CIRCULAR

Regulations on job code, occupational standards, appointment, and salary grading for teaching staff in public preschool education institutions

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces; and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular stipulating job codes, occupational standards, appointment, and salary grading for teaching staff in public preschool education institutions.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates job codes, occupational standards, appointment, and salary grading for teaching staff in public preschool education institutions.

Article 2. This Circular applies to teaching staff implementing preschool education programs, including teachers, principals, deputy principals (hereinafter referred to collectively as preschool teachers) in public preschool education institutions, including kindergarten schools, nursery schools, kindergartens, groups, independent kindergarten classes (hereinafter referred to collectively as public kindergarten schools), and other related organizations and individuals.

Article 3. Private and private preschool education institutions may apply the provisions of this Circular in hiring, using, and managing teachers.

Article 4. Job Code and Rank of Preschool Teacher

The preschool teacher occupation includes:

1. Preschool Teacher Rank III - Job Code V.07.02.26;

2. Preschool Teacher Rank II - Job Code V.07.02.25;

3. Preschool Teacher Rank I - Job Code V.07.02.24.

Chapter II

OCCUPATIONAL STANDARDS

Article 5. Preschool Teacher Rank III - Job Code V.07.02.26

1. Tasks

a) Implement nurturing, caring, and educating children according to the school's educational plan and specialized team; be responsible for the quality and effectiveness of nurturing, caring, and educating children in the assigned group or class under the preschool education program; implement inclusive education and children's rights;

b) Cultivate professional ethics; set a good example, treat children fairly and respect their dignity; protect their legitimate rights and interests;

c) Maintain health; complete professional training courses and programs; self-study and improve political, professional, and vocational qualifications; participate in professional activities; manage and use assigned educational equipment;

d) Coordinate with parents or guardians and the community in nurturing, caring, and educating children;

e) Fulfill civic duties, comply with laws, regulations of the education sector, and local authorities;

e) Fulfill other tasks assigned by the principal.

2. Professional ethics standards

a) Adhere to the Party's policies, State laws, and regulations of the education sector and locality regarding preschool education;

b) Love the profession and children; be patient, control emotions; have a high sense of responsibility; possess necessary knowledge and skills; have pedagogical abilities suitable for job requirements;

c) Continuously cultivate ethics, maintain integrity, honor, and reputation; set a good example, treat children fairly and respect their dignity; protect their legitimate rights and interests; support and assist colleagues;

d) Strictly follow regulations on teacher ethics; behavior, conduct, and attire.

3. Educational and Training Standards

a) Hold a college degree in early childhood education or higher;

b) Have a certificate meeting the occupational standard for preschool teacher rank III (for newly recruited preschool teachers at rank III, they must obtain the certificate within 36 months from the date of recruitment);

Article 4. Professional Competence Standards

a) Understand the Party's policies, State laws, regulations, and requirements of the education sector and locality regarding preschool education and implement them in assigned tasks;

b) Correctly implement the preschool education program;

c) Know how to coordinate with colleagues, parents, and the community in nurturing, caring, and educating children;

d) Know how to manage, use, store, and effectively maintain property and equipment of the group/class and school;

e) Possess the ability to apply information technology in performing tasks of preschool teacher rank III and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned.

Article 4. Early Childhood Education Teacher Grade II - Code V.07.02.25

1. Tasks

In addition to the tasks of Early Childhood Education Teacher Grade III, Early Childhood Education Teacher Grade II must perform the following tasks:

a) Serve as a lecturer or demonstrator in early childhood education training courses at school level or higher; guide colleagues in implementing the program and activities for nurturing, caring, and educating children;

b) Propose contents for professional development and specialized topic discussions within the department (specialized group);

c) Participate in examination boards for early childhood education competitions at school level or higher;

d) Engage in other professional activities such as self-assessment councils or external assessment teams; conduct professional and pedagogical inspections at school level or higher; participate in guiding and evaluating student teaching internships (if applicable).

2. Professional ethics standards

Besides the ethical standards of Early Childhood Education Teacher Grade III, Early Childhood Education Teacher Grade II must always set a good example in adhering to regulations on teacher ethics.

