Regulations on the Implementation of Rules of Origin for Goods
in the Free Trade Agreement between
Vietnam and the Eurasian Economic Union
Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 19/2006/NĐ-CP dated February 20, 2006, promulgated by the Government detailing the Law on Commerce regarding the origin of goods;
To implement the Free Trade Agreement between Vietnam and the Eurasian Economic Union, signed officially in Kazakhstan on May 29, 2015.
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade issues this Circular to regulate the implementation of rules of origin for goods in the Free Trade Agreement between Vietnam and the Eurasian Economic Union.
Article 1. Scope of Regulation and Applicability
1. This Circular regulates the implementation of rules of origin for goods in the Free Trade Agreement between Vietnam and the Eurasian Economic Union (hereinafter referred to as the Vietnam-EAEU FTA).
2. This Circular applies to agencies, organizations, and individuals participating in activities related to the origin of goods under the Vietnam-EAEU FTA.
Article 2. Rules of Origin for Goods in the Vietnam-EAEU FTA
This Circular annexes Appendices to guide the implementation of rules of origin for goods in the Vietnam-EAEU FTA:
1. Rules of Origin (Appendix I); 2. Specific Product Rules (Appendix II);
3. List of Islands under Article 10 of Appendix I (Appendix III);
4. Model Certificate of Origin Form EAV, Supplementary Declaration for Certificate of Origin Form EAV, and Instructions for Filling Out the Certificate of Origin (Appendix IV);
5. List of Organizations Issuing Certificates of Origin of Vietnam (Appendix V).
The procedures for issuing and checking the Certificate of Origin shall be carried out in accordance with the provisions of Appendix I issued together with this Circular; Circular No. 06/2011/TT-BCT dated March 21, 2011 of the Ministry of Industry and Trade on the procedures for issuing preferential certificates of origin; and Circular No. 01/2013/TT-BCT dated January 3, 2013 of the Ministry of Industry and Trade amending and supplementing Circular No. 06/2011/TT-BCT dated March 21, 2011.
Article 4. Implementation provisions
This Circular takes effect from October 5, 2016./.
