Pursuant to Decree No. 87/2020/NĐ-CP dated July 28, 2020, issued by the Government, regarding the electronic household registration database and online household registration;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 30/2020/NĐ-CP dated March 5, 2020 of the Government on archival work;

Pursuant to Decree No. 45/2020/NĐ-CP dated April 8, 2020, issued by the Government on implementing administrative procedures in an electronic environment;

Pursuant to Decree No. 47/2020/NĐ-CP dated April 9, 2020, issued by the Government, on the management, connection, and sharing of digital data of state agencies;

On the basis of Decree No. 61/2018/NĐ-CP dated April 23, 2018 of the Government on implementing the one-stop shop mechanism;Decree No. 107/2021/NĐ-CP dated December 6, 2021 of the Government amending and supplementing certain articles of Decree No. 61 The Minister of Justice issues this Circular detailing certain provisions and implementation measures of Decree No. 87/2020/NĐ-CP dated July 28, 2020 of the Government regarding the Electronic Household Registration Database and online household registration/2018/NĐ-CP dated April 23, 2018 of the Government on implementing the one-stop shop mechanism;Decree No. 107/2021/NĐ-CP dated December 6, 2021 of the Government

At the proposal of the Director of the Department of Household Registration, Nationality, and Notarization;

This Circular details certain provisions and implementation measures of Decree No. 87/2020/NĐ-CP dated July 28, 2020 of the Government regarding the Electronic Household Registration Database and online household registration concerning management, exploitation, and utilization of the Electronic Household Registration Database, connection and sharing of information with the National Population Database and other databases; procedures for online household registration; confirmation of household registration information; issuance, guidance on use, and management of electronic household registration documents..

Article 1. Scope of Regulation

1. Ministries, ministerial-level agencies, government agencies, and other state agencies shall implement connections, sharing, exploitation, and utilization of the Electronic Household Registration Database.

Article 2. Applicability

2. People's Committees at all levels, household registration registration and management agencies within the country, and Diplomatic Missions, Consular Offices of the Socialist Republic of Vietnam abroad (hereinafter referred to as Diplomatic Missions).

3. Organizations and individuals related to the construction, management, updating, exploitation, and utilization of the Electronic Household Registration Database; online household registration.

Article 3. Connection and sharing of information between the Electronic Household Registration Database and the National Population Database, the National Health Insurance Database, other databases, the National Public Service Portal, Provincial Public Service Portals, and the Provincial Single Window Electronic Information System

The connection and sharing of information between the Electronic Household Registration Database and the National Population Database, the National Health Insurance Database, other databases; the National Public Service Portal; Provincial Public Service Portals, the Provincial Single Window Electronic Information System, and other electronic information systems serving administrative procedure resolution shall be carried out in accordance with Articles 10 and 11 of Decree No. 87/2020/NĐ-CP and the following guidelines:

1. The connection and sharing of information between the Electronic Household Registration Database and the National Population Database, the National Health Insurance Database, other databases; the National Public Service Portal; Provincial Public Service Portals, the Provincial Single Window Electronic Information System, and other electronic information systems serving administrative procedure resolution for online household registration shall be implemented through the national data integration and sharing platform or other connection methods based on written agreements between the Ministry of Justice and the managing agencies of the databases and electronic information systems, ensuring compliance with the provisions of Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on the management, connection, and sharing of digital data of state agencies, and guidance from the Ministry of Information and Communications.

2. The Electronic Household Registration Database shall connect, share, and provide information as stipulated in Clause 2 of Article 10 of Decree No. 87/2020/NĐ-CP to the National Population Database immediately upon registration in the Household Register and formal storage in the Electronic Household Registration Database. In cases where technical reasons prevent connection and sharing at the time of registration, the database management agencies shall coordinate and resolve within five working days. The establishment time of the information is calculated from the time of registration in the Household Register.

3. Adjustments and supplements to household registration information of individuals in the Electronic Household Registration Database shall be updated and shared immediately with the National Population Database through the convenient functions provided in the Common Household Registration Management Software; serving as the basis for updating other databases when connected and shared to ensure consistency, synchronization, and accuracy of information.

