Regulations on periodic reporting within the scope of state management
of the Ministry of Agriculture and Rural Development

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular stipulates the periodic reporting regime within the scope of state management of the Ministry of Agriculture and Rural Development.
2. This Circular does not regulate:
a) The statistical reporting system for the agricultural sector and rural development in accordance with the laws on statistics;
b) Confidential reporting regimes as prescribed by laws on state secrets;
c) The internal reporting system within the agencies under the Ministry of Agriculture and Rural Development.
3. The special topic reporting and ad hoc reporting regimes within the scope of state management of the Ministry of Agriculture and Rural Development shall be implemented in accordance with current regulatory legal documents and the provisions set out in Clause 2, Clause 3, Article 4, and Articles 8 and 9 of Decree No. 09/2019/NĐ-CP dated January 24, 2019 stipulating the reporting regime of administrative agencies (hereinafter referred to as Decree No. 09/2019/NĐ-CP).
Article 2. Applicability
1. Administrative agencies, civil servants, and officials related to the implementation of periodic reporting regimes within the scope of state management of the Ministry of Agriculture and Rural Development.
2. Organizations and individuals related to the implementation of the reporting regime within the scope of state management of the Ministry of Agriculture and Rural Development shall be determined by competent authorities.
Article 3. Principles and requirements for issuing periodic reporting regimes
Principles and requirements for issuing periodic reporting regimes shall be carried out in accordance with the provisions of Article 5 and Article 11 of Decree No. 09/2019/NĐ-CP.
Chapter II
CONTENT OF PERIODIC REPORTING REGIMES WITHIN THE SCOPE OF STATE MANAGEMENT OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
Article 4. Components of periodic reports
1. The components of some periodic reporting regimes within the scope of state management of the Ministry of Agriculture and Rural Development shall be implemented according to the guidelines in Appendix I attached to this Circular;
2. The components of other periodic reporting regimes in the list of periodic reports of the agriculture and rural development sector shall be implemented in accordance with the provisions of current regulatory legal documents.
Article 5. Forms of reports and methods of submitting reports
1. Reports shall be presented in one of the following forms:
a) Written reports on paper, signed by the authorized person of the agency, organization, or unit, stamped according to regulations, and sent in soft copy (file.doc) via the electronic mail system;
b) Electronic written reports in the form of data messages, in the format prescribed by the competent state authority, created or digitized from paper documents and submitted/received through the National Document Interconnection Trunk and the Reporting Information System of the Ministry of Agriculture and Rural Development.
2. Reports shall be sent to the Ministry of Agriculture and Rural Development in one of the following ways:
a) Through the National Document Interconnection Trunk;
b) Through the Reporting Information System of the Ministry of Agriculture and Rural Development;
c) Direct submission/receipt;
d) Submission/receipt through postal services;
đ) Submission/receipt through Fax;
e) Submission/receipt through the electronic mail system;
Article 6. Time for finalizing report data and deadline for submitting reports
1. The time for finalizing report data of the Ministry of Agriculture and Rural Development shall be implemented in accordance with the provisions of Article 12 of Decree No. 09/2019/NĐ-CP.
2. Deadline for submitting periodic reports:
a) Monthly periodic report: from the 16th to the 25th of the month within the reporting period;
b) Quarterly periodic report: from the 16th to the 25th of the last month of the quarter within the reporting period;
c) Six-month periodic report: from June 16 to June 25 of the reporting period;
d) Annual periodic report: from December 16 to December 25 of the reporting period.
Chapter III
APPLICATION OF INFORMATION TECHNOLOGY IN THE IMPLEMENTATION OF REPORTING REGIME
Article 7. Application of information technology in the implementation of the reporting regime
1. The Ministry of Agriculture and Rural Development shall have the responsibility to apply information technology in the implementation of the reporting regime, build a reporting information system to implement electronic reporting, creating favorable conditions for the consolidation, sharing of reporting information, and saving time and costs for the entities responsible for reporting.
2. The legal value of electronic reports and the use of digital signatures shall be carried out in accordance with current regulations on the application of information technology in the activities of state agencies.
Article 8. Reporting Information System of dated November 17, 2020;
1. The reporting information system of the Ministry of Agriculture and Rural Development shall be built in compliance with the principles stipulated in Article 15 of Decree No. 09/2019/NĐ-CP and the basic functional requirements stipulated in Article 17 and Clause 2 of Article 18 of Decree No. 09/2019/NĐ-CP.