3. Educational and Training Standards

a) Hold a bachelor's degree in early childhood education or higher; or hold a college diploma in early childhood education and a bachelor's degree in educational management or higher;

b) Possess a certificate for professional development according to the standards for the position of Early Childhood Education Teacher Grade II.

Article 4. Professional Competence Standards

a) Be thoroughly familiar with the policies, guidelines, laws, regulations, and requirements of the Party, State, and industry regarding early childhood education, and effectively implement them in assigned tasks;

b) Effectively carry out the early childhood education curriculum; proactively and flexibly adjust plans for nurturing, caring, and educating children to suit the actual conditions of the school and locality;

c) Proactively organize and promptly coordinate with colleagues, parents, or guardians of children, and the community in nurturing, caring, and educating children;

d) Have the ability to apply information technology in performing tasks of Early Childhood Education Teacher Grade II and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

đ) Be recognized as a grassroots model worker or excellent early childhood education teacher at school level or higher;

e) A civil servant participating in the examination or review for promotion to the position of Early Childhood Education Teacher Grade II (code V.07.02.25) must have held the position of Early Childhood Education Teacher Grade III (code V.07.02.26) or equivalent for at least nine years (excluding probation period), calculated up to the deadline for submitting application registration for examination or review for promotion.

Article 5. Early Childhood Education Teacher Grade I - Code V.07.02.24

1. Tasks

In addition to the tasks of Early Childhood Education Teacher Grade II, Early Childhood Education Teacher Grade I must perform the following tasks:

a) Participate in editing or compiling content for early childhood education teacher training materials at district level or higher;

b) Participate in training or advise, propose, consult, support, lead, and share professional knowledge and skills for early childhood education teachers at school level or higher;

c) Participate in examination boards for early childhood education competitions at district level or higher;

d) Participate in self-assessment councils or external assessment teams or professional and pedagogical inspections at district level or higher.

2. Professional ethics standards

Besides the ethical standards of Early Childhood Education Teacher Grade II, Early Childhood Education Teacher Grade I must be a role model in teacher ethics and encourage and support colleagues in complying with regulations on teacher ethics.

3. Educational and Training Standards

a) Hold a bachelor's degree in early childhood education or higher; or hold a college diploma in early childhood education and a bachelor's degree in educational management or higher;

b) Possess a certificate for professional development according to the standards for the position of Early Childhood Education Teacher Grade I.

Article 4. Professional Competence Standards

a) Actively and proactively implement and promote, guide colleagues in applying the policies, guidelines, laws, regulations, and requirements of the Party, State, and industry regarding early childhood education in their assigned tasks;

b) Creatively and flexibly implement; share experiences, guide, and support colleagues in carrying out the early childhood education program and plan;

c) Actively and proactively share experiences, guide, and support colleagues, parents, and guardians of children, and the community in nurturing, caring, and educating children; have the ability to perform core teacher tasks;

d) Have the ability to apply information technology in performing tasks of Early Childhood Education Teacher Grade I and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

đ) Be recognized as a grassroots model worker or excellent early childhood education teacher at district level or higher;

e) A civil servant participating in the examination or review for promotion to the position of Early Childhood Education Teacher Grade I (code V.07.02.24) must have held the position of Early Childhood Education Teacher Grade II (code V.07.02.25) or equivalent for at least six years, calculated up to the deadline for submitting application registration for examination or review for promotion.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING

 BY PROFESSIONAL POSITION

Article 6. Principles for Appointment to Professional Titles for Preschool Teachers

1. The appointment of professional titles for preschool teachers as prescribed in this Circular must be based on the current job position held and ensure compliance with the professional title standards set forth in Articles 3, 4, 5, and Article 7 of this Circular.

2. When appointing preschool teachers from the professional title of preschool teacher as stipulated in Joint Circular No. 20/2015/TTLT-BGDĐT-BNV dated September 14, 2015, issued by the Ministry of Education and Training and the Ministry of Home Affairs, which specifies the code number and standards for the professional title of preschool teacher (hereinafter referred to as Joint Circular No. 20/2015/TTLT-BGDĐT-BNV) to the professional title of preschool teacher as stipulated in this Circular, it shall not combine with promotion of professional titles.

3. The level of education obtained shall not be the basis for appointing to a higher professional title level than the one successfully recruited for newly hired preschool teachers.