4. In cases of receiving and processing requests for online interconnection of procedures: birth registration, permanent residence registration, health insurance card issuance for children under six years old; death registration, permanent residence cancellation, funeral allowance payment, burial expense support, and funeral benefit receipt, after completing birth registration and death registration, the household registration registration agency shall transfer the electronic Birth Certificate and Death Extract along with corresponding electronic files through the convenient functions provided in the Common Household Registration Management Software to the competent authority for residence registration, the competent authority for health insurance card issuance, and the authority responsible for funeral allowance and burial expense support to process according to regulations.

4. In cases where requests for online interconnection procedures are accepted and processed: birth registration, permanent residence registration, issuance of health insurance cards for children under six years old; death registration, cancellation of permanent residence registration, receipt of survivor benefits, support for funeral expenses, receipt of funeral grants, after completing the birth registration and death registration, the household registration authority shall transfer the electronic Birth Registration Certificate and Death Registration Extract along with the corresponding electronic files through the utility function provided on the Common Electronic Household Registration Management Software to the competent authorities responsible for residence registration, health insurance card issuance, survivor benefit processing, funeral expense support, and funeral grant receipt for further processing in accordance with regulations.

Article 4. Principles for Processing Information in the Electronic Household Registration Database

1. In cases where individuals register birth after January 1, 2016, and are issued a personal identification number upon registration, if the information of the person registered for birth in the Electronic Household Registration Database is the initial input for the National Population Database, then personal information may only be adjusted according to the provisions of Clause 1, Article 12 of this Circular.

In cases where corrections, supplements, or revocations of the legal value of birth registration information require re-establishment or revocation of the personal identification number, the management agency of the Electronic Household Registration Database and the management agency of the National Population Database shall coordinate to handle such matters; update and record the results of processing in the Electronic Household Registration Database; connect, share, and ensure synchronization with the National Population Database.

2. In cases where household registration is registered, and the household book is digitized, but does not fall under Clause 1 of this Article, and the individual's information in the Electronic Household Registration Database differs from that in the National Population Database, the household registration registration authority where the registration was made shall be responsible for coordinating with the police authority at the same level to verify and confirm accurate information; adjust the information in the database based on the verification results to ensure consistency between the two databases. The adjustment of information must be recorded regarding the basis, the person who authorized the adjustment, the person who carried it out, the time, and the content of the adjustment.

3. In cases where citizen information in other databases (if any) is inconsistent with the information in the Electronic Household Registration Database and the National Population Database, the information in the Electronic Household Registration Database and the National Population Database shall serve as the basis for adjusting citizen information in other databases.

In cases where there are documents or materials proving that the information in another database predates the information in the Electronic Household Registration Database, the managing agency of the database shall be responsible for exchanging with the managing agency of the Electronic Household Registration Database to verify and clarify. If there is a legal basis to determine that the information in the Electronic Household Registration Database is incorrect, guidance shall be provided to individuals whose information is inconsistent to correct their household registration in accordance with the law.

Article 5. Level of Online Household Registration

1. The household registration registration authority shall accept and process online household registration requests in accordance with the level of deployment of public services online at localities within the country and diplomatic missions.

2. A list of household registration authorities that have not yet had the conditions to accept and process online household registration requests must be publicly announced on the National Public Service Portal, the Ministry of Justice’s website, the Consular Affairs Department’s website of the Ministry of Foreign Affairs, and the provincial single window portal.

Article 6. Submission, Acceptance, and Delivery of Results for Online Household Registration

The submission, acceptance, and processing of online household registration requests shall be carried out in accordance with Article 12 of Decree No. 87/2020/NĐ-CP and the following guidelines:

1. Scans of documents required to be submitted with the online household registration application must be clear, complete, and intact in content, taken by camera or phone, or scanned using electronic devices, from valid documents still in use; legalized and translated into Vietnamese if issued by foreign competent authorities, except in cases exempted from legalization.

In cases where the applicant does not provide sufficient scans of necessary documents as required or the scans submitted with the online household registration application do not meet the requirements of this clause, the household registration authority shall notify the applicant to supplement and complete them.

2. In cases where the documents required to be submitted with the online household registration application already have electronic copies or electronic versions of household registration documents, the applicant may use these electronic versions.

