel must be arranged to ensure the full and effective performance of the following tasks:
a) Monitoring the X-ray machine screen; this task must be performed continuously for no more than 30 minutes and only resumed at least 30 minutes later;
b) Conducting visual inspections and security searches;
c) The team leader is responsible for directing, managing, and supervising all activities at the security checkpoint.
4. The procedures and methods for inspecting and monitoring the security of checked baggage are detailed in the Airport and Airfield Aviation Security Program.
5. Visual inspections of checked baggage must be conducted in the presence of the owner of the baggage or their authorized representative or airline representative, except in emergency situations.
6. Checked baggage that is in transit, connecting, or on domestic stopover flights that have been unloaded from the aircraft, before being reloaded onto the aircraft, must undergo security checks as if it were checked baggage for departure, except in cases meeting the following requirements:
a) The baggage does not leave the aircraft parking area or is under continuous security surveillance from the time it is unloaded until it is reloaded onto the aircraft;
b) The baggage has a transit, connection, or domestic stopover tag.
Article 48. Supervision of Security for Checked Baggage
1. Checked baggage of departing, connecting, and transit passengers, after acceptance for transportation and security inspection, must be continuously monitored by appropriate means until loaded onto the aircraft, and unauthorized persons must not be allowed access.
2. Baggage conveyor belt areas and baggage sorting areas must be continuously controlled and monitored by appropriate means, and unauthorized persons must not be permitted to access these areas.
3. Enterprises providing baggage transportation services from the terminal to the aircraft and vice versa are responsible for implementing measures to prevent loss of property in checked baggage and to prevent unauthorized baggage from being placed on conveyors or baggage carts.
4. Checked baggage that is torn, broken, or has loose locks, or shows signs of unauthorized interference, must be re-inspected for security. The re-inspection must be documented. Specific management, supervision, and handling procedures for baggage that is damaged or shows signs of unauthorized interference before loading onto the aircraft must be stipulated in the relevant Aviation Security Program and Regulations.
Article 49. Synchronized Passenger and Luggage Transport
1. The luggage of each passenger must be transported on the same flight with the passenger, except as provided for in Clause 2 of Article 149 of the Civil Aviation Law of Vietnam.
2. The airline or aircraft operator must ensure:
a) Each piece of checked luggage must have a baggage tag clearly indicating the flight number, date, month, year, and the identification code of that piece of luggage;
b) Before the flight, a list of checked luggage must be prepared and cross-checked against the passenger manifest of the flight;
c) Sign off the list of checked luggage loaded onto the aircraft.
3. In cases where a passenger has been issued a boarding pass but does not appear to board the flight, the airline shall be responsible for ensuring that all luggage of such passenger must be removed from the aircraft before departure.
4. Except for diplomatic pouches and consular pouches, checked luggage transported separately from passengers on the flight according to the provisions of the Civil Aviation Law of Vietnam must apply at least one of the following additional aviation security inspection measures and must be documented:
a) X-ray screening of objects in different positions;
b) Explosive detection device testing.
Article 50. Storage of Lost and Unclaimed Luggage
1. The enterprise providing passenger terminal service shall be responsible for arranging storage areas for lost and unclaimed luggage until such luggage is transferred to the owner. The storage area must be secured, and unauthorized persons may not enter this area.
2. Airlines and enterprises providing passenger and luggage services shall be responsible for storing and maintaining records of lost and unclaimed luggage, including recording quantity, weight, flight number, route, and resolution measures. Lost and unclaimed luggage must undergo aviation security screening through X-ray scanning and security sealing before being stored, and must be screened through X-ray scanning before being loaded onto the aircraft.
3. In cases where there are signs or information threatening the security and safety of the flight, lost and unclaimed luggage must undergo aviation security search.
Article 51. Security Inspection and Supervision of Diplomatic and Consular Pouches
1. Diplomatic pouches and consular pouches are exempt from X-ray screening, visual inspection, and aviation security search, except as provided for in Clause 6 of this Article.
2. The security personnel shall conduct the inspection of diplomatic and consular pouches as follows:
a) Inspect the seals and external identifying marks of diplomatic and consular pouches in accordance with the laws on diplomacy and consular affairs;
b) Inspect passports, authorization letters for carrying diplomatic and consular pouches, and confirmation documents from diplomatic and consular agencies regarding the number of items in the diplomatic and consular pouches.
3. If there is sufficient evidence to confirm that a diplomatic or consular pouch contains dangerous items prohibited from being transported on aircraft, then such diplomatic or consular pouch will be refused carriage.
4. When refusing carriage, a record must be made detailing the reasons, with confirmation from the diplomatic courier or consular courier and the relevant Civil Aviation Authority; the record must be sent to the diplomatic mission.
5. Diplomatic couriers, consular couriers, or representatives of diplomatic missions and consular agencies, along with items they carry when entering restricted areas to send or accompany diplomatic and consular pouches, must undergo aviation security screening in accordance with Articles 39 and 44 of this Circular.
6. Diplomatic and consular pouches shall be subject to X-ray screening if the airline directly transporting them requests it in writing to the head of the aviation security force at the airport. The X-ray screening must be recorded in a document confirmed by the airline, diplomatic courier or consular courier, aviation security personnel, and the relevant Civil Aviation Authority; the document must be sent to the diplomatic mission.
Article 52. Security inspection and supervision for crew members, passengers, baggage, cargo of special aircraft flights
1. The security inspection and supervision for crew members, passengers, baggage, and cargo of special aircraft flights shall be carried out by aviation security control forces in accordance with the provisions of Articles 44, 46, 47, and 48 of this Circular, except where otherwise provided by law.
2. The Civil Aviation Authority shall coordinate with the General Directorate of Security - Ministry of Public Security and relevant agencies to issue regulations on security inspection and supervision for crew members, passengers, baggage, and cargo of special aircraft flights.
3. The exemption from aviation security inspection for special aircraft flights shall be implemented in accordance with the provisions of the law.
Article 53. Security inspection and supervision for cargo and mail transported on aircraft at airports, airfields
1. At each point of cargo and mail security inspection, sufficient aviation security control staff must be arranged to ensure the full and effective performance of the following tasks:
a) Checking documents (sender's declaration form, completion of customs procedures for cargo sent on international flights), recording information about each inspected consignment;
b) Monitoring X-ray screen images; this task must be performed continuously for no more than 30 minutes and only resumed after a minimum of 30 minutes; conducting explosive detection using equipment;
c) Applying security seals, conducting visual inspections, and security searches;
d) The team leader is responsible for directing, managing, and supervising all activities at the security inspection point.
2. The procedures and steps for security inspection and supervision for cargo and mail are detailed in the Security Program and related Aviation Security Regulations.
3. Cargo and mail departing must undergo 100% X-ray screening, except in cases stipulated in Clause 7 of this Article and those exempted from screening as specified in Article 55 of this Circular. In case of suspicion, further visual inspection or other appropriate measures must be conducted. Visual inspection must be carried out in the presence of the owner or their authorized representative or airline representative. If there are signs or information threatening the security and safety of the flight, cargo and mail must undergo a security search.
4. Cargo and mail that have been inspected according to the provisions of Clause 3 of this Article must be continuously monitored by appropriate means until loaded onto the aircraft. When discovering that cargo and mail are not intact or lack security seals before being loaded onto the aircraft, the cargo and mail service staff must promptly inform the aviation security control staff. The aviation security control staff is responsible for implementing appropriate re-inspection measures to detect and prevent dangerous items as prescribed.
5. Cargo and mail that have undergone aviation security inspection but must be transported through public areas to reach the aircraft must be escorted or continuously monitored by appropriate means during transportation to prevent unauthorized introduction of dangerous items into the cargo and mail.
6. Transiting cargo and mail must be screened and subject to aviation security supervision like outgoing cargo and mail, except when confirmed in writing or sealed with confirmation that the aviation security inspection has been completed at the departure point.
7. Cargo and mail on passenger-carrying aircraft do not need to undergo aviation security inspection in the following cases:
a) Cargo and mail transiting or transferring without leaving the aircraft or airport apron, or under continuous appropriate security supervision;
b) Cargo and mail transiting or transferring transported from the aircraft apron to the cargo storage area through public areas and vice versa, sealed with security seals and continuously monitored by appropriate security measures during transportation to prevent unauthorized introduction of dangerous items into the cargo and mail.
8. Measures for security inspection and supervision for cargo and mail must be detailed in the Security Program and related Aviation Security Regulations.
9. Records of cargo and mail operations, weapons, explosives, support tools, and related minutes must be retained in accordance with the law.
Article 54. Security Inspection and Supervision for Goods and Mail at Facilities Outside Airports
1. Only facilities handling goods and mail with large volumes transported by air that meet the conditions regarding infrastructure and personnel to ensure aviation security, and have an approved Aviation Security Regulation by the Civil Aviation Authority of Vietnam shall establish points for aviation security inspection for goods and mail at facilities outside airports.
2. The Civil Aviation Authority of Vietnam designates the aviation security control force at airports and aerodromes providing services for aviation security inspection for goods and mail at facilities outside airports based on ensuring aviation security and the interests of all parties involved.
3. The enterprise managing the facility handling goods and mail is responsible for ensuring security and protecting the facility handling goods and mail according to the approved Aviation Security Regulation; implementing appropriate security inspection and supervision measures for goods and mail after receiving, storing, and transporting them from security inspections to airports and aerodromes.
4. The Civil Aviation Authority of Vietnam issues specific regulations on measures, procedures, and formalities for aviation security inspection for goods and mail throughout the entire supply chain of air transportation, suitable for the nature of each type of goods and mail. Enterprises related to air cargo transportation must implement the aviation security inspection measures, procedures, and formalities issued by the Civil Aviation Authority of Vietnam to eliminate the illegal transportation of dangerous items.
Article 55. Security Inspection for Special Items
1. X-ray screening and visual inspection are exempted for human remains transported by aircraft placed in sealed zinc coffins. The packaging and sealing process of the zinc coffin must be supervised by authorized health authorities. The zinc coffin must remain sealed and accompanied by a confirmation document from the supervising health authority along with a death certificate.
2. X-ray screening and visual inspection are exempted for blood products, organ transplants, vaccines, and pharmaceuticals that must remain sealed. Packaging must be sealed and accompanied by a confirmation document from authorized health authorities.
3. X-ray screening and visual inspection are exempted for hazardous materials whose screening or inspection would endanger the lives and health of aviation security inspectors such as nuclear research materials and radioactive materials. Packaging must be sealed and accompanied by a confirmation document of safe packaging, and a request document from authorized state agencies.
4. For cremains and ashes, aviation security inspection is conducted like ordinary goods and luggage, except when there is a request for exemption from X-ray screening by individuals, relevant state agencies, or foreign diplomatic representatives. Such requests must be accepted by the head of the aviation security control force at the airport or aerodrome.
5. For live animals and perishable items, if confirmed by authorized agencies that X-ray screening cannot be performed, they must undergo visual inspection or other appropriate methods.
6. Transportation of hazardous materials must comply with regulations on air transport of hazardous materials. Hazardous materials must be properly packaged, labeled, and declared before acceptance for transport. Airlines are responsible for checking and verifying compliance with air transport regulations for hazardous materials prior to accepting them for transport. When hazardous materials are discovered during aviation security inspection, the aviation security control force must notify the carrier to consider their decision.
7. Bringing medical equipment as hazardous items aboard aircraft for patient care and protection must be requested in writing and approved by airline representatives and the head of the aviation security control force at the airport or aerodrome..
8. All special items mentioned in Clauses 1, 2, 4, 5, and 7 of this Article must be inspected using explosive detection devices and equipment.
Article 56. Security Inspection and Supervision for In-flight Meals
1. Enterprises producing, processing, and supplying in-flight meals (hereinafter referred to collectively as meal enterprises) shall be responsible for implementing security measures for in-flight meals in accordance with the approved security regulations of the enterprise.
2. Production, processing, and supply areas for in-flight meals must be protected; entry and activities in these areas require security clearance cards or permits. Transport vehicles carrying in-flight meals from supply points to public areas and onto aircraft must have accompanying security personnel from the enterprise or appropriate security measures must be implemented.
3. Sample in-flight meals must be retained for at least 24 hours from the time they are served on board the aircraft.
4. Meal storage containers or bags used on board the aircraft, after being subject to aviation security inspection, must be sealed with security seals. Aviation security officers only permit access to restricted areas of airports and airfields if the meal storage containers retain their original security seals issued by the meal enterprise.
5. In cases where meal storage containers or bags lack security seals or the seals are not intact, they must undergo aviation security inspection using X-ray screening or visual inspection before being brought into restricted areas at the airport for loading onto the aircraft, and continuous aviation security monitoring must be maintained.
Article 57. Security Inspection and Supervision for Onboard Service Items
1. Onboard service items must be stored in boxes or bags and subjected to aviation security inspection using X-ray screening. Boxes or bags containing onboard service items must be sealed with aviation security seals after undergoing X-ray screening and must be continuously monitored using appropriate methods until loaded onto the aircraft, except as provided in Clause 3 of this Article.
2. Storage areas for onboard service items must be protected; entry and activities in these areas require security clearance cards or permits.
3. Aircraft operators, maintainers, and repairers are responsible for inspecting and verifying the quantity and type of service items used for maintenance and repair when loading and unloading them onto the aircraft, recording such actions in writing, and presenting them to aviation security officers upon entering and exiting restricted areas.
Article 58. Ensuring Aviation Security for Aircraft Fuel
1. Fuel supply enterprises shall be responsible for implementing security measures for fuel in accordance with the approved security regulations of the enterprise.
2. Fuel storage areas and transport vehicles must be protected; entry and activities in these areas require security clearance cards or permits.
3. Refueling vehicle intake and exhaust ports, after receiving fuel for aircraft refueling, must be sealed with security seals; the vehicle must have accompanying security personnel from the enterprise or appropriate security measures must be implemented during circulation in public areas.
4. Airport and airfield aviation security forces are responsible for inspecting and supervising refueling vehicles before entering the airport, ensuring that the intake and exhaust ports of the refueling vehicle retain their original security seals intact.
Article 59. Security checks and supervision for air passengers who are suspects, defendants, convicts, deported persons, extradited persons, or arrested persons based on arrest warrants 1. When going through aviation procedures, escorts must present escort orders or decisions issued by competent authorities.
2. Representatives of airlines shall cooperate with escorts to assess risks associated with transporting escorted passengers and determine appropriate security measures; they shall inform aviation security control forces and airport authorities at departure points.
3. Escorted persons and their escorts may be subject to aviation security checks in a separate area. The escorted person and their luggage and belongings must undergo visual inspection.
4. Aviation security personnel shall work closely with escorts to manage and supervise the process of boarding and deplaning escorted persons.
5. Airlines representatives must inform the aircraft commander of the seating positions of suspects, convicts, deported persons, extradited persons, and their escorts, along with any support equipment they carry. The aircraft commander shall notify the aviation security control force at the destination airport about any necessary assistance.
Article 60. Security checks and supervision for air passengers refused entry
1. Airlines are responsible for passengers refused entry by Vietnam, specifically: a) Transporting passengers out of Vietnam as soon as possible;
b) Cooperating with border police to temporarily hold personal identification documents of passengers and to obtain other necessary documents issued by immigration management authorities for the purpose of transporting such passengers if they lack valid personal identification documents;
c) Notifying border police and relevant airport authorities of passenger lists, times, and locations where passengers refused entry are managed, and flights transporting them out of Vietnam;
d) Holding personal identification documents or other documents issued by immigration management authorities until they are handed over to competent authorities of the country where the aircraft arrives.
2. In cases where airlines transport passengers refused entry from abroad back to Vietnam, airlines are responsible for cooperating with competent authorities of the host country to obtain personal identification documents of such passengers or other documents issued by competent authorities of the host country for the purpose of transporting them.
3. Aviation security forces at airports shall manage and supervise passengers until they board flights leaving Vietnam. If passengers refused entry do not voluntarily return to their home countries, airlines must arrange security personnel to escort them on the flight, with a minimum of one escort for each passenger.
4. Airlines shall bear all costs related to passengers refused entry.
5. Airlines representatives must inform the aircraft commander of the seating positions of passengers refused entry and their escorts, along with any support equipment they carry. The aircraft commander shall notify the aviation security control force at the airport or foreign authorities at the destination airport about any necessary assistance.
4. The airline shall bear all costs related to passengers refused entry.
5. The airline representative must inform the aircraft commander of the seating position of the passenger refused entry and those accompanying them along with any support tools they carry. The aircraft commander shall notify the airport or airfield civil aviation security force or foreign authorities where the aircraft is scheduled to land of any necessary assistance requirements.
Article 61. Security checks and supervision for passengers losing control of their behavior
1. Passengers losing control of their behavior include:
a) Losing control of their behavior due to mental illness;
b) Losing control of their behavior due to alcohol consumption or other stimulants.
2. Transporting passengers who lose control of their behavior due to stimulant use shall not be accepted.
3. Acceptance of transport for passengers with mental illness shall be evaluated and decided by airline representatives. When accepting transport, the following requirements must be met:
a) Mentally ill passengers must be accompanied by a doctor or relative capable of controlling the passenger's abnormal behavior. In necessary cases, mentally ill passengers must be sedated before boarding the aircraft, and the flight time must not exceed the duration of the drug's effect;
b) Mentally ill passengers and their luggage, belongings must be visually inspected; the inspection may be conducted in a separate area;
c) At the request of airline representatives, aviation security personnel must escort mentally ill passengers on board the aircraft and vice versa when necessary;
d) Airline representatives must inform the aircraft commander of the seating position of mentally ill passengers. The aircraft commander informs the airport operator about assistance requirements if deemed necessary.
Article 62. Procedure for handling disruptive passengers
1. In cases where passengers have not boarded the aircraft, aviation security personnel prevent passengers from boarding, temporarily detain the passenger and personal identification documents, prepare a violation report according to the model specified in Appendix XXIV of this Circular, notify the Civil Aviation Authority and relevant airline representatives. Handling must ensure minimal impact on the normal operation of the airport.
2. In cases where passengers have boarded the aircraft but the aircraft is still on the ground, the aircraft commander must apply appropriate measures within their authority; decide to suspend the flight if necessary for safety and security reasons; notify the airline representative; the airline representative reports the incident to the aviation security force and the Civil Aviation Authority at the airport for coordinated handling.
3. In cases where the aircraft is in flight, the aircraft commander must apply appropriate measures within their authority; decide to land the aircraft if necessary for safety and security reasons; notify the airline representative if landing at a domestic airport; notify the airport authority if landing at a foreign airport; the aircraft commander organizes the preparation of a violation report according to the model specified in Appendix XXIV of this Circular, hand over the case to the local authorities for handling in accordance with the laws of that country.
4. Upon receiving notification, aviation security forces at the airport immediately board the aircraft to coordinate with the crew, apply necessary coercive measures to remove the passenger from the aircraft, temporarily detain the passenger's personal identification documents, and items in violation; the crew prepares a report on the incident to transfer to the Civil Aviation Authority for handling within their authority and the airline representative must be present to witness and coordinate during the handling process.
5. Upon receiving notification, the relevant Civil Aviation Authority must immediately go to the location of the incident to directly assess and decide on handling within their authority; supervise the entire handling process, including on the aircraft; lead coordination with the aviation security forces at the airport, the airline to evaluate the incident, decide to apply necessary security measures; require the crew to prepare a report on the incident as a basis for considering the handling of violations on the aircraft; suspend or allow the continuation of the flight; prepare a record, impose administrative penalties; in cases exceeding their authority, transfer the case to competent authorities with sufficient authority.
Article 63. Refusal, embargo on transportation for security reasons; Mandatory visual inspection of passengers
1. The airline has the right to refuse transportation of passengers for security reasons as prescribed by law.
2. The procedures, formalities, and authority to decide on refusing transportation of passengers for security reasons must be clearly specified in the airline's aviation security program. The refusal of transportation of passengers must be immediately reported to the Civil Aviation Port Authority for supervision within its jurisdiction.
3. The Civil Aviation Authority issues decisions to embargo air transportation for a limited period or permanently against passengers who violate the provisions of the law; depending on the nature and degree of violation, the Civil Aviation Authority considers and decides to apply mandatory visual inspections for persons who commit violations related to aviation security and discipline on aircraft at airports.
4. The Civil Aviation Authority regularly updates and informs the Civil Aviation Port Authorities, airlines, and airport operators about the list of passengers subject to embargoes on transportation and those required to undergo mandatory visual inspections.
5. Airlines must take appropriate and effective measures to warn and detect immediately passengers subject to embargoes on transportation and those required to undergo mandatory visual inspections when they make reservations or check-in procedures to prevent such occurrences promptly and effectively.
Article 64Re- kSecurity re-inspection
1. Passengers and carry-on luggage that have undergone aviation security checks but leave the restricted area and return must undergo security re-inspection.