Article 7. Cases of Appointment to the Professional Title of Preschool Teacher

1. Civil servants who have been appointed to the professional title levels of preschool teacher as stipulated in Joint Circular No. 20/2015/TTLT-BGDĐT-BNV, if they meet the standards for the professional title levels as prescribed in this Circular, shall be appointed to the professional title of preschool teacher as follows:

a) Preschool teacher level IV (code V.07.02.06) shall be appointed to the professional title of preschool teacher level III (code V.07.02.26);

b) Preschool teacher level III (code V.07.02.05) shall be appointed to the professional title of preschool teacher level III (code V.07.02.26);

c) Preschool teacher level II (code V.07.02.04) shall be appointed to the professional title of preschool teacher level II (code V.07.02.25).

2. Preschool teacher level II (code V.07.02.25) shall be appointed to the professional title of preschool teacher level I (code V.07.02.24) when determined as successful candidates in the examination/promotion of professional title levels for preschool teachers.

3. Preschool teacher level II (code V.07.02.04) who has not met the corresponding standards as prescribed in Clause 4 of Article 4 of this Circular shall be appointed to the professional title of preschool teacher level III (code V.07.02.26).

4. Newly recruited preschool teachers, after completing the probationary period as prescribed and being evaluated by the head of the public service unit as meeting the requirements, shall be appointed to the corresponding professional title level of preschool teacher that they were recruited for.

Article 8. Salary Classification

1. Civil servants appointed to the professional titles of preschool teacher as prescribed in this Circular shall apply the corresponding salary scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel, specifically as follows:

a) Preschool teacher level III, code V.07.02.26, shall apply the salary coefficient of public official type A0, from salary coefficient 2.10 to salary coefficient 4.89;

b) Preschool teacher level II, code V.07.02.25, shall apply the salary coefficient of public official type A1, from salary coefficient 2.34 to salary coefficient 4.98;

c) Preschool teacher level I, code V.07.02.24, shall apply the salary coefficient of public official type A2, group A2.2, from salary coefficient 4.0 to salary coefficient 6.38.

2. The classification of salaries upon appointment to professional title levels shall be implemented according to the guidelines in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the classification of salaries upon promotion, transfer of ranks, and change of types of civil servants and public officials, and according to the current provisions of the law. When implementing new wage policies, the transition to new wages shall be carried out according to the regulations of the Government.

Chapter IV

IMPLEMENTING PROVISIONS

Article 9. Transitional Provisions

1. Preschool teacher level IV (code V.07.02.06) who has not yet met the training standard of preschool teachers as prescribed in Point a Clause 1 Article 72 of the Education Law 2019 shall retain the code V.07.02.06 and apply the salary coefficient of public official type B (from salary coefficient 1.86 to salary coefficient 4.06) until they meet the training standard, then be appointed to the professional title of preschool teacher level III (code V.07.02.26) or until retirement if they do not belong to the category required to upgrade their training standard according to Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government stipulating the implementation timeline for upgrading the training standard of preschool teachers, primary school teachers, and junior high school teachers.

2. In cases where preschool teacher level II (code V.07.02.04) is appointed to the professional title of preschool teacher level III (code V.07.02.26) as prescribed in Clause 3 Article 7 of this Circular due to not meeting the standards of level II (code V.07.02.25), after meeting the standards of level II (code V.07.02.25), they shall be appointed to the professional title of preschool teacher level II (code V.07.02.25) without having to go through an examination or evaluation for promotion.

Article 10. Provisions on Application

1. Preschool teachers with a bachelor's degree in early childhood education shall be recognized as equivalent to the bachelor's degree specified in Point a Clause 3 Article 4 and Point a Clause 3 Article 5 of this Circular.

2. In cases where preschool teachers participate in examinations or evaluations for promotion to the professional title of preschool teacher level II (code V.07.02.25) and already hold a bachelor's degree or higher before recruitment, meet the educational qualification standards for preschool teacher level II, and have held the professional title of preschool teacher level III (code V.07.02.26) or equivalent for at least six years (excluding the probationary period), calculated up to the deadline for submitting application forms for the examination or evaluation for promotion, they shall be considered to meet the time requirement for holding the level as stipulated in Point e Clause 4 Article 4 of this Circular.