In cases where the applicant has provided a personal identification number, they are not required to submit scans of identity cards or residence certificates in the online household registration application. The household registration authority shall be responsible for exploiting and utilizing information from the Electronic Household Registration Database and the National Population Database based on the personal identification number provided by the applicant.

3. After receiving the application through the system, the civil servant handling household registration shall be responsible for checking and comparing the information in the application and sending back the completed electronic form to the applicant via email or digital device. Within one working day, the applicant shall be responsible for verifying the accuracy and completeness of the information on the electronic form.

If the applicant confirms that the information is consistent and complete or does not respond within the requested period, the civil servant handling household registration shall proceed to process the application.

4. The procedures and formalities for handling household registration matters after accepting online household registration applications shall be carried out in accordance with the provisions of the Household Registration Law, Decree No. 123/2015/NĐ-CP dated November 15, 2015 of the Government detailing certain provisions and implementing measures of the Household Registration Law, Clause 12, Clause 13 of Decree No. 87/2020/NĐ-CP, and Circular No. 04/2020/TT-BTP dated May 28, 2020 of the Minister of Justice detailing certain provisions of the Household Registration Law and Decree No. 123/2015/NĐ-CP (hereinafter referred to as Circular No. 04/2020/TT-BTP).

5. The delivery of results for online household registration shall be carried out in accordance with Clause 4 and Clause 5 of Article 12 of Decree No. 87/2020/NĐ-CP and the following guidelines:

a) For household registration matters where the law requires the applicant to be present at the household registration authority, when collecting the result according to the Result Delivery Notice, the applicant must present identity documents to prove their identity; submit or present the original documents that were scanned in the online household registration application for the household registration authority to file the records or check and compare according to the household registration law, except for those that have been submitted electronically (if any).

b) In case the person requesting registration of household records cannot provide the documents specified in point a of this clause or the submitted documents have been erased, altered, or falsified, the competent household registration authority shall revoke the results of the household registration.

Article 7. Issuing certified copies of household records

1. The person requesting a certified copy of a household record or a certified copy of a Birth Registration Certificate shall be responsible for providing complete and accurate information including: the name of the household record; number, date, month, year of registration, and the authority that registered the household matter.

2. In cases where the required information under Clause 1 of this Article cannot be provided fully, the person requesting must provide basic information from the registered household record to facilitate search.

Example: - Requesting a certified copy of a Marriage Registration but unable to provide the Marriage Certificate number, date, and year of registration, then must provide information about the surname, middle name, given name, date, month, and year of birth of both the husband and wife.

- Requesting a certified copy of a Birth Registration but unable to provide the Birth Registration number, date, and year of registration, then must provide the surname, middle name, given name, date, month, and year of birth of the person being registered; the surname, middle name, given name, date, month, and year of birth of the father and mother of the person being registered.

3. In cases where the person requesting a certified copy of a household record or a certified copy of a Birth Registration does not provide complete information or provides inaccurate information, making it impossible to retrieve the information, the household registration authority shall refuse to process the request.

Article 8. Confirmation of Household Information of Individuals

1. The competent authority for household registration and management, as stipulated in Clause 2 of Article 13 of Decree No. 87/2020/ND-CP, based on the Electronic Household Record Database, Household Register, and household registration files, shall issue a document confirming household information for individuals who request confirmation in the following situations:

a) Confirming information about a household matter of an individual that has been registered, but the content of the registration has changed due to permission granted by a competent state agency to change, correct, or supplement household information, re-determine ethnicity, record in the Household Register the resolution of a Vietnamese citizen's household matter at a competent authority abroad, or record in the Household Register changes to the individual's household status according to a court judgment or decision of a competent state agency.

Example: - Confirming information about marriage where the competent household registration authority has allowed the change of surname, middle name, given name, or correction of the year of birth of the wife or husband, or where the couple has divorced.

- Confirming birth registration information of an individual whose ethnicity has been re-determined or who has ceased Vietnamese citizenship.