2. In cases where there is contact or mixing between passengers and carry-on luggage that have been checked and those that have not undergone aviation security checks, the aviation security control force must immediately implement the following measures:
a) All passengers and carry-on luggage must be transferred to another area and the entire restricted area related to them must be re-inspected.
b) A full security re-inspection of all passengers and carry-on luggage must be conducted before boarding the aircraft.
c) If passengers have already boarded the aircraft, a full security re-inspection must be conducted on all passengers, carry-on luggage, and the passenger cabin of the aircraft.
3. In cases where security seals are not intact or checked baggage, cargo, mail, onboard service items, food containers, and storage bags are torn or broken, a security re-inspection must be conducted before loading onto the aircraft.
4. The security re-inspections stipulated in Clauses 2 and 3 of this Article must be documented in a report.
Article 65. Measures for handling dangerous items during aviation security checks on passengers, luggage, and cargo mail
1. When a bomb, mine, explosive material, explosive precursor, flammable substance, radioactive material, or toxic substance posing a danger is discovered or suspected, the aviation security control force must immediately assess the risk and take appropriate measures. In the case of a bomb or mine with an unknown detonation mechanism, it should remain in place, the area should be quickly sealed off, passengers evacuated to a safe location, and the bomb disposal unit of the police or military should be notified immediately to defuse the device. The movement of flammable substances, radioactive materials, and toxic substances shall be carried out in accordance with the law.
2. When dangerous items without a permit as prescribed by law are discovered, the aviation security control force at the airport must document the incident and transfer the person, file, and dangerous item to the competent authority with jurisdiction, while simultaneously informing the relevant airline to take appropriate measures.
3. When dangerous items that do not comply with the conditions for safe air transportation are discovered, the aviation security control force at the airport must instruct passengers to leave the items behind or follow the prescribed procedures for transportation or refuse to complete the aviation security check process and require the airline, the legal representative of the sender, and the passenger to comply with the transportation conditions.
4. When weapons or explosive materials are found on passengers, they must be quickly controlled and stopped using appropriate measures; when weapons or explosive materials are found in passengers' carry-on luggage, the passenger must be immediately isolated from the luggage and controlled to handle the situation.
Article 66. Security Inspection and Supervision of the Isolation Area
1. The isolation area must be subject to security inspection prior to daily operation and must be closely and continuously monitored during the entire period of operation.
2. When not in use, all entrances and exits of the isolation area must be locked or guarded by security personnel.
3. Staff members of state management agencies, enterprises operating at airports, and other individuals along with their belongings when entering the isolation area must undergo security inspection and supervision similar to passengers and checked baggage.
4. The procedures and methods for security inspection and supervision of the isolation area shall be specifically detailed in the Security Program and relevant Aviation Security Regulations.
Section 4
ENSURING SECURITY FOR COMMERCIAL AIRCRAFT
Article 67. Protection of Aircraft on the Ramp aircraft
1. Aircraft parked on the ramp must be protected by appropriate measures to detect and prevent unauthorized persons or vehicles from approaching, loading or unloading items, or leaving items on the aircraft.
2. Non-operational aircraft must comply with the provisions of Clause 1 of this Article and the following requirements:
a) Stairs, passenger boarding bridges, conveyor belts, and other service equipment must be removed from the aircraft;
b) The aircraft operator is responsible for closing and locking the aircraft doors; sealing the aircraft doors; and illuminating the aircraft overnight.
3. Operational aircraft must comply with the provisions of Clause 1 of this Article and the following requirements:
a) Continuous security supervision or closure, locking, and sealing of the aircraft doors;
b) The aircraft operator is responsible for organizing the recording and retention of lists of authorized persons and vehicles allowed to approach and serve the aircraft.
Article 68Security inspection, search aircraft
1. Prior to accepting passengers, baggage, cargo, and mail onto the aircraft and after all passengers, baggage, cargo, and mail have disembarked from the aircraft, the aircraft operator must conduct a security inspection of the aircraft according to the specific type of aircraft to detect dangerous items that may be hidden or individuals who may be hiding on board. The aircraft operator must detail the procedures and methods for conducting security inspections of the aircraft in the airline's Security Program.
2. Security inspections and searches of the aircraft must be conducted according to a checklist. Each aircraft must have a security inspection checklist and search checklist, and the contents of the security inspection checklist must be specified in the airline's Security Program.
Article 69. Protection of the Flight Deck
1. Throughout the flight, the flight deck door must be locked from the inside, and there must be a method for secret communication between the cabin crew and the flight crew when suspicious activities or threats to aviation security are detected in the passenger cabin.
2. Aircraft with a maximum takeoff weight of 45,500 kilograms or more or a capacity of 60 passengers or more must meet the following requirements:
a) The flight deck door of the aircraft must be capable of resisting light weapons, grenade fragments, or forceful attempts to enter the flight deck illegally;
b) There must be equipment installed to allow the flight crew to monitor the entire area outside the flight deck door to identify individuals requesting entry to the flight deck and to detect suspicious behavior or potential threats.
3. The aircraft operator must ensure that after the aircraft doors are closed for departure, no one is permitted to enter the flight deck until the aircraft doors are opened for passengers to disembark, except for the following individuals if the Aircraft Commander agrees:
a) Members of the flight crew performing duties;
b) Individuals permitted by the aircraft operator;
c) Individuals permitted to enter the flight deck in accordance with the law.
4. Flight crew members are not permitted to leave the flight deck without permission from the Aircraft Commander; there must always be two flight crew members present in the flight deck. In exceptional circumstances, if only one flight crew member is present, it is mandatory to have one cabin crew member and that flight crew member present.
Article 70. Ensuring Air Security on Flights
1. When passengers board the aircraft, the airline shall be responsible for organizing checks and verifying personal identification documents and boarding passes of passengers to ensure that they match the correct individual and flight. The measures for such checks must be detailed in the airline's aviation security program.
2. Prior to allowing the aircraft to depart, the aircraft commander must organize a verification of the total number of passengers who have been issued boarding passes with the actual number of passengers present on the aircraft using appropriate methods; if there is no match, the cause must be clarified before departure is permitted.
3. During the flight, the aircraft commander is responsible for ensuring air security, maintaining order and discipline on the aircraft; preventive, deterrent, and responsive measures may be applied against illegal interventions, violations of aviation security regulations, disruptive behavior, breaches of order and discipline, and non-compliance with crew instructions as prescribed by law; the commander must organize the handover of violators, evidence, and violation reports or records to competent state authorities when the aircraft lands at an airport. The aircraft commander must organize the monitoring of air security and maintenance of order and discipline throughout the flight.
4. Crew members must comply with the orders, commands, and management of the aircraft commander; they must continuously observe the passenger cabin to promptly detect any unusual behavior by passengers, report it to the aircraft commander for handling; cooperate with in-flight security personnel to resolve and handle situations where the aircraft is subject to illegal intervention during flight.
5. The Civil Aviation Authority of Vietnam serves as the coordinating body with relevant agencies and units of the Ministry of Public Security, foreign competent authorities, and airlines regarding the deployment of in-flight security personnel on flights.
Article 71. Transporting Suspects, Convicts, Deported Persons, Extradited Persons, and Arrested Persons Pursuant to Warrants
1. The transport of individuals posing a threat to aviation security must comply with legal provisions and be accompanied by escorts. On any single flight, no more than five such individuals may be transported. Special charter flights do not carry suspects, defendants, convicts, deported persons, extradited persons, or arrested persons pursuant to warrants.
2. For flights returning from abroad to Vietnam, if the legal provisions of the country of origin differ from those stipulated in Clause 1 of this Article, the Civil Aviation Authority of Vietnam shall assess and determine the limit on transportation.
3. The seating position of escorted individuals must be designated far from entry and exit doors and emergency exits. Escort personnel sit by the aisle, while the escorted individual sits in the middle seat; if the number of escort personnel is twice the number of escorted individuals, the escorted individual sits between two escort personnel.
4. Escorted individuals must be monitored by their escorts throughout the flight, including when entering the restroom; escorted individuals may be served meals with the consent of their escorts; neither the escorts nor the escorted individuals may consume stimulants or alcohol-containing beverages.
5. It is prohibited to secure the hands or feet of escorted individuals to any part of the aircraft.
6. Airlines must arrange for escorts and escorted individuals to board the aircraft before other passengers and disembark after all other passengers.
7. The transport of voluntarily repatriated deportees exceeding the number specified in Clause 1 of this Article may be carried out if adequate security assurance is provided. The airline bears responsibility for assessing and deciding on this matter.
Article 72. Transport of weapons, war equipment, radioactive materials, and other dangerous items on aircraft
Clause 1. The transport of weapons, war equipment, radioactive materials, and other dangerous items on aircraft into or through the territory of Vietnam must comply with the provisions of Vietnamese law.
Clause 2. The list of dangerous items that passengers and flight crews are not allowed to carry on their person, in hand luggage, or checked baggage onto aircraft shall be issued by the Civil Aviation Administration of Vietnam.
Clause 3. For dangerous items that are hazardous goods when transported, they must be accepted for carriage on the aircraft by a representative of the airline in accordance with the regulations on the transportation of hazardous goods.
Clause 4. Airports and airfields operators must post the list of dangerous items that are not allowed to be carried on the person, in hand luggage, or checked baggage at the aviation security checkpoint for passengers; and notify by appropriate means at the terminal the list of dangerous items that are not allowed to be brought onto the aircraft as stipulated in Clause 2 of this Article.
Airlines must organize the posting of the list of dangerous items that are not allowed to be carried on the person, in hand luggage, or checked baggage at ticket counters and check-in counters.
Article 73. Procedures and sequence for receiving, managing, transporting, and handing over weapons and support tools
Clause 1. When going through check-in procedures at the counter for boarding the aircraft, persons carrying weapons and support tools must:
Point a) Present weapons, support tools, and related permits to airline staff for inspection during the check-in process;
Point b) In cases where firearms are carried on the person onto the aircraft, they must complete a declaration form according to the model prescribed in Appendix XV attached to this Circular. In cases where firearms and ammunition are checked in, they must complete a declaration form according to the model prescribed in Appendix XVI attached to this Circular.
Clause 2. Check-in staff of the airline must inform aviation security personnel to inspect the permits related to weapons and support tools. In cases involving firearms and ammunition, aviation security personnel must verify the contents of the declaration and sign to confirm on the declaration form.
Clause 3. Procedure for receiving, transporting weapons, and support tools:
Point a) Persons with firearms must disassemble the magazine from the firearm; disassemble or disconnect the power source of the support tool; ensure that weapons and support tools are in a safe state;
Point b) Ammunition must be packed and stacked in accordance with the regulations on the transportation of hazardous goods. A representative of the airline must sign to confirm on the declaration form according to the model prescribed in Appendix XVI attached to this Circular;
Point c) Ground service staff transporting firearms and ammunition from the check-in point to the aircraft must be accompanied and escorted by aviation security personnel;
Point d) Weapons and support tools must be placed in areas inaccessible to passengers throughout the flight;
Point đ) A representative of the airline must notify by appropriate means the representative of the airline at the airport to come and receive and supervise.
Clause 4. The aircraft commander must be informed about the quantity of firearms and ammunition being transported on the flight.
5. Tại cảng hàng không, sân bay đến, quy trình bàn giao vũ khí, công cụ hỗ trợ như sau:
a) Nhân viên phục vụ mặt đất có trách nhiệm vận chuyển vũ khí, công cụ hỗ trợ từ tàu bay vào khu vực trả hành lý; đối chiếu giấy tờ về nhân thân, thẻ lên tàu bay với thẻ hành lý ký gửi; bàn giao vũ khí, đạn, công cụ hỗ trợ cho hành khách tại nơi trả hành lý ký gửi;
b) Lực lượng kiểm soát an ninh hàng không có trách nhiệm giám sát quá trình vận chuyển, bàn giao, đăng ký vào sổ và giám sát việc hành khách mang vũ khí, công cụ hỗ trợ ra khỏi khu vực hạn chế cảng hàng không, sân bay.
6. Quy trình, thủ tục tiếp nhận, quản lý, vận chuyển, bàn giao vũ khí, công cụ hỗ trợ phải được quy định chi tiết trong Chương trình an ninh hàng không dân dụng của hãng hàng không và người khai thác cảng hàng không, sân bay.
Điều 74. Mang chất lỏng, chất đặc sánh, dung dịch xịt (chất lỏng) theo người và hành lý xách tay đối với chuyến bay quốc tế
1. Khi qua điểm kiểm tra an ninh hàng không vào khu vực cách ly quốc tế, mỗi hành khách, thành viên tổ bay chỉ được mang không quá 01 lít chất lỏng theo người và hành lý xách tay; dung tích của mỗi chai, lọ, bình chứa chất lỏng không quá 100 mi-li-lít, đồng thời phải được đóng kín hoàn toàn.
2. Không áp dụng khoản 1 Điều này đối với chất lỏng là thuốc chữa bệnh, sữa, thức ăn cho trẻ em nếu đáp ứng các điều kiện sau:
a) Thuốc chữa bệnh có kèm theo đơn thuốc trong đó ghi rõ họ và tên, địa chỉ của người kê đơn thuốc, họ và tên người sử dụng thuốc phù hợp với họ và tên trên vé hành khách;
b) Sữa, thức ăn dành cho trẻ em, trẻ sơ sinh phải có trẻ em, trẻ sơ sinh đi cùng.
3. Chất lỏng mua tại cửa hàng trong khu cách ly quốc tế, trên chuyến bay quốc tế được phép mang theo người và hành lý xách tay không giới hạn dung tích với điều kiện phải đựng trong túi nhựa an ninh được dán kín.
Mục 5
BẢO ĐẢM AN NINH CHO HOẠT ĐỘNG HÀNG KHÔNG CHUNG
Điều 75. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung
1. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung được thực hiện như đối với tàu bay vận chuyển hàng không thương mại.
2. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung đỗ ngoài cảng hàng không, sân bay thực hiện như sau:
a) Người khai thác tàu bay phải xây dựng quy định về bảo vệ tàu bay phù hợp với hoạt động khai thác của mình; phối hợp, hiệp đồng với chính quyền địa phương tổ chức bảo vệ tàu bay; bố trí lực lượng canh gác tàu bay liên tục nhằm phát hiện và ngăn chặn kịp thời người, phương tiện tiếp cận và lên tàu bay trái phép; thiết lập hệ thống hàng rào, chiếu sáng ban đêm thích hợp quanh khu vực tàu bay đỗ;
b) Cửa tàu bay phải được khoá hoặc niêm phong.
3. Người khai thác tàu bay hoạt động hàng không chung chịu trách nhiệm tổ chức kiểm tra an ninh hàng không đối với tàu bay trước khi cho người, đồ vật lên tàu bay và bảo đảm an ninh trong khi bay.
4. Tàu bay hoạt động hàng không chung có trọng lượng cất cánh tối đa trên 5.700 kg phải được bảo đảm an ninh như tàu bay vận chuyển hàng không thương mại.
5. Hãng hàng không thực hiện hoạt động hàng không chung vì mục đích thương mại phải xây dựng Chương trình an ninh hàng không cho hoạt động khai thác của hãng. Nội dung phải quy định chi tiết các biện pháp bảo đảm an ninh hàng không, bảo vệ tàu bay của hãng trong và ngoài phạm vi cảng hàng không, sân bay; thiết lập, duy trì bộ phận bảo đảm an ninh hàng không của hãng và chỉ định người chịu trách nhiệm về toàn bộ công tác bảo đảm an ninh của hãng theo hệ thống độc lập, không kiêm nhiệm.
Điều 76. Kiểm tra, giám sát an ninh người, đồ vật đưa lên chuyến bay hoạt động hàng không chung
1. Việc kiểm tra, giám sát an ninh đối với người, đồ vật đưa lên tàu bay hoạt động hàng không chung được thực hiện bằng biện pháp thích hợp và được quy định cụ thể trong Chương trình an ninh hàng không của hãng hàng không.
2. Tàu bay xuất phát từ một cảng hàng không, sân bay, người khai thác tàu bay phải gửi danh sách người, đồ vật đưa lên tàu bay cho người khai thác cảng hàng không, sân bay để thực hiện kiểm tra, giám sát an ninh hàng không trước chuyến bay.
3. Tàu bay xuất phát từ nơi nằm ngoài cảng hàng không, sân bay, người khai thác tàu bay phải tổ chức thực hiện kiểm tra, giám sát an ninh hàng không đối với người, đồ vật đưa lên tàu bay.
Mục 6
BIỆN PHÁP KIỂM SOÁT AN NINH HÀNG KHÔNG TĂNG CƯỜNG
Điều 77. Thu thập thông tin về nguy cơ uy hiếp an ninh hàng không
1. Cục Hàng không Việt Nam phối hợp với các cơ quan thuộc Bộ Công an, Bộ Quốc phòng và các bộ, ngành liên quan thu thập, đánh giá thông tin về tình hình an ninh chính trị, trật tự an toàn xã hội; âm mưu, phương thức, thủ đoạn hoạt động của khủng bố, các tổ chức phản động và các loại tội phạm, âm mưu can thiệp bất hợp pháp vào hoạt động hàng không dân dụng để quyết định áp dụng biện pháp kiểm soát an ninh tăng cường cho từng cấp độ theo quy định của pháp luật.
2. Cục Hàng không Việt Nam, người khai thác cảng hàng không, sân bay, hãng hàng không công bố số điện thoại đường dây nóng để tiếp nhận các thông tin liên quan đến âm mưu tấn công can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
3. Quyết định áp dụng biện pháp kiểm soát an ninh hàng không tăng cường phải được triển khai ngay đến các cơ quan, đơn vị liên quan bằng hình thức thích hợp trong thời gian sớm nhất để thực hiện, đồng thời được gửi ngay để báo cáo Bộ trưởng Bộ Giao thông vận tải và Bộ trưởng Bộ Công an qua số fax do Bộ Giao thông vận tải và Bộ Công an xác định.
Điều 78. Phạm vi áp dụng kiểm soát an ninh hàng không tăng cường
Căn cứ thông tin về tình hình, nguy cơ đe doạ, uy hiếp an ninh hàng không, Cục trưởng Cục Hàng không Việt Nam quyết định áp dụng, hủy bỏ cấp độ kiểm soát an ninh hàng không tăng cường trên phạm vi toàn quốc hoặc tại một cảng hàng không, sân bay cụ thể.
Điều 79. Các biện pháp kiểm soát an ninh hàng không tăng cường
1. Quy trình triển khai các biện pháp kiểm soát an ninh hàng không tăng cường áp dụng cho từng cấp độ phải được quy định cụ thể trong Chương trình an ninh, Quy chế an ninh hàng không của người khai thác cảng hàng không, sân bay, hãng hàng không Việt Nam, doanh nghiệp cung cấp dịch vụ hàng không trên cơ sở nội dung quy định tại Phụ lục XVII ban hành kèm theo Thông tư này.
2. Cục Hàng không Việt Nam chỉ đạo triển khai thực hiện các biện pháp kiểm soát an ninh hàng không tăng cường tương ứng với cấp độ được áp dụng. Người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu và các cơ quan, đơn vị liên quan phải thực hiện ngay theo chỉ đạo của Cục Hàng không Việt Nam.
Mục 7
CUNG CẤP, SỬ DỤNG THÔNG TIN VỀ HÀNH KHÁCH, HÀNG HÓA
VÀ AN NINH HỆ THỐNG THÔNG TIN CHUYÊN NGÀNH HÀNG KHÔNG
Điều 80. Nguyên tắc sử dụng, cung cấp thông tin về nhân thân hành khách, người gửi, người nhận hàng hoá
1. Chỉ hãng hàng không liên quan đến việc vận chuyển hành khách, hàng hoá được phép khai thác, sử dụng thông tin về nhân thân hành khách, người gửi, người nhận hàng hoá, trừ trường hợp quy định tại khoản 2 Điều này.
2. Hãng hàng không có trách nhiệm bảo mật thông tin cá nhân của hành khách; chỉ cung cấp thông tin về nhân thân hành khách, người gửi, người nhận hàng hoá cho cơ quan nhà nước có thẩm quyền theo yêu cầu vì mục đích phục vụ công tác quản lý nhà nước về an ninh, an toàn hàng không dân dụng, bảo đảm an ninh chính trị, trật tự an toàn xã hội, phòng, chống buôn lậu, gian lận thương mại và các tội phạm hình sự khác.
Điều 81. Bảo vệ hệ thống thông tin chuyên ngành hàng không
1. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải xây dựng và ban hành các quy định về bảo vệ, quản lý, sử dụng để chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng, đánh cắp và làm sai lệch thông tin, dữ liệu theo quy định của pháp luật.
