CIRCULAR

Regulations on the list and periodic rotation terms for positions of civil servants not holding leadership or management positions in units under the Ministry of Health and within the scope of management in the health sector at local levels.

Pursuant to the Law on Prevention and Control of Corruption dated November 20, 2018;

Pursuant to Decree No. 59/2019/NĐ-CP dated July 1, 2019 of the Government detailing certain provisions and measures for implementing the Law on Anti-Corruption;

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Health issues this Circular to regulate the list and periodic rotation terms for positions of civil servants not holding leadership or management positions in units under the Ministry of Health and within the scope of management in the health sector at local levels.

Article 1. Scope of Regulation and Applicability

This Circular provides detailed regulations on the list of positions and periodic rotation terms for positions of civil servants not holding leadership or management positions in units under the Ministry of Health and units within the scope of management in the health sector at local levels.

Article 2. List of positions in the health sector that must undergo periodic rotation

Receiving applications, processing, and submitting to competent authorities for decisions regarding issuance, reissuance, adjustment, revocation, extension, change, supplementation, publication of various types of licenses, registration certificates, certification certificates, confirmation certificates, certificates, application receipt numbers; issuing lists, programs, and materials within the scope of state management in the health sector, including:

1. Preventive Medicine

a) Certificate of biological safety level III and IV for testing facilities;

b) Import permit for disease specimens;

c) Registration number for circulation, import permit, and free circulation certificate for chemicals, insecticides, and bactericides used in household and medical fields;

d) Confirmation certificate for advertising content of chemicals, insecticides, and bactericides used in household and medical fields;

đ) Certificate of qualification for confirming HIV positive cases;

e) Receipt certificate for declaration of conformity with regulations for tobacco products;

g) Operating license for occupational disease clinics and treatment centers.

2. Medical Examination and Treatment

a) Practice license for medical examination and treatment;

b) Operating license for medical examination and treatment;

c) Confirmation certificate for advertising content of medical examination and treatment services;

d) Technical directory of medical examination and treatment facilities.

3. Pharmaceuticals, Cosmetics, Traditional Medicine

a) Registration certificate for drug circulation and raw material for drugs;

b) Export and import permit for drugs, raw materials for drugs, and direct contact drug packaging;

c) Product certificate for pharmaceuticals for drug trading units according to the law;

d) Pharmacy practice certificate;

đ) Certificate of qualification for pharmaceutical business, medicinal herbs, traditional medicine;

e) Certificate of compliance with good manufacturing practices (GMP) for drugs, raw materials for drugs, direct contact drug packaging, good laboratory practices (GLP) for drugs, raw materials for drugs, good storage practices (GSP) for drugs, raw materials for drugs, good clinical practices (GCP);

g) Certificate of compliance with good manufacturing practices for cosmetics (CGMP);

h) Production qualification certificate for cosmetics;

i) Application receipt number for cosmetic product declaration;

k) Confirmation certificate for cosmetic advertising;

l) Registration certificate for the circulation of medicinal herbs and traditional medicine according to the law;

m) Certificate of compliance with good agricultural and collection practices (GACP) for medicinal herbs according to the law;

n) Certificate of qualification for traditional prescriptions or traditional healing methods.

o) Confirmation certificate for information and advertising content of traditional medicine and adjustments to information and advertising content of traditional medicine

4. Food Safety and Nutrition

a) Application receipt number for declaration of health food products, new mixed food additives, food additives not included in the list of permitted food additives or not used for the intended purpose as specified by the Ministry of Health;

b) Confirmation certificate for advertising content of health food products, medical nutrition products, special diet food products, nutritional products for children up to 36 months old;

c) Free circulation certificate for food products within the assigned management scope;

d) Health certificate and other certificates for food products for export when organizations or individuals request according to the law;

đ) Certificate of compliance with food safety requirements for production and business establishments: new mixed food additives, food additives not included in the list of permitted food additives or not used for the intended purpose as specified by the Ministry of Health, bottled water, natural mineral water, instant ice, ice used for food preparation, production establishments of food supplements, medical nutrition products, special diet food products, nutritional products for children up to 36 months old;

e) Certificate of compliance with food safety requirements for health food products meeting good manufacturing practices (GMP) as stipulated by the law.

5. Medical Devices

a) Circulation number for medical devices;

b) Free circulation certificate for medical devices;

c) Import permit for medical devices;

d) Registration certificate for calibration activities of medical devices within the assigned management scope;

đ) Application receipt number for declaration of compliance with medical device production conditions, declaration of compliance with medical device purchase and sale conditions.

6. Health Insurance:

a) List and reimbursement ratio and conditions for new chemical drugs, biological products, and labeled substances; list of herbal medicines, traditional medicines, medicines combining chemical substances with herbal ingredients, traditional herbal medicines, and medicinal herbs; medical supplies within the scope of benefits for health insurance participants;

b) Program for free provision of medicines to medical examination and treatment facilities for treating patients not covered by non-governmental foreign aid.

7. Science and Technology:

a) Certificate of compliance with good clinical practices.

b) List of science and technology tasks at the ministerial level.

Article 3. Term for Periodic Rotation of Work Positions and Rotation of Work Positions in Special Cases

1. The term for periodic rotation of work positions ranges from two to five years based on the characteristics of each work position. The rotation date is calculated from the date of the decision or document assigning the work position. For decisions and documents assigning work positions issued before the effective date of this Circular, they will be considered for calculating the time spent in that work position.

2. For units having only one position in the periodic rotation list which has different professional requirements from other positions within the unit, the unit shall report to the directly superior authority. The rotation plan will be established by the head of the directly superior authority.

Article 4. Organization of Implementation

The heads of units shall base on the List of work positions subject to periodic rotation under Article 2 of this Circular and the actual situation at their units to develop plans for rotating work positions; specify the term for periodic rotation of work positions for each position of the unit.

Article 5. Effective Date

This Circular takes effect from the date 15 the 04 2024.

Article 6. Responsibility for Implementation

1. Heads of units under the Ministry of Health, Provincial Departments of Health, and Municipal Departments of Health under the Central Government shall organize the implementation of this Circular.

2. In the course of implementation, if there are any difficulties, agencies and units are requested to reflect them to the Ministry of Health (Department of Organization and Cadres) for guidance or consideration and resolution.
