Regulations on the list and periodic rotation term of job positions

in fields under the management scope of the agricultural sector

and rural development at local authorities

Pursuant to the Law on Prevention and Control of Corruption dated November 20, 2018;

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government pursuant to the Law on Forestry dated November 15, 2017;

Pursuant to Decree No. 59/2019/NĐ-CP dated July 1, 2019 of the Government detailing certain provisions and implementing measures of the Law on Prevention and Combating Corruption; Decree No. 134/2021/NĐ-CP dated December 30, 2021 of the Government amending and supplementing some articles of Decree No. 59/2019/NĐ-CP;

At the proposal of the Director of the Cadre and Civil Servant Organization Department;

The Minister of Agriculture and Rural Development issues this Circular stipulating the list and periodic rotation term of job positions in fields under the management scope of the agricultural sector and rural development at local authorities.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the list and periodic rotation term of job positions in fields under the management scope of the agricultural sector and rural development at local authorities.

Article 2. This Circular applies to civil servants not holding leadership or managerial positions, and staff working at public service units directly interacting with and handling matters in fields under the management scope of the agricultural sector and rural development, and related organizations and individuals.

Article 2. List of job positions for periodic rotation

1. Management of rare animals.

2. Animal quarantine.

3. Forest protection.

4. Supervision of veterinary drugs, plant protection chemicals, animal diseases, livestock, and poultry.

5. Monitoring and managing fishery resources, quality control, food safety, veterinary, and fishery hygiene.

Article 3. Periodic Term for Position Rotation

Clause 1. The periodic rotation term of job positions for civil servants and staff directly interacting with and handling matters specified in Article 2 of this Circular is from two years to five years.

Clause 2. The time point for calculating the rotation period is the date when the competent authority assigns them to work in that position according to the law.

Article 4. Transitional Provisions

For cases subject to periodic rotation of job positions as stipulated in Article 2 of this Circular, which are being monitored and the rotation period calculated according to Circular No. 32/2015/TT-BNNPTNT dated October 6, 2015 of the Minister of Agriculture and Rural Development on the list of job positions and periodic rotation terms for civil servants and staff in the agricultural sector and rural development before the effective date of this Circular and have not yet completed the periodic rotation term according to Circular No. 32/2015/TT-BNNPTNT, the relevant agencies, organizations, and units shall continue to monitor and calculate the time spent in the position to review the periodic rotation according to the term specified in Article 3 of this Circular.

Article 5. Effective Date

Article 3. This Circular takes effect from July 17, 2023.

Article 4. Abolish Circular No. 32/2015/TT-BNNPTNT dated October 6, 2015 of the Minister of Agriculture and Rural Development on the list of job positions and periodic rotation terms for civil servants and staff in the agricultural sector and rural development.

Article 6. Responsibility for Implementation

Article 5. Provincial People's Committees, municipal people's committees directly under the central government, and heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular.

Clause 1. Provincial People's Committees, municipal people's committees directly under the central government shall aggregate and report the results of periodic job position rotation as stipulated in this Circular to the Ministry of Agriculture and Rural Development before December 15 each year for consolidation and inspection as prescribed.

Clause 2. In the course of implementation, if there are difficulties, agencies and units shall reflect them to the Ministry of Agriculture and Rural Development for consideration and resolution./.
