This Circular amends and supplements Appendix II and Article 3 of Circular No. 21/2016/TT-BCT on rules of origin for goods under the Free Trade Agreement between Vietnam and the Eurasian Economic Union. Notably, it replaces Appendix II with a new version based on the Harmonized System (HS) 2022.

Amending and supplementing certain Articles of
Circular No. 21/2016/TT-MCT dated September 20, 2016 of
the Minister of Industry and Trade stipulating the implementation of Rules of Origin for Goods

Pursuant to Decree No. 96/2022/ND-CP dated November 29 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Article 1. Amending and supplementing certain provisions of Circular No. 21/2016/TT-MCT dated September 20, 2016 of the Minister of Industry and Trade stipulating the implementation of Rules of Origin for Goods under the Free Trade Agreement between Vietnam and the Eurasian Economic Union, amended and supplemented by Circular No. 11/2018/TT-MCT dated May 29, 2018 of the Minister of Industry and Trade amending and supplementing Circular No. 21/2016/TT-MCT dated September 20, 2016 of the Minister of Industry and Trade stipulating the implementation of Rules of Origin for Goods under the Free Trade Agreement between Vietnam and the Eurasian Economic Union
1. Replacing Appendix II - Specific Rules of Origin (PSR) at Clause 2, Article 2 of Circular No. 21/2016/TT-MCT (already replaced by Appendix at Article 2 of Circular No. 11/2018/TT-MCT) with the Appendix issued together with this Circular.
2. Amending and supplementing Article 3 of Circular No. 21/2016/TT-MCT (already amended and supplemented by Article 1 of Circular No. 11/2018/TT-MCT) as follows:
The process of certifying and inspecting the Certificate of Origin (C/O) shall be carried out in accordance with the provisions set forth in Appendix I issued together with Circular No. 21/2016/TT-MCT; Decree No. 31/2018/ND-CP dated March 8, 2018 of the Government detailing the Law on Foreign Trade Management regarding origin of goods and other relevant laws on origin of goods.
1. This Circular takes effect from March 1, 2024.
Article 2. Implementation clause
2. Organizations issuing C/Os shall consider issuing C/O model EAV according to the PSR version HS 2022 specified in the Appendix issued together with this Circular, including issuing C/Os after export shipments and deliveries from October 1, 2023 to enjoy preferential tariffs under the Free Trade Agreement between Vietnam and the Eurasian Economic Union.
3. Customs authorities will accept C/O model EAV issued from October 1, 2023 according to the PSR version HS 2022. Procedures for checking C/O model EAV to enjoy preferential tariffs shall be carried out in accordance with the Free Trade Agreement between Vietnam and the Eurasian Economic Union and related regulatory legal documents.
4. This Circular abolishes Circular No. 11/2018/TT-MCT dated May 29, 2018 of the Minister of Industry and Trade amending and supplementing Circular No. 21/2016/TT-MCT dated September 20, 2016 of the Minister of Industry and Trade stipulating the implementation of Rules of Origin for Goods under the Free Trade Agreement between Vietnam and the Eurasian Economic Union./.
This Circular abolishes Circular No. 11/2018/TT-BCT dated May 29, 2018, issued by the Minister of Industry and Trade to amend and supplement Circular No. 21/2016/TT-BCT dated September 20, 2016, issued by the Minister of Industry and Trade, concerning the implementation of Rules of Origin for goods under the Free Trade Agreement between Vietnam and the Eurasian Economic Union./.