If there is no change in the household information of an individual, the household registration and management authority will not issue a document confirming household information, and will guide the requester to apply for a certified copy of a Birth Registration or a certified copy of a household record, except when a competent authority or organization requests issuance of a confirmation document to resolve matters related to the individual.

b) Confirming different household information of an individual.

Example: - Confirming all household information of an individual, including: information about birth registration; marriage registration; changes, corrections to household information, re-determination of ethnicity; acknowledgment of parentage; guardianship; death registration...

- Confirming information about certain household matters that have been registered such as: birth registration information; acknowledgment of parentage; determination of parentage; adoption; marriage registration information...

c) Confirming information of an individual in household documents that are inconsistent, without having corrected household information, not falling within the provisions of Clause 1 of Article 4, and without having established an electronic household record data file for the individual as prescribed in Article 11 of this Circular.

Example: - An individual has a Birth Registration stating Tran Van Q, born in 1963; a Marriage Certificate stating Tran Manh Q, born in 1963;

- An individual has a Birth Registration stating Le Manh A, born in 1951; a Death Registration Extract stating Le Hoang A, born in 1952.

d) The requester must attach a copy or an electronic copy of relevant documents and materials to prove household information. In cases requiring verification, the household registration and management authority receiving the request shall issue a document requesting verification from the police and other relevant agencies according to Clause 3 of Article 13 of Decree No. 87/2020/ND-CP. If the verification result does not contain information or the information is inconsistent with the documents provided by the requester, the issuance of a document confirming household information will be refused.

đ) The document confirming household information requested by an individual must clearly and fully state the initial registration content, time; the content, basis, and time of implementing changes and adjustments to household information up to the time of issuing the confirmation document.

2. The competent authority for household registration and management, based on the Electronic Household Record Database, Household Register, and household registration files, and the functions of the requesting agency or organization, shall issue a document confirming household information for agencies or organizations in the following situations:

a) Confirming information about a household matter or several household matters of an individual that have been registered.

Example: - Confirming information about the birth registration of Mr. Nguyen Van A;

- Confirming information: birth registration, recording in the book changes to household status according to a court judgment or decision of a competent state agency (Divorce Judgment/Decision, Determination of Parental Relationship, Decision to Cease Vietnamese Citizenship...);

- Confirming all household information of an individual (including all information about the individual's household matters from birth registration, marriage registration, to death registration... that have been registered and recorded in the Electronic Household Record Database).

b) Confirming household information of multiple individuals.

Example: - Confirming birth registration information of all children of a couple;

- Confirming birth registration information of cases born in 2020 residing in Ward A.

c) Based on the content of the request, the functions of the agency or organization proposing to confirm household registration information, the confirmation document may clearly and fully state the initial registration content and time; the content, basis, and time of implementing changes and adjustments to the information up to the issuance date of the confirmation document, or only confirm the registration information (number, time, registration authority) or confirm statistical data on household registration that has been registered.

Example: - In cases where an individual's household registration information is requested for investigative, verification, or litigation activities by an investigation agency, the registration management agency may issue a confirmation document containing all the registered household registration information of the individual based on its functions and the requesting agency's requirements, including detailed initial registration content, time, and authority, as well as subsequent changes and adjustments up to the confirmation date;

 - In cases where confirmation of marriage registration information of Mr. Nguyen Van A is requested for divorce proceedings or other civil disputes by a judicial agency, the confirmation document will only confirm that Mr. Nguyen Van A has registered his marriage, including the marriage certificate number, registration time, and authority;

- In cases where confirmation of information is requested for school attendance rate checks as required by educational institutions or education management agencies, the confirmation document may provide statistical data on children by residential area and year of birth, or provide a list of children with their birth registration information (birth certificate number, registration time, and authority);

3. Confirmation of household registration information at the request of organizations or individuals must comply with legal provisions regarding the protection of private life, personal privacy, family secrets, honor, and reputation of individuals.

4. The confirmation document of an individual's household registration information as stipulated in points a, b, and c Clause 1 of this Article shall have the same value as household registration documents and can be used to prove household registration information when the individual handles administrative procedures or participates in other civil transactions as prescribed by law.