2. Việc bảo vệ hệ thống thông tin chuyên ngành hàng không phải được thực hiện từ giai đoạn lựa chọn nhà cung cấp và trong quá trình thiết kế lắp đặt, sử dụng hệ thống. Các biện pháp bảo vệ bao gồm:
a) Quản trị hệ thống thông qua việc ban hành tiêu chuẩn, quy trình, thủ tục an ninh; lựa chọn và đào tạo cán bộ, đặc biệt là những người có quyền quản trị hệ thống; đánh giá mối đe dọa và rủi ro để xác định các lỗ hổng của hệ thống và khả năng bị tấn công; kiểm tra và thử nghiệm; bảo đảm an ninh chuỗi cung ứng;
b) Kiểm soát bằng tường lửa; mã hóa dữ liệu; sử dụng hệ thống phát hiện xâm nhập mạng và hệ thống chống vi-rút;
c) Bảo vệ hệ thống, đặc biệt là các máy chủ, phải nằm trong khu vực mà việc vào, ra và hoạt động trong khu vực đó được kiểm soát và hạn chế; chỉ những người có thẩm quyền được truy cập vào hệ thống bằng phương pháp đăng nhập sinh trắc học, mật khẩu; hạn chế số lượng người có quyền truy cập; kiểm soát và giám sát liên tục việc truy cập vào hệ thống; sử dụng hệ thống sao lưu đề phòng trường hợp hệ thống chính bị trục trặc; ghi lưu các hoạt động để phục vụ kiểm tra, đánh giá và cảnh báo khi có hoạt động bất thường.
3. Chương trình, Quy chế an ninh hàng không, phương án khẩn nguy, phương án ứng phó không lưu của các doanh nghiệp ngành hàng không liên quan phải quy định cụ thể về nội dung bảo vệ thông tin và hệ thống công nghệ thông tin; phương án phòng ngừa, đảm bảo an ninh thông tin, phương án ứng phó khi bị tấn công can thiệp bất hợp pháp bằng kỹ thuật điện tử.
4. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải thực hiện việc đánh giá nguy cơ uy hiếp an ninh, an toàn hàng không, mức độ thiệt hại nếu bị tấn công, can thiệp bất hợp pháp vào các thiết bị, hệ thống thông tin của đơn vị mình để có biện pháp bảo vệ thích hợp. Việc đánh giá dựa trên tiêu chí sau:
a) Mức độ uy hiếp trực tiếp đến hoạt động điều hành bay và tàu bay đang bay;
b) Mức độ uy hiếp trực tiếp đến tính mạng hành khách, nhân viên tại cảng hàng không, sân bay;
c) Mức độ uy tiếp trực tiếp đến hoạt động bình thường của các thiết bị điều hành bay, hệ thống cơ sở hạ tầng, thiết bị bảo đảm an ninh hàng không.
5. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải phối hợp với các cơ quan an ninh thông tin của Bộ Công an để bảo vệ, chống hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp, làm sai lệch thông tin, dữ liệu; tuân thủ các quy định của pháp luật về an ninh thông tin.
Mục 8
KIỂM SOÁT AN NINH NỘI BỘ
Điều 82. Nguyên tắc thực hiện kiểm soát an ninh nội bộ đối với nhân viên hàng không
1. Kiểm soát an ninh nội bộ được thực hiện thông qua việc xây dựng, duy trì thực hiện tiêu chuẩn chức danh công việc; nội quy, kỷ luật của cơ quan, đơn vị và công tác phối hợp với cơ quan chức năng trong phòng, chống các hành vi vi phạm pháp luật và thẩm tra xác minh nhân thân.
2. Kiểm soát an ninh nội bộ phải được thực hiện trong tất cả các quy trình tuyển dụng, huấn luyện, đào tạo, quản lý, giám sát, xử lý vi phạm, đánh giá, nhận xét, bổ nhiệm, điều động của mỗi cơ quan, đơn vị; phải kết hợp chặt chẽ công tác kiểm soát an ninh nội bộ với công tác bảo vệ chính trị nội bộ.
3. Đơn vị tuyển dụng, quản lý, sử dụng nhân viên hàng không phải tiến hành kiểm tra án tích tại cơ quan tư pháp; thẩm tra, xác minh lý lịch và nhân thân tại nơi cư trú và nơi họ đã làm việc trước khi quyết định tuyển dụng; định kỳ đánh giá nhân viên hàng không. Khi có biểu hiện bất thường về phẩm chất đạo đức, sinh hoạt, kinh tế, ý thức chấp hành kỷ luật, nội quy của cơ quan, đơn vị, phải xác minh làm rõ.
Điều 83. Trách nhiệm của các cơ quan, đơn vị trong công tác kiểm soát an ninh nội bộ
1. Cục Hàng không Việt Nam chịu trách nhiệm chỉ đạo, hướng dẫn, kiểm tra công tác kiểm soát an ninh nội bộ đối với các cơ quan, đơn vị trong ngành hàng không dân dụng; tạm đình chỉ hoạt động của nhân viên hàng không có dấu hiệu vi phạm pháp luật, uy hiếp an ninh, an toàn hàng không hoặc theo yêu cầu của cơ quan an ninh có thẩm quyền thuộc Bộ Công an; chỉ đạo các doanh nghiệp ngành hàng không dân dụng trong việc phối hợp với các cơ quan công an liên quan thực hiện công tác kiểm soát an ninh nội bộ.
2. Doanh nghiệp quản lý, sử dụng nhân viên hàng không phải ban hành quy định về kiểm soát an ninh nội bộ gồm các nội dung sau:
a) Xác minh và định kỳ thực hiện đánh giá nhân thân đối với nhân viên hàng không khi tuyển dụng, đề nghị cấp phép, năng định chuyên môn và giám sát quá trình thực hiện nhiệm vụ của nhân viên thuộc đơn vị mình;
b) Thường xuyên quán triệt, nhắc nhở, giáo dục nâng cao ý thức chấp hành kỷ luật, phẩm chất đạo đức của cán bộ, nhân viên trong cơ quan, đơn vị;
c) Kiểm soát chặt chẽ việc đi lại, mang đồ vật ra, vào khu vực hạn chế, lên, xuống tàu bay; hoạt động thực hiện nhiệm vụ của nhân viên trong các khu vực hạn chế;
d) Có người hoặc bộ phận chuyên trách hoặc kiêm nhiệm bảo đảm thực hiện hiệu quả công tác kiểm soát an ninh nội bộ, lập hồ sơ quản lý nhân viên; phối hợp chặt chẽ với cơ quan công an, chính quyền địa phương để trao đổi, nắm bắt thông tin liên quan đến người lao động; tích cực, chủ động phối hợp kịp thời phát hiện, xử lý các trường hợp vi phạm kỷ luật lao động, vi phạm pháp luật và khắc phục thiếu sót; triển khai công tác kiểm tra lý lịch nhân viên hàng năm;
đ) Doanh nghiệp quản lý, sử dụng nhân viên hàng không phải xây dựng các tiêu chí để tuyển dụng, bố trí sắp xếp phù hợp đối với từng loại nhân viên hàng không; phối hợp với cơ quan an ninh có thẩm quyền thuộc Bộ Công an để kiểm tra nhân thân đối với nhân viên hàng không là người nước ngoài.
Chương III
XỬ LÝ VỤ VIỆC VI PHẠM AN NINH HÀNG KHÔNG VÀ ĐỐI PHÓ VỚI HÀNH VI CAN THIỆP BẤT HỢP PHÁP
Mục I
XỬ LÝ VỤ VIỆC VI PHẠM AN NINH HÀNG KHÔNG
Điều 84. Nguyên tắc xử lý vi phạm
1. Mọi vụ việc vi phạm an ninh hàng không phải được xử lý kịp thời, nhanh chóng, không để vi phạm lan rộng và hạn chế tới mức thấp nhất hậu quả. Việc xử lý căn cứ vào tính chất, mức độ vi phạm, hậu quả do hành vi vi phạm gây ra và tuân thủ các quy định của pháp luật hiện hành. Việc lên tàu bay của lực lượng kiểm soát an ninh hàng không để trấn áp, cưỡng chế, áp giải đối tượng vi phạm được thực hiện theo yêu cầu của người chỉ huy tàu bay hoặc Cảng vụ hàng không trừ trường hợp đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
2. Lực lượng kiểm soát an ninh hàng không bố trí nơi xử lý, giải quyết vụ việc vi phạm; bảo đảm việc xử lý vi phạm nhanh chóng, an toàn, thuận tiện và hạn chế đến mức tối thiểu việc gây ách tắc làm ảnh hưởng đến các hoạt động bình thường của cảng hàng không, sân bay và chuyến bay.
3. Cảng vụ hàng không chủ trì phối hợp với các cơ quan, đơn vị liên quan hoạt động tại cảng hàng không, sân bay để thống nhất những vấn đề cụ thể trong phối hợp xử lý vi phạm về an ninh hàng không, trật tự công cộng tại cảng hàng không, sân bay và giải quyết những vướng mắc phát sinh trong quá trình phối hợp theo quy định của pháp luật. Doanh nghiệp cung cấp dịch vụ hàng không phối hợp với công an, chính quyền địa phương trong xử lý vi phạm về an ninh hàng không xảy ra tại khu vực nằm ngoài cảng hàng không, sân bay trong phạm vi quản lý của doanh nghiệp.
4. Cảng vụ hàng không, các đơn vị, doanh nghiệp có lực lượng kiểm soát an ninh hàng không và các doanh nghiệp cung cấp dịch vụ hàng không có lực lượng bảo vệ phải tổ chức trực ban 24 giờ trong ngày và trong cả tuần, công bố số máy điện thoại trực để tiếp nhận thông tin và xử lý kịp thời vụ việc vi phạm an ninh hàng không, trật tự công cộng tại cảng hàng không, sân bay.
5. Hồ sơ, thủ tục, biên bản, quyết định xử lý vi phạm phải được lập và lưu giữ theo quy định của pháp luật.
Điều 85. Trách nhiệm, quy trình xử lý đối với vụ việc vi phạm an ninh hàng không
1. Lực lượng kiểm soát an ninh hàng không, bảo vệ của doanh nghiệp tại cảng hàng không, sân bay chịu trách nhiệm xử lý ban đầu các vụ việc vi phạm an ninh hàng không, trật tự công cộng xảy ra tại cảng hàng không, sân bay thuộc quyền quản lý. Quy trình xử lý như sau:
a) Ngăn chặn hành vi vi phạm; tạm giữ đối tượng vi phạm;
b) Kiểm tra, lục soát, thu giữ tang vật, chứng cứ;
c) Đưa người, tang vật vi phạm về nơi quy định để giải quyết, xử lý vi phạm;
d) Thông báo ngay vụ việc cho Cảng vụ hàng không, cơ quan công an (nếu vụ việc có dấu hiệu hình sự) và các cơ quan, đơn vị liên quan tại cảng hàng không, sân bay;
đ) Bảo vệ hiện trường nếu xét thấy cần thiết;
e) Lập hồ sơ ban đầu (Biên bản vi phạm, Biên bản bàn giao theo mẫu quy định tại Phụ lục XXIV của Thông tư này) và bàn giao hồ sơ, bằng chứng, tang vật, người vi phạm cho cơ quan nhà nước có thẩm quyền theo yêu cầu của Cảng vụ hàng không.
2. Các cơ quan, đơn vị, cá nhân có liên quan có trách nhiệm phối hợp chặt chẽ với lực lượng kiểm soát an ninh hàng không trong quá trình xử lý các vụ việc vi phạm an ninh hàng không.
3. Người chỉ huy tàu bay chịu trách nhiệm tổ chức xử lý đối với vụ việc vi phạm an ninh hàng không trên tàu bay đang bay. Nhân viên an ninh trên không hoạt động bí mật, không tham gia xử lý vụ việc vi phạm an ninh hàng không.
4. Lực lượng kiểm soát an ninh hàng không của doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp sửa chữa, bảo dưỡng tàu bay, hãng hàng không và lực lượng bảo vệ của các doanh nghiệp cung cấp dịch vụ hàng không khác chịu trách nhiệm xử lý ban đầu đối với vụ việc vi phạm an ninh hàng không xảy ra tại cơ sở nằm ngoài cảng hàng không, sân bay do mình quản lý; quy trình xử lý theo quy định tại các điểm a, b, c và đ của khoản 1 Điều này; lập hồ sơ ban đầu (Biên bản vi phạm, Biên bản bàn giao theo mẫu quy định tại Phụ lục XXIV của Thông tư này), bàn giao hồ sơ, bằng chứng, tang vật, người vi phạm cho cơ quan chức năng tại địa phương và phối hợp xử lý tiếp theo đối với các vụ việc vi phạm an ninh hàng không.
5. Cảng vụ hàng không có trách nhiệm cử người trực tiếp đến ngay địa điểm đang giải quyết vi phạm ngay sau khi nhận được thông báo theo quy định tại điểm d khoản 1 Điều này để giám sát việc xử lý ban đầu, đánh giá tính chất, mức độ vi phạm, thẩm quyền giải quyết vụ việc và quyết định việc xử lý tiếp theo như sau:
a) Trường hợp vi phạm xét thấy chưa tới mức xử phạt hành chính thì tiếp nhận vụ việc và có văn bản yêu cầu cơ quan có người vi phạm xem xét xử lý kỷ luật đối với người vi phạm và thông báo kết quả xử lý cho Cảng vụ hàng không biết;
b) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của Cảng vụ hàng không, Thanh tra hàng không, Cục Hàng không Việt Nam, Thanh tra Bộ Giao thông vận tải thì Cảng vụ hàng không nhận bàn giao và tiến hành các công việc cần thiết theo quy định của pháp luật để xử phạt vi phạm hành chính theo thẩm quyền hoặc chuyển giao cho người, cơ quan có thẩm quyền;
c) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của cơ quan công an, vi phạm có dấu hiệu hình sự thì yêu cầu lực lượng kiểm soát an ninh hàng không, bảo vệ bàn giao cho cơ quan công an để cơ quan công an xử lý, điều tra. Cảng vụ hàng không tiếp tục theo dõi, phối hợp với cơ quan công an trong quá trình xử lý để đảm bảo việc xử lý đạt hiệu quả;
d) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của cơ quan Hải quan hoặc cơ quan nhà nước có thẩm quyền khác thì yêu cầu lực lượng kiểm soát an ninh hàng không, bảo vệ bàn giao cho cơ quan có thẩm quyền để xử lý; Cảng vụ hàng không tiếp tục theo dõi, phối hợp với cơ quan thụ lý vụ việc trong quá trình xử lý để đảm bảo việc xử lý đạt hiệu quả;
đ) Trong trường hợp vi phạm hành chính thuộc thẩm quyền xử phạt của nhiều cơ quan, thì Giám đốc Cảng vụ hàng không phối hợp với các cơ quan có thẩm quyền xử phạt để quyết định theo quy định của pháp luật.
6. Khi bàn giao vụ việc cho Cảng vụ hàng không, Công an, Hải quan hoặc cơ quan nhà nước có thẩm quyền khác, lực lượng kiểm soát an ninh hàng không lập biên bản bàn giao theo mẫu quy định tại Phụ lục XXIV của Thông tư này và phối hợp thực hiện các biện pháp dẫn giải, giữ người, phương tiện, tang vật vi phạm khi được yêu cầu.
7. Cảng vụ hàng không, doanh nghiệp cảng hàng không, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay và các doanh nghiệp cung cấp dịch vụ hàng không khác phải trang bị cho lực lượng kiểm soát an ninh hàng không, lực lượng bảo vệ của đơn vị mình máy ghi hình, máy ghi âm, máy ảnh, ống nhòm và các thiết bị hỗ trợ phù hợp khác để ngăn chặn kịp thời hành vi vi phạm và ghi nhận, thu thập lại toàn bộ diễn biến của vụ việc vi phạm một cách chính xác, đầy đủ, phục vụ cho việc xử lý được nhanh chóng, đúng người, đúng tính chất, mức độ vi phạm và đúng quy định của pháp luật hiện hành.
8. Cảng vụ hàng không, lực lượng kiểm soát an ninh hàng không cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp bảo dưỡng, sửa chữa tàu bay và các doanh nghiệp khác hoạt động tại cảng hàng không, sân bay phải trang bị máy điện thoại có chức năng hiển thị, lưu số gọi đến, gọi đi và ghi âm với thời gian tối thiểu 03 giờ đồng hồ cho các số điện thoại trực ban, trực khẩn nguy, đường dây nóng, giải đáp thông tin cho hành khách. Các đơn vị phải sử dụng dịch vụ thông báo nhanh số máy gọi đi, gọi đến các số máy điện thoại của đơn vị để kịp thời tra cứu khi nhận được thông tin đe dọa qua điện thoại; thiết lập hòm thư tiếp nhận các thông tin về các vụ việc vi phạm, các hành vi can thiệp bất hợp pháp.
Điều 86. Giảng bình, rút kinh nghiệm vụ việc vi phạm
1. Vụ việc vi phạm an ninh hàng không phải được rút kinh nghiệm, giảng bình để khắc phục những sơ hở, thiếu sót:
a) Căn cứ tính chất, mức độ của từng vụ việc vi phạm xảy ra tại cảng hàng không, sân bay, Cảng vụ hàng không quyết định giao cho cơ quan, đơn vị thích hợp chủ trì tổ chức rút kinh nghiệm, giảng bình cấp cơ sở hoặc Cảng vụ hàng không chủ trì tổ chức rút kinh nghiệm, giảng bình cấp Cảng vụ hàng không hoặc đề nghị Cục Hàng không Việt Nam chủ trì tổ chức rút kinh nghiệm, giảng bình;
b) Đơn vị chủ quản cơ sở nằm ngoài cảng hàng không chủ trì tổ chức rút kinh nghiệm, giảng bình đối với vụ việc vi phạm xảy ra tại cơ sở của mình;
c) Cục Hàng không Việt Nam chủ trì tổ chức rút kinh nghiệm, giảng bình cấp Cục đối với vụ việc vi phạm nghiêm trọng, phức tạp hoặc theo yêu cầu của Bộ Giao thông vận tải, Ủy ban An ninh hàng không dân dụng quốc gia.
2. Thời gian tổ chức rút kinh nghiệm, giảng bình phải được tiến hành sớm nhất có thể, chậm nhất không quá 05 ngày làm việc đối với cấp cơ sở, 07 ngày làm việc đối với cấp Cảng vụ và 10 ngày làm việc đối với cấp Cục kể từ ngày xảy ra vi phạm.
3. Nội dung rút kinh nghiệm, giảng bình tối thiểu phải bao gồm:
a) Biện pháp, quy trình xử lý của đơn vị, cá nhân liên quan trong quá trình xử lý vụ việc vi phạm: đúng, sai, nguyên nhân;
b) Công tác phối hợp xử lý vụ việc vi phạm của đơn vị, cá nhân liên quan: đúng, sai, nguyên nhân;
c) Những bất cập trong các quy định của pháp luật, Chương trình, Quy chế an ninh hàng không, quy định và các văn bản có liên quan cần phải được bổ sung, sửa đổi;
d) Những sơ hở, thiếu sót của từng đơn vị, cá nhân liên quan, nguyên nhân và biện pháp khắc phục.
Mục II
ĐỐI PHÓ VỚI HÀNH VI CAN THIỆP BẤT HỢP PHÁP
Điều 87. Quy định chung
1. Việc đối phó với các hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng thực hiện theo các quy định của pháp luật và tuân thủ phương án khẩn nguy đối phó với các hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng do cấp có thẩm quyền ban hành.
2. Khi nhận được thông tin về một hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng, người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu liên quan có trách nhiệm phân tích, đánh giá sơ bộ về tính chất của thông tin để xem xét triển khai phương án khẩn nguy thích hợp; báo cáo ngay thông tin, kết quả đánh giá và kiến nghị biện pháp đối phó bằng cách thức phù hợp về Cục Hàng không Việt Nam. Huy động lực lượng, phương tiện của đơn vị mình tổ chức đối phó ban đầu theo quy định; trường hợp cần thiết, Cục Hàng không Việt Nam trực tiếp chỉ đạo các lực lượng hàng không thực hiện phương án khẩn nguy ban đầu.
3. Mọi biện pháp đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng phải ưu tiên bảo đảm an toàn cho tàu bay và tính mạng con người. Đối với tàu bay đang bay bị can thiệp bất hợp pháp, cơ sở cung cấp dịch vụ không lưu liên quan ưu tiên trợ giúp tối đa để bảo đảm an toàn cho tàu bay trong vùng trời của Việt Nam, vùng thông báo bay do Việt Nam quản lý.
4. Sau khi kết thúc việc đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay, các cơ quan, đơn vị có trách nhiệm nhanh chóng thực hiện các biện pháp cần thiết để đảm bảo đưa cảng hàng không, sân bay trở lại hoạt động bình thường; bố trí cho hành khách tiếp tục hành trình trong thời gian sớm nhất có thể.