3. Certificates for professional development according to the standards for professional titles of level II and level III as prescribed in Joint Circular No. 20/2015/TTLT-BGDĐT-BNV shall be recognized as equivalent to certificates for professional development according to the standards for professional titles of level II and level III as prescribed in this Circular.

4. The period during which a kindergarten teacher holds Grade II (code V.07.02.04) and equivalent, and Grade III (code V.07.02.05) and equivalent, shall be considered equivalent to the period of holding Grade II and Grade III as stipulated in this Circular.

5. The programs for professional development according to the standards of the kindergarten teacher's occupational title at Grade II and Grade III (issued together with Decision No. 2186/QD-BGDĐT dated June 28, 2016; Decision No. 2188/QD-BGDĐT dated June 28, 2016 of the Minister of Education and Training) shall continue to be implemented until replaced programs are available.

6. The requirement for a certificate of professional development according to the standards of the kindergarten teacher's occupational title at Grade III as stipulated in point b, Clause 3, Article 3 of this Circular shall apply to kindergarten teachers recruited after the effective date of this Circular and kindergarten teachers at Grade III (code V.07.02.05) when appointed to the kindergarten teacher's occupational title at Grade III (code V.07.02.26) as stipulated in point b, Clause 1, Article 7 of this Circular.

7. For tasks assigned according to the grade of the kindergarten teacher's occupational title that public kindergarten schools are not assigned or do not have the conditions to perform, the head of the public kindergarten school shall report to the competent authority directly to decide on converting such tasks to related tasks.

Article 11. Implementation Organization

1. This Circular serves as the basis for determining job positions, the structure of staff members according to the kindergarten teacher's occupational title, and implementing the recruitment, utilization, and management of kindergarten teachers in public kindergartens within the national education system. The Department of Teachers and School Management Staff shall take the lead and provide detailed guidance on the implementation of this Circular.

2. The heads of public kindergartens directly manage and utilize staff members shall be responsible for:

a) Developing the Job Position Plan; specifically determining the structure of staff members according to the kindergarten teacher's occupational title in accordance with the conditions of the school and ensuring the implementation of plans and strategies for developing the teaching staff of the school; reviewing the Job Position Plan, formulating appointment plans for the kindergarten teacher's occupational title and salary grading for kindergarten teachers in public kindergartens under their jurisdiction; submitting to the competent authority for examination and decision-making or deciding according to the delegated authority;

b) Reporting to the competent managing authority as prescribed the results of appointments and salary grading for kindergarten teachers;

c) Formulating training and professional development plans for kindergarten teachers; creating conditions for kindergarten teachers to receive training and professional development to meet the occupational title standards as prescribed by law;

d) Assigning and distributing tasks to kindergarten teachers based on the duties of the occupational title grade, reasonably utilizing their capabilities and enhancing their work efficiency.

3. The heads of competent authorities managing public kindergartens shall be responsible for:

a) Approving plans for appointing the occupational title and salary grading for kindergarten teachers in public kindergartens under their jurisdiction; resolving issues within their authority during the process of appointing the occupational title and salary grading for kindergarten teachers in public kindergartens under their jurisdiction;

b) Deciding within their authority or delegating decisions on appointing to the occupational title grade and salary grading for kindergarten teachers in public kindergartens according to their authority;

c) Reporting the results of appointing the occupational title and salary grading for kindergarten teachers who are staff members in public kindergartens under their jurisdiction to the competent authority as prescribed.

Article 12. Effectiveness and responsibility for implementation

1. This Circular shall take effect from March 20, 2021.

2. The Director of the Office, the Director of the Department of Teachers and School Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairmen of Provincial People's Committees and Municipal People's Committees directly under the Central Government; the Directors of Departments of Education and Training, and the Directors of Departments of Education, Science and Technology in Bac Lieu Province shall be responsible for implementing this Circular.

3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the new documents.

4. This Circular replaces Joint Circular No. 20/2015/TTLT-BGDĐT-BNV dated September 14, 2015 of the Ministry of Education and Training and the Ministry of Home Affairs stipulating the code numbers and standards of the kindergarten teacher's occupational title.

5. In case of difficulties during implementation, please reflect them to the Ministry of Education and Training for consideration and resolution./.