Article 9. Electronic version of household registration documents, interactive electronic household registration forms

a) Two Register models (Annex I);

a) Content of the electronic version of household registration documents; confirmation document of household registration information; Death Notice (Annex 1);

b) Content of interactive electronic household registration forms integrated to serve online household registration (Annex 2).

2. The legal effect of the electronic version of household registration documents is implemented according to the provisions of Clause 6 Article 12 Decree No. 87/2020/ND-CP and the following guidance:

a) The electronic version of household registration documents has the same value as paper household registration documents in online transactions and administrative procedures; it can replace paper household registration documents when handling direct registration procedures at the household registration registration authority.

b) The QR code on the electronic version of household registration documents is an internet address leading to the corresponding household registration document data and image format in the electronic household registration database, providing information on the accuracy and validity of the household registration document in the electronic household registration database.

c) Individuals, agencies, or organizations receiving the electronic version of household registration documents submitted or presented by the person requesting household registration can verify the accuracy, validity period, and updated information of the electronic document through the QR code on the document.

Article 10. Digitization of Household Registration Books

1. The household registration information to be digitized is the information registered in Household Registration Books prior to the time when the household registration authority began using the common electronic household registration management software.

2. Responsibilities for digitization:

a) The Consular Department under the Ministry of Foreign Affairs and representative offices are responsible for digitizing Household Registration Books registered at representative offices. The Consular Department under the Ministry of Foreign Affairs is responsible for the accuracy and legal validity of the household registration information digitized from Household Registration Books registered at representative offices.

b) The Department of Justice is responsible for developing a digitization plan for Household Registration Books registered and stored locally, submitting it for approval by the provincial People's Committee, and implementing it; it is also responsible for the accuracy and legal validity of the household registration information digitized from Household Registration Books registered and stored within its jurisdiction.

c) The Justice Office of districts, cities under provinces, and centrally governed cities (hereinafter referred to as district level); the People's Committee of communes, wards, towns (hereinafter referred to as commune level) are responsible for cooperating with the Department of Justice in the digitization process and ensuring the accuracy and legal validity of the household registration information digitized from Household Registration Books registered and stored within their jurisdiction.

3. The digitization process of household registration data shall be carried out according to technical documents guided by the Ministry of Justice. The agency responsible for digitizing Household Registration Books must ensure accuracy and completeness before approving and officially updating the data into the electronic household registration database.

4. The digitization of Household Registration Books must comply with regulations on protecting private life, personal privacy, family secrets, and related laws, ensuring confidentiality and information security.

Article 11. Creation and Updating of Individual Electronic Household Registration Data Records

1. Each individual has a unified and unique electronic household registration data record on the electronic household registration database corresponding to their personal identification number; all household registration information of the individual that is registered or changes are updated and recorded in the electronic household registration data record.

2. In cases where the individual's electronic household registration data record is established through new birth registration on the common electronic household registration management software, the individual's electronic household registration data record will be automatically updated.

In cases where the individual's electronic household registration data record is established through registering other household matters not involving birth registration or through digitizing Household Registration Books as stipulated in Article 10 of this Circular, the civil servant handling household registration shall be responsible for using the functions and utilities on the common electronic household registration management software to extract information from the national population database through the personal identification number, and update citizen information into the individual's electronic household registration data record. If there is no personal identification number, then based on basic information about the individual such as ID card number, surname, middle name, given name, gender, date of birth, father's surname, middle name, given name, year of birth, mother's surname, middle name, given name, year of birth, to determine the personal identification number, ensuring that the individual's electronic household registration data record does not duplicate.

3. After updating the individual's electronic household registration data record as prescribed in Clause 2 of this Article and receiving the personal identification number, the household registration authority shall base on the electronic household registration database to supplement the personal identification number into the section of personal identification number in the Birth Registration Book. In cases where the previous Birth Registration Book did not have a section for personal identification number, it should be recorded in the Notes column in the Birth Registration Book, clearly stating the basis: "supplementing the personal identification number from the electronic household registration database," and signing and stamping; attaching a copy of the relevant page of the Birth Registration Book with the supplementary content to the individual's electronic household registration data record on the electronic household registration database.

4. In cases where the original birth certificate issued after January 1, 2016 does not contain a personal identification number but the citizen requests supplementation, the household registration authority shall base on the electronic household registration database or the Citizen Identity Card or notification of a validly issued personal identification number to supplement household registration information as prescribed.