Điều 88. Kế hoạch khẩn nguy
1. Kế hoạch khẩn nguy đối phó ban đầu với hành vi can thiệp bất hợp pháp của cảng hàng không, sân bay do người khai thác cảng hàng không, sân bay xây dựng trình Cục Hàng không Việt Nam phê duyệt phải phù hợp với Phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp do Thủ tướng Chính phủ ban hành và Phương án khẩn nguy của Ban chỉ huy khẩn nguy hàng không cấp tỉnh, thành phố, huyện đảo.
2. Doanh nghiệp chủ quản cơ sở cung cấp dịch vụ bảo đảm hoạt động bay xây dựng Kế hoạch khẩn nguy của cơ sở bảo đảm hoạt động bay; doanh nghiệp chủ quản cơ sở cung cấp dịch vụ không lưu phải xây dựng Kế hoạch ứng phó không lưu trình Cục Hàng không Việt Nam phê duyệt và tổ chức thực hiện. Kế hoạch khẩn nguy, Kế hoạch ứng phó không lưu phải phù hợp với Phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp do Thủ tướng Chính phủ ban hành và Phương án khẩn nguy của Ban chỉ huy khẩn nguy hàng không cấp tỉnh, thành phố, huyện đảo.
3. Kế hoạch khẩn nguy, Kế hoạch ứng phó không lưu đối phó với hành vi can thiệp bất hợp pháp được quản lý theo chế độ mật.
4. Văn phòng thường trực Ủy ban An ninh hàng không dân dụng quốc gia chủ trì phối hợp với Cục Hàng không Việt Nam hướng dẫn xây dựng và thực hiện các Kế hoạch khẩn nguy, Kế hoạch ứng phó không lưu.
Điều 89. Quản lý thông tin và họp báo
Việc cung cấp thông tin, phát ngôn và họp báo liên quan đến hành vi can thiệp bất hợp pháp và công tác đối phó thực hiện theo Phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng do Thủ tướng Chính phủ ban hành.
Điều 90. Chế độ báo cáo về đối phó với hành vi can thiệp bất hợp pháp
1. Người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, đơn vị chủ quản của khu vực hạn chế ngoài cảng hàng không, sân bay có trách nhiệm báo cáo ban đầu bằng văn bản về Cục Hàng không Việt Nam trong vòng 24 giờ kể từ thời điểm xảy ra hành vi can thiệp bất hợp pháp; báo cáo 02 lần trên 01 ngày trong thời gian đối phó với hành vi can thiệp bất hợp pháp; báo cáo sơ bộ trong vòng 24 giờ kể từ thời điểm kết thúc việc đối phó.
2. Cục Hàng không Việt Nam có trách nhiệm báo cáo Bộ Giao thông vận tải bằng văn bản trong trong vòng 24 giờ kể từ thời điểm nhận được báo cáo của đơn vị về công tác đối phó với hành vi can thiệp bất hợp pháp.
Điều 91. Thông báo cho quốc gia liên quan và báo cáo cho ICAO
1. Cục Hàng không Việt Nam có trách nhiệm thông báo những thông tin về tàu bay bị can thiệp bất hợp pháp hạ cánh trong lãnh thổ Việt Nam cho nhà chức trách hàng không của quốc gia liên quan trong thời gian sớm nhất có thể. Thông tin bao gồm: loại tàu bay, số hiệu chuyến bay, đường bay, số lượng hành khách, tổ bay trên chuyến bay và những yêu cầu đề nghị các quốc gia liên quan trợ giúp. Thông báo được gửi tới các địa chỉ sau qua đường fax:
a) Quốc gia nơi tàu bay đăng ký;
b) Quốc gia của nhà khai thác tàu bay;
c) Quốc gia có các công dân bị chết, bị thương hoặc bị giữ do hành vi can thiệp bất hợp pháp;
d) Quốc gia có công dân là hành khách trên tàu bay bị can thiệp bất hợp pháp;
đ) ICAO.
2. Cục Hàng không Việt Nam có trách nhiệm báo cáo ICAO về các hành vi can thiệp bất hợp pháp như sau:
a) Báo cáo sơ bộ theo mẫu quy định tại Phụ lục XXII ban hành kèm theo Thông tư này trong vòng 30 ngày kể từ ngày vụ việc xảy ra;
b) Báo cáo chính thức theo mẫu quy định tại Phụ lục XXIII ban hành kèm theo Thông tư này trong vòng 60 ngày kể từ ngày vụ việc xảy ra.
Điều 92. Diễn tập đối phó hành vi can thiệp bất hợp pháp
1. Cục Hàng không Việt Nam chủ trì phối hợp với cơ quan, đơn vị liên quan trong và ngoài ngành hàng không tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp ngành tối thiểu 03 năm một lần tại 01 cảng hàng không hoặc 01 cơ sở cung cấp dịch vụ không lưu.
2. Cục Hàng không Việt Nam chỉ đạo người khai thác cảng hàng không, sân bay, hãng hàng không Việt Nam, doanh nghiệp chủ quản cơ sở cung cấp dịch vụ bảo đảm hoạt động bay, doanh nghiệp chủ quản cơ sở cung cấp dịch vụ không lưu phối hợp với các cơ quan, đơn vị liên quan tổ chức diễn tập cấp cơ sở tại mỗi cảng hàng không, mỗi cơ sở cung cấp dịch vụ không lưu tối thiểu 02 năm 01 lần.
3. Cơ quan, tổ chức nước ngoài có thể được mời tham quan diễn tập đối phó với các hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
4. Cục Hàng không Việt Nam báo cáo Bộ Giao thông vận tải về kế hoạch tổ chức diễn tập cấp ngành.
Chương IV
HỆ THỐNG TỔ CHỨC BẢO ĐẢM AN NINH HÀNG KHÔNG CỦA NGÀNH HÀNG KHÔNG DÂN DỤNG
Điều 93. Các cơ quan, đơn vị chuyên trách bảo đảm an ninh hàng không của ngành hàng không dân dụng
1. Phòng An ninh hàng không thuộc Cục Hàng không Việt Nam có nhiệm vụ tham mưu chỉ đạo, kiểm tra việc thực hiện công tác bảo đảm an ninh hàng không của các cơ quan, đơn vị trong ngành hàng không dân dụng và triển khai trách nhiệm của nhà chức trách hàng không trong lĩnh vực an ninh hàng không.
2. Phòng Giám sát an ninh hàng không thuộc Cảng vụ hàng không khu vực thực hiện nhiệm vụ giám sát việc thực hiện các quy định của pháp luật về an ninh hàng không của các cơ quan, đơn vị, doanh nghiệp và cá nhân tại cảng hàng không, sân bay.
3. Người khai thác cảng hàng không, sân bay; hãng hàng không Việt Nam; doanh nghiệp cung cấp dịch vụ không lưu; doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay; doanh nghiệp kinh doanh hàng không chung phải thiết lập tổ chức bảo đảm an ninh hàng không của mình độc lập về chức năng, nhiệm vụ và không kiêm nhiệm các nhiệm vụ khác; trong Chương trình, Quy chế an ninh hàng không gửi Cục Hàng không Việt Nam phê duyệt phải quy định cụ thể người đứng đầu tổ chức bảo đảm an ninh hàng không đáp ứng tiêu chuẩn của ICAO và người đứng đầu các bộ phận thuộc tổ chức bảo đảm an ninh hàng không.
4. Người đứng đầu tổ chức bảo đảm an ninh hàng không và người đứng đầu các bộ phận thuộc tổ chức bảo đảm an ninh hàng không quy định tại khoản 3 Điều này chịu trách nhiệm trực tiếp về công tác bảo đảm an ninh hàng không và có đầy đủ thẩm quyền, trách nhiệm để triển khai thực hiện Chương trình, Quy chế an ninh hàng không.
5. Hãng hàng không Việt Nam khai thác các chuyến bay thường lệ ở nước ngoài phải chỉ định người chịu trách nhiệm về công tác bảo đảm an ninh hàng không của hãng tại quốc gia đó và phải thông báo bằng văn bản cho Cục Hàng không Việt Nam.
6. Các hãng hàng không nước ngoài khai thác các chuyến bay thường lệ đến Việt Nam phải chỉ định và thông báo bằng văn bản cho Cục Hàng không Việt Nam người chịu trách nhiệm về an ninh hàng không của hãng tại Việt Nam.
7. Thủ trưởng cơ quan, đơn vị quy định chức năng, nhiệm vụ cụ thể của các tổ chức bảo đảm an ninh hàng không quy định tại các khoản 1, 2, và 3 của Điều này.
Điều 94. Lực lượng kiểm soát an ninh hàng không của ngành hàng không dân dụng và tiêu chuẩn tuyển dụng nhân viên kiểm soát an ninh hàng không
1. Lực lượng kiểm soát an ninh hàng không bao gồm cán bộ, nhân viên của các tổ chức an ninh hàng không của người khai thác cảng hàng không, sân bay; hãng hàng không Việt Nam; doanh nghiệp cung cấp dịch vụ không lưu; doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay; doanh nghiệp kinh doanh hàng không chung được quy định tại các khoản 4, 5 và 6 Điều 93 của Thông tư này.
2. Lực lượng kiểm soát an ninh hàng không là lực lượng chuyên trách bảo đảm an ninh hàng không thực hiện chức năng tham mưu, quản lý, giám sát và trực tiếp thực hiện các biện pháp kiểm soát an ninh hàng không, phòng ngừa, đối phó với các hành vi can thiệp bất hợp pháp và vụ việc vi phạm an ninh hàng không theo quy định.
3. Người khai thác cảng hàng không, sân bay tổ chức lực lượng kiểm soát an ninh hàng không để thực hiện các biện pháp bảo đảm an ninh hàng không và cung cấp dịch vụ bảo đảm an ninh hàng không tại cảng hàng không, sân bay và các khu vực hạn chế của cơ sở xử lý hàng hoá, bưu gửi để đưa lên tàu bay.
4. Lực lượng kiểm soát an ninh hàng không phải được đào tạo huấn luyện nghiệp vụ phù hợp với chức danh, nhiệm vụ công việc được giao theo quy định về đào tạo, huấn luyện an ninh hàng không của Bộ trưởng Bộ Giao thông vận tải.
5. Tiêu chuẩn tuyển dụng nhân viên kiểm soát an ninh hàng không:
a) Là công dân Việt Nam đủ 18 tuổi trở lên có lý lịch rõ ràng, đủ sức khỏe, tốt nghiệp trung học phổ thông trở lên;
b) Không có tiền án, tiền sự theo quy định của pháp luật; không nghiện ma túy (sử dụng hoặc có kết quả dương tính đối với chất ma túy hoặc chất kích thích không được phép sử dụng).
Điều 95. Tiêu chuẩn, nhiệm vụ của người đứng đầu tổ chức bảo đảm an ninh hàng không của người khai thác cảng hàng không, sân bay; hãng hàng không Việt Nam; doanh nghiệp cung cấp dịch vụ không lưu; doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay; doanh nghiệp kinh doanh hàng không chung
1. Tiêu chuẩn người đứng đầu tổ chức an ninh hàng không (Post Hoder)
a) Là công dân Việt Nam, có kiến thức, kinh nghiệm về hàng không, an ninh hàng không và có thời gian công tác liên tục tối thiểu 02 năm trong lĩnh vực an ninh hàng không;
b) Có chứng chỉ hoặc chứng nhận hoàn thành khóa học trong nước hoặc quốc tế về bồi dưỡng nghiệp vụ quản lý an ninh hàng không.
2. Nhiệm vụ của người đứng đầu tổ chức bảo đảm an ninh hàng không của người khai thác cảng hàng không, sân bay:
a) Tham mưu cho Giám đốc Cảng hàng không thực hiện các nhiệm vụ thuộc trách nhiệm của người khai thác cảng hàng không, sân bay được quy định trong Thông tư này và các quy định khác của pháp luật. Chủ trì xây dựng Chương trình an ninh hàng không của người khai thác cảng hàng không, sân bay; triển khai thực hiện hiệu quả Chương trình sau khi được phê duyệt;
b) Chỉ đạo tổ chức thực hiện các biện pháp, quy trình, thủ tục bảo đảm an ninh hàng không và cung cấp dịch vụ bảo đảm an ninh hàng không; công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không; công tác bảo vệ hệ thống thông tin chuyên ngành; triển khai kế hoạch khẩn nguy đối phó với hành vi can thiệp bất hợp pháp đã được phê duyệt;
c) Duy trì liên lạc hiệu quả với các cơ quan, đơn vị trong nội bộ, Cảng vụ hàng không, hãng hàng không, các cơ sở cung cấp dịch vụ hàng không và các cơ quan chức năng có liên quan tại cảng hàng không; thực hiện các biện pháp thích hợp nhằm nâng cao nhận thức về an ninh hàng không và tinh thần cảnh giác của tất cả những người làm việc tại cảng hàng không, sân bay;
d) Chịu sự chỉ đạo, hướng dẫn trực tiếp của Cục Hàng không Việt Nam, Giám đốc Cảng hàng không trong việc thực hiện nhiệm vụ bảo đảm an ninh hàng không và xử lý các vụ việc vi phạm an ninh hàng không;
đ) Đảm bảo năng lực ứng phó hiệu quả đối với các mối đe dọa, vụ việc vi phạm an ninh hàng không; thực hiện các biện pháp khắc phục theo yêu cầu, khuyến cáo an ninh hàng không của cơ quan nhà nước, người có thẩm quyền;
e) Tổ chức thẩm định, phê duyệt hồ sơ xin cấp thẻ, giấy phép kiểm soát an ninh hàng không theo thẩm quyền;
g) Tham gia thẩm định các tiêu chuẩn và yêu cầu an ninh hàng không trong quy hoạch, thiết kế xây dựng mới và cải tạo, nâng cấp hệ thống kết cấu hạ tầng của cảng hàng không, sân bay; tham gia tuyển dụng nhân viên kiểm soát an ninh hàng không, mua sắm trang bị, thiết bị an ninh hàng không;
h) Tổ chức thực hiện các hoạt động kiểm soát chất lượng an ninh hàng không theo quy định; lưu trữ hồ sơ, tài liệu của tất cả các vụ việc vi phạm an ninh hàng không và các hành vi can thiệp bất hợp pháp xảy ra tại cảng hàng không, sân bay.
3. Nhiệm vụ của người đứng đầu tổ chức an ninh hàng không của hãng hàng không Việt Nam:
a) Tham mưu cho Tổng giám đốc (Giám đốc điều hành) hãng hàng không thực hiện các nhiệm vụ thuộc trách nhiệm của hãng hàng không được quy định trong Thông tư này và các quy định khác của pháp luật. Xây dựng Chương trình an ninh hàng không của hãng hàng không; triển khai thực hiện hiệu quả Chương trình an ninh hàng không của hãng sau khi được phê duyệt;
b) Triển khai các biện pháp, quy trình, thủ tục bảo đảm an ninh hàng không công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không; công tác bảo vệ hệ thống thông tin chuyên ngành và các nhiệm vụ khác thuộc trách nhiệm của hãng hàng không theo quy định;
c) Duy trì liên lạc hiệu quả với các cơ quan, đơn vị trong nội bộ, Cảng vụ hàng không, tổ chức bảo đảm an ninh hàng không của người khai thác cảng hàng không, sân bay, các cơ sở cung cấp dịch vụ hàng không và các cơ quan chức năng có liên quan tại cảng hàng không, sân bay; thực hiện các biện pháp thích hợp nhằm nâng cao nhận thức về an ninh hàng không của tất cả cán bộ, nhân viên của hãng hàng không;
d) Chịu sự chỉ đạo, hướng dẫn trực tiếp của Cục Hàng không Việt Nam, Tổng giám đốc (Giám đốc điều hành) hãng hàng không trong việc thực hiện nhiệm vụ bảo đảm an ninh hàng không và xử lý các vụ việc vi phạm an ninh hàng không;
đ) Đảm bảo năng lực ứng phó hiệu quả với mối đe dọa, vụ việc vi phạm an ninh hàng không đối với hãng hàng không;
e) Trực tiếp phê duyệt hồ sơ xin cấp thẻ nhận dạng tổ bay thuộc thẩm quyền của hãng hàng không;
g) Tham gia thẩm định các tiêu chuẩn và yêu cầu an ninh hàng không trong việc khai thác tàu bay, trang thiết bị an ninh hàng không, hệ thống thông tin của hãng hàng không; tham gia tuyển dụng nhân viên kiểm soát an ninh hàng không;
h) Tổ chức thực hiện kiểm soát chất lượng an ninh hàng không theo quy định; khảo sát, đánh giá an ninh hàng không; các biện pháp khắc phục sơ hở, thiếu sót theo yêu cầu, khuyến cáo của cơ quan, người có thẩm quyền;
i) Yêu cầu các tổ chức, cá nhân của hãng hàng không thực hiện đầy đủ nghĩa vụ, trách nhiệm của mình được quy định trong Chương trình an ninh hàng không của hãng hàng không;
k) Triển khai các biện pháp kiểm soát an ninh hàng không tăng cường trên các chuyến bay hoặc đường bay cụ thể theo quy định;
l) Nghiên cứu, nắm vững luật và các quy định về an ninh hàng không liên quan được áp dụng trong các khu vực, quốc gia mà hãng hàng không có các chuyến bay khai thác thường lệ; triển khai các quy định pháp luật của Việt Nam liên quan đến khai thác vận chuyển hàng không cho các tổ chức cung cấp dịch vụ hàng không cho hãng tại nước ngoài.
4. Nhiệm vụ của người đứng đầu tổ chức an ninh hàng không của doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay; doanh nghiệp kinh doanh hàng không chung:
a) Tham mưu cho Tổng giám đốc (Giám đốc) doanh nghiệp thực hiện các nhiệm vụ thuộc trách nhiệm của doanh nghiệp được quy định trong Thông tư này và các quy định khác của pháp luật, xây dựng Quy chế an ninh hàng không và triển khai thực hiện hiệu quả Quy chế sau khi được phê duyệt;
b) Triển khai thực hiện đầy đủ hiệu quả các biện pháp, quy trình, thủ tục bảo đảm an ninh hàng không; công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không; công tác bảo vệ hệ thống thông tin chuyên ngành và các nhiệm vụ khác thuộc trách nhiệm của doanh nghiệp;
c) Tổ chức thực hiện kiểm soát chất lượng an ninh hàng không trong phạm vi nội bộ doanh nghiệp. Chịu sự kiểm soát chất lượng của các cơ quan, đơn vị theo quy định tại Thông tư này; thực hiện các biện pháp khắc phục sơ hở, thiếu sót theo yêu cầu, khuyến cáo của cơ quan, người có thẩm quyền;
d) Chịu sự chỉ đạo, hướng dẫn trực tiếp của Cục Hàng không Việt Nam và Tổng giám đốc (Giám đốc) doanh nghiệp trong việc thực hiện nhiệm vụ bảo đảm an ninh hàng không và xử lý các vụ việc vi phạm an ninh hàng không.
5. Người đứng đầu tổ chức an ninh hàng không của doanh nghiệp cung cấp dịch vụ không lưu có nhiệm vụ như sau:
a) Tham mưu cho Tổng giám đốc (Giám đốc) doanh nghiệp thực hiện các nhiệm vụ thuộc trách nhiệm của doanh nghiệp được quy định trong Thông tư này và các quy định khác của pháp luật. Chủ trì xây dựng Quy chế an ninh hàng không và triển khai thực hiện hiệu quả Quy chế sau khi được phê duyệt;
b) Hướng dẫn, chỉ đạo tổ chức triển khai thực hiện đầy đủ hiệu quả các biện pháp, quy trình, thủ tục bảo đảm an ninh hàng không; công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không; công tác bảo vệ hệ thống thông tin chuyên ngành và các nhiệm vụ khác thuộc trách nhiệm của doanh nghiệp;
c) Tổ chức thực hiện kiểm soát chất lượng an ninh hàng không trong phạm vi nội bộ doanh nghiệp; chủ trì tổ chức đánh giá đe dọa và nguy cơ đối với các cơ sở bảo đảm hoạt động bay. Chịu sự kiểm soát chất lượng của các cơ quan, đơn vị theo quy định tại Thông tư này; hướng dẫn, chỉ đạo thực hiện các biện pháp khắc phục sơ hở, thiếu sót được phát hiện và theo yêu cầu, khuyến cáo của cơ quan, người có thẩm quyền;
d) Chịu sự chỉ đạo, hướng dẫn trực tiếp của Cục Hàng không Việt Nam, Tổng giám đốc (Giám đốc) doanh nghiệp trong việc thực hiện nhiệm vụ bảo đảm an ninh hàng không và xử lý các vụ việc vi phạm an ninh hàng không;
đ) Tổ chức lưu trữ hồ sơ, tài liệu của tất cả các vụ việc vi phạm an ninh hàng không và các hành vi can thiệp bất hợp pháp xảy ra tại các cơ sở của doanh nghiệp;
e) Tổ chức thẩm định, đề nghị phê duyệt hồ sơ xin cấp thẻ, giấy phép kiểm soát an ninh bộ;
g) Tham gia thẩm định các tiêu chuẩn và yêu cầu an ninh hàng không trong quy hoạch, thiết kế xây dựng mới và cải tạo nâng cấp hệ thống cơ sở hạ tầng, mua sắm trang bị, thiết bị an ninh hàng không của doanh nghiệp; tham gia tuyển dụng nhân viên kiểm soát an ninh hàng không.