2. The reporting information system of the Ministry of Agriculture and Rural Development shall be built and installed to integrate with the administrative document management system of the Ministry of Agriculture and Rural Development, allowing extraction of consolidated reports from specialized information systems and databases, ensuring uniformity with the forms provided by the National Reporting Information System.
3. The Ministry of Agriculture and Rural Development shall ensure technical infrastructure, technology, security, and safety services for the operation of the reporting information system of the Ministry of Agriculture and Rural Development.
Chapter IV
Article 30. IMPLEMENTATION AND ORGANIZATION OF IMPLEMENTATION
Article 9. Responsibilities of units under dated November 17, 2020;
1. Responsibilities of units under the Ministry
a) Regularly organize reviews of periodic reporting regimes to propose amendments and supplements to meet the requirements of state management and comply with the principles and requirements of Decree No. 09/2019/NĐ-CP.
b) Organize the management, operation, and exploitation of reporting data of the unit based on clearly defined authorities and responsibilities in accordance with regulations, while complying with the Law on Access to Information.
c) Compile and submit to the Ministry's Office for consolidation and submission to the Minister for public announcement on the Ministry of Agriculture and Rural Development’s Electronic Portal the list of periodic reporting regimes prescribed in legal documents drafted by the unit within five days from the date of issuance of such documents.
2. Responsibilities of the Ministry's Office
a) Advise and assist the Minister in guiding, monitoring, urging, and inspecting the implementation of this Circular; manage storage and sharing of industry and sectoral reporting information managed and issued by the Ministry.
b) Build and operate the Ministry's reporting information system and connect, share data with the Government's reporting information system and other ministries, agencies, and localities.
c) Guide and organize training sessions on updating, exploiting, and using data from the Ministry of Agriculture and Rural Development's reporting information system.
d) Take the lead in presenting the Minister for public announcement the list of periodic reports at legal documents issued or promulgated by the Minister, and update and announce regularly when changes occur as prescribed.
Article 6. Responsibilities of the Center for Information Technology and Statistics
a) Determine the level of information security assurance and implement security measures according to the level for the Ministry of Agriculture and Rural Development's reporting information system in accordance with the law. Establish monitoring systems, prevent data loss, and protect against viruses to ensure security and safety for the system.
b) Take the lead and coordinate with the Ministry's Office to implement monitoring measures to ensure information security for the Ministry of Agriculture and Rural Development's reporting information system.
c) Guide agencies and units under the Ministry to implement security measures to support connection, integration, and sharing of data on the Ministry of Agriculture and Rural Development's reporting information system.
Article 10. Effective Date
1. This Circular takes effect from March 5, 2020.
2. Repeal Clause 11 of Article 16 of Circular No. 21/2018/TT-BNNPTNT dated November 15, 2018, which stipulates the recording and submission of fishing activity logs, declaration of designated fishery ports, lists of illegal fishing vessels, confirmation of raw materials, and certification of origin of fishery products; Points a, b, and c of Clause 7 of Article 7 of Circular No. 07/2016/TT-BNNPTNT dated May 31, 2016, which stipulates animal disease prevention and control; Clause 6 of Article 5 of Circular No. 04/2016/TT-BNNPTNT dated May 10, 2016, which stipulates aquatic disease prevention and control; Clause 3 of Article 43 of Circular No. 22/2018/TT-BNNPTNT dated November 15, 2018, which stipulates crew members of fishing vessels and fisheries service vessels; Decision No. 241/QĐ-BNN-TCLN dated February 5, 2013, which stipulates the reporting regime for implementing forestry plans; Repeal the phrase "The deadline for submitting the six-month mid-year report is before July 15 and the annual report is before January 15 of the following year" in Article 41 of Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015, concerning the management of plant protection chemicals.
3. For periodic reporting regimes within the scope of management of the Ministry of Agriculture and Rural Development that are currently in force and prescribed in legal documents issued by the Government and the Prime Minister, they shall be implemented in accordance with Clause 3 of Article 32 of Decree No. 09/2019/NĐ-CP.
Article 11. Responsibility for Implementation
1. The agencies, units under the Ministry, state administrative bodies, and organizations and individuals related thereto shall be responsible for implementing this Circular.
2. In the course of implementation, if there are any difficulties, the agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Agriculture and Rural Development for appropriate amendments and supplements.