Article 12. Adjustment of Information in the Electronic Household Registration Database

1. The household registration information of individuals that has been officially registered and recorded in the Electronic Household Registration Database within the electronic household registration record of the individual may only be adjusted in the following cases:

a) Individuals are permitted by the competent household registration authority to change, correct household registration, supplement household registration information, re-determine ethnicity; record in the Household Register the resolution of Vietnamese citizen's household registration at the competent authority abroad; record in the Household Register changes to household registration according to the judgment or decision of the competent state authority.

b) In case it is discovered that the information of an individual in the Electronic Household Registration Database differs from the household registration file, the household registration authority shall have the responsibility to report to the superior authority managing the Electronic Household Registration Database through the functions and utilities provided on the Common Household Registration and Management Software, and such adjustment can only be made with the permission of the superior authority managing the Electronic Household Registration Database.

2. The head of the authority managing the Electronic Household Registration Database or the individual granted authority shall be responsible for checking the information and files before making a decision and shall bear responsibility for allowing adjustments to the information in the Electronic Household Registration Database.

Article 13. Deletion of Electronic Household Registration Data

1. Upon receiving a judgment or decision with legal effect from the competent state authority regarding the recovery, revocation of the legal validity of household registration documents, entries in the Household Register, the household registration authority that has carried out the registration shall establish a request to delete corresponding electronic household registration data in the Electronic Household Registration Database through the functions and utilities provided on the Common Household Registration and Management Software.

2. The request to delete electronic household registration data includes the following information:

a) Information about the type of household registration that was registered, the registering authority, the number, date, month, year of registration, specific information to be deleted;

b) Reason and basis for requesting deletion;

c) An electronic copy of the judgment or decision regarding the recovery, revocation of household registration documents issued by the competent state authority.

3. The authority directly managing the Electronic Household Registration Database under the Ministry of Justice shall be responsible for reviewing and approving valid requests to delete electronic household registration data on the Common Household Registration and Management Software. Deleted household registration data will lose legal validity but will still be retained in the individual's electronic household registration record and can be accessed and used when issuing confirmation documents of household registration information. If there is a legal document or decision from a competent state authority permitting restoration, the authority directly managing the Electronic Household Registration Database under the Ministry of Justice has the authority to restore electronic household registration data prior to adjustment or deletion.

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

The household registration authority and civil servants engaged in household registration work shall be responsible for promptly, fully, and accurately updating household registration information that has been registered into the Electronic Household Registration Database; creating and updating individual electronic household registration records through the functions and utilities provided by the Common Household Registration and Management Software.

2. Departments of Justice, Justice Offices, People's Committees at the commune level shall be responsible for developing plans, budgeting, ensuring equipment and infrastructure for the digitization of Household Registers, building, updating, accessing, and using the Electronic Household Registration Database, online household registration in accordance with the degree of implementation of online public services at the local level.

3. During the period when the digitization of Household Registers has not been completed, the Electronic Household Registration Database has not been uniformly operational, and has not connected or accessed data from the National Population Database; the authorities responsible for handling interlinked administrative procedures as stipulated in Clause 4, Article 3 of this Circular have not connected or shared data with the Electronic Household Registration Database, if the applicant cannot provide an electronic copy or digital version of household registration documents for household registrations that do not require presence at the household registration authority upon receipt of results, then the household registration authority shall accept and process the application for household registration in accordance with Clause 5, Article 12 of Decree No. 87/2020/ND-CP, issue household registration documents, copies of Birth Certificates, copies of household registration extracts according to the forms attached to Circular No. 04/2020/TT-BTP, implement digital signatures in accordance with Circular No. 41/2017/TT-BTTTT dated December 19, 2017 of the Minister of Information and Communications on the use of digital signatures for electronic documents in state agencies.

Article 15. Effective Date

1. This Circular takes effect from February 18, 2022.

2. People's Committees at all levels and related agencies shall be responsible for organizing the implementation of this Circular.

During the implementation process, if there are difficulties, please promptly reflect them to the Ministry of Justice for guidance./.