6. Người được chỉ định chịu trách nhiệm về an ninh hàng không của hãng hàng không nước ngoài tại Việt Nam có trách nhiệm:
a) Trình Cục Hàng không Việt Nam Chương trình an ninh hàng không của hãng và triển khai thực hiện Chương trình sau khi được chấp thuận;
b) Duy trì liên lạc hiệu quả với Cục Hàng không Việt Nam và các đơn vị liên quan trong việc thực hiện nhiệm vụ bảo đảm an ninh hàng không và xử lý các sự cố an ninh hàng không liên quan; thực hiện các biện pháp thích hợp nhằm nâng cao nhận thức về an ninh hàng không của tất cả cán bộ, nhân viên của hãng;
c) Yêu cầu các tổ chức, cá nhân của hãng hàng không thực hiện đầy đủ nghĩa vụ, trách nhiệm được quy định trong Chương trình an ninh hàng không của hãng.
Điều 96. Cấp giấy phép, gia hạn, bổ sung, phục hồi năng định nhân viên kiểm soát an ninh hàng không
1. Nhân viên kiểm soát an ninh hàng không là người trực tiếp thực hiện kiểm tra, soi chiếu, giám sát và lục soát an ninh hàng không bao gồm nhân viên kiểm soát, nhân viên soi chiếu và nhân viên cơ động, khi thực hiện nhiệm vụ phải có giấy phép và năng định còn hiệu lực do Cục Hàng không Việt Nam cấp.
2. Giấy phép nhân viên kiểm soát an ninh hàng không có hiệu lực là 07 năm. Thời hạn hiệu lực của năng định nhân viên soi chiếu là 12 tháng; nhân viên cơ động, nhân viên kiểm soát là 24 tháng. Trường hợp không làm công việc được năng định trong thời gian 06 tháng liên tục, năng định được cấp sẽ mất hiệu lực, khi trở lại làm việc phải qua kỳ thi cấp năng định lại.
3. Nhân viên kiểm soát an ninh hàng không được cấp giấy phép và năng định khi đáp ứng các điều kiện sau đây:
a) Có đủ tiêu chuẩn theo quy định của Bộ trưởng Bộ Giao thông vận tải về tiêu chuẩn nhân viên hàng không và nhân viên kiểm soát an ninh hàng không theo quy định; có chứng chỉ chuyên môn phù hợp; có thời gian thực tập nghiệp vụ chuyên môn phù hợp tối thiểu là 01 tháng do cơ quan chủ quản xác nhận;
b) Tham dự kỳ thi cấp giấy phép và năng định chuyên môn về an ninh hàng không phù hợp do Hội đồng kiểm tra cấp giấy phép, năng định nhân viên kiểm soát an ninh hàng không của Cục Hàng không Việt Nam tổ chức; đạt từ 85 điểm trở lên và không bị điểm 0 (không).
4. Hồ sơ đề nghị cấp giấy phép lần đầu, bao gồm:
a) Văn bản đề nghị cấp giấy phép, năng định cho nhân viên của cơ quan, đơn vị theo mẫu quy định tại Phụ lục V ban hành kèm theo Thông tư này;
b) Bản sao được chứng thực hoặc bản sao kèm theo bản gốc văn bằng, chứng chỉ chuyên môn phù hợp để đối chiếu;
c) 02 ảnh màu chụp chính diện, mắt nhìn thẳng, rõ vành tai, kích thước 03 cen-ti-mét x 04 cen-ti-mét (chụp trên phông nền màu trắng, không quá 06 tháng kể từ ngày chụp tính đến ngày nộp hồ sơ).
5. Hồ sơ đề nghị cấp lại giấy phép đã hết thời hạn hiệu lực, mất, hỏng bao gồm:
a) Văn bản đề nghị cấp lại giấy phép cho nhân viên của cơ quan, đơn vị theo mẫu quy định tại Phụ lục V ban hành kèm theo Thông tư này;
b) Bản chính giấy phép trong trường hợp giấy phép đã hết thời hạn hiệu lực, bị hỏng. Trường hợp mất giấy phép có văn bản xác nhận của Thủ trưởng đơn vị;
c) Bản sao kết quả huấn luyện định kỳ phù hợp (trường hợp giấy phép đã hết thời hạn hiệu lực);
d) 02 ảnh màu chụp chính diện, mắt nhìn thẳng, rõ vành tai, kích thước 03 cen-ti-mét x 04 cen-ti-mét (chụp trên phông nền màu trắng, không quá 06 tháng kể từ ngày chụp tính đến ngày nộp hồ sơ).
6. Hồ sơ đề nghị gia hạn, bổ sung, phục hồi năng định, bao gồm:
a) Văn bản đề nghị gia hạn, bổ sung, phục hồi năng định nhân viên của cơ quan, đơn vị theo mẫu quy định tại Phụ lục V ban hành kèm theo Thông tư này;
b) Bản sao kết quả huấn luyện định kỳ phù hợp với năng định đề nghị gia hạn, phục hồi;
c) Bản sao được chứng thực hoặc bản sao kèm theo bản gốc văn bằng, chứng chỉ chuyên môn phù hợp để đối chiếu với trường hợp bổ sung năng định;
d) Bản chính giấy phép nhân viên kiểm soát an ninh.
7. Thủ tục cấp giấy phép, năng định:
a) Hồ sơ đề nghị cấp lần đầu, cấp lại giấy phép, gia hạn, bổ sung phục hồi năng định nhân viên kiểm soát an ninh được gửi trực tiếp hoặc qua đường bưu điện hoặc các hình thức phù hợp khác đến Cục Hàng không Việt Nam;
b) Cục Hàng không Việt Nam có trách nhiệm thẩm định hồ sơ, tổ chức kiểm tra và cấp, cấp lại giấy phép, gia hạn, bổ sung, phục hồi năng định cho nhân viên kiểm soát an ninh hàng không trong thời hạn tối đa 30 ngày đối với cấp giấy phép lần đầu, cấp lại giấy phép đã hết thời hạn hiệu lực, gia hạn, bổ sung, phục hồi năng định; tối đa 10 ngày đối với cấp lại giấy phép bị mất, hỏng kể từ ngày nhận hồ sơ đầy đủ theo quy định;
c) Trường hợp hồ sơ chưa đầy đủ theo quy định, trong thời hạn 02 ngày làm việc, Cục Hàng không Việt Nam phải thông báo bằng văn bản về những nội dung chưa đầy đủ, yêu cầu người đề nghị bổ sung hoàn chỉnh hồ sơ hoặc thông báo việc từ chối cấp và nêu rõ lý do.
8. Giấy phép nhân viên kiểm soát an ninh hàng không bị Cục Hàng không Việt Nam thu hồi trong các trường hợp sau:
a) Thu hồi khi không còn đủ điều kiện để được cấp giấy phép theo quy định tại khoản 3 Điều này;
b) Thu hồi giấy phép trong thời gian tối đa 01 tháng trong các trường hợp: bị kỷ luật khiển trách; có sai phạm về chuyên môn nghiệp vụ nhưng chưa gây ra hậu quả mất an ninh, an toàn; uống rượu, bia trong khi thực hiện nhiệm vụ;
c) Thu hồi giấy phép trong thời gian tối đa 03 tháng đối với các trường hợp kỷ luật khiển trách lần thứ 02 hoặc cảnh cáo;
d) Thu hồi giấy phép trong thời gian tối đa 06 tháng đối với các trường hợp thực hiện nhiệm vụ không đúng với nghiệp vụ chuyên môn được cấp phép, năng định;
đ) Thu hồi vĩnh viễn trong trường hợp: sử dụng hoặc có kết quả dương tính đối với chất ma túy hoặc chất kích thích không được phép sử dụng; có hành vi vi phạm hoặc sai phạm về chuyên môn nghiệp vụ gây ra hậu quả mất an toàn, an ninh hàng không tại cảng hàng không, sân bay; có hành vi che dấu lỗi vi phạm quy định về an toàn, an ninh hàng không.
9. Người bị thu hồi giấy phép nhân viên kiểm soát an ninh hàng không quy định tại các điểm b, c và d khoản 8 của Điều này khi trở lại làm việc phải qua kỳ kiểm tra để cấp lại giấy phép.
Điều 97. Đánh giá chất lượng nhân viên kiểm soát an ninh hàng không
1. Hàng năm, Thủ trưởng đơn vị quản lý nhân viên kiểm soát an ninh hàng không phải đánh giá bằng văn bản nhân viên kiểm soát an ninh về các nội dung sau đây:
a) Năng lực chuyên môn nghiệp vụ;
b) Chấp hành nội quy, quy định của cơ quan, đơn vị;
c) Trách nhiệm, thái độ phục vụ trong công việc.
2. Đánh giá quy định tại khoản 1 của Điều này là căn cứ để xếp loại nhân viên kiểm soát an ninh hàng không ở 4 mức độ: xuất sắc, tốt, trung bình, kém. Kết quả phân loại là cơ sở để bố trí sắp xếp nhân viên và đào tạo, huấn luyện bổ sung nhân viên kiểm soát an ninh hàng không. Trường hợp xếp loại kém phải đưa ra biện pháp và thời hạn khắc phục hoặc đưa ra khỏi lực lượng kiểm soát an ninh hàng không.
3. Văn bản đánh giá và xếp loại nhân viên kiểm soát an ninh hàng không phải được lưu giữ tại đơn vị chủ quản.
Chương V
CÔNG TRÌNH, TRANG BỊ, THIẾT BỊ, PHƯƠNG TIỆN VÀ VŨ KHÍ, CÔNG CỤ HỖ TRỢ PHỤC VỤ BẢO ĐẢM AN NINH HÀNG KHÔNG
Điều 98. Yêu cầu an ninh đối với việc thiết kế, xây dựng cảng hàng không, sân bay, công trình hàng không
1. Chủ đầu tư xây dựng, cải tạo nâng cấp, sửa chữa công trình hàng không, kết cấu hạ tầng cảng hàng không khi lập dự án, khảo sát, thiết kế xây dựng phải tuân thủ các yêu cầu, tiêu chuẩn về an ninh hàng không được quy định tại Thông tư này.
2. Cơ quan có thẩm quyền thẩm định, phê duyệt thiết kế kỹ thuật, thiết kế bản vẽ thi công và dự toán xây dựng, cải tạo, nâng cấp, sửa chữa công trình hàng không, kết cấu hạ tầng cảng hàng không, sân bay phải thẩm định các yêu cầu, tiêu chuẩn về an ninh hàng không bảo đảm tuân thủ quy định tại Thông tư này.
Điều 99. Các công trình phục vụ bảo đảm an ninh hàng không
1. Công trình phục vụ bảo đảm an ninh hàng không của nhà ga, sân bay bao gồm:
a) Công trình phục vụ bảo đảm an ninh vành đai sân bay: hàng rào, đường tuần tra, hệ thống cảnh báo xâm nhập, hệ thống chiếu sáng, bốt gác, cổng, cửa, điểm kiểm tra an ninh hàng không, hệ thống đèn chiếu sáng vị trí đỗ của tàu bay ban đêm;
b) Cổng, cửa, điểm kiểm tra an ninh hàng không tại lối vào sân đỗ tàu bay và cổng, cửa, lối đi từ khu vực công cộng vào khu vực hạn chế;
c) Trung tâm hiệp đồng khẩn nguy; vị trí đỗ biệt lập cho tàu bay; hầm xử lý bom mìn, vật phẩm nguy hiểm; khu vực tập kết hành khách, hành lý, hàng hoá trong trường hợp tàu bay bị can thiệp bất hợp pháp;
d) Hệ thống ca-me-ra giám sát an ninh toàn bộ nhà ga, sân đỗ tàu bay, đường giao thông liền kề nhà ga và phòng giám sát điều khiển hệ thống ca-me-ra;
đ) Điểm (khu vực) kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hoá gồm cả phòng lục soát, kiểm tra trực quan tại nhà ga;
e) Phòng trực ban của lực lượng kiểm soát an ninh hàng không, Cảng vụ hàng không tại nhà ga; phòng quản lý hành khách bị từ chối nhập cảnh tại nhà ga quốc tế.
2. Công trình phục vụ bảo đảm an ninh hàng không nằm ngoài nhà ga, sân bay bao gồm:
a) Hàng rào, hệ thống đèn chiếu sáng vành đai; hệ thống ca-me-ra giám sát an ninh toàn bộ các khu vực hạn chế; hàng rào ngăn cách khu vực hạn chế với khu vực công cộng;
b) Bốt gác, cổng, cửa, điểm kiểm tra an ninh hàng không tại lối vào khu vực hạn chế từ khu vực công cộng.
3. Yêu cầu đối với công trình phục vụ bảo đảm an ninh hàng không:
a) Công trình phục vụ bảo đảm an ninh hàng không phải được kiểm tra, bảo dưỡng, bảo trì theo đúng tiêu chuẩn, quy chuẩn, quy định của pháp luật và phải có đầy đủ hồ sơ, lý lịch; khi có hư hỏng phải khắc phục kịp thời;
b) Hàng rào an ninh giữa khu vực hạn chế với khu vực công cộng phải có khả năng ngăn chặn, cảnh báo việc xâm nhập qua hàng rào;
c) Số lượng cổng, cửa vào khu vực hạn chế từ khu vực công cộng phải hạn chế ở mức tối thiểu cần thiết;
d) Bảo đảm sự tách biệt giữa hành khách, hành lý, hàng hóa, bưu gửi đã được kiểm tra an ninh hàng không với hành khách, hành lý, hàng hóa, bưu gửi chưa kiểm tra an ninh hàng không;
đ) Vị trí trung tâm khẩn nguy; vị trí đỗ biệt lập cho tàu bay; hầm xử lý bom mìn, vật phẩm nguy hiểm; khu vực tập kết hành khách, hành lý, hàng hoá trong trường hợp tàu bay bị can thiệp bất hợp pháp phải thuận tiện cho việc xử lý các tình huống khẩn cấp và thực hiện kế hoạch khẩn nguy;
e) Bảo đảm tách biệt luồng hành khách đi, đến, nối chuyến và quá cảnh; luồng hành khách, hàng hóa quốc tế và nội địa;
g) Khu vực bố trí điểm kiểm tra an ninh hàng không đối với hành khách, hành lý phải có đủ diện tích để tránh gây ùn tắc và bảo đảm thuận lợi cho việc kiểm tra, soi chiếu hành khách, hành lý;
h) Khu vực cách ly phải được ngăn cách tuyệt đối với khu vực công cộng hoặc khu vực hạn chế khác bằng vật liệu bền vững;
i) Sử dụng nguyên vật liệu phù hợp nhằm giảm thiểu tối đa những tổn thất, thiệt hại đối với người, thiết bị của nhà ga, sân bay khi xảy ra cháy, nổ;
k) Đến năm 2020, các cảng hàng không, sân bay đã xây dựng nhưng chưa có công trình phục vụ bảo đảm an ninh hàng không phải đáp ứng đầy đủ theo quy định tại khoản 1 Điều này.
4. Yêu cầu, tiêu chuẩn về hàng rào, cổng, cửa, rào chắn, hệ thống chiếu sáng, hệ thống ca-me-ra giám sát, vọng gác, đường tuần tra an ninh được quy định tại Phụ lục XI ban hành kèm theo Thông tư này.
Điều 100. Thiết bị, phương tiện bảo đảm an ninh hàng không
1. Thiết bị, phương tiện bảo đảm an ninh hàng không bao gồm:
a) Máy soi tia X, cổng từ, thiết bị phát hiện kim loại cầm tay; thiết bị, dụng cụ chuyên dụng phát hiện chất nổ, vũ khí, vật phẩm nguy hiểm;
b) Phương tiện sử dụng cho tuần tra; thiết bị ghi âm, ghi hình, quan sát, nhận dạng, phát hiện giấy tờ, tài liệu giả chuyên dụng; thiết bị sử dụng cho việc cấp thẻ, giấy phép kiểm soát an ninh hàng không;
c) Phương tiện, thiết bị thông tin liên lạc phục vụ chỉ huy, điều hành, đối phó với hành vi can thiệp bất hợp pháp; mũ, áo giáp và các trang bị, công cụ chuyên dụng cho đối phó với hành vi can thiệp bất hợp pháp; hầm, thiết bị phục vụ xử lý bom, mìn, vật phẩm nguy hiểm;
d) Dụng cụ, thiết bị sử dụng cho thử nghiệm, đào tạo, huấn luyện an ninh hàng không; vũ khí, công cụ hỗ trợ.
2. Yêu cầu đối với thiết bị, phương tiện bảo đảm an ninh hàng không:
a) Thiết bị, phương tiện quy định tại khoản 1 Điều này phải đáp ứng các quy chuẩn, tiêu chuẩn theo quy định của pháp luật;
b) Hệ thống máy soi tia X phải có bộ mẫu thử của nhà sản xuất; cổng từ, thiết bị phát hiện kim loại cầm tay, thiết bị phát hiện chất nổ phải có bộ mẫu thử của nhà sản xuất hoặc đơn vị vận hành, khai thác;
c) Hệ thống thiết bị sử dụng cho việc cấp thẻ, giấy phép kiểm soát an ninh hàng không phải bảo đảm tính đồng bộ, thống nhất trong toàn ngành;
d) Thiết bị, phương tiện quy định tại khoản 1 Điều này phải có đầy đủ hồ sơ, lý lịch; hệ thống máy soi tia X phải được cấp phép an toàn bức xạ của cơ quan có thẩm quyền.
đ) Khi đầu tư mới thiết bị an ninh hàng không, phải đảm bảo thiết bị đáp ứng công nghệ tiên tiến trên thế giới.
Điều 101. Quy định về khai thác, bảo trì thiết bị, phương tiện an ninh hàng không
1. Khai thác, quản lý, bảo trì thiết bị, phương tiện bảo đảm an ninh hàng không phải tuân thủ theo quy định của nhà sản xuất và đơn vị khai thác, sử dụng thiết bị, phương tiện; phải có sổ sách theo dõi các hỏng hóc và việc sửa chữa, bảo trì thiết bị, phương tiện.
2. Dữ liệu hình ảnh từ máy soi tia X, ca-me-ra giám sát an ninh phải được lưu giữ tối thiểu 90 ngày. Dữ liệu hình ảnh từ máy soi tia X, ca-me-ra giám sát, có liên quan đến các hành vi can thiệp bất hợp pháp, vụ việc vi phạm an ninh hàng không phải được lưu trữ tối thiểu 05 năm.
3. Máy soi tia X, cổng từ, thiết bị phát hiện kim loại cầm tay phải được kiểm tra bằng bộ mẫu thử trước khi sử dụng hàng ngày, hàng tuần hoặc bị ngừng do mất điện trong khi hoạt động.
a) Đối với máy soi tia X: yêu cầu kiểm tra, các bước tiến hành kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XVIII ban hành kèm theo Thông tư này;
b) Đối với cổng từ: yêu cầu kiểm tra, cách thức kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XIX ban hành kèm theo Thông tư này;
c) Đối với thiết bị phát hiện kim loại cầm tay: yêu cầu kiểm tra, cách thức kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XX ban hành kèm theo Thông tư này.
4. Máy soi tia X, cổng từ, thiết bị phát hiện kim loại cầm tay, thiết bị phát hiện chất nổ, ca-me-ra giám sát an ninh, hệ thống cảnh báo xâm nhập phải định kỳ bảo dưỡng theo quy định của nhà sản xuất để bảo đảm các thiết bị hoạt động ổn định. Thiết bị an ninh hàng không khi kiểm tra không đạt tiêu chuẩn phải ngừng khai thác sử dụng. Sổ kiểm tra, bảo dưỡng định kỳ, sửa chữa đột xuất phải được ghi chép rõ ràng, chính xác và phải có các thông tin sau:
a) Tên thiết bị, vị trí, người, thời gian lắp đặt;
b) Ngày, tháng, năm tiến hành kiểm tra, bảo dưỡng; nội dung, kết quả kiểm tra, bảo dưỡng; tên nhân viên kỹ thuật tiến hành kiểm tra, bảo dưỡng.
5. Định kỳ tháng 12 hàng năm, các cơ quan, đơn vị quản lý khai thác thiết bị an ninh báo cáo bằng văn bản về Cục Hàng không Việt Nam tổng hợp tình hình công tác quản lý thiết bị an ninh hàng không; phân loại về số lượng, chất lượng, thiết bị; cập nhật thiết bị bổ sung mới, hỏng, tiêu hủy.
6. Đơn vị quản lý khai thác thiết bị an ninh hàng không chịu trách nhiệm ban hành quy trình quản lý, vận hành, kiểm tra, bảo dưỡng thiết bị an ninh hàng không.
Điều 102. Quản lý, sử dụng vũ khí, công cụ hỗ trợ
1. Người khai thác cảng hàng không, sân bay; hãng hàng không Việt Nam, doanh nghiệp cung cấp dịch vụ không lưu; doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, trang bị, thiết bị tàu bay, doanh nghiệp cung cấp dịch vụ hàng không khác thực hiện thủ tục xin giấy phép trang bị, sử dụng vũ khí, công cụ hỗ trợ theo quy định của pháp luật.
2. Nhân viên kiểm soát an ninh hàng không được trang bị vũ khí, công cụ hỗ trợ khi làm nhiệm vụ, phải có giấy phép sử dụng và xuất trình khi cơ quan chức năng kiểm tra; khi đi công tác ra ngoài cơ quan, đơn vị, nếu được mang vũ khí, công cụ hỗ trợ phải mang theo giấy phép sử dụng, giấy điều động công tác của Thủ trưởng cơ quan và giấy tờ về nhân thân để xuất trình khi cơ quan chức năng kiểm tra. Sử dụng vũ khí, công cụ hỗ trợ phải tuân thủ theo các quy định của pháp luật.
3. Đối tượng được trang bị, sử dụng công cụ hỗ trợ:
a) Đối tượng nêu tại các điểm a, b, d và đ khoản 4 Điều này được trang bị, sử dụng mũ chống đạn, áo chống đạn; lá chắn, găng tay điện; lựu đạn hơi cay; súng bắn hơi cay, súng bắn đạn nhựa, cao su; các loại phương tiện xịt hơi cay, gây mê; roi điện, dùi cui điện, dùi cui cao su, khoá số tám;
b) Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội), nhân viên an ninh kiểm soát khi thực hiện nhiệm vụ tuần tra, canh gác tại các trạm gác thuộc khu vực đường cất hạ cánh, đường lăn, cổng, cửa vào, ra tiếp giáp sân bay, khu vực hạn chế, khu vực công cộng (nhà ga, bãi đỗ xe) được trang bị, sử dụng súng bắn hơi cay, súng bắn đạn nhựa, cao su; roi điện, dùi cui điện, dùi cui cao su, khoá số tám;
c) Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội), nhân viên kiểm soát an ninh hàng không thực hiện nhiệm vụ tăng cường đảm bảo an ninh cho chuyến bay, cưỡng chế, áp giải hành khách gây rối, hành khách bị từ chối nhập cảnh được trang bị, sử dụng súng bắn hơi cay, súng bắn đạn nhựa, cao su; roi điện, dùi cui điện, dùi cui cao su, khoá số tám;
d) Trưởng ca trực khi thực hiện nhiệm vụ tại điểm kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hóa được trang bị, sử dụng súng bắn hơi cay; roi điện, dùi cui điện, dùi cui cao su;
đ) Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội), nhân viên kiểm soát an ninh hàng không khi thực hiện nhiệm vụ kiểm tra, giám sát, áp tải hàng hóa ngoài phạm vi cảng hàng không, sân bay được trang bị, sử dụng roi điện, dùi cui điện, dùi cui cao su.
4. Những đối tượng quy định dưới đây được trang bị, sử dụng vũ khí quân dụng khi làm nhiệm vụ:
a) Nhân viên kiểm soát an ninh hàng không khi đối phó với hành vi can thiệp bất hợp pháp xảy ra tại cảng hàng không, sân bay, trên tàu bay;
b) Nhân viên kiểm soát an ninh hàng không khi làm nhiệm vụ trong thời gian thực hiện các biện pháp bảo đảm an ninh hàng không tăng cường cấp độ 2 và cấp độ 3;
c) Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội);
d) Nhân viên an ninh cơ động, nhân viên kiểm soát an ninh làm nhiệm vụ tuần tra, canh gác ban đêm;
đ) Nhân viên an ninh trên không khi thực hiện nhiệm vụ được trang bị súng và đạn phù hợp sử dụng trên tàu bay.
5. Bảo quản vũ khí, công cụ hỗ trợ:
a) Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội), nhân viên kiểm soát an ninh hàng không được trang bị, sử dụng vũ khí, công cụ hỗ trợ khi làm nhiệm vụ phải nghiêm chỉnh chấp hành chế độ kiểm tra, bảo quản vũ khí, công cụ hỗ trợ được trang bị. Khi hoàn thành nhiệm vụ hoặc kết thúc ca trực phải bàn giao vũ khí, công cụ hỗ trợ cho người có trách nhiệm để quản lý hoặc bàn giao cho người trực ca sau. Việc bàn giao vũ khí, công cụ hỗ trợ phải đảm bảo chặt chẽ và cập nhật vào sổ, có chữ ký của người nhận và người giao;
b) Đối với vũ khí, công cụ hỗ trợ sử dụng thường xuyên, đơn vị được trang bị vũ khí, công cụ hỗ trợ phải có tủ đựng vũ khí, công cụ hỗ trợ riêng biệt, duy trì chế độ bảo dưỡng hàng ngày và tổ chức kiểm tra chất lượng bảo quản vào cuối tuần;
c) Đối với vũ khí, công cụ hỗ trợ không sử dụng thường xuyên phải bố trí người chuyên trách bảo quản, phải có kho, tủ riêng để bảo quản. Kho bảo quản vũ khí, công cụ hỗ trợ phải bảo đảm các yêu cầu kỹ thuật an toàn phòng, chống cháy, nổ, có nội quy ra, vào kho; vũ khí, công cụ hỗ trợ bảo quản trong kho phải được bôi dầu, mỡ thường xuyên; phải sắp xếp hợp lý, để riêng từng chủng loại, nhãn hiệu. Hàng năm, các cơ quan, đơn vị phải thực hiện việc kiểm tra kỹ thuật, tiến hành bảo dưỡng theo đúng định kỳ và quy trình bảo dưỡng của nhà sản xuất;
d) Người được giao chuyên trách bảo quản vũ khí, công cụ hỗ trợ phải có phẩm chất đạo đức tốt, có trách nhiệm; đã qua lớp đào tạo, huấn luyện cơ bản về bảo quản, sử dụng vũ khí, công cụ hỗ trợ; chấp hành nghiêm chỉnh chế độ kiểm tra, bảo quản và có sổ sách theo dõi việc bảo quản vũ khí, công cụ hỗ trợ.
6. Cấp Trưởng, Phó thuộc Trung tâm (Tổ, Đội), nhân viên kiểm soát an ninh hàng không có chứng nhận đã được đào tạo, huấn luyện cơ bản về bảo quản, sử dụng vũ khí, công cụ hỗ trợ do cơ quan công an, quân đội hoặc đơn vị được phép theo quy định của pháp luật thì mới đủ điều kiện được trang bị, sử dụng vũ khí, công cụ hỗ trợ.
7. Định kỳ tháng 12 hàng năm, các cơ quan, đơn vị được trang bị vũ khí, công cụ hỗ trợ phải báo cáo bằng văn bản về Cục Hàng không Việt Nam tổng hợp tình hình công tác quản lý vũ khí và công cụ hỗ trợ và đào tạo, huấn luyện về bảo quản, sử dụng vũ khí, công cụ hỗ trợ; phân loại về số lượng, chất lượng vũ khí, công cụ hỗ trợ; thời hạn giấy phép sử dụng; vũ khí, công cụ hỗ trợ bổ sung mới, hỏng, tiêu hủy.
8. Cơ quan, đơn vị quản lý, sử dụng vũ khí, công cụ hỗ trợ chịu trách nhiệm ban hành quy định quản lý, sử dụng, bảo quản, kiểm tra, bảo dưỡng vũ khí, công cụ hỗ trợ.
Chương VI
KIỂM SOÁT CHẤT LƯỢNG AN NINH HÀNG KHÔNG
Điều 103. Hoạt động kiểm tra, khảo sát, thử nghiệm, đánh giá, điều tra an ninh hàng không
1. Cục Hàng không Việt Nam thực hiện kiểm tra, khảo sát, thử nghiệm công khai, bí mật, điều tra tại tất cả các cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không, hãng hàng không và các phương tiện, trang bị, thiết bị hoạt động hàng không dân dụng trong cả nước. Cảng vụ hàng không thực hiện kiểm tra, thử nghiệm công khai, bí mật, điều tra tại các cảng hàng không, hãng hàng không, cơ sở cung cấp dịch vụ hàng không và các phương tiện, trang bị, thiết bị hoạt động hàng không dân dụng trong phạm vi quản lý. Người khai thác cảng hàng không, sân bay thực hiện kiểm tra, khảo sát, thử nghiệm công khai, bí mật, điều tra nội bộ tại cảng hàng không, sân bay thuộc phạm vi quản lý của mình. Các doanh nghiệp có Chương trình, Quy chế an ninh hàng không thực hiện kiểm tra, khảo sát, thử nghiệm công khai, bí mật, điều tra nội bộ và đánh giá theo quy định.
2. Hoạt động kiểm tra, khảo sát, thử nghiệm, đánh giá, điều tra an ninh hàng không được thực hiện theo Kế hoạch hoạt động kiểm soát chất lượng hàng năm hoặc đột xuất phát sinh khi xét thấy cần thiết. Không thực hiện thử nghiệm đối với tàu bay đang bay hoặc chuyến bay chuyên cơ.
3. Kế hoạch hoạt động kiểm soát chất lượng an ninh hàng không hàng năm bao gồm các hoạt động kiểm tra, thử nghiệm, đánh giá được xây dựng căn cứ vào đánh giá nguy cơ, các nguồn lực về con người, kinh phí được cấp và các yếu tố khác có liên quan và phải bảo đảm tính thống nhất không chồng chéo trong toàn ngành, tính bí mật đối với hoạt động thử nghiệm bí mật. Việc xây dựng kế hoạch thực hiện như sau:
a) Hàng năm trước ngày 15 tháng 10, Cảng vụ hàng không xây dựng kế hoạch kiểm soát chất lượng an ninh hàng không năm sau, báo cáo Cục Hàng không Việt Nam;
b) Hàng năm trước ngày 30 tháng 10, Cục Hàng không Việt Nam ban hành kế hoạch kiểm soát chất lượng an ninh hàng không năm sau của Cục Hàng không Việt Nam và Cảng vụ hàng không, gửi các đơn vị và doanh nghiệp có Chương trình, Quy chế an ninh hàng không;
c) Hàng năm trước ngày 30 tháng 11, căn cứ kế hoạch kiểm soát chất lượng an ninh hàng không của Cục Hàng không Việt Nam và Cảng vụ hàng không, người khai thác cảng hàng không, sân bay, hãng hàng không và doanh nghiệp có Chương trình, Quy chế an ninh hàng không xây dựng và ban hành kế hoạch kiểm soát chất lượng an ninh hàng không nội bộ, báo cáo Cục Hàng không Việt Nam và Cảng vụ hàng không liên quan để giám sát.
4. Hoạt động thanh tra, kiểm tra, thử nghiệm, đánh giá và hoạt động khảo sát, điều tra đột xuất do người có thẩm quyền quyết định khi xét thấy cần thiết.
5. Cục Hàng không Việt Nam ban hành Sổ tay Kiểm soát chất lượng an ninh hàng không để triển khai thực hiện hiệu quả, thống nhất trong toàn ngành.
Điều 104. Yêu cầu đối với hoạt động thanh tra, kiểm tra, khảo sát, thử nghiệm, đánh giá, điều tra an ninh hàng không
1. Yêu cầu đối với hoạt động kiểm tra, thử nghiệm, khảo sát, điều tra của Cục Hàng không Việt Nam và Cảng vụ hàng không:
a) Có quyết định thành lập đoàn của người có thẩm quyền. Kế hoạch kiểm tra, thử nghiệm, khảo sát, điều tra phải được người ra quyết định thành lập đoàn phê duyệt;
b) Trưởng đoàn chịu trách nhiệm xây dựng kế hoạch kiểm tra, thử nghiệm, khảo sát, điều tra và báo cáo kết quả thực hiện với người ra quyết định thành lập đoàn chậm nhất 10 ngày làm việc tính từ ngày kết thúc các hoạt động kiểm tra, thử nghiệm, khảo sát, điều tra;
c) Trưởng đoàn đình chỉ theo thẩm quyền hoặc kiến nghị người có thẩm quyền đình chỉ hoạt động của người có hành vi vi phạm, thiết bị không đảm bảo tiêu chuẩn an ninh hàng không trong khi thực hiện kiểm tra, thử nghiệm, khảo sát, điều tra;
d) Sau 15 ngày làm việc tính từ ngày kết thúc các hoạt động kiểm tra, thử nghiệm, khảo sát, điều tra, người ra quyết định thành lập đoàn phải có văn bản kết luận, trong đó nêu rõ những sơ hở, thiếu sót và yêu cầu, khuyến cáo khắc phục, nếu có;
đ) Sau 10 ngày làm việc tính từ ngày nhận được kết luận kiểm tra, thử nghiệm, khảo sát, điều tra, đơn vị chịu sự kiểm tra, thử nghiệm, khảo sát, điều tra phải gửi kế hoạch khắc phục sơ hở, thiếu sót trong đó nêu cụ thể biện pháp khắc phục, cá nhân, tổ chức chịu trách nhiệm khắc phục và thời gian hoàn thành việc khắc phục;
e) Sau 05 ngày làm việc tính từ ngày nhận được kế hoạch khắc phục, người ra quyết định thành lập đoàn phải có văn bản phản hồi về kế hoạch khắc phục sơ hở, thiếu sót gửi đơn vị, trong đó nêu rõ việc chấp thuận hay không chấp thuận với từng nội dung. Với những nội dung không chấp thuận, phải trao đổi thống nhất lại với đơn vị; trường hợp không thống nhất được, người ra quyết định thành lập đoàn sẽ quyết định.
2. Yêu cầu đối với hoạt động kiểm tra, khảo sát, thử nghiệm, điều tra, đánh giá của người khai thác cảng hàng không, sân bay, hãng hàng không và các doanh nghiệp khác có Chương trình, Quy chế an ninh hàng không:
a) Phải có kế hoạch kiểm tra, khảo sát, thử nghiệm, điều tra, đánh giá được người đứng đầu tổ chức bảo đảm an ninh hàng không phê duyệt;
b) Sau 10 ngày làm việc tính từ ngày kết thúc kiểm tra, khảo sát, điều tra, thử nghiệm nội bộ, đánh giá phải ban hành kết luận và kế hoạch khắc phục sơ hở, thiếu sót sau kiểm tra, khảo sát, điều tra, trong đó nêu cụ thể biện pháp khắc phục, cá nhân, tổ chức chịu trách nhiệm khắc phục và thời gian hoàn thành việc khắc phục, nếu có;
c) Sau 15 ngày, kết luận kiểm tra, khảo sát, điều tra, thử nghiệm và kế hoạch khắc phục sơ hở, thiếu sót phải gửi Cục Hàng không Việt Nam và Cảng vụ hàng không liên quan. Đối với kết luận của hoạt động đánh giá phải được gửi đến các đơn vị chịu sự đánh giá, Cảng vụ hàng không liên quan và Cục Hàng không Việt Nam;
d) Hoạt động đánh giá của các hãng hàng không Việt Nam tại các cảng hàng không nước ngoài do hãng hàng không chịu chi phí phải có sự tham gia của Cục Hàng không Việt Nam. Hoạt động đánh giá của nhà chức trách, hãng hàng không nước ngoài tại Việt Nam phải được Cục Hàng không Việt Nam cho phép.
3. Cảng vụ hàng không, người khai thác cảng hàng không, sân bay, hãng hàng không và các doanh nghiệp có Chương trình, Quy chế an ninh gửi báo cáo kết quả thực hiện công tác kiểm soát chất lượng an ninh hàng không về Cục Hàng không Việt Nam trước ngày 10 tháng 12 hàng năm.
4. Hồ sơ, tài liệu hoạt động thanh tra, kiểm tra, khảo sát, thử nghiệm, đánh giá, điều tra an ninh hàng không phải được quản lý, lưu trữ theo quy định của pháp luật về văn thư lưu trữ.
Điều 105. Thử nghiệm an ninh hàng không
1. Thử nghiệm bí mật phải bảo đảm bí mật nội dung, thời gian, địa điểm, kế hoạch, phương án và toàn bộ quá trình thử nghiệm, chỉ thành viên trong đoàn mới được phổ biến. Thử nghiệm công khai phải thông báo trước nội dung, thời gian, địa điểm thử nghiệm cho đơn vị là đối tượng chịu sự thử nghiệm. Căn cứ kế hoạch thử nghiệm được phê duyệt, trưởng đoàn thử nghiệm xây dựng phương án thực hiện cho từng thử nghiệm cụ thể.
2. Phải bảo đảm an ninh, an toàn cho người, tài sản, các hoạt động của người thử nghiệm và đối tượng chịu sự thử nghiệm trong quá trình thử nghiệm. Khi thử nghiệm bí mật bị phát hiện, người thử nghiệm phải xuất trình ngay quyết định thử nghiệm cùng với Thẻ giám sát viên an ninh hàng không hoặc giấy tờ về nhân thân có ảnh của người thử nghiệm cho đối tượng chịu sự thử nghiệm biết, đối tượng chịu sự thử nghiệm phải hợp tác và bảo đảm an ninh, an toàn cho người, phương tiện, đồ vật thử nghiệm.
3. Ngay sau cuộc thử nghiệm kết thúc, người thử nghiệm phải tiến hành lập biên bản ghi nhận kết quả cuộc thử nghiệm và yêu cầu đối tượng chịu sự thử nghiệm ký vào biên bản. Kết thúc cuộc thử nghiệm, trưởng đoàn thử nghiệm phải tổ chức họp với các thành phần liên quan tại đơn vị chịu sự thử nghiệm để rút kinh nghiệm, giảng bình và thông báo sơ bộ về kết quả của cuộc thử nghiệm với người đứng đầu hoặc đại diện được ủy quyền của đơn vị chịu sự thử nghiệm.
4. Thử nghiệm bí mật được phép sử dụng người trong lực lượng công an, quân đội hoặc hành khách có nhân thân tốt và đủ độ tin cậy để bảo đảm yếu tố bí mật và hiệu quả của hoạt động thử nghiệm.
Điều 106. Khắc phục sơ hở, thiếu sót qua kiểm tra, khảo sát, thử nghiệm, đánh giá, điều tra
1. Trong khi kiểm tra, khảo sát, thử nghiệm, điều tra xét thấy những sơ hở, thiếu sót cần phải khắc phục ngay nếu không sẽ gây mất an ninh, an toàn, trưởng đoàn lập biên bản yêu cầu phải khắc phục ngay hoặc chuyển giao cho người có thẩm quyền đình chỉ hoạt động để bảo đảm an ninh, an toàn.
2. Đơn vị được đánh giá, sau khi nhận được kết luận đánh giá, trong đó bao gồm các kiến nghị khắc phục sơ hở, thiếu sót phải xây dựng kế hoạch khắc phục, báo cáo Cục Hàng không Việt Nam; trường hợp có những kết luận, kiến nghị chưa chính xác thì có văn bản phản hồi gửi đến tổ chức thực hiện đánh giá và Cục Hàng không Việt Nam.
3. Bộ phận kiểm soát chất lượng an ninh hàng không của cơ quan ban hành văn bản phản hồi về kế hoạch khắc phục sơ hở, thiếu sót có trách nhiệm theo dõi, kiểm tra đánh giá thực tế việc thực hiện kế hoạch khắc phục, báo cáo kết quả cho thủ trưởng cơ quan, đơn vị.
4. Trường hợp không khắc phục đúng theo kế hoạch đã được chấp thuận, bộ phận kiểm soát chất lượng của cơ quan ban hành văn bản phản hồi về kế hoạch khắc phục khiếm khuyết, xem xét kiến nghị áp dụng hình thức chế tài cần thiết để bảo đảm việc khắc phục.
Điều 107. Quy định về Giám sát viên an ninh hàng không, Giám sát viên an ninh nội bộ và người được cấp Thẻ, Giấy phép của Ủy ban An ninh hàng không dân dụng quốc gia
1. Giám sát viên an ninh hàng không là người thuộc Cảng vụ hàng không và Cục Hàng không Việt Nam thực hiện các hoạt động kiểm soát chất lượng và các hoạt động giám sát an ninh hàng không được Cục Hàng không Việt Nam bổ nhiệm và cấp Thẻ giám sát viên an ninh hàng không. Mẫu Thẻ giám sát viên an ninh hàng không theo mẫu quy định tại Phụ lục XXI ban hành kèm theo Thông tư này.
2. Giám sát viên an ninh hàng không khi thực hiện nhiệm vụ có các quyền hạn sau đây:
a) Được phép tiếp cận, lên tàu bay, vào bất cứ khu vực hạn chế nào tại cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không, công trình, trang thiết bị, phương tiện;
b) Được quyền yêu cầu tổ chức, cá nhân cung cấp giấy tờ, tài liệu hoặc đồ vật có liên quan; thu giữ giấy phép, thẻ kiểm soát an ninh hàng không có liên quan của nhân viên vi phạm; đình chỉ hoạt động của trang thiết bị, phương tiện vi phạm gây uy hiếp an ninh hàng không;
c) Yêu cầu người có trách nhiệm thực hiện ngay các biện pháp khắc phục có thể; lập biên bản vi phạm, chuyển cho người có thẩm quyền để xử lý theo quy định của pháp luật.
3. Giám sát viên an ninh nội bộ là người của các doanh nghiệp có Chương trình an ninh, Quy chế an ninh hàng không do doanh nghiệp thực hiện việc bổ nhiệm, cấp thẻ và quy định về quyền hạn và trách nhiệm cho giám sát viên an ninh nội bộ khi thực hiện nhiệm vụ. Mẫu Thẻ giám sát viên an ninh nội bộ phải được thông báo cho Cục Hàng không Việt Nam và Cảng vụ hàng không liên quan.
4. Thành viên Ủy ban An ninh hàng không dân dụng quốc gia và cán bộ của Văn phòng thường trực được cấp Thẻ; phương tiện của cơ quan, đơn vị phục vụ trực tiếp thành viên Ủy ban An ninh hàng không dân dụng quốc gia được cấp Giấy phép có quyền hạn, nhiệm vụ sau đây:
a) Thực hiện công tác kiểm tra, giám sát, đánh giá việc tuân thủ các quy định về bảo đảm an ninh hàng không quốc gia tại các cơ sở cung cấp dịch vụ hàng không;
b) Tiếp cận và vào tất cả các khu vực hạn chế, phương tiện, thiết bị, tàu bay thuộc phạm vi giám sát an ninh hàng không theo quy định trong Chương trình an ninh hàng không dân dụng Việt Nam và kiểm soát chất lượng an ninh hàng không; ra, vào Trung tâm chỉ huy khẩn nguy, khu vực hiện trường các vụ can thiệp bất hợp pháp vào hoạt động hàng không dân dụng;
c) Sử dụng Thẻ, Giấy phép đúng mục đích, nhiệm vụ có liên quan đến công tác bảo đảm an ninh hàng không; xuất trình Thẻ còn hiệu lực khi thực hiện nhiệm vụ tại các khu vực hạn chế thuộc ngành hàng không dân dụng;
d) Phương tiện có Giấy phép Ủy ban An ninh hàng không quốc gia ra, vào khu vực công cộng của cảng hàng không, sân bay được miễn các khoản thu khi thực hiện nhiệm vụ.
5. Giám sát viên an ninh hàng không, Giám sát viên an ninh nội bộ, người được cấp Thẻ của Ủy ban An ninh hàng không dân dụng quốc gia khi thực hiện nhiệm vụ phải chịu trách nhiệm về những việc làm của mình; sử dụng Thẻ đúng nhiệm vụ, quyền hạn theo quy định của pháp luật.
6. Tiêu chuẩn của Giám sát viên an ninh hàng không:
a) Có kiến thức, kinh nghiệm chuyên sâu trong lĩnh vực được bổ nhiệm;
b) Có thời gian làm việc trong lĩnh vực an ninh hàng không tối thiểu 03 năm hoặc tối thiểu 02 năm đối với trường hợp đã công tác trong lực lượng công an, quân đội;
c) Đã hoàn thành khóa học nghiệp vụ giám sát viên an ninh hàng không và được cấp chứng chỉ hoặc chứng nhận theo quy định.
7. Tiêu chuẩn Giám sát viên an ninh nội bộ:
a) Có thời gian làm việc trong lĩnh vực an ninh hàng không tối thiểu 02 năm hoặc tối thiểu 01 năm đối với trường hợp đã công tác trong lực lượng công an, quân đội;
b) Đã hoàn thành khóa học nghiệp vụ giám sát viên an ninh hàng không và được cấp chứng chỉ hoặc chứng nhận theo quy định.
Điều 108. Tổ chức xây dựng cơ sở dữ liệu an ninh hàng không
1. Cục Hàng không Việt Nam tổ chức thống kê và xây dựng cơ sở dữ liệu an ninh hàng không thống nhất trong toàn ngành hàng không dân dụng. Cơ sở dữ liệu an ninh hàng không phải được bảo vệ, tránh truy cập trái phép; chỉ những tổ chức, cá nhân được Cục Hàng không Việt Nam cho phép mới được truy cập và khai thác. Cơ sở dữ liệu về an ninh hàng không gồm:
a) Các hành vi can thiệp bất hợp pháp và các vụ việc vi phạm an ninh hàng không;
b) Đối tượng phải kiểm tra trực quan hàng không bắt buộc, bị từ chối vận chuyển vì lý do an ninh, cấm vận chuyển bằng đường hàng không;
c) Các sơ hở, thiếu sót qua hoạt động giám sát và các cuộc thanh tra, kiểm tra, thử nghiệm, khảo sát, đánh giá, điều tra an ninh hàng không;
d) Thẻ, giấy phép kiểm soát an ninh hàng không;
đ) Hệ thống kết cấu hạ tầng, trang bị, thiết bị, vũ khí, công cụ hỗ trợ;
e) Hệ thống tổ chức, lực lượng kiểm soát an ninh hàng không, giấy phép nhân viên kiểm soát an ninh hàng không.
2. Cục Hàng không Việt Nam tổ chức quản trị cơ sở dữ liệu an ninh hàng không; Cảng vụ hàng không, các doanh nghiệp có Chương trình, Quy chế an ninh hàng không phải thường xuyên thống kê, cập nhật các nội dung nêu tại khoản 1 của Điều này vào cơ sở dữ liệu.
3. Cục Hàng không Việt Nam hướng dẫn về việc thống kê, báo cáo, cập nhật, khai thác, quản lý và sử dụng cơ sở dữ liệu an ninh hàng không.
Điều 109. Quản lý rủi ro về an ninh hàng không
1. Rủi ro an ninh hàng không là các mối đe doạ tiềm ẩn trong một giai đoạn nhất định đối với công tác bảo đảm an ninh hàng không, bao gồm: mối đe doạ từ các loại tội phạm; các sơ hở, thiếu sót trong hệ thống an ninh hàng không; các hành vi can thiệp bất hợp pháp, vi phạm an ninh hàng không đã xảy ra.
2. Quản lý rủi ro về an ninh hàng không là việc thu thập, đánh giá và xác định mức độ của các mối đe doạ tiềm ẩn để đề ra các biện pháp kiểm soát an ninh hàng không phù hợp tương xứng với mức độ đe doạ được xác định.
3. Cục Hàng không Việt Nam thiết lập hệ thống báo cáo tự nguyện, báo cáo mật để thu thập các thông tin an ninh hàng không từ các nguồn hành khách, tổ bay, nhân viên trong ngành hàng không dân dụng và các nguồn khác thích hợp phục vụ cho hoạt động kiểm soát chất lượng và quản lý rủi ro về an ninh hàng không.
4. Cục Hàng không Việt Nam phối hợp với các cơ quan, đơn vị liên quan đánh giá và xác định mức độ của các mối đe đọa tiềm ẩn đối với an ninh hàng không trong toàn ngành mỗi năm một lần; chỉ đạo đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn đối với công tác bảo đảm an ninh hàng không của các cảng hàng không, sân bay, hãng hàng không Việt Nam và các doanh nghiệp cung cấp dịch vụ hàng không.
5. Cảng vụ hàng không chủ trì, phối hợp với các cơ quan, đơn vị liên quan đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn đối với công tác bảo đảm an ninh hàng không tại cảng hàng không, sân bay 6 tháng một lần.
6. Hãng hàng không Việt Nam, doanh nghiệp cung cấp dịch vụ không lưu đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn đối với công tác bảo đảm an ninh hàng không của hãng, doanh nghiệp 6 tháng một lần.
7. Kết quả đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn được phổ biến cho cơ quan, đơn vị liên quan để xem xét sửa đổi, bổ sung các tiêu chuẩn, biện pháp kiểm soát an ninh hàng không cần thiết trong Chương trình an ninh, Quy chế an ninh hàng không và trong các quy định khác có liên quan.
8. Các cơ quan, đơn vị quy định tại các khoản 4, 5 và 6 Điều này thành lập Hội đồng đánh giá rủi ro, ban hành nhiệm vụ và cơ chế hoạt động của Hội đồng để thực hiện trách nhiệm được giao. Các thành viên của Hội đồng đánh giá rủi ro về an ninh hàng không hoạt động theo chế độ kiêm nhiệm.
Chương VII
TRÁCH NHIỆM CỦA CÁC TỔ CHỨC, CÁ NHÂN TRONG CÔNG TÁC BẢO ĐẢM AN NINH HÀNG KHÔNG
Điều 110. Trách nhiệm của Cục Hàng không Việt Nam
1. Thực hiện nhiệm vụ, quyền hạn của Nhà chức trách hàng không đối với công tác bảo đảm an ninh hàng không theo quy định của pháp luật. Tham mưu cho Bộ trưởng Bộ Giao thông vận tải thực hiện công tác quản lý nhà nước về bảo đảm an ninh cho hoạt động hàng không dân dụng. Trình Bộ trưởng ban hành theo thẩm quyền hoặc trình các cấp có thẩm quyền ban hành các chính sách, văn bản quy phạm pháp luật; Chương trình an ninh hàng không Việt Nam, Chương trình đào tạo, huấn luyện an ninh hàng không Việt Nam, Chương trình kiểm soát chất lượng an ninh hàng không Việt Nam; tiêu chuẩn, quy chuẩn kỹ thuật trong lĩnh vực bảo đảm an ninh hàng không.
2. Phê duyệt, chấp thuận và giám sát thực hiện Chương trình an ninh, Quy chế an ninh hàng không của người khai thác cảng hàng không, sân bay, hãng hàng không, cơ sở cung cấp dịch vụ không lưu, cơ sở sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, cơ sở cung cấp dịch vụ hàng không tại cảng hàng không, sân bay, cơ sở xử lý hàng hoá, bưu gửi để đưa lên tàu bay.
3. Ban hành, công nhận và giám sát việc thực hiện:
a) Tiêu chuẩn cơ sở, quy trình, chỉ thị, hướng dẫn, tài liệu nghiệp vụ, khuyến cáo về an ninh hàng không;
b) Huấn lệnh, các biện pháp khẩn cấp bao gồm cả việc tạm ngừng hoạt động bay tại sân bay, đình chỉ chuyến bay và hoạt động của phương tiện, thiết bị, nhân viên hàng không, hoạt động của người khai thác tàu bay, cơ sở cung cấp dịch vụ không lưu, cơ sở sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, cơ sở cung cấp dịch vụ hàng không tại cảng hàng không, sân bay, cơ sở xử lý hàng hoá, bưu gửi để đưa lên tàu bay để bảo đảm an ninh hàng không;
c) Mẫu thẻ, mẫu giấy phép kiểm soát an ninh hàng không; Thẻ giám sát viên an ninh hàng không; giấy phép, chứng chỉ, chứng nhận chuyên môn cho cán bộ an ninh hàng không, nhân viên kiểm soát an ninh hàng không;
d) Danh mục các vật phẩm nguy hiểm bị cấm hoặc hạn chế mang theo người và hành lý lên tàu bay tuân thủ theo hướng dẫn kỹ thuật và yêu cầu của ICAO.
4. Tổ chức thực hiện, giám sát công tác cấp thẻ, giấy phép kiểm soát an ninh hàng không.
5. Yêu cầu các cơ quan, đơn vị thay đổi mẫu, nội dung thẻ, giấy phép kiểm soát an ninh hàng không khi có đánh giá có nguy cơ về an ninh hàng không.
6. Tham gia thẩm định, đánh giá về việc áp dụng các tiêu chuẩn và yêu cầu an ninh hàng không trong việc thiết kế xây dựng, cải tạo cảng hàng không, sân bay.
7. Tổ chức điều tra, xác minh và chỉ đạo xử lý các vụ việc vi phạm, uy hiếp an ninh hàng không; giám sát việc thực hiện các biện pháp khẩn cấp bao gồm việc đình chỉ chuyến bay và hoạt động của phương tiện, thiết bị, nhân viên hàng không để bảo đảm an ninh hàng không.
8. Tổ chức chỉ đạo các đơn vị trong ngành hàng không dân dụng thực hiện các biện pháp đối phó ban đầu với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng, thực hiện các biện pháp khẩn cấp phục vụ an ninh, quốc phòng, khẩn nguy quốc gia; đánh giá lại các biện pháp, thủ tục an ninh sau khi xảy ra hành vi can thiệp bất hợp pháp và đưa ra các biện pháp khắc phục để ngăn ngừa các hành vi tương tự tái diễn.
9. Chỉ đạo các đơn vị trong ngành hàng không dân dụng về công tác bảo đảm an ninh hàng không, bao gồm:
a) Thực hiện các biện pháp phòng ngừa và đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng; các biện pháp khẩn cấp phục vụ an ninh, quốc phòng, khẩn nguy quốc gia;
b) Diễn tập khẩn nguy về an ninh hàng không, kiểm soát chất lượng an ninh hàng không;
c) Hệ thống tổ chức lực lượng chuyên ngành bảo đảm an ninh hàng không trong ngành hàng không dân dụng đáp ứng tiêu chuẩn của ICAO;
d) Kiểm soát an ninh nội bộ, an ninh thông tin; xử lý, rút kinh nghiệm, giảng bình vụ việc vi phạm an ninh hàng không.
10. Chỉ đạo Cảng vụ hàng không thực hiện chức năng kiểm tra, giám sát việc tuân thủ các quy định về an ninh hàng không dân dụng tại cảng hàng không, sân bay.
11. Kiểm tra, sát hạch, cấp, đình chỉ, thu hồi giấy phép và năng định chuyên môn cho nhân viên kiểm soát an ninh hàng không; cấp, thu hồi thẻ, giấy phép kiểm soát an ninh cảng hàng không, sân bay theo quy định tại Thông tư này; bổ nhiệm, đình chỉ và cấp, thu hồi Thẻ giám sát viên an ninh hàng không.
12. Thanh tra, kiểm tra, thử nghiệm, điều tra, khảo sát việc tuân thủ các quy định của pháp luật về an ninh hàng không đối với các cơ quan, tổ chức, cá nhân tham gia vào hoạt động hàng không dân dụng; ban hành các khuyến cáo, chỉ thị cần thiết nhằm phòng ngừa, ngăn chặn sự cố an ninh hàng không; xử phạt vi phạm hành chính đối với các vụ việc vi phạm an ninh hàng không; kiểm tra, giám sát việc xử lý, khắc phục, giảng bình vụ việc vi phạm an ninh hàng không.
13. Thiết lập hệ thống báo cáo, thu thập thông tin, phân tích và đánh giá nguy cơ đe dọa đến an ninh hàng không; quyết định áp dụng các biện pháp, quy trình, thủ tục phòng ngừa an ninh hàng không phù hợp với nguy cơ đe dọa.
14. Tổ chức đánh giá và quyết định không cho phép thực hiện các chuyến bay dân dụng trong các trường hợp sau đây:
a) Tại cảng hàng không, sân bay của Việt Nam không đảm bảo các yêu cầu của pháp luật về bảo đảm an ninh hàng không;
b) Chuyến bay của hãng hàng không không tuân thủ các quy định về bảo đảm an ninh hàng không;
c) Chuyến bay xuất phát từ cảng hàng không, sân bay nước ngoài không đảm bảo tuân thủ các tiêu chuẩn của ICAO về an ninh hàng không.
15. Là đầu mối quan hệ, hợp tác quốc tế về an ninh hàng không của Việt Nam với ICAO, các tổ chức quốc tế liên quan, các quốc gia, chịu trách nhiệm:
a) Chủ trì phối hợp với các cơ quan, đơn vị liên quan của Việt Nam trong các hoạt động hợp tác quốc tế về an ninh hàng không;
b) Tiếp nhận, cung cấp, trao đổi thông tin, tài liệu, kinh nghiệm về an ninh hàng không với ICAO, các quốc gia, tổ chức, hãng hàng không nước ngoài;
c) Quyết định thực hiện các biện pháp bảo đảm an ninh khi các quốc gia, hãng hàng không nước ngoài có yêu cầu, kể cả việc khảo sát, đánh giá an ninh hàng không;
d) Thông báo cho ICAO các khác biệt giữa pháp luật Việt Nam về an ninh hàng không với các tiêu chuẩn của ICAO.
16. Kiểm soát việc áp dụng các quy định của pháp luật về giá các dịch vụ bảo đảm an ninh hàng không để đảm bảo áp dụng giá dịch vụ đúng quy định, phù hợp thực tế.
17. Chấp thuận miễn kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hóa và chịu trách nhiệm trong những trường hợp có yêu cầu của cơ quan có thẩm quyền thuộc Văn phòng Trung ương Đảng, Văn phòng Chủ tịch nước, Văn phòng Quốc hội, Văn phòng Chính phủ, Ban Đối ngoại Trung ương, Bộ Ngoại giao, Bộ Công an, Bộ Quốc phòng.
Điều 111. Trách nhiệm phối hợp của Cục Hàng không Việt Nam
1. Phối hợp với các cơ quan, đơn vị thuộc Bộ Công an, Bộ Quốc phòng:
a) Tổ chức đào tạo, huấn luyện, chỉ đạo, hướng dẫn nghiệp vụ cho lực lượng kiểm soát an ninh hàng không;
b) Tiếp nhận, trao đổi, xử lý thông tin về tình hình an ninh chính trị, trật tự an toàn xã hội; âm mưu, phương thức, thủ đoạn hoạt động của đối tượng khủng bố, các loại tội phạm; âm mưu can thiệp bất hợp pháp; đánh giá rủi ro và đe dọa đối với hoạt động hàng không dân dụng;
c) Bảo đảm an ninh chuyến bay khai thác thương mại có đối tượng chuyên cơ theo quy định của chuyến bay chuyên cơ;
d) Phối hợp với các cơ quan chức năng liên quan của Bộ Công an, Bộ Quốc phòng thực hiện các quy định của pháp luật về an ninh quốc gia, quốc phòng, công an nhân dân, phòng, chống khủng bố và pháp luật khác có liên quan đến bảo đảm an ninh hàng không;
đ) Ký kết và triển khai thực hiện các Quy chế phối hợp với các cơ quan chức năng liên quan của Bộ Công an, Bộ Quốc phòng trong công tác bảo đảm an ninh hàng không;
e) Phối hợp với cơ quan an ninh có thẩm quyền của Bộ Công an để kiểm soát nhân thân của nhân viên hàng không nhằm kịp thời phát hiện các hành vi vi phạm pháp luật, uy hiếp an ninh, an toàn hàng không.
2. Phối hợp với các cơ quan, đơn vị thuộc Bộ Ngoại giao:
a) Giải quyết các vấn đề liên quan trong trường hợp tàu bay mang quốc tịch Việt Nam bị can thiệp bất hợp pháp tại nước ngoài; tàu bay mang quốc tịch nước ngoài bị can thiệp bất hợp pháp tại Việt Nam;
b) Trao đổi, xử lý thông tin có yếu tố nước ngoài liên quan đến can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
3. Phối hợp với Ban chỉ huy khẩn nguy hàng không tỉnh, thành phố, huyện đảo tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp ngành; cấp quốc gia theo quy định.
4. Phối hợp với Tổng cục Hải quan trong việc thực hiện bảo đảm an ninh hàng không và phòng chống buôn lậu, vận chuyển trái phép trên các chuyến bay quốc tế; chỉ đạo việc bố trí thiết bị soi chiếu chung giữa lực lượng kiểm soát an ninh hàng không và hải quan.
Điều 112. Trách nhiệm của Cảng vụ hàng không
1. Kiểm tra, giám sát việc tuân thủ các quy định của pháp luật về bảo đảm an ninh hàng không; các Chương trình an ninh, Quy chế an ninh hàng không; việc thực hiện các biện pháp bảo đảm an ninh hàng không và cung cấp dịch vụ bảo đảm an ninh hàng không tại cảng hàng không, sân bay; việc xử lý vụ việc vi phạm an ninh hàng không, trật tự công cộng tại cảng hàng không, sân bay. Tham gia đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay theo quy định.
2. Quyết định đình chỉ chuyến bay, yêu cầu tàu bay hạ cánh trong trường hợp chuyến bay vi phạm các quy định về an ninh hàng không, phát hiện chuyến bay có dấu hiệu bị uy hiếp an ninh, an toàn hàng không; cho phép tàu bay bị đình chỉ tiếp tục thực hiện chuyến bay; tạm giữ tàu bay trong trường hợp không khắc phục vi phạm quy định về an ninh hàng không; đình chỉ thực hiện nhiệm vụ, thu thẻ kiểm soát an ninh hàng không và giấy phép nhân viên hàng không của nhân viên hàng không vi phạm quy định của pháp luật về bảo đảm an ninh hàng không.
3. Xử phạt hành vi vi phạm hành chính xảy ra tại cảng hàng không, sân bay theo thẩm quyền trong lĩnh vực an ninh hàng không; chuyển giao vụ việc vi phạm không thuộc thẩm quyền cho các cơ quan chức năng liên quan.
4. Tổ chức cấp, quản lý thẻ, giấy phép kiểm soát an ninh cảng hàng không, sân bay trong phạm vi quản lý của Cảng vụ hàng không.
5. Chủ trì phối hợp với các cơ quan quản lý nhà nước hoạt động tại cảng hàng không, sân bay giải quyết các vướng mắc phát sinh, bảo đảm an ninh, trật tự và hoạt động bình thường của cảng hàng không, sân bay. Chủ trì tổ chức đánh giá các vấn đề về bảo đảm an ninh tại cảng hàng không, sân bay trong các cuộc họp định kỳ hoặc bất thường giữa các cơ quan quản lý nhà nước và các tổ chức hoạt động tại cảng hàng không, sân bay. Giám đốc Cảng vụ hàng không xem xét quyết định và chịu trách nhiệm về những vấn đề về bảo đảm an ninh hàng không phát sinh mà các cơ quan quản lý nhà nước liên quan tại cảng hàng không, sân bay không thống nhất cách giải quyết và báo cáo ngay cho Cục Hàng không Việt Nam.
6. Phối hợp với các cơ quan, đơn vị liên quan trao đổi, nắm tình hình về an ninh, trật tự, tội phạm và vi phạm pháp luật khác có liên quan đến cảng hàng không, sân bay.
7. Tiếp nhận, truyền, khai thác, xử lý, sử dụng thông tin, dữ liệu API (thông tin trước về hành khách) theo quy định. Thông báo để các hãng hàng không hoặc người khai thác các chuyến bay tư nhân biết về việc thực hiện cung cấp dữ liệu API theo quy định của pháp luật.
Điều 113. Trách nhiệm của người khai thác cảng hàng không, sân bay
1. Tổ chức hệ thống bảo đảm an ninh hàng không theo quy định của Thông tư này. Đảm bảo nguồn lực về con người, hệ thống kết cấu hạ tầng, trang thiết bị, kinh phí cho việc triển khai thực hiện Chương trình an ninh hàng không của cảng. Tổ chức cung cấp dịch vụ bảo đảm an ninh hàng không tại cảng hàng không, sân bay.
2. Chủ trì phối hợp với Cảng vụ hàng không, các cơ quan, đơn vị liên quan tại cảng hàng không xây dựng Chương trình an ninh hàng không của người khai thác cảng hàng không, sân bay và tổ chức triển khai thực hiện sau khi được phê duyệt. Cung cấp Chương trình an ninh của người khai thác cảng hàng không, sân bay được phê duyệt cho Cảng vụ hàng không liên quan, cung cấp phần thích hợp của Chương trình cho các hãng hàng không, cơ quan, doanh nghiệp liên quan hoạt động tại cảng hàng không, sân bay theo yêu cầu. Chịu sự thanh tra, kiểm tra, thử nghiệm, điều tra an ninh của Cục Hàng không Việt Nam và Cảng vụ hàng không theo quy định.
3. Xây dựng kết cấu hạ tầng, bố trí phương tiện, trang bị, thiết bị an ninh hàng không và các điều kiện cần thiết cho việc bảo đảm an ninh hàng không, bảo vệ cảng hàng không, sân bay và duy trì trật tự công cộng tại cảng hàng không, sân bay.
4. Chủ trì phối hợp với Cảng vụ hàng không xác định ranh giới các khu vực hạn chế tại cảng hàng không, sân bay. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh nội bộ theo quy định.
5. Phối hợp với các cơ quan chức năng thu thập thông tin, tình hình và đánh giá rủi ro tại cảng hàng không, sân bay. Tham mưu cho Cục Hàng không Việt Nam, Ban chỉ huy khẩn nguy hàng không tỉnh, thành phố, huyện đảo về tăng cường các biện pháp kiểm soát an ninh hàng không thích hợp.
6. Xây dựng Trung tâm Khẩn nguy cảng hàng không, sân bay, trụ sở chính để chỉ huy điều hành việc đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay. Xây dựng phương án khẩn nguy đối phó ban đầu với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay; chỉ huy, điều hành phối hợp các đơn vị hàng không hoạt động tại cảng hàng không, sân bay thực hiện phương án khẩn nguy đối phó ban đầu với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay; bàn giao quyền chỉ huy trưởng cho đại diện của công an hoặc quân đội tùy từng trường hợp theo quy định của pháp luật khi đại diện đó đã sẵn sàng tiếp nhận, chịu sự chỉ huy của chỉ huy trưởng sau khi đã bàn giao. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở, tham gia diễn tập cấp ngành, cấp quốc gia theo quy định.
7. Bảo đảm các yêu cầu, tiêu chuẩn về an ninh hàng không được áp dụng khi thiết kế, xây dựng, cải tạo các công trình thuộc cảng hàng không, sân bay.
8. Xây dựng và duy trì các tiêu chuẩn, quy trình, thủ tục cụ thể cho hoạt động kiểm tra, giám sát an ninh hàng không để thực hiện đầy đủ các quy định của Chương trình an ninh của người khai thác cảng hàng không, sân bay đã được phê duyệt. Tổ chức hệ thống kiểm tra, giám sát nội bộ trong việc thực hiện các tiêu chuẩn, quy trình, thủ tục an ninh hàng không để khắc phục kịp thời những sơ hở, thiếu sót trong công tác bảo đảm an ninh hàng không.
9. Tổ chức ký kết các Quy chế phối hợp về công tác bảo đảm an ninh hàng không, an ninh trật tự, an toàn xã hội với chính quyền địa phương, đơn vị công an, quân đội trên địa bàn cảng hàng không, sân bay và các cơ quan, đơn vị liên quan.
10. Thực hiện đào tạo, bồi dưỡng nghiệp vụ, huấn luyện kiến thức an ninh hàng không cho cán bộ, nhân viên có liên quan theo quy định pháp luật.
11. Phối hợp với Cảng vụ hàng không, cơ quan công an, quân đội, chính quyền địa phương có liên quan trong việc giải quyết, xử lý các vụ việc, hành vi vi phạm an ninh hàng không và trật tự công cộng tại cảng hàng không, sân bay.
12. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh cảng hàng không, sân bay theo quy định.
13. Xây dựng quy định về kiểm soát an ninh nội bộ và thực hiện trong tất cả các quy trình tuyển dụng, huấn luyện, đào tạo, quản lý, giám sát, xử lý vi phạm, đánh giá, nhận xét, bổ nhiệm, điều động của đơn vị; đề nghị cấp phép, năng định chuyên môn và định kỳ thực hiện đánh giá đối với nhân viên hàng không.
14. Xây dựng quy định về bảo vệ thông tin và hệ thống công nghệ thông tin hàng không được sử dụng trong hoạt động hàng không dân dụng chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật.
15. Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên thuộc doanh nghiệp mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tổ chức tuyên truyền trên các phương tiện thông tin đại chúng các quy định về an ninh hàng không trừ tài liệu an ninh hàng không hạn chế.
16. Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Hàng không Việt Nam.
Điều 114. Trách nhiệm của doanh nghiệp cung cấp dịch vụ hàng không
1. Xây dựng Quy chế an ninh hàng không bao gồm phương án khẩn nguy đối phó với hành vi can thiệp bất hợp pháp và tổ chức triển khai thực hiện sau khi được phê duyệt; cung cấp Quy chế an ninh hàng không được phê duyệt cho Cảng vụ hàng không liên quan và người khai thác cảng hàng không, sân bay. Chịu sự thanh tra, kiểm tra, giám sát, đánh giá, thử nghiệm, khảo sát an ninh hàng không của các cơ quan có thẩm quyền theo quy định của pháp luật và Thông tư này.
2. Tổ chức hệ thống bảo đảm an ninh hàng không theo quy định của Thông tư này; doanh nghiệp cung cấp dịch vụ không lưu tổ chức lực lượng kiểm soát an ninh hàng không làm công tác bảo đảm an ninh hàng không tại các khu vực hạn chế của doanh nghiệp; doanh nghiệp bảo dưỡng, sửa chữa tàu bay tổ chức lực lượng kiểm soát an ninh hàng không làm công tác bảo đảm an ninh hàng không tại cơ sở bảo dưỡng, sửa chữa tàu bay.
3. Thực hiện quyền hạn, trách nhiệm đối phó ban đầu với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng tại các cơ sở cung cấp dịch vụ nằm ngoài khu vực cảng hàng không, theo quy định của pháp luật.
4. Phối hợp với Cảng vụ hàng không, lực lượng kiểm soát an ninh hàng không, cơ quan công an, quân đội, chính quyền địa phương có liên quan trong việc giải quyết, xử lý các vụ việc, hành vi vi phạm an ninh hàng không tại các khu vực hạn chế của doanh nghiệp.
5. Thu thập thông tin, tình hình, đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn đối với công tác bảo đảm an ninh hàng không tại cơ sở để tham mưu cho Cục Hàng không Việt Nam, Ban chỉ huy khẩn nguy hàng không tỉnh, thành phố, huyện đảo về tăng cường các biện pháp kiểm soát an ninh hàng không thích hợp.
6. Chịu sự thanh tra, kiểm tra, giám sát, thử nghiệm, khảo sát, điều tra an ninh hàng không của Cục Hàng không Việt Nam và Cảng vụ hàng không theo quy định của pháp luật và Thông tư này.
7. Trong phạm vi nội bộ do mình quản lý, chịu trách nhiệm:
a) Xác định khu vực hạn chế của doanh nghiệp nằm ngoài cảng hàng không, sân bay. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh nội bộ theo quy định;
b) Kiểm soát an ninh nội bộ đối với nhân viên hàng không. Tổ chức hệ thống kiểm tra, giám sát nội bộ;
c) Bảo vệ thông tin và hệ thống công nghệ thông tin hàng không dân dụng do mình quản lý chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật theo quy định của pháp luật;
d) Tổ chức thực hiện kiểm soát chất lượng an ninh nội bộ theo quy định;
đ) Đào tạo, bồi dưỡng nghiệp vụ, huấn luyện kiến thức an ninh hàng không cho cán bộ, nhân viên có liên quan theo quy định của pháp luật;
e) Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên của mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tổ chức tuyên truyền trên các phương tiện thông tin đại chúng các quy định về an ninh hàng không, trừ tài liệu an ninh hàng không hạn chế.
8. Tổ chức ký kết các văn bản phối hợp về công tác bảo đảm an ninh hàng không, an ninh trật tự, an toàn xã hội với chính quyền, công an địa phương, đơn vị quân đội liên quan nơi có cơ sở cung cấp dịch vụ.
9. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở, tham gia diễn tập cấp ngành, cấp quốc gia theo quy định.
10. Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Hàng không Việt Nam.
Điều 115. Trách nhiệm của hãng hàng không, người khai thác tàu bay
1. Xây dựng Chương trình an ninh hàng không của hãng hàng không trình Cục Hàng không Việt Nam và tổ chức triển khai thực hiện sau khi được phê duyệt, chấp thuận; cung cấp toàn bộ Chương trình an ninh đã được phê duyệt, chấp thuận cho Cảng vụ hàng không liên quan để kiểm tra, giám sát việc tuân thủ.
2. Tổ chức đào tạo, bồi dưỡng nghiệp vụ, huấn luyện về an ninh hàng không cho những cán bộ, nhân viên có liên quan theo đúng các quy định của pháp luật.
3. Phối hợp với Cảng vụ hàng không, người khai thác cảng hàng không, sân bay, các cơ quan, đơn vị liên quan xử lý các vụ việc vi phạm an ninh hàng không và những vi phạm khác liên quan đến tàu bay trong thời gian tàu bay đang khai thác, không khai thác.
4. Thực hiện kiểm tra an ninh hàng không tàu bay trước chuyến bay, phối hợp lục soát an ninh tàu bay khi có thông tin đe dọa theo quy định của pháp luật. Bảo đảm an ninh, duy trì trật tự kỷ luật trên tàu bay đang bay.
5. Hãng hàng không, người khai thác tàu bay Việt Nam:
a) Tổ chức lực lượng kiểm soát an ninh hàng không thực hiện các biện pháp kiểm soát an ninh hàng không, duy trì an ninh, trật tự kỷ luật trên tàu bay và bảo đảm an ninh cho hoạt động khai thác tàu bay ngoài khu vực cảng hàng không, sân bay;
b) Tổ chức hệ thống an ninh hàng không độc lập và có người đứng đầu chịu trách nhiệm về toàn bộ công tác bảo đảm an ninh hàng không của hãng được phê chuẩn;
c) Tổ chức khảo sát, đánh giá công tác bảo đảm an ninh hàng không đối với hoạt động của hãng tại cảng hàng không, sân bay trong và ngoài nước; bảo đảm kinh phí cho Cục Hàng không Việt Nam tham gia hoạt động khảo sát, đánh giá của hãng tại cảng hàng không nước ngoài;
d) Phối hợp thực hiện Phương án khẩn nguy đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng trong phạm vi trách nhiệm của mình theo quy định. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở; tham gia diễn tập cấp ngành, cấp quốc gia theo quy định;
đ) Xác định ranh giới khu vực hạn chế thuộc phạm vi quản lý nằm ngoài cảng hàng không, sân bay. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh nội bộ, thẻ nhận dạng tổ bay theo quy định;
e) Bố trí chỗ ngồi trên chuyến bay cho nhân viên an ninh trên không đi làm nhiệm vụ trên chuyến bay theo yêu cầu của cơ quan có thẩm quyền;
g) Thực hiện công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không theo quy định;
h) Bảo vệ thông tin và hệ thống công nghệ thông tin hàng không của hãng chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật bao gồm cả thông tin cá nhân của hành khách;
i) Phổ biến, giáo dục cán bộ, nhân viên của mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tuyên truyền, phổ biến các quy định về an ninh hàng không bằng các hình thức thích hợp cho hành khách đi tàu bay;
k) Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Hàng không Việt Nam.
6. Hãng hàng không nước ngoài phải tuân thủ đầy đủ các quy định của pháp luật Việt Nam về an ninh hàng không trong hoạt động khai thác của hãng tại Việt Nam; chỉ định và thông báo cho Cục Hàng không Việt Nam người chịu trách nhiệm trực tiếp, toàn diện về bảo đảm an ninh hàng không trong hoạt động khai thác của hãng tại Việt Nam.
7. Trường hợp cảng hàng không, sân bay nước ngoài không đảm bảo tuân thủ các tiêu chuẩn của ICAO về an ninh hàng không thì Cục Hàng không Việt Nam đánh giá và quyết định không cho phép khai thác các chuyến bay dân dụng xuất phát từ cảng hàng không, sân bay đó đến Việt Nam.
Điều 116. Trách nhiệm của tổ chức, cá nhân có liên quan
1. Tuân thủ đầy đủ các quy định của Thông tư này, Chương trình an ninh của người khai thác cảng hàng không, sân bay khi hoạt động tại cảng hàng không, sân bay. Chịu sự thanh tra, kiểm tra, giám sát, điều tra, thử nghiệm, khảo sát, đánh giá an ninh hàng không của Cục Hàng không Việt Nam, Cảng vụ hàng không liên quan và lực lượng kiểm soát an ninh hàng không.
2. Đối với tổ chức, cá nhân kinh doanh dịch vụ phi hàng không tại cảng hàng không, sân bay:
a) Bảo vệ cơ sở vật chất, tài sản, trang thiết bị, bảo đảm an ninh hàng không, trật tự cho các hoạt động của mình thông qua việc giao kết hợp đồng dịch vụ bảo đảm an ninh với người khai thác cảng hàng không, sân bay;
b) Phối hợp với Cảng vụ hàng không, lực lượng kiểm soát an ninh hàng không và các cơ quan, đơn vị liên quan xử lý các vụ việc vi phạm an ninh hàng không và trật tự xảy ra trong phạm vi quản lý của mình;
c) Đảm bảo cho những cán bộ, nhân viên có liên quan được huấn luyện về an ninh hàng không theo quy định của pháp luật;
d) Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên thuộc doanh nghiệp mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không.
3. Hành khách, người gửi hàng phải thực hiện các quy định về bảo đảm an ninh hàng không theo quy định của Thông tư này và quy định pháp luật về an ninh hàng không. Hành khách phải tuyệt đối chấp hành các chỉ dẫn về an ninh, trật tự của nhân viên kiểm soát an ninh hàng không, mệnh lệnh của thành viên tổ bay. Trong trường hợp không tuân thủ thì căn cứ vào tính chất và mức độ vi phạm sẽ bị xử lý theo quy định của pháp luật.
4. Nhân viên hàng không phải tuân thủ các quy định về bảo đảm an ninh hàng không theo quy định của Thông tư này và quy định pháp luật về an ninh hàng không; trong khi thực hiện nhiệm vụ không được uống rượu, bia; nếu vi phạm sẽ bị đình chỉ thực hiện nhiệm vụ, thu hồi hoặc tạm giữ Thẻ kiểm soát an ninh hàng không và Giấy phép nhân viên hàng không.
Điều 117. Kinh phí bảo đảm an ninh hàng không
1. Văn phòng thường trực Ủy ban An ninh hàng không dân dụng quốc gia và Cục Hàng không Việt Nam căn cứ nhiệm vụ được giao hàng năm xây dựng dự toán kinh phí từ nguồn ngân sách nhà nước, trình Bộ Giao thông vận tải và triển khai thực hiện sau khi được phê duyệt.
2. Các doanh nghiệp tự bảo đảm toàn bộ kinh phí cho công tác bảo đảm an ninh hàng không thuộc trách nhiệm của mình được quy định trong Thông tư này và các quy định khác của pháp luật, bao gồm cả kinh phí đầu tư kết cấu hạ tầng, thiết bị, phương tiện bảo đảm an ninh hàng không của doanh nghiệp.
Chương VIII
ĐIỀU KHOẢN THI HÀNH
Điều 118. Phụ lục ban hành kèm theo Thông tư này
1. Phụ lục I: Đề cương Chương trình an ninh hàng không của người khai thác cảng hàng không, sân bay.
2. Phụ lục II: Đề cương Chương trình an ninh hàng không của hãng hàng không, người khai thác tàu bay Việt Nam.
3. Phụ lục III: Đề cương Quy chế an ninh hàng không của doanh nghiệp cung cấp dịch vụ không lưu.
4. Phụ lục IV: Đề cương Quy chế an ninh hàng không của doanh nghiệp cung cấp dịch vụ hàng không tại cảng hàng không, sân bay; doanh nghiệp sản xuất, sửa chữa, bảo dưỡng tàu bay, thiết bị tàu bay; doanh nghiệp xử lý hàng hoá, bưu gửi để đưa lên tàu bay.

6. Phụ lục VI: Danh sách trích ngang cán bộ, nhân viên cấp thẻ kiểm soát an ninh cảng hàng không, sân bay có giá trị sử dụng dài hạn.
7. Phụ lục VII: Mẫu tờ khai cấp thẻ kiểm soát an ninh cảng hàng không, sân bay có giá trị sử dụng dài hạn.

Điều 119. Hiệu lực thi hành
1. Thông tư này có hiệu lực kể từ ngày 01 tháng 5 năm 2016.
2. Thông tư này thay thế Thông tư số 30/2012/TT-BGTVT ngày 01 tháng 8 năm 2012 của Bộ trưởng Bộ Giao thông vận tải quy định chi tiết Chương trình an ninh hàng không Việt Nam và kiểm soát chất lượng an ninh hàng không.
3. Chánh Văn phòng Bộ, Chánh Thanh tra Bộ, các Vụ trưởng, Cục trưởng Cục Hàng không Việt Nam, Thủ trưởng các cơ quan, tổ chức và cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này./.
